Each country which allows for organ transplantation developed legal regula-tions concerning the related procedure the objective of which is to both ensure the safety of the procedure and to prevent trafficking in human organs . There are however substantial differences between the solutions adopted by particular legislators .The most commonly used models include the legal construct of explicit consent (represented by Norwegian legislator) and presumed consent (adopted in Poland) . A half-way model described as a bridge between those two constructs is the gift law construct adopted in the USA .The analysis of particular legal regulations related to transplantology may have an impact on amendments to Polish legislation aiming at an increase in the number of organ transplants .

The purpose of article is to present, analyse and evaluate the effective legal regulations concerning the extent and manner of passing information about surgical implantation of cells, tissues or an organ to the recipient of the graft. The prospective recipient of the graft should possess extensive knowledge concerning the suggested medical intervention by way of implantation of cells, tissues or an organ as well as data regarding the subsequent medical procedures that follow. Therefore, information obtained by the patient ought to be as exhaustive as possible. That is to say, it must contain any data that would enable the prospective recipient to make a reasonable decision whether to agree to the intervention or not while being fully aware of what they give their consent to and what might be expected. Information should be presented in a manner that is intelligible and comprehensive for the prospective recipient of transplant, which shall be assessed individually, on the basis of current intellectual abilities of the patient.

The purpose of this opinion is to explain two legal issues relating to rules of concluding such contracts and control their execution by the National Health Fund. The author claims that the National Health Fund can shape content of contest notice and intention of obligations relationship to provide more than minimum required by the law number of employees in institution, where such health services are supplied. In the author’s view, control of the execution of contracts for performance of basic health services, carried out at night or during the holidays is allowed in any time without prior notice to the performer.

The article raises the question of the influence of the EU clinical trials of medicinal products legislation on the Polish criminal law. Although this issue does not fall within the scope of the Article 83 of the Treaty on Functioning of the European Union, its significant importance results from the expected beginning of application of the Regulation No. 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC. The impact of the EU legislation on member states’ criminal law in the field of clinical trials is based on the principle of pri- macy. Three directions of this impact can be distinguished concerning Regulation No. 536/2014. The first is the exclusion of the unlawfulness of the acts prohibited by the chapter 19 of the Polish Criminal Code within the scope of the prerequisites for the admissibility of clinical trials. The second is the de facto depenalisation of the behaviors described by in Article 126a (1) (3–5) of Pharmaceutical Act. The indicated two effects may take place ex lege with the beginning of application of Regulation No. 536/2014, if there is no change in the Polish law beforehand. The realisation of the third direction depends on the decision of the Polish legislator, who is required to introduce effective, proportionate and dissuasive penalties applicable to infringements of the Regulation No. 536/2014. The type of these measures is left to the discretion of the member states, but the current legal situation combined with the principle of assimilation prompts us to suppose that the choice of criminal penalties will be sustained.

Objectives: In Poland, 95% of medical personnel had not received legal education before they completed their studies. Having been given these facts, we have started questioning legal awareness of people providing medical services. Aim of the study: The study aimed at evaluating the knowledge of allergists and pulmonologists. Material and Methods: The group consisting of 328 allergists and/or pulmonologist completed the questionnaire. Results: The participants possess the best knowledge in providing information to patients about their health status (CV1). Sixty nine % of responders replied correctly, and the difference was significant (p < 0.001) in comparison with next aspect referring to the principles of providing medical services following guidelines created by think-tanks and also possibilities to take autonomous decisions by physicians (CV2). The correct answers in relation to CV2 were given by 57% of responders. The third compared aspect was physicians' awareness of patients' right to giving a consent or refusal before undertaking the medical procedure CV3. Only 55% of physicians gave correct answers and the difference was significant compared to CV1 (p < 0.001) as well as CV2 (p < 0.05). Younger doctors showed to have better knowledge than their older colleagues (p < 0.05). Working in urban workplaces proved to be more associated with better knowledge than in rural ones (p < 0.05). Discussion: Insufficient knowledge results in a low quality of provided services and puts the doctors at risk of being liable. The rates indicate that doctors are not aware of the fact that only legal regulations are binding, while standards not published by the Minister of Health are not legally valid. Half of the respondents have the wrong belief that the opinions expressed by experts make the doctor feel exempt from liability. Probably there are specialities, like occupational medicine which are specially linked with awareness of valid legal rules.

Opis:
Local government units try to ensure better access to health care services and assignment of municipal properties for tenancy is one of the most common ways of achieving this goal. Thanks to this activity, entrepreneurs have the possibility to start providing health care services to the local population. The author introduces the provisions of law which should be applied in order to organize and carry out such a tender. Special attention was paid to the process of constructing criteria for the evaluation of offers. The choice of business partner to render medical services in municipal properties could not be a random one. The article contains much advice on how to construct criteria for the evaluation of offers in the correct way (especially from the point of view of the tender’s goals), and reviews the most commonly committed errors by the organizers of tenderprocesses.

Introduction: As Polish society is in its majority Christian, the knowledge and attitudes presented by priests may have a tangible impact on Church mem-bers’ decisions concerning organ donation. Purpose: To evaluate the knowledge, attitudes, and decisions of priests of various Christian denomina-tions regarding organ transplants in Poland. Materials and methods: The paper presents the re-sults of a study carried out in the form of a question-naire survey of 86 priests. Survey participants in-cluded priests of 3 most common Christian denomi-nations in Poland: Catholic, Protestant and Eastern Orthodox. Results: Awareness of the current regulatory frame-work among the clergy is relatively low. Only a small percentage gave correct answers to questions about applicable laws regulating the matter of organ transplantation in Poland. Conclusions: Data gathered during the study implies a positive attitude among priests towards organ transplantation performed to save life and improve health. A vast majority of survey participants support the idea of transplantation. The problem is low awareness of existing documents and laws regulating organ transplantation.
