Эффективность государственного управления имеет существенное значение для любого государства в мире. В экономической литературе предлагаются различные методы и критерии оценки качества государственного управления. В статье рассматриваются инструменты региональной политики как способ повышения эффективности государственного управления в целом. В региональной политике можно выделить административно-правовые, экономические, социально-психологические, а также комплексные методы управления. В своей работе автор сосредотачивается в основном на анализе экономических и административно-правовых методов государственного управления региональной экономикой. В качестве примера автор выбрал Латгальский регион Латвийской Республики как наиболее отсталый регион и определил основные способы его развития. Автор использовал методы социологического исследования, статистического анализа и метод экспертных оценок. В заключительной части автор показывает, что программы энергоэффективности жилого фонда являются эффективным инструментом развития отсталых регионов и могут служить основой для выравнивания социально–экономического потенциала различных регионов.
Public administration efficiency is essential for any country in the world. Economic literature offers a variety of methods and criteria for assessing the quality of governance. The article deals with regional policy tools as a way to improve the efficiency of public administration in general. In regional policy, there can be distinguished administrative, legal, economic, social and psychological methods and integrated management method as well. In this work, the author focuses on the analysis of the main economic and legal methods of state regional management of the economy. As an example, the author chose the Latgale region of the Republic of Latvia as the most backward region and identified the main ways of its development. The author used the methods of Sociological research, statistical analysis and method of expert evaluations. In the concluding part, the author showed that the housing energy efficiency programs are an effective tool for the development of backward regions and can serve as a basis for alignment of the socio-economic potential of various regions.

W artykule uwaga skoncentrowana została na podatku od środków transportowych, interesującym nie tyle ze względu na jego wydajność, ile dużą mobilność bazy podatkowej. Celem było rozpoznanie zróżnicowania fiskalnych skutków decyzji z zakresu władztwa podatkowego gmin z punktu widzenia takich kryteriów, jak typ gminy i kategoria podatnika. Pogłębione badania, do których wykorzystano analizę korelacyjną, klasyczny test niezależności Pearsona i korelację rho Spearmana, umożliwiły pozytywne zweryfikowanie hipotez. Otóż polityka podatkowa gmin wpływała na wysokość dochodów z tego podatku, ale jej skutki były w poszczególnych jednostkach w okresie bieżącym i późniejszych zróżnicowane. Ponadto władztwo podatkowe gmin w przypadku podatku od środków transportowych dotyczyło w szczególności obniżenia górnych stawek podatkowych. Dla gmin, w których zależności były najbardziej widoczne, zaprezentowano również modele ekonometryczne ilustrujące skutki polityki podatkowej w stosunku do niektórych kategorii podatników podatku od środków transportowych.
The article concentrates on vehicle tax, which is interesting not only due to its efficiency, but also high mobility of the tax base. The study aims to examine the correlation between fiscal results and municipal policies, from the perspective of such criteria as the type of municipality and taxpayer category. The study is based on correlation analysis, in which Pearson’s independence test and Spearman’s rho coefficient are used. The results confirm that the tested correlations do exist. Municipal tax policy influences tax revenues of the studied tax, though the results in each unit are different between the current and later periods. Moreover, in the case of vehicle tax, municipal authorities’ main action was to lower the upper tax rates. For municipalities in which these relations were the most visible, econometric models were built. These illustrate the effects of tax policy in relation to certain taxpayer categories.

