We read on the canon 1055: a valid marriage contract cannot exist between baptised persons without its being by th at very fact a sacrament”. In the year 1563 Trident Synod announced the dogma about sacramentality o f marriage. Author of this publication analyses the documents o f Holy See details relative to question of the marriage not baptised persons and Christian person with not baptised person. The pope dissolves such valid contract on the Peters privilege - in favorem fidei. He can dissolves valid bu t only not sacramental contracts. Therefore - that marriage is not sacramental. He shows also regulations of canon law relate to make contract between catholic people and not baptised, and problems catholics - moslems marriages.

This article draws attention to two important values that are relatedto marriage. The first of them is love, which is a feature of marriage, and which is oriented on bearing and raising offspring who require responsible parenthood. The second is mercy, which is a prerequisite in marriage itself and a duty of the Church in its pastoral care of marriages facing difficulties which weaken their love and break their sacramental unity. These two values: love and mercy, considered in the context of sacramental marriage, are in a significant relation to covenant between God and human being and in relation to the covenant between Christ and the Church. Comparing these two God’s covenants with human being in the Old and New Testament with sacramental marriage leads to a clear conclusion that marriage seems as truly reflecting the covenant between Christ and the Church (cf. Ephesians 5, 21-33). In this part marriage is considered as good and sacred gift of God given to humans both for their best interests of one another and for social good. For marriage itself is a significant source of family which, in turn, is the fundamental unit of the society and nation. Since family finds its source in conjugal unity the care of Church and the state should be directed at the good of marriage and family. Such care should be displayed especially in situations in which the unity of marriage is endangered and which may lead to family breakdown.

W badaniu pilotażowym zrealizowanym w 2016 r. uczestniczyło dwunastu respondentów. Przeprowadzono wywiady pogłębione z osobami z niepełnosprawnością ruchową. Żaden z respondentów nie był nigdy wcześniej w związku małżeńskim. Dla większości z nich małżeństwo jest wartością ważną w życiu, niektórzy skłonni byliby być w związkach nieformalnych. Mając świadomość własnych ograniczeń, część z nich wskazała, że wolałaby być w związku z osobą sprawną, jednak bardzo często w wypowiedziach pobrzmiewała znacząca rola miłości w podejmowaniu decyzji o ślubie lub byciu w związku nieformalnym. Mimo że respondenci to osoby aktywne (pracujące, studiujące) i wyrażają chęć bycia w związkach, to w ich wypowiedziach pobrzmiewa poczucie samotności.

The author of the paper refers to the institution of marriage. He states in his conclusions, that concept of institution in terms of secular law cannot be implemented into Christian marriage. The term of institution in the Church is not only limited to legal aspect, but it also includes the charismatic gifts. Therefore, in the institution of marriage which exists by the God’s will and thanks to that it has the exceptional elements and attributes, we cannot get in, but we create it.

Czasy współczesne wyznaczają kolejny rozdział w życiu społeczeństw. Poszerza się zakres możliwości dotyczących sposobów organizacji życia osobistego, przynosząc różnorodność form i sposobów organizacji bliskich związków. Małżeństwo przestało być jedyną dopuszczalną formą. Jednostki mogą żyć w związku małżeńskim, kohabitacyjnym czy typu LAT (Living Apart Together), mogą być bezdzietnymi małżeństwami z wyboru, a mogą też pozostać singlami. Przedstawiany artykuł zawiera analizę wpływu zmian społecznych na znaczenie małżeństwa, rozpowszechnianie się kohabitacji i relacji, gdy para nie dzieli wspólnego mieszkania i gospodarstwa domowego (LAT).

La Commissione per la Famiglia della Conferenza dei Vescovi della Francia ha pubblicato - con la data del 29 marzo 1992 - il documento intitolato "I divorziati e di nuovo sposati nella comunità cristiana".Dopo aver indicato la genesi, le premesse e la struttura della enunciazione l’autore presenta il contenuto di quel documento, cioè: la situazione degli anni ottanta sul campo familiare, il sacramento del matrimonio come segno di amore, il ruolo della coscienza e il bisogno della conversione, lo stato giuridico dei divorziati e civilmente risposati, i compiti pastorali.Si sottolinea l’importanza del documento francese per lo sviluppo della pastorale della famiglia nella Chiesa dopo il Concilio Vaticano II.

