    Local governments of Krakow created the system of financing commune operations of auxiliary units. No other local government has not decided to transfer so many powers and financial resources to your districts or the settlements. Districts progressively have won competences from financial resources for administrative service of their offices up to the tasks entrusted to the expanded program. One of the main factors which influenced the delegation of tasks and competences of districts was to use social potential in such entities.

    The paper is focused on the field of real property taxation in Slovakia, from a legal-budgetary point of view, at the local level (the City of Košice). The scientific goal of the paper is to assess the development in the total revenue, tax revenue and revenue from real property taxation in component-wise structure (revenue from the taxation of land, buildings and flats and non-residential premises) within the period from 2005 to 2019, as well as the search for causal relations between legislation and reported revenue. Within the first stage of targeted research; the authors applied standard scientific methods and procedures, namely the study and analysis of legislation (selected laws and generally binding regulations), the database of available and requested numerical data and information, which were provided by the selected subject of local self-government - the City of Košice; in the second stage of targeted research the authors created through abstraction, comparison, induction and deduction their own results and conclusions, which are presented in this paper in textual and graphical forms.

    Opis:
    Aim: The aim of the article is to answer the question whether the municipality or the volunteer fire department bears the normal maintenance costs of the property transferred by the municipality to the volunteer fire department through a lending agreement for the fire station. The purpose formulated in such a manner assumes that the building transferred to the volunteer fire department is the property of the municipality. This is the situation in most municipalities in Poland. Volunteer fire departments owning a fire station are a rarity in Poland. Related to the main problem are specific problems, such as the situation of TSO properties in Poland, the cost of maintaining lending real estate, the cost of maintaining volunteer fire departments, and taxation of volunteer fire departments’ properties. Project and methods: The study uses traditional scientific methods within the legal science such as the dogmatic-legal method, the hermeneutic method, and the argumentative method. Results: The municipality bears the usual costs of maintaining the properties transferred to the TSO by the municipality through a free lending agreement for the needs of a fire station. This is due to the article 713 of the Civil Code, which is relatively binding and can be excluded from application through contractual arrangements between the municipality and the TSO. In such a case, ordinary maintenance costs in the form of expenses and expenditures necessary to maintain a fire station in a condition as it was before the conclusion of the agreement, i.e. mainly the costs of maintenance, minor repairs and renovations, the costs related to the use of the premises will be borne by the municipality. Concluding an agreement for lending the fire station by the municipality and TSO also removes the obligation to pay the real estate tax (fire station) by the volunteer fire department. The results of the article allow to sort out the relationship between municipalities and volunteer fire departments in Poland in the area of concluding agreements on lending fire stations, which in many municipalities have remained neglected and improperly formed for many years, as indicated, among others, in the report of the Supreme Chamber of Control in 2019 on the financing of volunteer fire departments. Conclusions: Postulate de lege ferenda can be made, that in order to avoid interpretation disputes related to the interpretation of article 713 of the Civil Code, it would be reasonable to amend the provisions of the Act on Volunteer Fire Departments. It would be worth including a provision that when a municipality lends property to a TSO for a fire station, all maintenance costs, including ordinary costs, are borne by the municipality and article 713 of the Civil Code does not apply in this case.
