Opis:
A study of conditions and directions of spatial development of the commune, in accordance with Article 9 § 5 of the Act of 27 March 2003 on spatial planning and development is not an act of local law. The legislator only in a negative way determines what is not a study, but it does not define in a positive way what is the legal nature of this planning act. The article is an attempt to answer the question whether the study of conditions and directions of spatial development is only an act of internal management or is a legal act of a different nature. After analyzing the nature of the study, the article puts forward a thesis that the argument is that if the study is not an act of local law, it does not produce any legal consequences for external entities.
Studium uwarunkowań i kierunków zagospodarowania przestrzennego gminy, zgodnie z art. 9 ust. 5 ustawy z dnia 27 marca 2003 r. o planowaniu i zagospodarowaniu przestrzennym, nie jest aktem prawa miejscowego. Ustawodawca jedynie w sposób negatywny określa, czym nie jest studium, nie definiuje jednak w sposób pozytywny, jaki charakter prawny ma ten akt planistyczny. Artykuł jest próbą odpowiedzi na pytanie, czy studium uwarunkowań i kierunków zagospodarowania przestrzennego jest jedynie aktem kierownictwa wewnętrznego czy też jest aktem prawnym o innym charakterze. Po analizie charakteru studium w opracowaniu postawiono tezę, iż dyskusyjne jest stanowisko, że skoro studium nie jest aktem prawa miejscowego, to nie wywołuje żadnych skutków prawnych wobec podmiotów zewnętrznych.

Opis:
The article presents the essential features of strategic-marketing management as a basis for the effective and efficient control of the processes of local (gmina) government development, and in consequence the best way of satisfying the collective needs of inhabitants. The author indicates the role of local government in the regulation, creation and stimulation of local development and moreover the need for a complex approach to local development problems. The evolution of the approachto local development management in Polish local (gmina) authority areas is also presented. Against this background the paper presents the essence, concepts, elementary features and successive stages of the management of strategic-marketing development in local authority areas. Outcomes of the analysis show that achieving success in activities for local government development depends significantly on the efficient and effective use of management methods. One of these methods, according to the author, is the strategic-marketing method. As a result of this approach the synergy effect should be generated, that is an effect of value added beyond the simple sum of results obtained as a consequence of complementary management methods. This approach shows that priorities, goals and implementation tasks are determined comprehensively, honestly and are compatible with a realistic possibility of execution and financing. In consequence the effectiveness of implementation activities is an enhanced, which translates into a higher level of satisfaction of the collective needs of the inhabitants, increase in the attractiveness of the location, an improvement of its image and increasing competitiveness of the urban communes in the surrounding area.
W artykule przedstawiono istotę strategicznego zarządzania ze szczególnym uwzględnieniem działań marketingowych jako podstawy do skutecznego i efektywnego sterowania procesami rozwoju gminy, a w konsekwencji jak najlepszego zaspokajania zbiorowych potrzeb mieszkańców. Wskazano na rolę władz gminy w regulowaniu, kreowaniu i stymulowaniu rozwoju lokalnego, a także na konieczność kompleksowego podejścia do problemów rozwoju lokalnego. Przedstawiono także ewolucję metod zarządzania rozwojem lokalnym stosowanych przez władze polskich gmin. Na tym tle przedstawiono istotę, pojęcie, podstawowe cechy i etapy działań strategiczno-marketingowych na rzecz rozwoju gminy. Z przeprowadzonej analizy wynika, że odniesienie sukcesu w działaniach na rzecz rozwoju gminy w dużym stopniu zależy od umiejętności posługiwania się skutecznymi i efektywnymi metodami zarządzania. Taką – zdaniem autora – jest metoda strategiczno-marketingowa. W wyniku takiego podejścia powinien powstać efekt synergii, czyli efekt w postaci wartości dodanej ponad prostą sumę osiągniętych rezultatów, uzyskany w wyniku komplementarności obu metod zarządzania. Przy takim podejściu priorytety, cele i zadania do realizacji są określone w sposób kompleksowy, rzetelny oraz zgodny z realnymi możliwościami wykonawczymi, zwłaszcza finansowymi. W konsekwencji zwiększa się skuteczność działań realizacyjnych, co przekłada się na wyższy poziom zaspokojenia zbiorowych potrzeb mieszkańców, wzrost atrakcyjności lokalizacyjnej, poprawę wizerunku i wzrost konkurencyjności gminy w otoczeniu.

