    Opis:
    The article presents the process of applying the Austrian matrimonial property law in Poland based on the example of the interwar notary practice in Krakow. The subject of the analysis are the marital property agreements, which, in accordance with the legal provisions of the time, were mandatory and took the form of a notary deed. Based on the content of those contracts, an attempt was made to answer the question of whether and to what extent the marital property law included in ABGB affected the shape of the matrimonial property relations of the spouses. The analysis focused in particular on the legal functioning of such notions as dowry, hope chest, bride price, dower or contract of inheritance.

    Opis:
    The article deals with the institution of dowry in the royal marriage contracts. It is based on the sources consisted of eleven preserved marital contracts of the Polish kings from 1453–1669. The dowry was designated by the formal guardian of the bride who possessed the property of which the dowry was charged. In the event of bride’s father’s death, it was done by a guardianship council or a mother with close relatives. In seven out of eleven analyzed contracts (of which six concerned wives of the Habsburg provenance) the amount of dowry was 100,000 florins. However the dowry of two Habsburgs differed from the previous amount – it amounted 45,000 florins each. Exceptionally a dowry amounted up to 200,000 florins. In the sources we did not find any data proving the effects of not keeping the provisions of the marriage agreements.
    Artykuł traktuje o instytucji posagu w królewskich kontraktach małżeńskich. Podstawę źródłową stanowi 11 zachowanych umów małżeńskich z lat 1453–1669. Posag był wyznaczany przez formalnego opiekuna panny młodej, mającego w posiadaniu dobra, z których należał się posag. W przypadku śmierci ojca czyniła to rada opiekuńcza lub matka z najbliższymi krewnymi. Wśród analizowanych umów, w siedmiu przypadkach (z których sześć dotyczyło małżonek proweniencji habsburskiej) wysokość posagu wynosiła 100 000 fl. Posag dwóch Habsburżanek, żon Zygmunta III, odbiegał od podanej wysokości i wynosił po 45 000 fl . Do wyjątków należał też posag rzędu 200 000 fl . W źródłach nie napotkaliśmy informacji o zastosowaniu restrykcji przewidzianych w umowie na wypadek niedochowania warunków umowy ślubnej.

    Opis:
    The Aramaic marriage contracts from the Jewish military colony in Elephantine, written in the course of the fifth century B.C., provide much needed information about the legal position of the wife in the first millennium B.C., especially in the Persian period. They reflect the practice of middle class families, in which the wife’s rights and the basically monogamous character of marriage, as stipulated by the contracts, parallel an old Near Eastern legal tradition, quite different from the rabbinic one, based in part on a misread, misinterpreted, and widely discussed text of Deut 24:1-4. The article examines the successive steps of marriage agreement, as presented in the contracts, which have some basic features in common and record the bridegroom’s request, his solemn marriage declaration, the payment of the bride-price, the drawing up of a written contract with a description of the dowry, and the stipulations referring to the dissolution of marriage by divorce or death of one of the parties. Their equal rights in case of divorce are not due to the Egyptian environment, but to an old Semitic tradition, going back at least to the early second millennium B.C. The monogamous principle of the marriage contracts in question is also examined and their social context is briefly characterized.