    Cel: Celem artykułu jest odpowiedź na pytanie, która ze stron – gmina czy ochotnicza straż pożarna (OSP) – ponosi zwykłe koszty utrzymania nieruchomości przekazanych OSP przez gminę w drodze umowy użyczenia na potrzeby remizy strażackiej. Tak sformułowany cel zakłada, że budynek przekazywany ochotniczej straży pożarnej jest własnością gminy. Jest to sytuacja, z jaką mamy do czynienia w większości gmin w Polsce. Ochotnicze straże pożarne posiadające remizę na własność to rzadkie przypadki. Z problemem głównym wiążą się problemy szczegółowe, takie jak sytuacja nieruchomości OSP w Polsce, koszty utrzymywania nieruchomości użyczanych, koszty utrzymywania ochotniczych straży pożarnych, opodatkowanie nieruchomości ochotniczych straży pożarnych. Projekt i metody: W pracy zastosowano tradycyjne metody naukowe w ramach nauk prawnych, tj. metodę dogmatyczno-prawną, metody hermeneutyczną i argumentacyjną. Wyniki: Gmina ponosi zwykłe koszty utrzymania nieruchomości przekazanych przez nią dla OSP na potrzeby remizy strażackiej w drodze bezpłatnej umowy użyczenia. Wynika to z art. 713 kodeksu cywilnego, który ma charakter względnie wiążący i może zostać wyłączony z zastosowania w drodze uzgodnień umownych pomiędzy gminą a OSP. W takim przypadku zwykłe koszty utrzymania w postaci wydatków i nakładów koniecznych, pozwalających utrzymać remizę w stanie sprzed zawarcia umowy (czyli przede wszystkim koszty konserwacji, drobnych remontów i napraw, koszty związane z używaniem lokalu), będzie ponosić gmina. Zawarcie umowy użyczenia remizy przez gminę i OSP znosi także obowiązek opłacania podatku od nieruchomości (remizy) przez ochotniczą straż pożarną. Wyniki zaprezentowane w artykule pozwalają na uporządkowanie relacji pomiędzy gminami a ochotniczymi strażami pożarnymi w Polsce w zakresie zawierania umów użyczenia remizy. W wielu gminach zostały one niewłaściwie ukształtowane i od lat pozostają zaniedbane, co zostało wskazane m.in. w raporcie Najwyższej Izby Kontroli z 2019 r. dotyczącym finansowania ochotniczych straży pożarnych. Wnioski: Można zgłosić postulat de lege ferenda, że aby uniknąć sporów interpretacyjnych związanych z wykładnią art. 713 k.c., zasadne byłoby znowelizowanie przepisów ustawy o ochotniczych strażach pożarnych. Warto by znalazł się tam zapis mówiący, że gdy gmina użycza OSP nieruchomość pod remizę, wszelkie koszty jej utrzymania – w tym koszty zwykłe – ponosi gmina, a art. 713 k.c. nie ma w tym przypadku zastosowania.

    Posiadanie stabilnych źródeł dochodów ma kluczowe znaczenie dla prawidłowej realizacji zadań publicznych. Celem opracowania jest zbadanie, czy gminy wykorzystują swoje uprawnienia w odniesieniu do podatków i opłat lokalnych, by utrzymywać globalną wielkość dochodów na stabilnym poziomie, uwzględniając takie uwarunkowania wpływające na ich dynamikę, jak tempo wzrostu PKB czy kształtowanie się maksymalnych stawek podatków lokalnych. Zasadniczym wnioskiem wynikającym z przeprowadzonej analizy jest to, że gminy nie prowadzą dostatecznie elastycznej polityki nakierowanej na utrzymanie dochodów na stałym poziomie, a obniżając stawki podatkowe oraz stosując własne ulgi i zwolnienia, kierują się pozafiskalnymi celami. W artykule oparto się na danych empirycznych zgromadzonych przez Ministerstwo Finansów, Główny Urząd Statystyczny i Regionalną Izbę Obrachunkową za lata 2003-2014.
    The aim of the study is to examine whether the municipalities use their power to keep the volume of the total revenues stable taking into account such factors as the dynamics of the GDP growth or the level of the maximum local tax and fee rates. The main finding of the analysis is that the municipalities do not conduct very flexible policy aimed at maintaining total revenues at a fairly constant level, and they decrease tax rates and introduce their own tax reductions on the non-fiscal basis. The study is based on empirical data gathered by the Ministry of Finance, Central Statistical Office and Regional Chamber of Audit for the years 2003-2014.

    In order to ensure the balance of budgets of local government associations in interwar Poland, it was often necessary to establish additional sources of income, not provided for in the Act of 11 August 1923 on Temporary Regulation of Municipal Finance (in force until 1946). These included, among others, an autonomous countervailing tax for rural communes, which in its original form was in force only in 1924 and only in the territory of the former Russian partition. Later legislation systematically extended the time during which rural communes (from 1931 onwards in the whole country) could charge an autonomous countervailing tax. It turned out that this temporary tax — in the intentions of the legislator — survived to the end of interwar Poland and was the most significant revenue item among the budgets of rural communes.

