The need for law education is indispensable in the individual and, as a consequence, social dimension. Its early initiation will “internalize” patterns of behaviour and response which will contribute to conscious functioning in society, and, as a result, building of a society of law. Therefore, one of the goals of the presented text is to indicate the fact that ignorantia iuris nocet. Such a conceptualization is preventive, prophylactic, and inhibitory. First and foremost, the purpose of addressing the issue is to show the need to raise legal awareness that builds legal culture of society, and improves the quality of life. The analysis of the results of the research conducted among schoolchildren aged 15-16 indicates that legal awareness of the young generation differentiates the frequency of behaviours contrary to social and legal standards-the higher legal awareness of young people is, the lower the level of particular problem behaviours in this group is. The paper also outlines recommendations on solutions that can be used to create future prevention programs aimed at building an aware information society and the high legal culture of its members.

The model of legal profession is one of the most important features of every legal culture and constitutional identity. The paper aims at explaining the identity of Polish legal profession according to their history and evolution of Polish political and constitutional basic ideas. The argument is that the strongly manifested element of this identity is lawyers’ paternalism. That means lawyers act to protect the interest of their clients often without an alignment or even against their clients will. This attitude toward the lawyer-client relationship is deeply rooted in Polish legal culture, especially in interconnection of two discourses. First is the egalitarian one which establishes the task of lawyers as to provide to everyone equal legal aid and to protect everyone’s rights and liberties. Second is the elitist one that tend to justify the claim that effective legal aid and the protection of right and liberties is possible only through some special abilities and skills of lawyers which not everyone could possess.

The aim of the article was to define the role of the legal culture in development of the standards of judges’ professional ethics, to indicate the most representative definitions of culture and legal culture, and to specify the most important characteristics of judges required both in their work and in private life. The discussion covers also the issue of the legitimacy and significance of elaborating the most important principles of the judges’ professional ethics in the form of a code both in the past and present. The article presents the problem of the prestige of the judicial profession as viewed by the general public, lawyers, students and judges themselves. The analyses of documents, literature, as well as the historical and statistical techniques were exploited in the article. As a result of the conducted analyses, it was recognized that legal culture is the “third” element between law and its use, by which it also fulfils a social-regulatory role. The legal culture of authorities that apply law should not be in contradiction with the general system of values and ought to serve the society. This is particularly important in the context of judicial independence, because nowadays more and more influence of politicians and various lobbies on the activity of the judges is observable. As a consequence, it leads to the instrumental use of the legal acts and makes the position of the judge not impeccable in terms of ethics. In turn, this state of affairs brings about a significant decline of public esteem for judges
Celem artykułu było określenie roli kultury prawnej w kształtowaniu standardów etyki zawodowej sędziego, wskazanie najbardziej reprezentatywnych definicji kultury i kultury prawnej, a także wyszczególnienie najistotniejszych cech sędziego, wymaganych zarówno w jego pracy zawodowej, jak i w życiu prywatnym. Przedmiotem refleksji była też kwestia zasadności i istotności opracowania najważniejszych zasad etyki zawodowej sędziego i ich ujęcie w ramy kodeksu w kontekście historycznym. W artykule poruszono również zagadnienie prestiżu zawodu sędziego w opinii ogółu społeczeństwa, prawników, studentów i samych sędziów. Posłużono się metodą analizy dokumentów, analizy literatury, wykorzystano także metodę historyczną, jak i techniki statystyczne. W wyniku przeprowadzonych analiz uznano, że kultura prawna jest „trzecim” elementem między prawem i jego użyciem, przez co pełni też niejako rolę społeczno-regulującą. Należy dążyć do tego, aby kultura prawna organów, które stosują prawo, nie pozostawała w sprzeczności z ogólnie przyjętymi systemami wartości i służyła społeczeństwu. Jest to szczególnie istotne w kontekście niezawisłości sędziowskiej, ponieważ współcześnie uwidacznia się coraz większy wpływ polityków i różnorakich lobby na działalność sędziowską. W konsekwencji prowadzi to do instrumentalnego stosowania aktów prawnych i powoduje, że pozycja sędziego nie jest nieskazitelna pod względem etycznym. Ten stan rzeczy wpływa z kolei na znaczący spadek poważania dla zawodu sędziego w opinii społeczeństwa.

The reception of common law in the United States was stimulated by a very popular and influential treatise Commentaries on the Laws of England by Sir William Blackstone, published in the late 18th century. The work of Blackstone strengthened the continued reception of the common law from the American colonies into the constituent states. Because of the large measure of sovereignty of the states, common law had not exactly developed in the same way in every state. Despite the fact that a single common law was originally exported from England to America, a great variety of factors had led to the development of different common law rules in different states. Albert W. Alschuler from University of Chicago Law School is one of the contemporary American professors of law. The part of his works can be assumed as academic historical-legal narrations, especially those concerning Blackstone: Rediscovering Blackstone and Sir William Blackstone and the Shaping of American Law. Alschuler argues that Blackstone’s Commentaries inspired the evolution of American and British law. He introduces not only the profile of William Blackstone, but also examines to which extent the concepts of Blackstone have become the basis for the development of the American legal thought.

