    The basic theses of a semantic and cognitive approach to study of metaphors, developed by the author, are set forth in the article. This approach implies interpretation of metaphor as a mental and verbal construct. The principles, methods and technique of the corpus semantic and cognitive analysis of metaphors research are described, the prospects of its development are outlined.
    В статье изложены основные положения разработанного автором семантико-когнитивного подхода к изучению метафоры, при котором она рассматривается как ментально-вербальный конструкт. Описаны принципы, методы и методика корпусного семантико-когнитивного исследования метафор, намечены перспективы его развития.

    This article looks at metaphor aptness from the perspective of the class-inclusion model of metaphor comprehension and those models that assume a componential nature for the meanings of concepts. When the metaphor X is a Y is processed, the concept of X is included in a metaphorical class that is represented by Y, which is usually the most typical member of the metaphorical class. Degree of saliency of the defining feature in the vehicle and the extent to which this feature matches a relevant dimension of topic is the key factor in the degree of aptness of the metaphor. Degree of aptness becomes more complex in those metaphors that describe an abstract concept in terms of another concept. These metaphors include X into a metaphorical class through the mediation of those concepts that are associated to the abstract concept. If the associated concepts have a high degree of typicality in the metaphorical class, they could be better mediators for including the abstract concept into the metaphorical class. The variations of abstract concepts across individuals and their dependency on contexts and cultures could explain why such metaphors may have different degrees of aptness for different people.

    Według głównej tezy badań kognitywnych metafora jest podstawą myślenia. W kontekście prawa, które stanowi podstawę życia społecznego i ma wielki wpływ na każdego z nas, teza ta ma fundamentalne znaczenie. Zakres oddziaływania tej tezy określony jest w artykule poprzez charakterystykę trzech typów metafor. Są one też punktem wyjścia do sformułowania ogólnej definicji metafory, która pozwala dostrzec metaforyczność pewnych sytuacji pozornie z metaforą niemających nic wspólnego oraz związanych z nimi procesów rozumowania, które nazwane zostaną rozumowaniem metaforycznym.
    That metaphors are a part of law seems to be commonplace nowadays. Nevertheless, the extent of their influence is not commonly acknowledged. The three types of metaphors: (1) verbal, point metaphors, (2) systemic, thinking changing, model metaphors and (3) hidden systemic, conceptual metaphors are here associated with the distinction between what is said and how it is said and between a conscious and unconscious message delivery – all of them of particular relevance to a legal discourse. Not all types of metaphors can (and should) be dispensed with. In some negative cases the only way to reduce their adverse effects is to provide tools to detect them. The definition proposed may serve this purpose. As an illustration, the paper points to some ordinary situation giving rise to metaphoric reasoning which leads to quite unpredictable (misleading) conclusions.