    Choć średniowieczne księgi rachunkowe miasta Lwowa są jednymi ze starszych i lepiej zachowanych tego typu źródeł z ziem polskich, to nie były one dotąd szerzej wykorzystywane w studiach nad miejskimi rachunkowością i finansami. Artykuł stara się uzupełnić tę lukę, a także zweryfikować dotychczasowe ustalenia historiografii poprzez analizę budowy zewnętrznej i wewnętrznej wspomnianych rękopisów oraz ich treści. Porównanie struktury lwowskich rejestrów rachunkowych z ich zawartością wskazuje, że wszystkie trzy księgi powstały w wyniku jednorazowej czynności oprawienia określonej liczby składek. Tak przygotowane woluminy były stopniowo uzupełniane każdego roku. Wpisy z poszczególnych lat zapisywano wieloetapowo – najpierw pisarz wpisywał nagłówki rejestrów i przygotowywał miejsce na noty, które sukcesywnie zapełniał w późniejszym czasie. Lwowskie rachunki prowadzone były według określonego schematu. Wpisy każdego roku otwierały wykazy nowych urzędników i przyjętych do prawa miejskiego. Właściwe rachunki dzieliły się na kilka zasadniczych kategorii, takich jak: wynagrodzenia służb miejskich, czynsze z nieruchomości, przedsiębiorstw i wsi miejskich, wydatki ogólne (głównie wydatki budowlane i wypłaty dla dorywczych robotników), wydatki na podróże i podarki w sprawach miejskich czy wreszcie grupa rozliczeń z mieszczanami oraz rejestrów specjalnych. System ten stosowano do początku XVI wieku. Zawartość ksiąg dokumentuje jedynie wycinek działalności skarbowej miasta, co znajduje odbicie w corocznej znacznej przewadze wydatków nad dochodami oraz w sporych wahaniach ich kwot rok do roku. Rachunki sporadycznie wymieniają nierejestrowane w nich kategorie dochodów i wydatków, takie jak wpływy z podatków, czynszów spoza miasta i opłat gospodarczych. Rozproszone wzmianki wskazują też, że kancelaria prowadziła również rejestry pomocnicze, których część wykorzystywano do uzupełniania właściwych ksiąg. Praktyka rejestrowania w księgach jedynie określonych grup wpisów miała najpewniej związek ze zwyczajem składania rachunków przez ustępującą radę, zauważonym także w innych miastach polskich. Analiza lwowskich ksiąg wskazuje, że najprawdopodobniej wydatki i dochody miasta były bardziej zbilansowane niż pozornie dokumentują to rachunki. Jednocześnie pozwalają one wskazać zasady prowadzenia rachunkowości w późnośredniowiecznym mieście polskim.
    Even though the municipal bookkeeping records of Lvov are among the oldest and the best preserved sources of the time in the Polish or one-time Polish areas, they have not been more widely used in research on accountancy and finance so far. The article intends to fill in this gap and verify the historiographic data by analyzing the outer and inner shape of these manuscripts and their content. Comparison of the structure of bookkeeping registers in Lvov along with their content shows that all of the three books were created as a result of binding a specific number of contributions. The volumes once prepared in this way were gradually completed every year. Records from specific years were put down in stages: at first the writer inserted the headers to the registers and then prepared space for the notes, which were gradually completed later. In Lvov the books were kept according to a specific pattern. The records for each year showed registers of new clerks and people admitted to the municipal regulations. Appropriate records were subdivided into a few specific categories, such as remuneration of municipal services, rent from property, companies, and surrounding villages, general expenditure (construction expenditure and wages for temporary workers), travel and gift expenditure in the municipal affairs, accountancy with burghers, and special registers. The system was used till the beginning of the sixteenth century. The books’ contents document only a fraction of the town’s tax activities. It is reflected in the annually observable phenomenon of expenditure that dominates over revenue and in considerable wavering of the two every year. It is rare that the bills list the categories of revenue and expenditure that are not registered in them, such as tax revenue, rent that came from outside of the town, and administrative charges. Dispersed records show that the office also introduced assisting registers, a part of which was used to fill in the right books. The practice of keeping only specific groups of records in the books was probably related to the habit of presenting the books by the council that was finishing their term of office, The practice was also noticeable in other Polish towns. The analysis of Lvov bookkeeping demonstrates that the revenue and the expenditure were probably more balanced than is shown by the bills. At the same time they allow us to inspect the rules of bookkeeping in a late medieval Polish town.
