Opis:
A representative of the legislative initiative committee of citizens shall have the right to make amendments to a bill prepared and filed by this committee. This interpretation of Article 14 paragraph 2 of the Act, in conjunction with Article 36 paragraph 4 of the Standing Orders of the Sejm of the Republic of Poland, implements – to the fullest –the applicant’s right to introduce amendments to a bill under Article 119 Paragraph 2 of the Constitution. That right is, however, limited by a statutory requirement to represent the committee, and therefore amendments going beyond the scope of authorization, which may have the form of a „general power of attorney” or specific suggestions, guidelines or prohibitions, must be regarded as invalid.

The opinion deals, in particular, with the relationship between the requirement (ensuing from Article 25 para. 5 of the Constitution) for a church or religious organization to conclude an agreement with the Council of Ministers, and the admissibility of such an initiative. The literal and systematic interpretations of the Basic Law prove that the Council of Ministers is not vested with an exclusive legislative initiative in this regard, so it is therefore permissible to submit a bill by a group of deputies. The author concludes that the admissibility of a legislative initiative in this regard is not dependent on the fact of signing the agreement, but only on the real possibility of its conclusion confirmed by the government and representatives of the religious community. Otherwise, such a bill should be considered to be contrary to the law. The author proposes that the procedure for dealing with laws on religious issues be regulated in the Standing Orders of the Sejm.

Opis:
The article is an attempted analysis of the political discourse concerning citizens’ legislative initiatives. It allows one to see what happens at the interface between the legislative and groups of citizens, which in rare and exceptional circumstances present their "grass-roots" legislative proposals. This interdisciplinary work combines political science and a qualitative sociological approach. The specific method used was Martin Reisgl’s political rhetoric analysis. Transcripts of parliamentary debate on the three selected citizens’ legislative proposals served as research material. The analysis showed an overall specificity of debates on citizens’ projects, but also confirmed the importance of the context in discourse studies. Discussion about each of the three – unique – citizens’ projects was shaped differently.

Opis:
The Marshal of the Sejm is not allowed to verify, whether an explanatory statement to a bill submitted by a group of citizens meets requirements specified in Articles 34 paras. 2 and 3 of the Standing Orders of the Sejm of the Republic of Poland. Besides, demanding enclosure – to the notification of the establishment of the Committee – of statements on accession to the legislative initiative committee and of a statement on selection of committee’s agent, is not based on rules of the Act of 24th June 1999 on Exercise of the Legislative Initiative by Citizens. Therefore the current practice of demanding the enclosure of the above documents cannot be continued in future.

This opinion indicates that Polish citizens deprived of freedom and staying in prisons or remand centers, who have the right to vote in elections to the Sejm and are entitled to fully enjoy civil and political rights, therefore have a full right to participate in the submission of a bill initiated by citizens, as referred to in Article 118 para. 2 of the Constitution. In particular, they may establish a legislative initiative committee, and act as an agent of such a committee or his/her deputy. The exercise of this right cannot, however, lead to evade disadvantages related to the actual situation of the convicted person or a person suspected of committing a crime.

Political parties are the key element of the representative formula of democratic system. The aim of the paper is to show parties’ attitudes towards the citizen legislative initiative, being an institution of direct democracy. The analysis was carried out with the inclusion of the following three levels of party activity: conceptional, programme-related and functional. Both on the conceptional and programme-related levels there is a lack of reflexion and – in consequence – hardly any debate held on the essence of the institution of citizen legislative initiative, its significance and consequences with regard to the socio-political system. This results in an almost mechanical acceptance of concrete legal solutions, which – at the next stage, i.e., that of realization of these records – ends in an escape from the problem (here: prolonging works of Parliament or an instrumental making use of citizens’ activity).Both ruling parties and those in the Opposition – despite obvious differences in the approach towards institutions of direct democracy – are joined by an axiologically justified dislike of strengthening these forms of citizens’ engagement, which diminish the area of representative democracy.

The opinion points out that the rules and procedures of Sejm’s international cooperation, especially contacts within the European Union, must be regulated by the Standing Orders of the Sejm. Currently, both EU law and national law allow the Sejm to cooperate with the European Parliament on impact assessment of European Union legislation, involving the transfer to the European Parliament of the possessed materials relating to the exercise of EU law. It is advisable to regulate the cooperation on the basis of Article 9 of the Protocol (No. 1) and – prior to the adoption of the said regulation – the cooperation should be based on the structure of COSAC.

Opis:
The reform of the  entered into force at the beginning of 2020. The changes are intended to popularize and to give effect to the ECI, especially through the strengthening of the position of this tool as an instrument of e-democracy and the reinforcing of the principle of subsidiarity and the model of multi-level governance. The reform is a step in the right direction, however, it is rather unlikely that it could boost the ECI as an instrument of indirect legislative initiative, which so far has had little impact. The sheer scale of this issue can be illustrated by the juxtaposition of the over seventy registered ECIs with the merely two initiatives in which the EC decided to follow up with legislative proposals. Such a situation results from the fact that the ECI is treated as a subsidiary tool to the instruments of representative democracy, generally accepted as the basis of the system. This is also the effect of the way the quasi-monopoly of the European Commission in the area of legislative initiative is interpreted. In consequence, the effectiveness of the ECI is currently perceived through the prism of collecting over one million signatures and conducting noncommittal dialogue. Nevertheless, in this context it should be remembered that the most effective form of encouraging the civil society to participate in political activity is to reinforce its agency. Indeed, increasing the impact of the ECI on decision-making processes is not dependent on potential changes in primary or secondary law. The change of attitude will suffice. Indeed, an increased number of legislative proposals stemming from the ECIs might be the result of a change in EU political culture and a greater respect for democratic rules.

Opis:
Local democracy is considered one of the most important parts of the democratic system. It enables the articulation of civic needs and preferences. Creating grounds for active participation in creating local law for residents of local government units is one of the basic instruments for building a civil society. The aim of the article is to analyze legal provisions guaranteeing the inclusion of citizens in the creation of local law acts. The right to establish local law is expressed in social participation and is based on an appropriate system of values. The law-making activity of local self-government regulates the functioning of local self-government communities and creates the legal framework for its operation. The concept of local law and social participation institutions such as public consultation and legislative initiative are discussed in the paper.
