    Opis:
    This paper focuses on the highest frequency lexical resources within the area of online legal counselling. The research corpus included the content of discussions held around specific problems of legal and judicial character and the attempts to find practical solutions to those problems, found on the Internet forums. The texts in question were classified here as utterances of a legal commentary character and stemming from the legal and judicial language, in opposition to strictly legal communication, which is normative and depersonalized in its nature. This paper takes a closer look at the act of counselling as a linguistic action in both Polish and German linguistics, as well as the characteristics of a specific-content Internet discussion forum as a separate, well-defined genre of text functioning within the world-wide-web and oriented towards the exchange of views and gathering information on a specific topic. Besides their knowledge-broadening functions, these forums are nowadays more frequently becoming the sites for initiating social contacts and interactions. The paper is cultural-contrastive in its character, as the analysed material comes from two parallel sources: Polish and German texts. It aims at identifying discrepancies as well as regularities in online legal advice, including specific lexical items. The conclusions are likely to serve as the basis for defining a specific “linguistic realm” of the Internet forum users in both languages in question, as well as contribute to identifying some current trends in cross-cultural communication based on modern tools and social media.

    Opis:
    Based on a 2-million word bilingual comparable corpus of American and Italian judgments, this paper tests the applicability of a local grammar to study evaluative phraseology in judicial discourse in English and Italian. In particular, the study compares the use of two patterns: v-link + ADJ + that pattern / copula + ADJ + che and v-link + ADJ + to-infinitive pattern / copula + ADJ + verbo all’infinito in the disciplinary genre of criminal judgments delivered by the US Supreme Court and the Italian Corte Suprema di Cassazione. It is argued that these two patterns represent a viable and efficient diagnostic tool for retrieving instances of evaluative language and they represent an ideal starting point and a relevant unit of analysis for a cross-language analysis of evaluation in domainrestricted specialised discourse. Further, the findings provided shed light on important interactions occurring among major interactants involved in the judicial discourse.

    This paper investigates the interplay between judicial argumentation and evaluative or emotive language identified in two US Supreme Court landmark cases on the right of same-sex couples to marry. The analysis of both majority and dissenting opinions leads to two main observations. First, marriage and liberty are indeed emotive words and they represent two major sites of contention between the concurring and dissenting judges. Second, there are important differences within the argumentative strategies employed by the judges. While (re)defining the concepts remains the major argumentative goal for both types of opinion, the majority opinions tacitly integrate the redefined concept of marriage into their argumentation. It is the dissenting opinions that explicitly raise the issue of (re)definition in order to defend and retain the original sense of marriage.

    The paper presents results of a study aimed at analysing problems that arise in Polish‑English translation of selected court documents in divorce and judicial separation cases, as well as the ways of solving such problems in the light of the functional approach to translation. The methodology used includes parallel texts analysis, corpus linguistics for term extraction and comparative legal research into concept comparison. The results, including comments on specific terminological, phraseological and textual choices and a critical analysis of certain established equivalents, are presented in the form of an annotated translation. The findings also include general observations on the types and the sources of common problems encountered by both beginner and experienced translators. Finally, a need is identified for developing a more effective form of presenting results of practice-oriented research in the field of translation studies, especially with reference to legal translation, which would account for a richer knowledge component and more extensive contextual information than traditional dictionaries and term‑bases.
    W artykule zaprezentowano wyniki badań, których celem była analiza problemów właściwych dla tłumaczenia z języka polskiego na język angielski wybranych pism procesowych i orzeczeń sądowych w sprawach rozwodowych oraz w sprawach o orzeczenie separacji. W ramach badań przeprowadzono m.in. analizę tekstów paralelnych, zastosowano metody właściwe dla językoznawstwa korpusowego w celu ekstrakcji jednostek terminologicznych oraz komparastykę prawniczą w celu porównawczej analizy pojęć. Wyniki, w tym uwagi dotyczące konkretnych wyborów terminologicznych i frazeologicznych oraz rozwiązań na poziomie tekstu, a także krytyczną analizę wybranych powszechnie przyjętych ekwiwalentów, przedstawiono w formie tłumaczenia z komentarzem. W artykule ujęto także wyniki obserwacji dotyczących rodzajów oraz źródeł problemów tłumaczeniowych napotykanych przez początkujących oraz doświadczonych tłumaczy. Ponadto we wnioskach wskazano na potrzebę opracowania skuteczniejszej formy prezentowania wyników ukierunkowanych praktycznie badań w dziedzinie translatoryki, w szczególności w odniesieniu do tłumaczeń prawnych i prawniczych, która – w porównaniu do tradycyjnych słowników oraz baz terminologicznych – byłaby bogatsza pod względem merytorycznym oraz zawierała szersze informacje na temat kontekstu użycia poszczególnych terminów.