    Obwohl die mittelalterlichen Rechnungsbücher der Stadt Lemberg zu den ältesten und besterhaltenen Quellen dieser Art aus dem polnischen Gebiet gehören, fanden sie bisher keine breite Anwendung in der Forschung über Stadtfinanzen und -buchhaltung. Das Ziel des vorliegenden Artikels ist es, diese Lücke zu schließen und durch eine Analyse der äußeren und inneren Form der genannten Handschriften und deren Inhalts den aktuellen Wissensstand zu verifizieren. Ein Vergleich der Struktur von Lemberger Rechnungsbüchern mit deren Inhalt deutet darauf hin, dass alle drei Bücher infolge der einmaligen Einbindung einer bestimmten Anzahl von Beiträgen entstanden. So angefertigte Bände wurden jedes Jahr allmählich ausgefüllt. Die Einträge aus den einzelnen Jahren erfolgten mehrstufig — zuerst schrieb der Schreiber die Überschriften ein und bereitete den Platz für die Noten vor, die zu späterer Zeit sukzessiv vonihm ergänzt wurden. Die Lemberger Rechnungsbücher wurden nach einem bestimmten Schema geführt. Diejährlichen Einträge öffneten die Verzeichnisse von neuen Beamten und Stadtbürgern. Die eigentlichen Rechnungen konnten in einige Hauptkategorien geteilt werden, und zwar: Vergütung der Stadtbediensteten, erhobene Mieten aus Immobilien, Unternehmen und der Stadt gehörenden Dörfern, allgemeine Ausgaben (hauptsächlich Bauausgaben und Löhne für Zeitarbeiter), Ausgaben für Reisekosten und Geschenke im Rahmen der Stadtvertretung oder auch eine Serie der Abrechnungen mit Stadtbewohnern und Spezialregister. Dieses System wurde bis ins sechzehnte Jahrhundert hinein verwendet. Allerdings dokumentiert der Inhalt der Bücher lediglich einen Ausschnitt aus der Finanztätigkeit der Stadt. Aus diesem Grund dominieren die jährlichen Stadtausgaben über die Einnahmen und von Jahr zu Jahr weichen die Beträge wesentlich voneinander ab. Die Rechnungsbücher geben auch gelegentlich die darin nicht berücksichtigten Kategorien der Einnahmen und Ausgaben an, wie Steuereinnahmen, erhobene Mieten von außerhalb der Stadt und sonstige Abgaben. Des Weiteren kann man vereinzelt auf Notizen stoßen, die darauf hinweisen, dass die Kanzlei auch Hilfsbücher führte, deren Inhalt zum Teil bei der Führung von Hauptbüchern verwendet wurde. Die Praxis, nur bestimmte Kategorien der Einträge in die Rechnungsbücher aufzunehmen, hing höchstwahrscheinlich mit dem auch in anderen polnischen Städten zu beobachtenden Brauch zusammen, dass der zurücktretende Stadtrat Rechenschaft ablegen musste. Aus der Analyse der Lemberger Rechnungsbücher ergibt sich, dass die Ausgaben und Einnahmen der Stadt mit hoher Wahrscheinlichkeit mehr bilanziert waren, als dies scheinbar in den Rechnungen dokumentiert ist. Gleichzeitig lassen sich daraus die Rechnungslegungsregeln in der spätmittelalterlichen polnischen Stadt schließen.

    Opis:
    Communes as the smallest units of local government in Poland are responsible for social assistance. The growing number of older people can affect the level of care expenses, including these that are spent for care in social welfare houses (SWH). The expenses of municipalities related to the residence of their inhabitants in SWH are increasing systematically, and they are becoming a substantial problem especially for communes at lower socio‑economic development level. The aim of this paper is to identify those voivodeships in which communes are and will be mostly affected in the near future by residual charges for inhabitants of SWH and to check whether this is related to the demographic situation. Statistical data analyzed in this paper were taken from public sources: Ministry of Family, Labour and Social Policy reports, and Central Statistical Office. The current situation of voivodeships in the area of population aging and the expenditures on residual charges for inhabitants of SWH were described. There was diagnosed a diversification of voivodships due to the level of expenditures connected with residual charges for inhabitants of SWH and the lack of diversification due to the participation of the elderly in the population. Basing on linear trend models there was also prepared a forecast of expenditures of communes in the perspective up to 2020. It was shown that the communes located in the warmińsko‑mazurskie voivodship would have to face the greatest level of expenditures (per capita). The expenditures per capita in this voivodeship will be more than two times of the mazowieckie voivodship’s expenditures.
    Gminy jako najmniejsze jednostki samorządu terytorialnego w Polsce są odpowiedzialne za działania z zakresu pomocy społecznej. Rosnąca liczba osób starszych może wpływać na poziom wydatków związanych z zapewnieniem im opieki, w tym również tej całodobowej, świadczonej przez domy pomocy społecznej (DPS‑y). Od wielu lat systematycznie rosną wydatki gmin związane z pobytem ich mieszkańców w DPS‑ach i stanowią one coraz bardziej dotkliwy problem, zwłaszcza dla gmin o niższym poziomie rozwoju społeczno‑ekonomicznego. Celem niniejszego artykułu jest wskazanie tych województw, w których gminy są i będą w najbliższej przyszłości najbardziej obciążone z tytułu dopłat do pobytu mieszkańców w DPS‑ach, i sprawdzenie, czy ma to związek z obserwowaną w nich sytuacją demograficzną. Dane poddane analizie statystycznej pochodziły z ogólnodostępnych źródeł: sprawozdań Ministerstwa Rodziny, Pracy i Polityki Społecznej oraz opracowań Głównego Urzędu Statystycznego. Określono aktualną sytuację poszczególnych województw w zakresie starzenia się społeczeństwa oraz obciążenia wydatkami na dofinansowanie pobytu mieszkańców w DPS‑ach. Stwierdzono zróżnicowanie województw ze względu na stopień obciążenia przedmiotowymi wydatkami i brak zróżnicowania ze względu na udział osób starszych w populacji. W oparciu o modele trendu liniowego sporządzono również dla województw prognozy przedmiotowych wydatków gmin w perspektywie do 2020 roku. Wykazano, że największe obciążenie (w przeliczeniu na jednego mieszkańca) dotyczyć będzie gmin zlokalizowanych na terenie województwa warmińsko‑mazurskiego. Przypadające w tym województwie na jednego mieszkańca wydatki będą ponad dwukrotnie wyższe niż w województwie mazowieckim.