Management in accordance with the principle of sustainable development is one of the basic aspects of environmental protection, and is nevertheless important in macroeconomic management (eco-innovations in national regulations) as well as in micro-regulations (municipal regulations). The municipalities authorities are obliged to preventing the negative effects of environmental degradation, preventing pollution, providing information on the state of the environment, cover the environmental policy, in order to ensure the land advancement in accordance with the principles of sustainable development. The implemented projects should mainly improve the living conditions of the inhabitants. That is why eco-innovative activities introduced in individual, small territorial areas (municipalities) are becoming more and more important. The paper is based on a case study as a recognized method of analyzing and discussing authentic situations used in management sciences.

Nowadays, in conditions of globalisation, and simultaneously with tendencies to decentralise management at the level of states and regions, individual territorial units (cities, municipalities, regions) are forced to adopt a more proactive, market-oriented approach to development. This process requires constant analysis of the environment and response to emerging changes; consideration of the offers of the competition and customer’s expectations. The purpose of this article is to show a market approach to managing the development of territorial units as a function of entrepreneurship. In particular, to show the relationship between the market orientation of local governments and entrepreneurship. This is understood, on the one hand, as a process of identifying and using opportunities and on the other, as a process of creating new enterprises, where special attention is paid to the emerging idea of territorial units as entrepreneurs. The latter concept appears increasingly frequently in the literature and colloquial language. Market orientation is an expression of the entrepreneurship of local government. Its impact on entrepreneurship on a given territorial unit is a new and important research area that requires exploration. The paper is based on the theoretical discussion using selected literature on the subject.

Celem rozważań jest próba wyjaśnienia wpływu konkurencyjności na funkcjonowanie jednostek samorządu terytorialnego oraz wskazanie ważności tej orientacji dla efektywnego zarządzania tymi jednostkami. Wyjaśniono także takie pojęcia jak: konkurowanie, konkurencyjność, przewaga konkurencyjna, potencjał konkurencyjny oraz instrumenty konkurowania. Określono również wyznaczniki orientacji rynkowej zarządzania jednostek samorządu terytorialnego (jst). W końcowej części artykułu poddano ocenie jakość świadczenia usług publicznych przez jednostki samorządu terytorialnego. Artykuł należy zaliczyć do kategorii „przegląd literatury”.
An aim of considerations is an attempt to explain the impact of competitiveness on functioning of local self-governments as well as to indicate the importance of this orientation for an effective management of those entities. There are also explained such notions as competing, competitiveness, competitive advantage, competitive potential, and instruments of competing. The author also defined the determinants of market orientation of local self-government management. In the final part of the article, the author assessed the quality of public services rendered by local self-governments. The article belongs to the literature review category.
Цель рассуждений – попытка выяснисть влияние конкурентоспособности на функционирование единиц местного самоуправления и указать важность этой ориентировки для эффективного управления этими единицами. Выяснили также такие понятия как конкурирование, конкурентоспособность, конкурентное преимущество, конкуренционный потенциал и инструменты конкурирования. Определили также детерминанты рыночной ориентации управления единиц местного самоуправления. В последней части статьи про- вели оценку качества оказания публичных услуг единицами местного самоуправления. Статью следует отнести к категории «обзор литературы».