The purpose of this publication is to present the dogmatic teaching of matrimony basing on the selected statements of the Magisterium of the Church, like: the Waldensian Confession of Faith of 1208 framed by the Pope Innocent III, the Doctrine on the Sacrament of Matrimony formulated by the Council of Trent in 1563, the Encyclical Arcanum divinae spientiae of Leo XIII (1880) and the Apostolic Exhortation of John Paul II Familiaris consortio (1981). Everything that relates to the sacramentality and indissolubility of marriage has been chosen from the foregoing documents. The statements of the Church’s Magisterium indicate that the principles of the sacramentality and indissolubility of marriage are to be found in the Letter to Ephesians 5:21-33. The dogmatic teaching of matrimony can be built basing on this fragment of the Letter to Ephesians, where the Christological title of the Bridegroom has a crucial meaning. This title merges the sacrament of marriage with the Christ’s work of Redemption, which revives the work of Creation.

Opis:
Migrationen innerhalb der Europäischen Union führen dazu, dass das Phänomen der Migration in sich immer mehr einen permanenter Charakter annimmt und eine strukturelle Dimension bekommt. Deshalb gibt es eine Dringlichkeit zur Ausarbeitung einer Refleksion über die gegenwärtigen Formen der Evangelisation der polnsichen Diaspora in den Staaten der EU. Interne (innerhalb der EU) Migrationen von Polen sind auf die europäische Bürgerschaft und der Dynamik des Arbeitsmarktes ausgerichtet. Diese Migrationen werden als wichtige Komponenten der gesellschaftlichen, politischen, ökonomischen und demographischen Wirklichkeit der EU wahrgenommen. Als solche bringen sie neue Pastoralaufgaben für die Kirche der Herkunftsgemeinde (a quo) und auch für die Kirche der Ankunftsgemeinde (ad quem), da wo der Migrant wohnt oder nur sich temporär aufhält. Sie bringen auch neue Aufgabefelder für die Strukturen der polnischsprechenden Seelsorge in EU Staaten. Diese neue Herausforderungen erzwingen eine adequate Zusammenarbeit zwischen den obengenannten Krichen, in der eine besondere Rolle der polnsichesprechenden Seelsorge zugeteilt wird. Wenn man die Aufgaben der Kirche in Polen und der lokalen Kirchen in den EU Staaten die polnische Migranten aufnehmen systematisiert sowie die Rolle der polnischsprechenden Zentren der Seelsorge für die frischgekommenen polnischen Migranten betrachtet, eine besondere Zuwendung und Reflexion gehört dem Apostolat für ihre Ehe und Familien. Emigration zeichnet sich dadurch aus, dass diejenigen die sich dafür entschieden haben zusammen mit ihren Familien sich in einer Zwischensituation befinden: von ihrem Herkunftsland und dem Ankunftsland in dem sie Dauerhaft oder nur zietlich begrenzt wohnen, zwischen Vegangenheit und Zukunft, zwischen der Heimatgemeinde und der Gemeinschaft des Wohnortes, zwischen der Heimatkultur mit der Muttersprache und der Kultur der Umwelt, die die Ankömmilinge aufnimmt. Diese ersten Wirklichkeiten gibt es nicht mehr und die Zweiten sind sehr ungewiss. So eine Situation muss zweifellos die Ehe und die Familie des Migranten beeinflussen, unabhängig davon in welcher Dimension sie von Migration, Trennung oder Entfremdung betroffen sind. Die seelsorgeriche Betreung für eine Familie die von der Migration betroffen ist konzentriert sich auf die religiöse Berufung der Familie, die als „Hauskirche” ihre adäquate Funktionen erfüllen soll. In der Sorge um die Einheit der Ehe und die Integrität der Migrantenfamilie Seelsoger sowohl a quo und ad quem sollen durch die adäquaten Strukturen der Seelsorge die grundsätze des Eheund Familienleben erinnern sowie diejenigen Maßnahmen unternehmen, um die Gemeinschaft der Familie zu sichern, so dass die Migration in ihrer Komplexität sowohl für die Migranten als auch für ihre Ehen und  amilien immer mehr als eine Chance der Realisierung der individuellen christlichen Berufung wird und der migrant selbst in seiner Ehe und mit seiner Familie schließlig als den Weg der Kirche wahrgenommen wird.