    Gminy w granicach obowiązującego prawa mogą dokonać wyboru prawnej formy samodzielnego realizowania zadań własnych w zakresie zbiorowego zaopatrzenia w wodę i zbiorowego odprowadzania ścieków (poprzez urząd gminy, gminną jednostkę budżetową, samorządowy zakład budżetowy, spółkę komunalną), jak i prawnej formy współdziałania (poprzez związek międzygminny lub zawarte porozumienie międzygminne). Wybór formy organizacyjno-prawnej i sposobu realizacji działalności komunalnej wiąże się z określonymi skutkami prawnopodatkowymi. Na tym tle pojawia się pytanie: czy forma organizacyjno-prawna, za pomocą której gmina wykonuje usługi komunalne w zakresie dostaw wody i odbioru ścieków, determinuje wysokość deklarowanego z tytułu tej działalności podatku od towarów i usług w zharmonizowanym systemie VAT? Celem artykułu jest również udzielenie odpowiedzi na pytanie badawcze: który wariant działalności komunalnej, dotyczącej zbiorowego zaopatrzenia w wodę i zbiorowego odprowadzania ścieków, pozwala gminom na realizację zasady neutralności i potrącalności VAT oraz w jakim zakresie? Punktem wyjścia do realizacji tak postawionego celu będzie analiza formalno-dogmatyczna unijnego i krajowego prawa podatkowego, uzupełniona elementami metody prawnoporównawczej oraz historycznoprawnej, poglądami doktryny, judykatury, a także orzecznictwem interpretacyjnym organów podatkowych.
    Municipalities, within the boundaries of the binding law, may choose the legal form for the independent performance of their own tasks in the field of collective water supply and collective sewage disposal (through a municipal office, municipal budget unit, municipal budget establishment, municipal company), as well as the legal form of cooperation (through an inter-municipal union or concluded inter-municipal agreement). The choice of the organizational and legal form, and the manner of performance of municipal activities, is connected with specific legal and tax consequences. Against this background, the question arises: does the organizational and legal form by which the municipality provides the municipal services of water supply and sewage collection determine the amount of VAT declared on those activities under the harmonized VAT system? The aim of the article is also to answer another research question: which variant of municipal activity in the field of collective water supply and collective sewage disposal allows municipalities to implement the principle of VAT neutrality and deductibility, and to what extent? The starting point for the achievement of the objective set out above is a formal-dogmatic analysis of the EU and domestic tax law, supplemented with elements of comparative legal and historical law methods, the views of the doctrine and the judicature, as well as the interpretative judicial decisions of tax authorities.

    Gminy jako najmniejsze jednostki samorządu terytorialnego w Polsce są odpowiedzialne za działania z zakresu pomocy społecznej. Rosnąca liczba osób starszych może wpływać na poziom wydatków związanych z zapewnieniem im opieki i stanowić coraz większy problem dla samorządu lokalnego, zwłaszcza dla gmin o niższym poziomie rozwoju społeczno‑ekonomicznego. W ostatnich latach zaobserwowano stosunkowo wysoki wzrost kwoty świadczeń z tytułu usług opiekuńczych i specjalistycznych usług opiekuńczych. Rodzi się zatem pytanie: „Czy można zaobserwować istotną zależność między udziałem osób starszych w populacji a stopniem obciążenia finansowego gmin z tytułu świadczenia usług opiekuńczych?”. Celem artykułu jest wskazanie tych województw, w których gminy są najbardziej obciążone świadczeniem usług opiekuńczych i sprawdzenie, czy ma to związek z obserwowaną w nich sytuacją demograficzną. Dane poddane analizie statystycznej pochodziły z ogólnodostępnych źródeł: sprawozdań Ministerstwa Rodziny, Pracy i Polityki Społecznej oraz opracowań Głównego Urzędu Statystycznego. Określono aktualną sytuację poszczególnych województw w zakresie starzenia się społeczeństwa oraz obciążenia świadczeniami na usługi opiekuńcze. Tylko w przypadku połowy województw stwierdzono, że poziom (niski, średni lub wysoki) obciążenia przedmiotowymi świadczeniami odpowiada takiemu samemu poziomowi udziału osób starszych w populacji, co świadczyć może o związku kwoty świadczeń na usługi opiekuńcze z sytuacją demograficzną danego województwa.
