Nowadays there are six groups in Austria, which are officially known as national minorities. According to the figures from the 2001 national census, 17 241 persons have declared they were speaking Croatian in everyday life, 14 746 Slovenian, 15 390 Hungarian, 5 778 Czech, 1 775 Slovak and 1 732 Roma language. The widest rights possess Slovenian, Croatian and Hungarian minorities. In the administrative and judicial districts of Carinthia, Burgenland and Styria, the Slovene, Croat and Hungarian language are accepted as an official language in addition to German. In suchdistricts topographical terminology and inscriptions shall be in this languages as well as in German. This groups get also the biggest financial help from the government. The Roma, Czech and Slovak minorities have worse situation than others. The constitution, the acts (mainly from 1976 year) and many ordinances regulate problems of minorities. They guarantee the rights in different sphere of live (like education, culture, language rights). But on the other hand the group of people which speaks minority language has been decreased. In Austria Polish people are not accepted as the minority. There is still no official ordinance about that.

The subject matter of this article is the institution of the Speaker in the British parliamentary system. All the remarks, set out in the article, focus on four major themes: 1) genesis of the office, 2) mechanism for election and the duration of the term of office, 3) impartiality and, 4) scope of the powers produced by legislation or created in parliamentary practice. As can be seen then, the concept of the article enables the contemporary institution of the Speaker to be portrayed including the historical background. It also enables the author to prove his main thesis, indicating that all the changes concerning this institution, which have been made over last couple of years, resulted neither in enhancing nor in weakening the parliamentary role of the Speaker as a neutral arbitrator between political parties in the UK parliament.

The purpose of this article was to answer the question whether and how the legal status, and in particular its increase, influences the economic and professional adaptation of immigrants with different ethnic backgrounds. The analysis was of a qualitative nature and was based on in-depth interviews with Ukrainian and Vietnamese immigrants having different legal statuses. Contrary to the assumed hypothesis, it turned out that the increase of the legal status of the studied immigrants from Ukraine and Vietnam, meaning that they achieve more secure legal status – giving them wider scope of rights and a growing sense of security and stability – rarely contributed to a significant improvement of their economic and professional position. Meanwhile, there could be observed differences between these two groups in terms of patterns of adaptation in the Polish economy, which were influenced by the legal framework, but also by other important factors, such as, in particular, the availability of income-bringing activities and social networks.

In 1991 the regenerating country of Latvia had to face the consequences of Soviet occupation, including the "colonization" of Latvian grounds by the influx of hundreds of thousands Russians supplying the industrial plants, offices and politics of Latvian SSR. The way that Russians and Latvians have been through if it comes to the relations between them was not straight, if we take the accompanying internal conditions and international context into account. Surely it also has not been finished and still requires the will of dialogue from both sides. Giving the opportunity of gaining the citizenship by naturalization, supporting everybody who was interested in getting civic rights and aiming at social integration Latvia has answered positively the question about the future of Russian inhabitants of the republic and challenges that appeared after years of occupation.

The Arctic is a place which generates widespread interest on the international stage. This region, which was seemingly forgotten after the end of the Cold War, has again become a place of great rivalry. The reason for this is primarily the shrinking of the Arctic ice cap, which has opened up the possibility of exploiting the region’s rich natural resources and using new, attractive, maritime routes.The problem which arises in connection with these possibilities is the lack of a specific legal status for this area. Arctic countries, in this case meaning the big five of the Arctic, which are the states which have direct access to the Arctic Sea: Denmark (via Greenland), Canada, Norway, Russia and the United States, have submitted their own proposals for the regulation of the legal regime around the North Pole. The most important issues are considered to be: the concept of sectors, the common heritage of humanity and the rule of law subjecting the Arctic sea. These three issues arise from different periods and though many of their elements are varied, they also have convergent points. It is likely that the status of this strategic area will be based on one of them.

This article aims to analyse the legal status of regional cooperation among the South Pacific countries and territories, as not every entity in the Pacific Basin possesses International law features of a state. Regionalisation, as well as regionalism, as illustrated by the example of the South Pacific region, is a new topic to examine, especially in the Polish and European literature. Therefore, this topic does need further and deeper analysis. First of all, both regionalism and regionalisation are international phenomena that were set against the process of globalisation only in the last two decades of the 20th century. Secondly, the Pacific Ocean became more dominant in geopolitics than the Atlantic Community at the beginning of 21st century. There are many publications regarding local cooperation mechanisms worldwide. Most of them, though, concern political and/or economic integration, and neglect the legal aspects of regional integration. The outcome of this article is nonetheless to present the contemporary legal statusof the South Pacific cooperation, though it is at the stage of regionalisation, while not yet regionalism – fully formalised and structuralised just as it is on the other continents.

The concept of real estate legal status has not been explicitly defined by the legislator. Despite this, the literature took the view that this is generally the rights and restrictions assigned to the property. To determine legal status one should determine first the entities which has rights to the property. For the purpose of determining the legal status of real estate, mortgage registers are established in Poland. Unfortunately, at this moment, a large part of the properties, particularly in rural locations do not have established mortgage registers. In the absence of mortgage registers other documents showing ownership of the property may be land ownership acts. For agricultural properties, they are sometimes the only documents on the basis of which one can specify the entities to which it has rights in rem to real estate, they are also the basis for founding the mortgage register. In recent years the number of new mortgage registers increased significantly in real estate of rural areas. The basis for establishing the mortgage register in addition to the documents confirming the acquisition of rights is also data shown in the Land and Property Register, which are the basis for determination of the property. Due to the fact that the legal status of the property disclosed in the Land and Property Register report do not always reflect the legal situation, the necessity of regulation of the state is increasing for the purpose of founding the mortgage register. This need led the authors to a thorough analysis of the characteristics of the land ownership acts as a document confirming the legal status of real estate with a focus on surveying procedures performed during op erations aimed at demonstrating the correct legal status of the property at the Land and Property Register report. This analysis allowed the authors to identify gaps in the law, which main aim is to regulate legal title.

