The main topic discussed in the article is the question of the dignity of the post of judge of the common courts of law. The authoress, on the basis of the law and the jurisdiction of the disciplinary court, in that regard, sought to determine the scope of the concept of “dignity of the post of judge”. She tried to answer the question, what specific requirements should meet the judge, and how he should behave, or how he should not behave, to make his duties in dignified way? The answer was constructed by identifying the normative responsibilities, basing on the Constitution of Poland, content of the oath of judges, articles 82. and 82., points “a” and “b” of the act of the Law of the Common Court and “The Rules of Professional Ethics of Judges”. Then, under the jurisdiction of the disciplinary court of the Supreme Court was compiled the list of behaviors which affront to the dignity the post of judge.

The research goal of this paper is to develop a two-dimensional catalogue of security threats related to areas beyond national jurisdiction, taking into account specific features of each area and its legal regime. The catalogue of threats will take the form of a matrix where each area beyond national jurisdiction will be juxtaposed with five categories of threats: political, military, ecological, economic and human security. The matrix will visualize which threats are of relevance to the security of a particular area beyond national jurisdiction as well as which threats originating in a particular area beyond national jurisdiction are of relevance to the security of States and the whole international community.

This article examines the jurisdictional status of the internet. Because of the underlying nature of technology, nations cannot effectively monitor online transactions that originate or conclude within their borders. Governments can seek to enforce their laws within the constraints of their physical, geographical, and political domains as defined by an atlas, but a borderless cyberworld regulated by fast-expanding technology has a variety of challenges. This study sheds light on those challenges, the jurisdiction for parties to suit, the remedies accessible to them, and the territorial concerns discussed in various domestic courts. It also focuses on the pressures on stakeholders to act, as well as the economic, human rights, and technological infrastructure implications of jurisdictional concerns. In general, jurisdictional issues on the internet have resulted in haphazard and unrestricted jurisdictional implementations, and this article emphasizes the territorial difficulties of internet administration and its direct influence on many nations and elements.

From the times of William the Conqueror to 1858, jurisdiction in all marriage matters belonged to the ecclesiastical courts. The courts decided the cases applying the canon law. Marriage, as an institution of the canon law, was also the sacred sacrament. As a consequence, it was treated as an indissoluble union, lasting until the death of one spouse. Although it seemed that the idea of indissolubility of marriage was widely accepted, actions taken by people from various social layers were in contradiction to it. Since 1858 to the third decade of XX c. the English law of divorce was largely changed. This changes were accompanied by the transformation in social consciousness, that is why marriage has never been seen as before.

During the reign of Sigismund I the Old relations between gentry and clergy were visibly tense. The main source of the conflict was the issue of a state reform suggested by chivalry. Crystalizing in the first half of the XVI century, execution movement program considerably infringed clergy’s legal and economic privileges. The reform program proposed by gentry pertained to several social, religious, economic and legal issues. In all these spheres the Church and chivalry differed in opinions, which resulted in a complicated confrontation and impossibility of working out of consensus. The fact that the compromise could not be reached made both sides act even more vigorously, insisting on fulfillment of all their demands. In the fight against the Senate and Monarchy, members of the Chamber of Deputies were still more and more convinced of their increasing power. Thus, still more boldly and unanimously, they defended rights of chivalry and demanded extension of privileges on expense of clergy and the mighty. However, gentry was able neither to impose permanent taxes on the Church nor devoid clergy of remaining the only authority in deciding on issues concerning the faith. Undoubtedly, due to unhesitant position of the Polish Episcopate and support of Sigismund I the Old, clergy managed to retain their political and economic privileges, although political privileges were considerably undermined during the reign of Sigismund Augustus.

The subject matter of the article is notarial preventive jurisdiction and its rules provided in the Polish law, with an emphasis laid on refusal of performing a notarial transaction, pursuant to Art. 81 of the Law on Institution of Notary Public and Notarial Services. The issue under analysis boils down to answering the question whether the prerequisite for refusing a notarial transaction in the form of ‘contradiction with the law’ covers only the statutory law or also the principles of community life. According to the essential thesis of the article, the systemic and functional reasons advocate taking a stand on having the concept of law limited exclusively to a statute. A Notary Public, for being a person of public trust, is to be a guardian of the legitimacy of a notarial act conceived not only as a conflict with the statutory law, but also with the axiology resulting from other normative systems, including principles of community life. The objective of notarial preventive jurisdiction is to make institutional and procedural frameworks for legal entities which make declarations, which should, in turn, secure the safety of legal transactions, including protection of parties of legal transactions, the efficiency of execution of their rights, as well as that of the rights of third parties and the State. It means that in the course of a ‘notarial procedure’, the Notary Public is obliged not only to apply simply the statutory rules, but also to investigate and to examine the circumstances which might imply the illegitimacy of a notarial action due to a conflict with the law or with the principles of community life.

Recently Polish courts have started to attach bank accounts of foreign embassies for the purpose of enforcement of judgements against embassies of foreign States in e.g. employment cases. The courts have applied the same principle to jurisdictional State immunity and immunity from enforcement and recognized that if state activities giving rise to the claims examined by courts were of private-law character, they are not protected either by jurisdictional or enforcement immunity. This standpoint is contrary to the dominant trend in other states’ practice, confirmed by the International Court of Justice in 2012 (Germany v. Italy: Greece Intervening). While in the field of jurisdictional immunity, the nature of an act as iure imperii or iure gestionis is decisive, in a case of immunity from enforcement – the allocation of the property against which enforcement measures are sought. Embassy bank accounts are generally covered by immunity from enforcement. In this situation Polish courts should develop convincing and exhaustive reasons why it is necessary for the protection of an individual to overrule the ne impediatur legatio principle. The judgements are not sufficiently reasoned and there is no good argument to support this stance. They expose Poland to international liability.