    Local governments as the smallest units of territorial self‑government in Poland are responsible for providing care services. The growing number of the elderly can influence the expenditures level connected with ensuring proper care for them, and it may constitute a growing problem for local government, especially for districts with a lower level of socio‑economic development. In recent years, a quite high increase in benefits amount due to care services and specialist care services has been observed. Therefore, a question arises whether a significant dependence can be observed between the share of the elderly in the population and the degree of local governments’ financial burden due to providing care services. The aim of this paper is to indicate voivodeships where local governments bear the biggest burden of providing care services and to verify whether it is connected with their demographic situation. The data which were subject to the static analysis conducted came from public sources: the report of the Ministry of Family, Labour and Social Policy of the Republic of Poland and elaborations of the Central Statistic Office. The situation of particular voivodeships has been defined in the scope of society ageing and burdening local government with care services. Only in the case of half of voivodeships it has been proven that the level (low, medium or high) of burden of the said services corresponds to the same level of the number of the elderly in their population, which can confirm that the amount of care services is connected with a demographic situation of a given voivodeship.

    Ageing populations are a challenge for public finances. The problem is recognised better at country than at local level. This study aims to analyse the impact of the ageing of populations on the revenues and expenditures of Polish municipalities, as well as on their most important components. The author performed an econometric analysis (fixed effects regression) of panel data for 2,414 municipalities between 2004 and 2019. The data for the study was obtained from budgetary statements of Polish municipalities collected by the Ministry of Finance. It was preceded by an international literature review and an analysis of demographic changes in municipalities. The demographic data came from the Local Data Bank of Statistics Poland. The study positively verified the hypothesis that if the proportion of elderly citizens in a municipality increases, the local budget shrinks. A decrease in revenues and spending per capita was observed, which could mean that in ageing municipalities, citizens receive fewer and/or lower-quality public services. Since public services are in greater demand among lowerincome and less self-supporting citizens, they will be influenced by the cutting of local budgets to the largest extent. The study showed that ageing municipalities tend to spend less on care homes than those where the proportion of the elderly is smaller, even though this form of care is particularly needed in ageing communities. It means that the ageing problem might deepen horizontal inequalities between municipalities. Preventing this from happening requires effective local strategies in addition to a well-devised central policy.
    Starzenie się ludności jest wyzwaniem dla finansów publicznych. Problem ten lepiej rozpoznano na poziomie państwa niż na poziomie jednostek samorządowych. Celem badania omawianego w artykule jest ocena wpływu starzenia się mieszkańców na dochody i wydatki gmin ogółem oraz na ich najważniejsze części. Przeprowadzono analizę ekonometryczną (regresję z efektami stałymi) danych panelowych dla 2414 gmin za lata 2004-2019, które pochodziły ze sprawozdań budżetowych zbieranych przez Ministerstwo Finansów. Poprzedzono ją przeglądem literatury międzynarodowej i analizą zmian demograficznych w gminach opartą na danych z Banku Danych Lokalnych GUS. Pozytywnie zweryfikowano hipotezę, że w przypadku wzrostu udziału osób starszych w populacji budżet gminy się kurczy. Zaobserwowano również spadek dochodów i wydatków per capita. Może się to przekładać na niższą jakość usług publicznych oferowanych przez starzejącą się gminę lub ich mniejszą dostępność, co w największym stopniu dotknie osoby niesamodzielne i uboższe, które częściej niż inni korzystają z lokalnych usług publicznych. Jak wykazano w badaniu, gminy z przewagą ludzi starszych wydają mniej na domy opieki społecznej niż gminy z mniejszym odsetkiem seniorów, chociaż właśnie ta forma wsparcia jest szczególnie potrzebna w starzejących się gminach. Problem starzenia się ludności może zatem pogłębiać nierówności horyzontalne między gminami. Przeciwdziałanie temu zjawisku wymaga nie tylko odpowiedniej polityki centralnej, lecz także opracowania strategii lokalnych.