    Artykuł dotyczy wyjątkowego zabytku języka polskiego, jakim są średniowieczne roty kościańskie – jedyne zapiski tego typu, których część zachowała się w podwójnych redakcjach, brudnopisach i czystopisach. Sytuacja taka pozwala na badanie m. in. tego, w jaki sposób w średniowiecznych kancelariach pracowano nad tekstem przysięgi. Autorkę interesują wymiany leksykalne (autosemantycznych leksemów niewspółrdzennych). Zestawiając ze sobą odpowiedniki brudno- i czystopisowe, pokazuje charakter danej zmiany i próbuje rekonstruować motywy, dla których zostały one wprowadzone.
    The article focuses on lexical replacements, derived from the fi ft eenth-century polish rote sentences, writt en in Kościan (Wielkopolska). The case of this short notes remains unprecedented in the history of Old Polish language – about 370 sentences survive in two wordings: draft and fair copy; partially writt en and re-writt en by the same hand. Comparing equivalents from draft s and fair copies, the author shows the nature of these replacements and tries to reconstruct the motives for which they were introduced.

    Esta investigación parte de la pregunta de si el género de la sentencia es homogéneo o si, en realidad, hay factores que determinan las características concretas de una sentencia determinada. Para ello se ha compuesto un corpus de cuarenta sentencias españolas (combinando los órdenes civil y penal, y la 1ª instancia y la apelación). Este artículo demuestra que las variantes de orden e instancia jurisdiccional condicionan la forma lingüística de la sentencia y que, por ello, debe hablarse de variación en el género. En ese sentido, una descripción exhaustiva del género debería incluir dichas variantes.
    W niniejszym artykule zostaje postawione pytanie o to, czy orzeczenia sądowe tworzą homogeniczny gatunek lub czy istnieją czynniki determinujące specyficzny, językoznawczy charakter orzeczeń. Na potrzeby badania stworzono korpus składający się z czterdziestu hiszpańskich orzeczeń sądowych (w tym orzeczenia sądowe z zakresu prawa cywilnego i karnego, orzeczenia sądów pierwszej instancji oraz sądów apelacyjnych). W artykule wskazuje się, że zarówno gałąż prawa, w jakiej działa sąd, jak i jego instancja, warunkują językową postać orzeczenia i z tego względu należy mówić o wariacjach w ramach gatunku. Jest to powodem, dla którego w badaniach nad gatunkiem hiszpańskich orzeczeć sdowych, należy uwzględnić wspomnianą wariantywność.
    This research addresses the question of whether the genre of judgment is homogeneous or whether there are any factors which determine the specific linguistic characteristics of a judgment. For this purpose, a corpus of forty Spanish judgments has been compiled (containing civil and criminal judgments, and the 1st instance and appeal instance). This paper demonstrates that both the variant of judicial order and the variant of judicial instance condition the linguistic form of judgments; therefore, we should speak about genre variation. For that reason, a compre-hensive description of the judicial genre of Spanish judgments should include such variants.