Municipal taxes are connected with local tax governance, which includes the right of municipal authorities to shape the amounts of some taxes through establishing tax rates and introducing tax reliefs and exemptions. Therefore, it is important to identify and understand the reasons behind the policies of local authorities toward local taxes. The article concentrates on property tax, which is the most efficient local tax. The paper aims to show how municipal governments use opportunities provided by the law in force. For this reason, correlation methods were applied to establish the association between lowering tax rates and budget incomes and to explain the statistical diversification of property tax rates. The study is based on two sources: official data provided by budget status reports (Rb-27s reports) and minutes from municipal council meetings that passed tax resolutions. The analysis covers 12 Polish cities that are members of the Union of Polish Metropolises. The results of the empirical study demonstrate diversity in the tax policies of large cities. The differences can to an extent be explained by the size and wealth of a city. What’s more, the results confirm that tax policy is correlated with city income, but this changes significantly over time.
Z podatkami samorządowymi związane jest lokalne władztwo podatkowe, obejmujące m.in. prawo organów gmin do kształtowania wymiaru niektórych podatków, poprzez możliwość ustalania stawek podatkowych oraz wprowadzania ulg i zwolnień. Dlatego tak ważne jest rozpoznanie, a także zrozumienie motywów i zachowań władz samorządowych w odniesieniu do podatków lokalnych. W artykule uwaga skoncentrowana została na podatku od nieruchomości - najbardziej wydajnym ze wszystkich podatków lokalnych. Celem artykułu było ukazanie, w jaki sposób samorządy miejskie wykorzystują możliwości stwarzane przez obowiązujące obecnie w Polsce ramy prawne. Stąd w artykule starano się - dzięki metodom badania współzależności - ustalić związek między obniżeniem stawek oraz wielkością dochodów budżetowych, a także wyjaśnić statystyczne zróżnicowanie stawek w podatku od nieruchomości. Badanie oparte jest na dwóch źródłach: danych urzędowych pochodzących z oficjalnych sprawozdań budżetowych (Sprawozdanie Rb-27s) oraz protokołach z posiedzeń rad miejskich, na których były przyjmowane uchwały podatkowe. Zakres przestrzenny analiz to 12 miast w Polsce - członków Unii Metropolii Polskich. Wyniki badania empirycznego wskazują, że duże miasta miały zróżnicowaną politykę podatkową, a czynnikami po części tłumaczącymi te różnice są: wielkość i zamożność miasta. Ponadto uzyskane wyniki potwierdzają, że polityka podatkowa jest skorelowana z wysokością ich dochodów, ale ten związek nie jest stały w czasie.

Warunkiem niezbędnym, by przedsiębiorstwo rozwijało się prawidłowo, jest zapewnienie sprawnego i efektywnego zarządzania przez wykwalifikowaną osobę, zarówno jeżeli rozważamy funkcjonowanie przedsiębiorstwa prywatnego, jak i państwowego. Do niedawna z menedżerem w spółce z kapitałem państwowym można było zawierać standardową umowę o pracę lub zastosować kontrakt menedżerski. Od 9 września 2016 roku z członkiem organu zarządzającego spółka ma obowiązek zawrzeć umowę o świadczenie usług zarządzania. Zasadniczym zamiarem nadzoru właścicielskiego przedsiębiorstw komunalnych jest zapewnienie stanu, w którym zarządzający dąży do realizacji oczekiwań interesariuszy. Celem artykułu jest dokonanie wstępnego opisu i przywołanie badań dotyczących wykorzystania kontraktów menedżerskich w przedsiębiorstwach komunalnych oraz ocena ich efektywności. Przyjęto tezę, że kontrakt menedżerski jest efektywnym narzędziem nadzoru właścicielskiego przedsiębiorstw komunalnych. Za zasadniczy problem badań uznano opracowanie ramowej koncepcji analizy efektywności kontraktów menedżerskich w przedsiębiorstwach komunalnych. W artykule wykorzystano badania zawarte w literaturze przedmiotu, badanie koncepcyjne oparte na wnioskowaniu logicznym – zwłaszcza analizę czynników wpływu, metodę kwestionariuszową, badanie eksperckie i analizę przypadku.
The prerequisite for the proper development of a company is to ensure efficient and effective management by a qualified person, both when we consider the functioning of a private enterprise and a state one. Until recently, it was possible to conclude a standard contract of employment with a manager of a state capital company or apply a managerial contract. Since 9th September 2016 a member of the management body of a company is obliged to conclude a contract for the provision of management services. The primary objective of the corporate governance of municipal enterprises is to provide a state in which the manager is committed to meeting the expectations of stakeholders. The aim of the article is to recall the initial description and research on the use of management contracts in municipal enterprises and assess their effectiveness. It adopted the thesis that management contract is an effective tool for corporate governance of municipal enterprises. The adopted problem of the research was to develop a framework for the analysis of the effectiveness of management contracts in municipal enterprises. The paper uses the studies included in the literature, a conceptual study based on logical reasoning―especially the analysis of factor influence, the method of a questionnaire, expert research and a case study.

The paper deals with the constitutional right of the residents of municipalities and territorial units, which entitles them to take part in the conduct of public affairs within the Slovak republic. The citizens can directly or indirectly participate in sustainable development and good governance due to legal arrangements, in particular, such as the local referendum, the municipality inhabitant’s assemblies, the right to petition, the right to file motions, suggestions and complaints with the municipality bodies, and etc. It focuses on the rights of the residents to comment and to be hear within the activities and actions of the municipal authorities, but not only within the administrative procedures, but also within the decisions making processes, which have the impact on the performance of their other rights.