The university, as an intellectual community and space of research, education and development, shapes the academic culture. The aim of education is to provide law graduates with knowledge – undoubtedly crucial for practicing the profession, but also with competences and skills enabling them to participate in the legal culture. Deliberation is a process in which, through conscious, responsible and cognitively-oriented action, a rational, but also reflective change is possible, taking into account both the preferences of entities and, at the same time, the dynamics of the changing world around them. An organization of the university based on the philosophy of deliberation is in line with the academic tradition based on cognitive autonomy, understood as the right of researchers and students to freedom of learning and teaching.

Our article concentrates on emotions as related to the functioning of man in the judicial system seen as a modern bureaucratic institution. Special attention is given to the work of judges due to their key position in this system. In legal discourse there is a dominating normative idea of a judge as a decision-making subject free of any emotional factors influencing their judgment. According to this traditional approach, a decision biased even in the slightest way by emotions could not be regarded as impartial, whereas judicial impartiality is regarded as one of the core values of the justice system. Our standpoint assumes not only that judges experience emotions but also asserts that they are being manifested in varied ways. Our analysis is based on Arlie Hochschild’s conception of emotional labour. Such labour is being performed when an individual reflects on his or her feelings and makes an effort either to change or to inhibit emotions which are regarded as misfitting. The necessity of emotional work is a result of cultural feeling and expression rules. It seems prima facie that there is one clear expression rule regarding displaying emotions by the judge in the Polish legal culture: no emotions allowed. However, contrary to possible reconstructed declarations and recommendations warning judges against showing emotions, the rules of expressing them in Polish courts are not unequivocal. We claim that one can distinguish between unconditional and conditional rules of expressing emotions. The former relate to expressing emotions concerning non-professional participants, and conditional rules of expressing emotions relate to professional participants in the hearing. There are situations in which an emotional reaction is reasonable, because it represents certain values to which the justice department adheres, and those in which judges regret showing annoyance or anger. The goal of the emotional labour performed is not only a realization of the value of impartiality, but also the balance of the judges that allows them to efficiently fulfil their role.

This paper refers to the accurate usage of the word “Eurasian”, which is tightly connected with Russian Eurasianism, an intellectual movement that existed in the Interwar period, in the years 1921–1939. Nowadays, the concept of “Legal Culture” is rendered banal by comparative legal thinkers, who reduce it to legal tradition or even the legal system as a social system. In contrast to these theories, the Eurasianist jural project was mostly culture-oriented. For instance, the Eurasianist idea of Language Union, provided by Nikolai Trubetzkoy and the famous linguist Roman Jakobson, could be useful for developing a new concept of Legal Union instead of the idea of legal family. Piotr Savitzky’s notion of “Mestorazvitie”, Jakobson’s “method of linking”, and Nickolai Alekseev’s idea of “Right-Duty” could be very fruitful concepts for establishing cultural jurisprudence.

This article attempts to answer the question why is it worth to exhibit the category of agency in the legal practice. Answering the question I started my discussion from the presentation ideas related to the issue of the social role of the lawyers. In the completion of this objective, I discussed three ideas: moral responsibility, trust and subjective agency. Putting forward the role of the lawyer, I paid attention to the relationship between the notion of trust in the lawyer’s role and moral responsibility. This relationship is based on an ethical link, which is founded on a kind of obligation. This idea can be demonstrated by looking into confidence in the lawyer’s role as a special form of obligation to consider individual, institutional and social arguments. In the presented approach the state of limbo between the individual dimension, which focuses on the relationship between a specific individual and their rights, and the public dimension, where attention is paid to institutional and social arguments, is a characteristic feature of the professional role of a lawyer. The shaping of a professional role in a subjective and structural authorship is based on the idea of a two-way movement. It consists in highlighting the institutional structure with simultaneous reinforcement of the role of the subject who acts within it.

There can be no doubt that Professor Artur Kozak (1960-2009) was amongst the most original and innovative Central European legal theorists of the tu of the 2t0h and 21st century. His legal theory named 'juriscentrism', based on an unprecedented synthesis of philosophical interpretationism and anti--represent tionism, sociologocial constructivism, as well as pragmatist ethics (inspired b ethnocentrism), allowed to produce a fresh legitimising narrative for lawye power in society. The present paper aims to enquire about the place and role played by legal tradition within Kozak's jurisprudential project. Its main clai will be that legal tradition is a keystone of juriscentrism, as it is the basis for identity and the reproduction of the legal community, the sole guarantor of t reasonableness of judicial decisions.

