The order of the Second Senate of the German Federal Constitutional Court (the FCCt) of 14 October 2004 is a good example for a functioning of European legal community in an interpretation by German courts. Analyzing of effects of the European Court on Human Rights’ (the ECHR) decision in the Görgülü case on application of law by the state bodies, the FCCt emphasizes an openness of the German legal order towards the European law but parallel forms some legal restrictions on it, as it also does in European Union cases. On one hand in the German legal system, the European Convention on Human Rights (the Convention) in the interpretation of the ECHR has the status of a federal statute, and it must be taken into account in the interpretation of domestic law, including fundamental rights and constitutional guarantees. The authorities and courts of the Federal Republic of Germany are therefore obliged, under certain conditions, to take account of the Convention as interpreted by the ECHR in making their decisions. On the other hand this commitment takes effect only within the democratic and constitutional system of the Basic Law. The standard of protection of basic rights guaranteed by the Basic Law forms an important part of this constitutional system. What is more the state bodies must take into consideration effects of the ECHR’s decision on the national legal system. It means that taking into account decisions of the ECHR is possible only within the scope of the applicable law of procedure and the state bodies must evaluate decision’s effects, in particular in family law, the law concerning aliens, and also in the law on the protection of personality. It is worth to mention that an influence of the Görgülü case may be seen also in German legislation. In 2006 the German Code of Civil Procedure was changed. According to the section 580 of the above mentioned Code an action for retrial of the case may be brought: 8. Where the European Court of Human Rights has established that the Convention or its protocols have been violated, and where the judgment is based on this violation.

Brexit is a unique phenomenon as no Member State has ever expressed the will to leave the European Union. Never before had the in-depth impact of a Member State withdrawal been analysed. The issue has started to be analysed after the referendum in which the British voted in favour of leaving the European Union. The topic of the potential consequences of Brexit in the field of private international law concerns, inter alia, national jurisdiction in civil and commercial matters, mutual recognition and enforcement of judgments, specific procedures of EU uniform law, judicial cooperation between Member States or the functioning of the e-Justice Portal and dynamic forms. Before a given Member State withdraws from the EU, interested parties should have been informed, inter alia, of how pending proceedings will be conducted starting with the withdrawal day, what about proceedings initiated at the date of withdrawal or later on, and what about the rulings of the courts of the applicant state covered by the exequatur procedure before the withdrawal. Therefore, the primary purpose of the article is to determine the framework for the future relationship between the EU and the UK in the field of private international law. An additional aim of this paper is to better prepare natural and legal persons for the new post-Brexit reality. European integration has brought Europe peace and prosperity and enabled unprecedented cooperation in all areas of common interest. Following the withdrawal decision, the state and its citizens cease to benefit from the acquis communautaire. In fact, the United Kingdom left the European Union on 31 January 2020. As far as private international law is concerned, the United Kingdom has become a third country. Subsequently, on 1 February 2020 a transition period has started and it aims to provide more time for citizens and businesses to adapt. The negotiations on the future partnership between the EU and the UK has started in March 2020, but they were postponed due to the coronavirus COVID-19 pandemic. The relationship between the United Kingdom and the European Union is sometimes compared to love that has passed away, but former lovers must continue to meet from time to time to manage certain common affaires. The analysis of the topic leads to the conclusion that, in fact, Brexit is a unique phenomenon that has no added value.

Przedmiotem publikacji jest problematyka odpowiedzialności karnoskarbowej w Polsce za podżeganie za granicą do popełnienia przestępstwa skarbowego przeciwko obowiązkom podatkowym. W publikacji przedstawiono zakres znaczeniowy pojęcia „miejsce popełnienia przestępstwa skarbowego” i na tle wyników jego wykładni ukazano sytuacje, w których przestępstwo jest popełnione za granicą. Następnie zostały opisane warunki sine qua non pociągnięcia w Polsce podżegacza za czyn popełniony za granicą.
The subject of the publication is the issue of penal-fiscal liability in Poland for incitement abroad to commit a fiscal offence against tax obligations. The publication presents the meaning of the concept of place where a fiscal offence is committed and, against the background of the results of interpretation of this concept, presents situations in which the offence is committed abroad. Next are described the sine qua non conditions for charging an instigator in Poland for an act committed abroad.

The study attempts to analyse the competence and task standards of the Minister of National Defense in the area of the national cybersecurity system. The author distinguishes four types of functions that the Minister of National Defense performs in the created cybersecurity system in Poland. In this system, this entity is at the same time one of the specialized bodies competent for cybersecurity, at the same time the body separate and independent from them, and the entity managing CSIRT MON and a member of the College for cybersecurity.