Artykuł stanowi porównanie dwóch najbardziej popularnych w Polsce metod samooceny systemu zarządzania jakością stosowanych przez jednostki samorządu terytorialnego ("Wspólnej Metody Oceny CAF 2006" − model CAF i "Planowania Rozwoju Instytucjonalnego"− metoda PRI). Wprowadzenie do artykułu poświęcone jest genezie zjawiska doskonalenia jakości zarządzania w administracji oraz historii rozwoju obu omawianych metod. W dalszej części dokonana została analiza porównawcza obu omawianych metod z uwzględnieniem takich kryteriów, jak: konstrukcja procesu samooceny, struktura kryteriów samooceny, koszty wdrożenia metody, w tym czas niezbędny do przeprowadzenia samooceny, oddziaływania na organizację, czynniki wpływające na możliwość wdrożenia wybranej metody w jednostkach samorządu terytorialnego. Podsumowanie artykułu stanowi konkluzja nt. możliwości wykorzystania metod przez jednostki samorządu terytorialnego. Część ta zawiera informacje mające na celu ułatwienie przedstawicielom JST dokonania świadomego wyboru metody wdrożenia. Informacje te zostały przedstawione w sposób syntetyczny. Obie metody są porównane pod kątem czynników je różniących: społecznych, ekonomicznych, organizacyjnych i technicznych.
The paper is a comparison of the two most popular methods of self-esteem in Poland the quality management system used by local government units ("Common Assessment Framework CAF 2006" − CAF model, "Institutional Development Planning" − a method PRI). The introduction to the article is devoted to the origins of the phenomenon of improving the quality of administration and management in the history of both these methods. Later in this article was made comparative analysis of both these methods against criteria such as: self-construction process, the structure of the criteria for self-assessment, the costs of implementing this method in the time required to carry out self-assessment, the impact on the organization, factors affecting the possibility of implementing the chosen method of JST. Article Summary of conclusion about the possibility of using the methods by local government units. This section contains information to facilitate informed choices representatives of local government units to implement the method. This information is presented in a synthetic manner. Both methods were compared in this section in terms of social, economic, organizational and technical two different methods.

Opis:
Environmental protection was placed by the legislator as one of the public tasks performed by local government. Due to the fact that the local government performs decentralized tasks, which are mainly intended to meet the needs of local communities in a given territory, tasks related to the field of environmental protection also serve the needs of residents of communes, poviats and voivodships in terms of the use of the environment. Therefore, the type and nature of these tasks will be adapted to the role and specialization of individual local government units. Local government units perform tasks stipulated in the existing legislation. They are also obliged to use instruments related to planning and strategic documents that take account of statutory environmental protection assumptions. In order to achieve higher effectiveness in the scope of environmental protection, local government units may take actions that facilitate the use of techniques and methods for environmental management and use quality management tools.

Public administration (including local government administration), acts to implement the mission assigned to it by law. This mission – mainly related social life organizing and protecting of the general interest – requires an effective decision-making process. W artykule przedstawiono wyniki badań dotyczące oceny przebiegu procesu zarządzania ryzykiem w administracji samorządowej w kontekście zarządzania kryzysowego. Wskazano poziom poszczególnych rodzajów zagrożeń, w tym: naturalnych, technicznych i społecznych. Następnie dokonano analizy stanu obecnego procesu zarządzania ryzykiem w wybranych jednostkach administracji samorządowej na szczeblu województwa, powiatu i gminy oraz wskazano kierunki udoskonaleń w tym zakresie. Kluczowym elementem pracy było określenie związku pomiędzy występowaniem zagrożeń, zarządzania ryzykiem, a kształtowaniem się ogólnego poziomu bezpieczeństwa publicznego. W artykule wykorzystano między innymi wyniki badań ankietowych.
In the article the results of research of the assessment of the risk management process at the local government in terms of crisis management were presented. As well the level of the different kind of threats: natural, technical and social was indicated. Then the current condition of the risk management process was analysed in the chosen local goverment units (voivodeships, districts and communes) and the improvement directions in this field was indicated. The main element of this work was definition relationships between threats, risk management and formation the overall level of the public security. In article the survey research results were used.

