The Code of Canon Law of 1983 referring to hierarchical recourse, does not limit it merely to appeal to the Congregation of Roman Curia, but it refers to each recourse placed to higher executive administration organ. The subject of our interest, however, is the hierarchical recourse placed in front of the Roman Curia after exhausting the hierarchical path of lower grades. Because according to can. 1737 § 1 Code of Canon Law, anyone who considers himself injured with the decree can place recourse to hierarchic superior of the one who delivered the decree. Therefore we are speaking about the subject of the recourse, the motive, as well as, the procedure to be undertaken in order to obtain the desired goal, appeal or change of harmful act.

Thema des vorliegenden Beitrags ist die Untersuchung der Kontakte preußischer Kleriker zur Kurie vor dem Hintergrund der Personalpolitik des Deutschen Ordens in den ersten drei Jahrzehnten des 15. Jahrhunderts am Beispiel der aus Thorn stammenden Juristen Johann Abezier und Arnold Datteln. Während des „Großen Krieges“ und in den darauf folgenden Jahren waren die beiden Thorner Kleriker über einen längeren Zeitraum an der Kurie aktiv und bildeten als führende Juristen und Diplomaten des Deutschen Ordens ein wichtiges Bindeglied zwischen der Deutschordensführung und der päpstlichen Kurie. Des Weiteren werden die Kirchenkarrieren der beiden Kleriker vor dem Hintergrund der Versorgung von Deutschordensjuristen mit Benefizien näher untersucht. Bei den Bemühungen um Benefizien spielte das Domkapitel von Ermland als Versorgungseinrichtung eine zentrale Rolle. Es gelang sowohl Abezier als auch Datteln weiteren aus Thorn stammenden Klerikern im ermländischen Domkapitel Benefizien zu verschaffen. Somit bildete Ermland für die Thorner Kleriker gewissermaßen einen Mobilitätskanal und ermöglichte in einigen Fällen eine beachtliche Kirchenkarriere. Am Beispiel der beiden genannten Kleriker wird auch die Bedeutung verwandtschaftlicher und landsmannschaftlicher Beziehungen für den Karriereverlauf sowie für eine dauerhafte Netzwerkbildung innerhalb des Domkapitels herausgearbeitet.
Celem artykułu jest zbadanie relacji zachodzących pomiędzy pruskimi klerykami a Kurią papieską na tle polityki personalnej zakonu krzyżackiego w pierwszych trzech dziesięcioleciach XV w. Relacje te ukazano na przykładzie pochodzących z Torunia prawników Johanna Abeziera i Arnolda Dattelna. W okresie Wielkiej Wojny i w latach następujących po niej działali oni przez dłuższy czas w Kurii. Byli oni wiodącymi prawnikami i dyplomatami zakonu krzyżackiego, stanowiąc zarazem istotne ogniwo w relacjach Zakonu z Kurią papieską. Opracowanie przedstawia przebieg karier kościelnych obu tych kleryków. Centralną rolę w zdobywaniu beneficjów odgrywała warmińska kapituła katedralna. Zarówno Abezierowi, jak i Dattelnowi udawało się pozyskiwać beneficja w tej kapitule także dla innych kleryków pochodzących z Torunia. Uzyskanie beneficjum w warmińskiej kapitule katedralnej ułatwiało dalszą karierę kościelną. Na przykładzie obu wymienionych kleryków przedstawiona została również rola powiązań rodzinnych i regionalnych w budowaniu kariery oraz tworzeniu trwałych powiązań pomiędzy członkami kapituły.
The theme of this paper is to study the relationship between the Curia and the Prussian clergymen against a background of the personal policy of the Teutonic Order in the first three decades of the 15thc., on the example of the Toruń lawyers Johann Abezier and Arnold Datteln. During the "Great War" and in the following years, both these Toruń clerics worked for a long time in the Curia acting as the leading lawyers and diplomats of the Teutonic Knights and became a vital link in the relationship between the Teutonic Order and the papal curia. Study examines the careers of these two clerics against the background of the benefices received by the lawyers of the Teutonic Order. The central role in obtaining benefices played the cathedral chapter of Warmia. Both Datteln and Abezier managed to obtain benefices for other clerics from Torun in the cathedral chapter of Warmia, what allowed the same clerics achieve significant career in the church. On the example of both clerics has been developed the role of family and regional relations in building a career and creating permanent connections in frame of the cathedral chapter.