The paper presents the results of research projects conducted by the Chair of Sociology of Custom and Law, Institute of Applied Social Sciences, Warsaw University, on the chosen components of the Third Republic of Poland's legal culture. The popular legal culture is distinguished here from the professional one. The latter is not a subject of this paper, although their direct points of junction are indicated: law-makers, social origin and environment of lawyers and the participation of non-lawyers in the administration of justice. All of them make treating the legal culture as an autonomous entity hardly possible. General legal attitudes are discussed with reference to the 1964 pioneer studies of Adam Podgórecki, and the patterns and practices of dispute resolution. The instrumental treatment of law by political elites is debated; those who use the law as an instrument of political struggle and the political advantage for those who pass the laws. Finally, fi ve general conclusions are drawn. According to the most important one, in the Polish culture the most common is the interest in claiming 'one's own' right by using both legal and illegal means to obtain it, which is linked to the toleration of similar behavior of others. The latter occurs if such a behavior does not interfere with the fulfillment of one's own aims.

The article is dedicated to the comparative analysis of the Islamic legal culture and the Western legal culture. The article points out to the differences of those legal cultures and tries to find their roots. The author considers this problem in several basic contexts: the sources of law, the variability of law, the obligation of submission to law, the limits of legal system, the relation of law to morality, the functions which are attributed to law and the role of religion in public space. The paper examines each of them penetratingly. With reference to the author’s viewpoint, a prime difference between the Islamic and the Western legal cultures comes down to the number of normative systems possible to single out while examining the former or the latter. According to the text, in the Islamic legal culture there exists one universal normative system which includes legal rules as well as moral standards, unwritten laws, courtesy instructions, etc. On the other hand, the Western legal culture is characterized by strict separation between legal rules and other standards which belong to morality or customs. At the end of the article the author attempts to formulate a standpoint referring to the future of the Islamic and the Western legal cultures.

The merging of the Constitutional and Legal History of Poland with the General Constitutional and Legal History into one subject Constitutional and Legal History gave rise to the fear that Polish constitutional and legal institutions may be blurred in the area of general history. The absence of individual subject, whose name reflected Polishness, might contribute to the weakening of the spirit of historical community of Polish society, the spirit being previously moulded by the discussed subject. The essential educational element in the forming of the frame of mind of the lawyer inclined toward humanities is the knowledge of above all the constitutional history of his own country, the evolution of its political institutions and the law applied in courts. The discussed modification of the process of educating future lawyers at the Faculty of Law, Administration and Economy of the University of Wrocław may push to the background questions which laid the emphasis on the vernacular legal culture of the state. It is from the native constitutional and legal history that we obtain the first line experience. The subject that was thus eliminated was the one characterized by rich historiography and the one that emphasized the historical continuity of Polish state and law.

Significant changes in the field of education observed in recent years under the influence of economic, political and social processes, as well as Ukraine’s entry into the global, in particular European, educational space, have become the basis for the implementation of educational reforms at all levels – from preschool to adult education. That is why there is an urgent need for professionals in various fields to have a high level of legal culture, because ignorance of the law does not absolve one from responsibility. In addition, the goal of all reform processes in our country is to achieve compliance with the European architecture in the relevant fields – legal, educational, medical, etc. Regulations are the main means of regulating and implementing legal policy in the field of education. Formation of legal culture of all participants in the educational process is a guarantee of the rule of law, a guarantee of fostering respect for the law and the state as a guarantor of law and order in the exercise of the right to education by every citizen. Accordingly, the legal competence of students, regardless of their field of study, is no longer just a requirement of modern society, but also a basic need of every person. The category of «legal culture» is one of the main characteristics of the country’s legal system, which helps to determine the quality of the legal life of society. The level of legal knowledge is an indicator that reveals the quality of the legal life of a higher education student, which allows the latter to evaluate both his or her own actions and/or inaction and the actions of other members of society and to distinguish legal relations in different branches of law. Structural components aimed at improving the level of legal culture of higher education students can be divided into informative components (regulatory framework of a higher education institution, charter, collective agreement, internal regulations, provisions and procedures governing the educational process, etc.), an evaluative component is the direct attitude of a higher education student to law in general (teaching general legal disciplines to understand the importance of legal knowledge and skills) and an organizational component is the activities of research and teaching staff. The issue of forming legal culture in higher education students should be prioritized during higher education, since knowledge of and compliance with the rules of law at the present stage of European development is unconditional.

Opis:
The author presents the impact of Utopian thought on the French political and legal culture during the Age of Enlightenment. Contemporary Utopias were the ideological background of the French Revolution. The machinations of 18th century France aside, we can call this time the “Age of Utopia”. This is confirmed by the studies of many French scholars and researchers. Professor Bronisław Baczko, a Polish philosopher and histo- rian, also presented this view in his work: “Utopian Lights: The Evolution of the Idea of Social Progress” (English Edition: New York 1989). It should be noted that the Enlighten- ment Utopias were concentrating on the nature of man and his social, economic, political and legal life. The texts of Utopians were also associated with philosophy and literature. They challenged the old order: Feudalism and Absolutism. In this way, the Utopias were the ideological weapon in the fight for a better world, that could only be redeemed by the Revolution.