Federalisation, regionalisation and local governance has been an important issue of legal and administrative sciences. Although the differences of decentralised and federal systems have remained, several transformations could be observed and in several countries the model of the public administration has changed in the last decades. A convergence or hybridisation of the models can be observed: the competences of the municipal bodies have been strengthened. Although the boundaries between municipalities and member states of the federation have blurred in the governance of these entities, the legal distinction between them remained solid: the regional municipalities with broad competences do not have their statehood.
Regionalizacja, federalizm i samorząd lokalny to istotne zagadnienia będące przedmiotem refleksji w naukach prawnych i administracyjnych. Chociaż utrzymują się różnice w systemach zdecentralizowanych i federalnych, to można zauważyć pewne przekształcenia, w kilku krajach zaś model administracji publicznej w ciągu ostatnich kilkudziesięciu lat uległ zmianie. Obecnie można zaobserwować procesy upodabniania się lub hybrydyzacji modeli, kompetencje organów samorządu terytorialnego ulegają bowiem wzmocnieniu. Chociaż granice między gminami a państwami członkowskimi federacji zatarły się w zarządzaniu tymi podmiotami, prawne rozróżnienie między nimi pozostało sztywne – regionalne jednostki samorządu terytorialnego nie mają cechy państwowości.

Celem artykułu jest przedstawienie koncepcji oceny efektywności kontraktów menedżerskich w przedsiębiorstwach komunalnych oraz wyników badań empirycznych. Jako przedmiot badań przyjęto charakterystykę sektora przedsiębiorstw komunalnych, identyfikację uwarunkowań ekonomiczno-organizacyjnych i prawnych implementacji kontraktów menedżerskich, a także prezentację opinii prezesów badanych spółek. Jako problem badań uznano identyfikację korzyści i dysfunkcji wprowadzonych kontraktów menedżerskich oraz wskazanie sposobów usprawnienia tej formy zatrudnienia osób na stanowiskach kierowniczych. W badaniu wykorzystano metodę analizy wyników badań poprzedników, metodę analizy finansowej i technikę wywiadu z menedżerami badanych przedsiębiorstw, wywiady z przedstawicielami właściciela – jednostki samorządu terytorialnego. Artykuł podzielono na trzy znaczące części. Pierwsza to objaśnienie pojęcia kontraktu oraz omówienie procesu przygotowania kontraktu menedżerskiego. Wysunięto wniosek, że skuteczne zarządzanie może zapewnić tylko taki system motywacji, który pozwoli docenić kompetencje i uzyskane efekty oraz zrównoważy ryzyko i odpowiedzialność, jaka spoczywa na kadrze kierowniczej. Funkcję taką mają spełniać kontrakty menedżerskie, które odgrywają dużą rolę w teorii i praktyce nadzoru właścicielskiego. W drugiej części artykułu przedstawiono charakterystykę sektora przedsiębiorstw komunalnych. Ostatnia część to prezentacja wyników wstępnych badań empirycznych na temat stosowania kontraktów w praktyce przedsiębiorstw komunalnych.
The aim of the article is to present the concept of assessing the effectiveness of managerial contracts in municipal enterprises and presentation of the results of empirical research. The subject of the research was the description of the municipal enterprises sector, the identification of economic and organizational as well as legal conditions for the implementation of managerial contracts and the presentation of the opinions of the presidents of the surveyed companies. The identification of benefits and dysfunctions of managerial contracts introduced as well as identification of ways to improve this form of employment of people in managerial positions were acknowledged as a research problem. In the study the method of analysing the results of research of predecessors, the method of financial analysis and the technique of interview with managers of the surveyed enterprises, interviews with representatives of the owner—local government units—were used. The article is divided into three significant parts. The first one is an explanation the contract concept and discussion of the process of preparing a managerial contract. The conclusion was drawn stating that effective management can only be provided by a motivation system that will allow to appreciate the competences and results obtained and balance the risk and the responsibility that rests on the managerial staff. Managerial contracts, which play a large role in the theory and practice of corporate governance, are to fulfill this function. The second part of the article presents the characteristics of the municipal enterprises sector. The last part of the article is a presentation of the results of preliminary empirical research on the use of contracts in the practice of municipal enterprises.

The main aim of the article is to present the practice of network governance concept in Finnish local government and its impact on local democracy, including the role played by elected representatives. The main hypothesis of the study implies that the idea of network governing, not only forces municipal councils to redefine their roles, but also reduces the scope of their responsibilities and limits the level of accountability. The study is based on empirical research conducted in 22 municipalities located in Pirkanmaa Region, Southern Finland in Spring 2015. The results of the research indicate that although network governance easily fits into Finnish local government, the concept brings many challenges. One of the most important challenges is the necessity to strengthen the say of elected representatives, presently perceived with regard to governing process mainly as rubber-stamp councils.