Rezultatem trzydniowych obrad Synodu Łuckiego z 1927 r. był zbiór prawa diecezjalnego, obejmujący 502 statuty i 22 aneksy. Kodyfikacja ta była oparta na Kodeksie Prawa Kanonicznego z 1917 r., na dotychczasowym prawie partykularnym Diecezji Łuckiej, dokumentach Stolicy Apostolskiej, Piśmie Świętym i prawie świeckim. Jedynym ustawodawcą na Synodzie był biskup Adolf Piotr Szelążek.
The outcome of the three-day-long deliberations of the 1927 Synod of Lutsk was a collection of diocesan laws, including 502 statutes and 22 annexes. This codification was based on the 1917 Code of Canon Law, the existing particular law of the Lutsk Diocese, the documents of the Holy See, the Bible and secular law. The only legislator of the Synod was bishop Adolf Piotr Szelążek.

Kodeks prawa kanonicznego z 1983 r., normując przepisy dotyczące rekursu hierarchicznego, nie odnosi ich wyłącznie do Kongregacji Kurii Rzymskiej, ale każdego wyższego hierarchicznie organu administracji. Przedmiotem zainteresowania autora jest rekurs do Kurii Rzymskiej, następujący po wyczerpaniu niższej drogi hierarchicznej. Zgodnie z kan. 1737 § 1 Kodeksu prawa kanonicznego każdy, kto czuje się poszkodowany jakimś aktem administracyjnym, ma prawo złożenia rekursu do przełożonego hierarchicznego autora aktu administracyjnego. Dlatego też w artykule poruszane są kwestie motywu, przedmiotu, podmiotu rekursu, jak i samej procedury rozpatrzenia rekursu do Kurii Rzymskiej.

As a result of the Potsdam Conference, territory of Poland was shifted west. This decision forced the masses to migrate, and Polish government to populate and develop the new lands. Settlement of West Pomerania, Lubusz Land and other areas was started; priests came along with the crowds. The Church, trying to meet the expectations of the lost and anxious people, wanted to mark its presence in former German and Protestant areas. Curia was needed for this purpose – and its manager. Father Edmund Nowicki was first to be elected in 1945, however as a result of hostile policy of the authorities against the Church, he was replaced in 1951 by Fr. Tadeusz Załuczkowski. After his sudden death, the Curia manager position was taken by Zygmunt Szelążek. He occupied it until the end of 1956. Each one of the three had a huge influence on the religious life in the region. They built the Church structures virtually from scratch, they brought priests and religious, took over evangelical churches for the use of the Latin rite. They worked in the reality of the Polish People’s Republic, risking reprisals. On one hand, they were being defined by the circumstances of place and time, on the other, they were determined to achieve their goals and realize uneasy task of leading the Church in the most demanding and neglected, largest territorial unit in Poland at the time. The article depicts their struggle, insufficiently described in the literature, as of yet.

The Author analyses the competences of the Pontifical Council for Legislative Texts, especially the most important one – the authentic interpretation. At the beginning the Author shows the historical background for the Council. The interpretation of canon law was not included in the legal system until the XX century. Pope Benedict XVI with motu proprio Cum iuris canonici, dated 15 September 1917, established the Pontifical Commission of Cardinals for Authentic Interpretation of the Code of Canon Law. Then, Pope John Paul II, with motu proprio Recognito Iuris Canonici, dated 2 January 1984, established the Pontifical Commission for Authentic Interpretation of the Code of Canon Law. Under the Apostolic constitution Pastor bonus (28 June 1988), John Paul II changed its name to the Pontifical Council for the Interpretation of the Legislative Texts. The functions of the Pontifical Council for Legislative Texts are presented in the article. Its main competence is the interpretation of the laws of the Church (art. 154-155 Pastor bonus). Moreover, the Council is competent to grant the general decrees of the conferences of bishops the recognitio (art. 157 Pastor bonus) and is at the service of the other Roman dicasteries (art. 156 Pastor bonus). The Author shows the methods of work of the Pontifical Council and cites examples of the authentic interpretations of the Council (Commission). At the end of the article it is concluded that the interpretation's maxim of the canonical legal system is the “Spirit of the Vaticanum II”.