Artykuł koncentruje się na zagadnieniach związanych z wpływem jakości zarządzania w administracji samorządowej na poziomie gminnym na wykorzystanie funduszy unijnych wspierających rozwój lokalny. Polska, która od kilku lat jest członkiem Unii Europejskiej, ma możliwość korzystania z funduszy przeznaczonych na rozwój regionalny i wzmacnianie spójności na terenie Wspólnoty. Jedną z głównych grup beneficjentów, do których w obecnej perspektywie lat 2007–2013 należy większość środków, są samorządy terytorialne. Celem artykułu jest przedstawienie zależności między stosowaniem narzędzi wpisujących się w nurt New Public Management w administracji samorządowej a sprawnością w korzystaniu z funduszy unijnych przeznaczonych na rozwój lokalny/regionalny. Wpływ narzędzi rozpatrywany jest w trzech obszarach: ilości pozyskanych środków, sprawnej realizacji projektu (rzeczowej i finansowej) oraz jakości projektów.
The paper focuses on issues related to the impact of quality management in local government at the municipal level on the use of EU funds supporting local development. Poland is one of the greatest beneficiaries of structural funds provided for regional development and strengthening cohesion within the Community. Local governments are one of the groups which absorbed most of the funds for 2007–2013. The paper describes how and to what extent the implementation of New Public Management tools in local government administration can guarantee efficient use of EU funds. Three areas of such impact are taken into consideration – the amount of acquired funds, efficient implementation of the projects co-financed by the EU, and the quality of these projects.

The article herein discusses selected issues of the effectiveness of public governance model at the Province level of self-governance in regard to providing support services to persons with disabilities. Described herein are tasks for carrying out the policy of social inclusion of persons with disabilities that are the responsibility of the Province self-governance. Also described is the method for carrying out the said tasks and the most frequently used model of public governance. Discussed also are the critical challenges and flaws of the said model of public governance. Presented also are some suggestions for changes in regard to the discussed areas. The aim of the article is to analyze province social policy toward people with disabilities. The article also attempts to evaluate the methods used to implement it. The article is based on the analysis of legal acts regarding the social inclusion policy of persons with disabilities at the level of the province, with particular emphasis on the content of province programs on equal opportunities for people with disabilities and counteracting social exclusion and assistance in the implementation of tasks for the employment of disabled people. When writing an article, the dogmatic method was used in the analytical approach. The article proposes a thesis that the collaborative governance model used to implement the social inclusion policy of disabled people at the province level does not ensure sufficient control over the efficiency of using public funds, and thus does not guarantee the effective implementation of public tasks by non-public entities.

Ocena funkcjonowania i rozwoju samorządu terytorialnego stanowi jeden z najtrudniejszych aspektów w ekonomicznej interpretacji jego działalności. Działalność związana z dokonywaniem różnych ocen gospodarki i życia publicznego w samorządzie jest kluczowym ogniwem procesu zarządzania publicznego (rządzenia). Wiedza na ten temat jest jeszcze niewielka i ma charakter cząstkowy. Celem rozważań w artykule jest zbiór ocen, traktowanych jak system dotyczący funkcjonowania samorządu. Autorzy przyjmują następującą tezę badawczą: zbiór ocen działalności samorządu jest bardziej luźnym układem niż spójnym systemem zarządzania. Rola ocen samorządowych wynika z pełnienia wielu funkcji dla potrzeb procesów decyzyjnych (dostarczenie informacji, podstawa wyboru celów, ocena sposobów funkcjonowania władz). Każda działalność potrzebuje miar (ocen), które pozwalają określić stan i osiągnięcia podmiotów zarządzania publicznego w skali lokalnej. Problematyka dokonywania ocen funkcjonowania i rozwoju samorządu jest wieloaspektowa oraz wielopoziomowa. Oceny dotyczą ich charakteru, rodzaju, warunków, elementów struktur samorządowych, standardów. Stąd też wspólnym mianownikiem analizy jest poszukiwanie adekwatnych kryteriów oceny oraz ich koordynacja w polityce i w zarządzaniu publicznym w Polsce.
The assessment of the functioning and development of local government is one of the most difficult aspects in the economic interpretation of its activities. The activity associated with making various assessments of the economy and public life in local government is a key element of the public management process (governance). Knowledge about this subject is still small and has a partial character. The aim of the considerations in the article is a set of assessments treated as a system concerning the functioning of self-government. The authors accept the following research thesis: the set of self-government assessments is a looser arrangement than a coherent management system. The role of local government assessments results from the fulfillment of many functions for the needs of decision-making processes (providing information, the basis for the selection of objectives, evaluation of the ways in which the authorities operate). Every activity needs measures (assessments) that allow defining the status and achievements of public management entities on a local scale. The issues of assessing the functioning and development of local government are multi-faceted and multi-level. The assessments concern their nature, type, conditions, elements of local government structures, standards. Therefore, the common denominator of the analysis is the search for adequate assessment criteria and their coordination in politics and public management in Poland.