The new Water Law Act, which entered into force on 1 January 2018, has introduced numerous changes regarding the management of land covered by water. One of the most important changes concerns the procedure for determining the course of the shoreline. According to the previous act, the shoreline was determined ex officio during the modernisation of the land register survey. After the change in the legal regulations, it is no longer obligatory. The natural change in the course of the shoreline results in a change in the extent of ownership rights and the need to define the legal status of the land adjacent to the water, as flowing waters and the land beneath in Poland belong exclusively to the State Treasury. The problem of the undetermined legal status of private land occupied by water is significant because the land covered with flowing water is not subject to civil turnover. Without performing a demarcation procedure between the land occupied by a watercourse and the adjacent land, the owner cannot sell the property. The lack of the obligation to determine the course of the shoreline during the modernisation of the land register survey results in the aggravation of the problem of the undetermined legal status of land under water. This work analyses the boundaries of plots occupied by the watercourse in two provinces (Świętokrzyskie, Śląskie) where the land register survey was modernised after the entry into force of the new Water Law Act. The aim was to determine the scale of the problem of the land use Wp (flowing water ) occurring on private land.

The article concerns the humanitarian protection of animals in Polish law. It is of a scientific and research nature and its purpose is to define the relationship between the legal status of an animal and the nature and the scope of its humanitarian protection. The legal status of an animal is determined by the Animal Protection Act, through dereification and the general principle of humane treatment of animals. In the light of legal provisions, two basic categories of animals can be distinguished in the context of their humanitarian protection: domestic animals and working animals. The latter are then divided into further subcategories. The scope of humanitarian protection varies depending on belonging to a given category, because legal provisions differently define the scope and degree of obligations regarding animal welfare. However, the premises for classifying a given animal as belonging to one of those types, result not only from the scope of legal acts. The decisive role in this regard has the status that is given by a man, usually determined by the man’s attitude towards the animal and its utility for the man. This attitude is shaped individually in a specific case and is the actual source of the legal status of the animal and consequently its protection.
Artykuł dotyczy ochrony humanitarnej zwierząt w polskim prawie. Ma on charakter naukowo-badawczy, a jego celem jest określenie relacji pomiędzy statusem prawnym zwierzęcia a charakterem i zakresem jego ochrony humanitarnej. Status prawny zwierzęcia określa ustawa o ochronie zwierząt poprzez dereifikację i generalną zasadę humanitarnego traktowania zwierząt. W świetle przepisów prawa można wyróżnić dwie podstawowe kategorie zwierząt w kontekście ich ochrony humanitarnej: zwierzęta domowe i zwierzęta użytkowe. Druga z tych kategorii dzieli się na podkategorie. Zakres ochrony humanitarnej różni się w zależności od przynależności zwierzęcia do danej kategorii. Przepisy prawa różnie określają bowiem zakres i stopień obowiązków dotyczących zapewnienia dobrostanu zwierząt. Jednakże przesłanki zakwalifikowania konkretnego zwierzęcia jako należącego do jednej z tych kategorii nie wynikają jedynie z zakresu regulacyjnego aktów prawnych. Decydującą rolę w tym względzie odgrywa status nadany zwierzęciu przez człowieka, zdeterminowany stosunkiem do zwierzęcia i jego użytecznością dla człowieka. Ten stosunek kształtuje się indywidualnie w konkretnym przypadku i stanowi faktyczne źródło prawnego statusu zwierzęcia, a w konsekwencji zakresu jego ochrony.

The objective of the article is to delineate the present status of the Kashubian language. The analysis will be based on the 2007 reports compiled by the Council of Europe with reference to the commitments made by Poland concerning the implementation of the European Charter for Minority or Regional Languages. In particular, the analysis will cover the provisions defined in Part III thereof with regard to Kashubian. The paper will try to assess whether the privileged status given to the Kashubian language has triggered significant changes in the treatment of the language by the Polish government and Kashubians. Do the reports prove that the language policy towards regional and minority languages within the European Union is in fact state-based? Do legislative grounds correspond with the change of attitudes of both the authorities and Kashubians?
Celem artykułu jest przedstawienie obecnego statusu języka kaszubskiego w Polscew oparciu o dane z raportów sporządzonych na potrzeby Rady Europy dotyczących zobowiązań Polski względem wdrożenia postanowień części III Europejskiej karty języków regionalnych lub mniejszościowych dotyczących języka kaszubskiego. Artykuł ma również na celu ocenę czy uprzywilejowany status języka kaszubskiego doprowadził do zmian w traktowaniu tego języka przez władze lokalne oraz postrzeganiu przez Kaszubów. Autorka stawia pytania czy raporty stanowią dowód na to, iż polityka językowa Unii Europejskiej względem języków regionalnych i mniejszościowych jest w rzeczywistości zależna od danego państwa oraz czy zmiany legislacyjne korespondują ze zmianami wprowadzanymi przez władze oraz samych Kaszubów.