Samorząd gminny w Niemczech, wykonując zadania publiczne w ramach multilevel governance, pełni najważniejszą rolę w układzie sieciowym. Jako organ państwa inicjuje i zmienia formy koordynacji działań zbiorowych. Głównym problemem, jaki legł u podstaw artykułu jest używanie siatki pojęciowej, występującej w zdekoncentrowanej strukturze administracji publicznej w krajach anglosaskich, do opisu multi-level governance w zdecentralizowanych formach administracji publicznej. Celem głównym artykułu jest zaprezentowanie w jaki sposób koncepcja multi-level governance została dostosowana do specyfiki niemieckiego samorządu gminnego oraz na czym polega jej istota. Celowi głównemu podporządkowano następujące pytania badawcze: Jaka jest różnica w genezie governance w Niemczech w porównaniu do tradycji państw anglosaskich? W jaki sposób są realizowane zadania publiczne w ramach multi-level governance w Niemczech? Jakie są formy organizacyjno-prawne wykonywania zadań publicznych? Artykuł został przygotowany według założeń nowego instytucjonalizmu. W celu zaprezentowania sposobów wykonywania zadań publicznych w koncepcji multi-level governance zastosowano metodę funkcjonalną, która umożliwiła wyłonienie tych zadań, które mogą być realizowano zarówno przez jednostki samorządu terytorialnego, jak i instytucje samorządu gospodarczego. Uzupełniając rozważania zastosowano również metodę instytucjonalną pokazującą specyfikę współpracy samorządu gminnego z innymi podmiotami publicznoprawnymi i prywatnoprawnymi. Z badań nad multi-level governance w Niemczech autorka wyciągnęła trzy wnioski, wokół których powstał artykuł. Po pierwsze, powstanie multi-level governance w Niemczech oparte jest na działaniach odgórnych i następuje od kraju związkowego do gmin (top-down). Tworzenie układu sieciowego wynika wówczas z przekonania władz państwowych o efektywniejszej realizacji zadań publicznych opartej na współpracy z podmiotami prywatnymi, których działania moderowane są przez podmioty władcze. Po drugie, wprowadzenie multi-level governance na poziomie lokalnym poprzedzone jest regional governance na szczeblu krajów związkowych stanowiącą dostosowanie koncepcji governance do specyfiki państwa federalnego. Po trzecie, multi-level governance zostało wprowadzone w strukturę samorządu gminnego za pośrednictwem specjalnego typu zadań publicznych (Gemeinschaftsaufgaben).
Performing public tasks as part of multi-level governance, municipal governments in Germany play the most vital role in the network system. As state bodies, they initiate and change the forms of coordination of collective actions. The main issue addressed in this paper is the use of a conceptual grid applied in the deconcentrated structure of public administration in Anglo-Saxon countries for the description of multilevel governance in decentralized forms of public administration. The main aim of this paper is to present how the concept of multi-level governance has been adapted to the specific character of German municipal government and what its essence is. The following research questions are asked to achieve the main aim: What is the difference in the genesis of governance in Germany in comparison to the tradition of Anglo-Saxon countries? How are public tasks performed within the framework of multi-level governance in Germany? What are the organizational and legal forms of performing public tasks? The paper was prepared following the assumptions of the new institutionalism. In order to present ways of performing public tasks in the concept of multi-level governance the functional method was used. This enabled the selection of those tasks that can be implemented by both local government units and self-governing business institutions. Additionally, the institutional method was used to show the specificity of cooperation between municipal governments and other public and private entities. The research on multi-level governance in Germany resulted in three conclusions providing the framework for this paper. Firstly, the emergence of multi-level governance in Germany has been based on top-down activities which occur between the federal states and municipalities. The creation of network systems results from the conviction of the state authorities that the implementation of public tasks is more effective in cooperation with private organizations which are moderated by regulatory entities. Secondly, before implementing multi-level governance on the local level, regional governance has been established at the level of the Lands, allowing the concept of governance to be adjusted to the specific requirements of a federal state. Thirdly, multi-level governance has been embedded in the structure of local government through a specific type of public task (Gemeinschaftsaufgaben).