    Subject and purpose of work: The purpose of the study was to identify the areas of activity of the local authorities in the context of the implementation of public tasks that could be financed with funds from the issue of the so-called green bonds. Materials and methods: The main research method was critical analysis of documents (using document of a normative nature and of various ranks) and the literature on broadly defined public finance and financial market issues. The individual case method, as well as inductive and deductive reasoning were also supportive in achieving the purpose of the study. Results: The study presents areas related to the provision of public services and identifies those ofthem which represent negative environmental impact. The identified characteristics of public task entities included provide the premise for answering the question: will an instrument such as the ‘green bonds’ constitute a secure source of funding? The study shows the evolution of legislative changes relevant to the implementation of environmentally sustainable projects while presenting the benefits of their implementation. Conclusions: The conclusions indicate the benefits of financing investments with funds from the issue of ‘green bonds’ for the budget of the local authority, the issuer and the bondholders.

    W artykule opisano wskaźnik skonstruowany na potrzeby mierzenia przepływów finansowych pomiędzy samorządami w Polsce. Przepływy te uznano za miernik współpracy międzysamorządowej oraz siły powiązań funkcjonalnych przecinających granice administracyjne. Celem artykułu jest przedstawienie skali i przedmiotu transferów finansowych między samorządami oraz analiza czynników wpływających na ich zróżnicowanie. Największe wydatkowe transfery finansowe występują w funkcjonalnych obszarach miejskich, ale tylko w zakresie wydatków bieżących. Transfery w zakresie wydatków inwestycyjnych są większe poza tymi obszarami oraz stanowią cechę charakterystyczną gmin o niższym poziomie zamożności. Najsilniej powiązaną funkcją jest dostarczanie usług transportowych − tak w wymiarze wydatków bieżących, jak i inwestycyjnych.
    The paper describes an indicator constructed to measure financial flows between local governments in Poland. These flows are considered as the measure of local governments’ cooperation and of the strength of functional connections crossing administrative boundaries. The purpose of this paper is to present the scale and the subject of financial transfers between local governments and the factors explaining the variation of local governments’ financial cooperation. The biggest financial transfers take place in functional urban areas, but only in terms of current expenditures. Transfers of investments expenditures are higher outside these areas and are characteristic of less affluent municipalities. The strongest associate function is to provide transportation services: both in terms of current expenditures and investments.

    Przedmiotem rozważań artykułu jest analiza wielkości zadłużenia gmin i miast na prawach powiatu w powiązaniu z wielkością ich wydatków inwestycyjnych. Wyniki badań prezentowane są dla całego kraju, z podziałem na poszczególne typy gmin i miasta na prawach powiatu z uwzględnieniem zróżnicowań regionalnych (w układzie województw). Celem artykułu jest wykazanie znaczenia instrumentów rynku dłużnego w finansowaniu procesów inwestycyjnych gmin oraz miast na prawach powiatu, a także ich wpływu na bieżącą i przyszłą sytuację finansową jednostek samorządu terytorialnego. Przygotowując artykuł zastosowano metody analiz statystycznych i ekonomicznych, przeprowadzono analizę korelacji, opisano wyniki badań. Dokonano analizy statystyki GUS i Ministerstwa Finansów, wykorzystano wyniki autorskich badań ankietowych. W wielu gminach brak wystarczających środków budżetowych na realizację zadań inwestycyjnych stanowi istotną barierę rozwojową. Dla wielu samorządów szansą na przyspieszenie procesów rozwoju i realizację inwestycji infrastrukturalnych jest korzystanie z instrumentów rynku dłużnego. Na podstawie przeprowadzonych analiz można potwierdzić występującą zależność pomiędzy wielkością zadłużenia a wielkością inwestycji i wynikiem finansowym. Okres wysokich inwestycji to zapotrzebowania na zewnętrzne źródła finansowania, a więc także środki dłużne, w tym współfinansujące projekty unijne. Istotnym uwarunkowaniem zaciągania kredytów i emisji obligacji jest umiejętnie prowadzona polityka kredytowa i racjonalne zarządzenie długiem. Ma ona istotny wpływ na bieżącą i przyszłą sytuację finansową gmin.
