    The article discusses the decision of the Polish Supreme Court of 2 June 2022, I KZP 17/21. The ruling of the Supreme Court was issued based on a legal question submitted by a common court in relation to the European Investigation Order (EIO). The Author refers to the ruling by discussing broadly both the issues of the legal question and the authority issuing the European Investigation Order within the framework of pre-trial proceedings. Of paramount importance are the characteristics of the subjective sphere, i.e. the authority empowered to issue a European Investigation Order from the point of view of legally protected confidential information, in particular bank secrecy constituting the subject matter that served the basis for the ruling of the Supreme Court being commented herein.

    The idea of establishing the Bank of Poland as the central bank of the Second Polish Republic and introducing a new currency appeared shortly after Poland regained its independence. At the beginning of 1919, in the economic circles it was believed that one of the initial steps taken by the government would be to establish a new issuing bank in place of the Polish National Loan Fund, which had appeared on the Polish territory in an emergency situation—during the First World War, and which, contrary to the original (both German and Polish) plans survived for 7 years and was transformed after the war into the first bank of issue in the now independent Polish State. The Polish National Loan Fund established by the Germans as an issuing institution by way of the ordinance of December 9, 1916 establishing the Polnische Landes Darlehnskasse was granted the privilege of issuing a new currency, that is a new monetary unit under the name marka polska. The German authorities were guided by various objectives when creating the new issuing institution—first of all, the aim was to limit the area of circulation of the German mark and to create an instrument that would draw in the occupied area of the Polish territory to finance the war, contrary to the assurances of the occupying authorities that the PKKP would be an institution supporting the economy and banking system of the country—the Kingdom of Poland, whose creation was envisaged after the end of World War I.

    Initiation into discussion over the need of creation of an institution of issuing bank on Polish lands reach the period of the First Republic of Poland. At that time the idea of establishing of this bank appeared, which – in consequence of difficult political situation of the State – did not come into realization. But one should notice plenty of opinions about it, what resulted in lots of plans of establishing the first Polish issuing institution at that time. Conception of issuing bank on Polish lands materialized only in the Kingdom of Poland (excluding issuing institution from Kościuszko’s Uprising period – Dyrekcja Biletów Skarbowych, and from Duchy of Warsaw period – Komisja do Dyrekcji Biletów Kasowych), thanks to work and efforts of Franciszek Ksawery Drucki-Lubecki, who contributed to establishment in 1828 of Bank Polski, which is considered to be the first Polish issuing bank. It increased the full economic bossom of Polish lands in spite of the lack of Polish statehood.
    Początki dyskusji na temat potrzeby powołania banku emisyjnego na ziemiach polskich sięgają okresu I Rzeczypospolitej. Wtedy pojawiła się idea utworzenia tego banku, która – wskutek trudnej sytuacji politycznej państwa – wówczas nie doczekała się realizacji. Należy jednak dostrzec mnogość sądów i opinii na ten temat, czego wynikiem były także składane w tamtym czasie liczne projekty założenia pierwszej polskiej instytucji emisyjnej. Koncepcja banku emisyjnego na ziemiach polskich została urzeczywistniona dopiero w okresie Królestwa Polskiego (nie licząc instytucji emisyjnej z okresu powstania kościuszkowskiego – Dyrekcji Biletów Skarbowych, oraz z czasów Księstwa Warszawskiego – Komisji do Dyrekcji Biletów Kasowych), dzięki pracy i staraniom Franciszka Ksawerego Druckiego-Lubeckiego, który przyczynił się do ustanowienia w 1828 r. Banku Polskiego, uważanego za pierwszy polski bank emisyjny. Przyczynił się on znacząco do rozkwitu gospodarczego ziem polskich pomimo braku istnienia państwowości polskiej.