The aim of this paper is to present the genesis and the development of two models of the “leading path” to the integrated management of functional urban areas of voivodeship centres (FUA VC) in Poland in the context of the implementation of the new instrument of the EU’s Cohesion Policy – Integrated Territorial Investments (ITIs). The implementation of ITIs is presented in the light of the inter-commune cooperation in FUA VC, which has been realised variously so far. As examples of the “leading path” to the integrated management based on the ITI, two functional areas have been selected, differing in this respect, Poznań in western Poland (an example of a bottom-up model) and Lublin in its eastern part (an example of a top-down model). In the conclusion, the instrument of ITI was evaluated as a factor which initiates, deepens or complicates the cooperation of local governments in FUAs. It has been emphasised, that in spite of the creation of organisational and financial instruments (ITIs) which activate the cooperation of self-governments in functional areas, one must take into account the need for legislative changes which give a special status to metropolitan areas, income sources and specific powers.

Most studies about websites of local public administration can be found in the area of e-government, where models developed for the management and evaluation of these websites are composed of dimensions based on criteria of technical and technological nature such as accessibility, navigability, usability, aspects decisive for its functionality and quality. However, they have left in second place the analysis of dimensions related to the management of public organizations, such as transparency, network of relationships, human capital, social and environmental responsibility, aspects that are emphasized in the theories of intellectual capital. In this area websites are considered as strategic tools of knowledge management, however, there are very few models for management and evaluation of websites based on the theories of knowledge management and intellectual capital, and those that exist are mainly for the business area. Thus, this paper intends to propose an intellectual capital model for contents management of local government websites, as the literature leaves open that possibility. The dimensions of digital capital considered relevant in the development of local government websites were: services, democratic, relational and organizational e-capital.
Większość badań na temat stron internetowych lokalnej administracji publicznej można znaleźć w obszarze e-administracji, gdzie modele opracowane dla zarządzania oraz oceny tych stron składają się z wymiarów opartych o kryteria o charakterze technicznym i technologicznym, takie jak dostępność, nawigacja, przydatność, aspekty decydujące o jej funkcjonalności i jakości. Jednakże pozostawiły one na dalszym miejscu analizę wymiarów związanych z zarządzaniem organizacjami publicznymi, takich jak przejrzystość, sieć relacji, kapitał ludzki, odpowiedzialność społeczna i środowiskowa, aspekty, które są akcentowane w teoriach kapitału intelektualnego. W tym obszarze strony internetowe uważa się za narzędzia strategiczne zarządzania wiedzą, niemniej bardzo niewiele jest modeli zarządzania i oceny stron internetowych opartych na teoriach zarządzania wiedzą oraz kapitałem intelektualnym, te zaś, które istnieją, dotyczą głównie obszaru biznesu. W związku z tym niniejszy artykuł ma na celu zaproponowanie modelu kapitału intelektualnego do zarządzania treściami samorządowych stron internetowych, ponieważ literatura pozostawia taką możliwość otwartą. Wymiary kapitału cyfrowego uważane za relewantne przy opracowywaniu stron internetowych samorządów to: e-kapitał usług, demokratyczny, relacyjny i organizacyjny.

The main objective is to identify the essence and the fundamental objectives of corporate governance in commercial companies with the participation of local government units. Inter-municipal cooperation mechanisms have been promoted as flexible tools, reflecting the transition from government to governance in a new network economy and eliminating the need to engage in redrawing clear-cut boundaries in the context of soft spaces with fuzzy boundaries. An evaluation of inter-municipal cooperation in the development of industrial parks and tax revenue redistribution in Israel, from the first 1992 initiative to imposed redistribution in 2014/15, reveals how an initiative ’from below’ has been adopted and encouraged ’from above’, finally used by the central state as a tool of control, to serve its own objectives. It highlights the inherent temptation for top-down imposition, embedded in bottom-up cooperation mechanisms, calling for light-touch regulatory legislation and opting for gently imposed solutions where needed.

The article presents discussion around the essence and meaning of the privatization of public aims. The presentation of methods of their privatization, and detailed analysis of popular so-called: order “in house”. The entire problem was presented in the context of the performance of the owner’s supervision over a company performing this type of order. Further, the article presents the case study of functioning of this type of companies and presents the model of the supervisory structure on the example of research of empirical municipal companies end tools of the accountancy helping supervisory mechanisms in special municipal companies. The final part of the article presents conclusions from the research.

The article was tried to solve the dilemma of whether neighborhood inter-municipal cooperation in Ukraine is part of the European model of inter-municipal cooperation, or just another attempt to imitate it? The basis of the study is the work on the general theory of governance, territorial governance, inter-municipal cooperation, which provide a basis for understanding what the European model of neighborhood inter-municipal cooperation is. The research is based on an analysis of the legal framework governing inter-municipal cooperation in Ukraine, as well as official statistics on the practical implementation of the right to inter-municipal cooperation of neighboring territorial communities.