This article aims to analyze the European Union law in terms of the jurisdiction applicable in cases of infringement of personal rights on the Internet. After a short introduction to issues of technical, technological and civilizational progress, consideration is given to the fact that the Internet has become a common platform of human activity. The role, characteristics, and specificity of this state of affairs are presented, and the consequences assessed. The paper then turns to the fact that the problem of determining the applicable jurisdiction in the European Union law is based on general terms from which there are normative exceptions. Such exceptions include a special jurisdiction mechanism that is analysed in this paper. With regard to the case-law of the Court of Justice of the European Union, the paper proposes ways the jurisdiction of European Union Member States should be determined in cases of infringement of personal rights on the Internet. The paper also contains postulates related to the interpretation of relevant Union legislation, which are directed to legislative and judicial authorities. The discussion is closed with a brief summary of the authors’ reflections on the analysed issues, as well as some comments on the recent relevant cases.

It’s hard to deny that the history of administrative jurisdiction in Poland attests the dramatic fate the country faced in the twentieth century. It is the only country in Europe which, through deliberate actions of the German occupant, suffered the loss of its entire decree archives. Similar were personnel losses: following the end of the war only 37% of all justices and prosecutors from before the war returned to work. The most serious blow, however, to the idea of the revival of the administrative jurisdiction in Poland, came from the communists’ complete rejection of such type of jurisdiction. It was considered irreconcilable with the then propagated doctrine of socialist legitimacy, according to which a conflict between the administration of the state, realising the will of the working people, was eo ipso impossible. It was, therefore, a departure from the previous understanding of law, according to which the role of administration was to guard the legal rights of every individual. Restitution of administrative jurisdiction (initially of a quite limited scope) at the dawn of the communist rule in Poland was therefore an exception in all of the then Ostblock. The gradual development from that moment onwards of the Polish administrative jurisdiction, and also an increase in popular awareness of individual rights, are best testified by the statistical data. If in 1980, the first year of the restored administrative jurisdiction, 2,470 cases were submitted to court, in 2015 there were as many as 83,529 cases.
Trudno nie przyznać, że również historia sądownictwa administracyjnego w Polsce poświadcza dramatyczne losy polskiego państwa w XX stuleciu. Jako jedyne bowiem w Europie może się ono poskarżyć na utratę w wyniku celowej działalności okupanta niemieckiego całości swojego archiwum orzeczniczego. Nie inaczej jest z poważnymi stratami ludzkimi: po zakończeniu działań wojennych zgłosiło się do pracy zaledwie 37% wszystkich sędziów i prokuratorów z przed wybuchu wojny. Najpoważniejszy cios idei przywrócenia sądownictwa administracyjnego w Polsce zadało jednak odrzucenie przez komunistów w ogóle takiego typu sądownictwa, uznanego za nie do pogodzenia z ówcześnie głoszoną doktryną socjalistycznej praworządności. Według niej konflikt między administracją państwa urzeczywistniającą wolę ludu pracującego a obywatelem nie był eo ipso możliwy. Tym samym oznaczało to odejście od dotychczasowego rozumienia prawa, według którego zadaniem administracji było strzec praw podmiotowych każdej jednostki. Restytucja sądownictwa administracyjnego (początkowo w dość ograniczonym zakresie) u schyłku panowania komunistów w Polsce była zatem ewenementem w całym ówczesnym Ostblocku. Stopniowy rozwój od tego momentu polskiego sądownictwa administracyjnego, ale i zarazem wzrost świadomości społecznej w zakresie przysługujących jednostkom praw poświadczają jednakże najlepiej dane statystyczne. Jeśli bowiem w 1980 r. (w pierwszym roku działalności przywróconego sądownictwa administracyjnego) wniesiono 2.470 spraw, to w 2015 r. było ich już 83.529.

What it meant by European Integration? We mean the historical process whereby European nation-states have been willing to transfer, or more usually pool, their sovereign powers in a collective enterprise. The European Union, which today contains twenty-eight member states, which has a complex institutional structure that includes a supranational central administration (the European Commission), an elected Parliament, a Court of Justice and a Central Bank, is the outcome of this processes. Many American and European scientists of the European Union have chided “intergovemmentalist” accounts for emphasizing the duration of member state authority over the process of European integration. This article attempts to prove these criticisms in a “historical institutionalist” account that mentions the importance of research on European integration as a political process which spreads over time. Such an aspect distinguishes the limitations of member-state control over permanent institutional improvements, due to a fixation with short-term interests, the existence of unexpected consequences, and actions that “lock in” past decisions and make affirmation of member-state control difficult. Short exploration of the development of social policy in the EC advocates the limitations of conducting the EC as an international regime promoting collective activity among sovereign states. It is important to view integration as a “path-dependent” process that has composed a dispersed, but still obvious “multitiered” European polity.

Marriage is an institution regulated by the Polish and canon law. The Polish law understands the institution of marriage differently than the canon law. In the Polish law marriage can be terminated by divorce. In the canon law marriage is indissoluble, but we can proceed the annulment process of the marriage. The Polish concordat provides for the possibility of marriage as a religious form, but does not provide for a right of termination of the marriage. It means that the civil law has jurisdiction over the civil marriage, while the canon law has jurisdiction over the canon marriage. The question of the recognition of the judgments of the diocesan tribunal in the civil forum is still open.