Niezależnie od czasów, w jakich żyjemy, obyczajów, systemu władzy, pewne wzory związane z kontrolowaniem wydatkowania środków publicznych są przekazywane kolejnym pokoleniom. Gmina jest podstawowym organem jednostki samorządu terytorialnego i zobowiązana została do realizacji zadań własnych i zleconych o charakterze obligatoryjnym i fakultatywnym. W obecnych czasach gospodarka finansowa gmin jest zaskakiwana nagłymi i często kontrowersyjnymi zmianami przepisów prawa, co znacznie utrudnia zaspokajanie potrzeb społecznych. Ciągłe uświadamianie społeczeństwu przerostów zatrudnienia w administracji prowadzi do praktycznych problemów wykonywania wszystkich wprowadzanych zmian przez ustawodawcę w zakresie planowania i sprawozdawczości budżetowej. Niejedna gmina wiejska byłaby zainteresowana wprowadzeniem układu zadaniowego w budżecie, jednak ze względu na brak kadry odpowiedzialnej za tego typu analizy jest zmuszona rezygnować z nowoczesnej metody zarządzania. Artykuł prezentuje nowatorskie rozwiązanie wykorzystania funkcjonującej już ewidencji księgowej kosztów w gminach wiejskich, które jest alternatywą budżetu zadaniowego i nie wymaga zwiększenia nakładów na zatrudnienie kolejnych pracowników. Temat jest istotny, ponieważ gminy borykające się z problemami finansowymi związanymi z wprowadzaniem nowych reguł ograniczających ich deficyt powinny w budżecie wykazywać wszystkie realizowane zadania, wskazując, na co przeznaczają środki. Proponowana metoda pozwala zestawić rzeczywiste i pełne koszty realizacji zadań oraz kontrolować przyjętą wartość planu, a także nie dopuszcza do przekroczenia planu wydatków w ramach poszczególnych paragrafów klasyfikacji budżetowej.
Regardless of times we live in, customs or a governmental system, certain patterns related to control over public spending are passed on to next generations. Commune council is the basic local government unit, which is obliged to perform its own and ordered tasks of both obligatory and non-obligatory nature. Nowadays, the financial activity of communes is influenced by sudden and often controversial changes in law, which makes it particularly difficult to satisfy social needs. Constant attempts to make the society aware of overemployment within administrative bodies cause problems related to practical implementation of all changes introduced by legislative bodies in the area of budget planning and reporting. Many rural communes would be interested in introduction of a performance-based budgeting, yet, due to lack of personnel responsible for this kind of analyses, they are not able to implement this modern management method. This article discusses an innovative solution based on use of the already functioning cost keeping method in rural communes, which constitutes an alternative to performance-based budgeting and does not require increase of expenses related to employment of additional staff. The issue is very important, since communes dealing with financial problems related to introduction of new financial regulations limiting their deficit should declare all perofrmed tasks and expenses. The proposed method enables preparation of statements on actual and full costs related to task performance and control over the accepted value of the plan. It also prevents from exceeding the expenditure plan within each budget classification section.