    The subject of the article is the analysis of the size of the debt of communes and cities with poviat cities rights in relation to the size of their investment expenditures. The results of the research are presented for the whole country, divided into individual types of communes and cities with poviat rights, taking into account regional differences (in the voivodship system). The purpose of the article is to demonstrate the importance of indebted market instruments in financing investments of communes and cities with poviat rights, as well as their impact on the current and the future financial situation of local government units. While preparing the article, there were used methods of statistical and economic analysis, the corelation analysis was carried out and research results were described. The statistics of the Central Statistical Office and the Ministry of Finance were analyzed and the results of the original surveys were used. In many communes lack of sufficient budgetary resources for the implementation of investment tasks constitutes a significant development barrier. For many local governments, the opportunity to accelerate development processes and implement infrastructure investments is the use of debt market instruments. Based on the carried out analyzes, the relationship between the size of the debt and the size of the investment and the financial result can be confirmed. The period of high investment means the demand for external sources of financing, and thus also debt funds, including co-financing EU projects. An important condition for incurring and issuing bonds is a skillfully conducted credit policy and rational debt management. It has a significant impact on the current and the future financial situation of municipalities.

    The drastic increase in volume of local government debt in Hungary started in 2006. From that year to 2009 the value of municipal bonds issued increased sevenfold and exceeded USD 1 billion. My hypothesis assumes that a supposable improvement in local municipal financial management may have resulted in the spread of bond issue, which in Hungary is still considered innovative. My research, which was based on a stratified sample of 308 Hungarian municipalities, came to the conclusion that expertise of local governments’ financial executives related to loan financing (including also bond financing) is extremely low. As an interval estimation, we can conclude that practically 31–39% of all the Hungarian municipalities have no professional knowledge in this field. Based on my survey, the least right answers were given to statements relating to bond financing itself, though most respondents knew that long term borrowing’s priority is investment. The majority of local governments are unable to distinguish the economic differences between bank loans and bonds, and are unclear concerning the potential benefits, advantages, and disadvantages of bonds. No wonder that nearly all the bonds were issued privately where the buyers were solely commercial banks. In addition, 12–18% of the municipalities has prejudices and clearly has misconceptions about obtaining funds through borrowing. According to the results of principal component analysis local governments’ knowledge level can be classified and explained by three components: theoretical knowledge of local borrowing, knowledge of legal and administrative regulation, and skill in capital market financing. By summing up the results of the research it can be stated that the improvement in local financial management couldn’t have been the primary reason for municipal bond boom, but there were external factors that determined and dominated this process of booming.

    Opis:
    The goal of this article was to identify and characterize entities that participate in the process of performing public tasks. It contains their types and method of financial and/or organizational relationship with the budget of the municipal self-government. The article uses the methods of analysis and literature review as well as inductive and deductive reasoning. Institutional documents of a normative nature regarding the principles of self-government functions and literature on public (local) finances were used for the conducted research. The results show that functionally, the relationships between municipal companies and a commune budget can lead to disruptions in the assessment of the state of indebtedness of a local government entity. Following the experience of Great Britain, it can be concluded that one of the rational possibilities for carrying out projects is through a Public-Private Partnership. However, this solution can also bring financial dangers. Incorrectly dividing risks may lead to postponements of project performance or an excessive financial burden on the local government. It should also be noted that the private capital involvement formula (PPP contracts) can be used when there are economic benefits in the implementation of a specific public project, the scale of which may be of interest to the owners of capital. A significant number of public projects that are carried out by municipalities, especially in smaller (rural) entities, are in short supply and, in principle, do not give such an opportunity.
    Celem artykułu było wskazanie i scharakteryzowanie podmiotów, które uczestniczą w procesie wykonywania zadań publicznych. Zamieszczono w nim ich typy i sposób finansowego lub/i organizacyjnego powiazania z budżetem samorządu gminnego. W artykule wykorzystano metodę analizy i krytyki piśmiennictwa oraz wnioskowania indukcyjnego i dedukcyjnego. Do prowadzonych badań wykorzystano dokumenty instytucjonalne o charakterze normatywnym dotyczące zasad funkcjonowania samorządu oraz literaturę przedmiotu z zakresu finansów publicznych (lokalnych). Po dokonaniu badań dowiedziono, że funkcjonalnie spółek komunalnych i ich rozliczenia z budżetem gminy może prowadzić do zakłóceń w dokonaniu oceny stanu zadłużenia podmiotu samorządowego. Podążając za doświadczeniem Wielkiej Brytanii uznać można, że jedną z racjonalnych możliwości realizacji zadań jest zawieranie umów w ramach Parnterstwa Publiczno-Prywatnego. Jednakże i to rozwiązanie może nieść ze sobą niebezpieczeństwa finansowe. Nieprawidłowy podział ryzyk, może doprowadzić do przesunięcia wykonania zadania w czasie lub zbyt dużego obciążenia finansowego samorządu. Ponadto formuła angażowania kapitału prywatnego w ramach PPP może być zastosowana w sytuacji, gdy przy realizacji określonego zadania publicznego pojawiają się korzyści ekonomiczne, których skala może zainteresować właścicieli kapitału.
