    Opis:
    The aim of this paper is to find conditions that assure the existence of the commutant lifting theorem for commuting pairs of contractions (briefly, bicontractions) having (*-)regular dilations. It is known that in such generality, a commutant lifting theorem fails to be true. A positive answer is given for contractive intertwinings which doubly intertwine one of the components. We also show that it is possible to drop the doubly intertwining property for one of the components in some special cases, for instance for semi-subnormal bicontractions. As an application, a result regarding the existence of a unitary (isometric) dilation for three commuting contractions is obtained.

    Opis:
    Celem niniejszego artykułu jest zaprezentowanie analizy dwóch, bardzo ściśle powiązanych ze sobą kategorii, nacjonalizmu ekonomicznego oraz ekonomicznego populizmu. Obie kategorie przenikają się zarówno w realnej polityce, jak i w refleksji akademickiej. Mimo bardzo bogatego dyskursu naukowego na temat obydwu, ich badacze cały czas spierają się nie tylko na temat tego jak je wyjaśniać, ale nawet co do ich zasadniczych treści. Zaproponowana analiza stanowi odpowiedź na ten deficyt i próbuje skupić się na związkach ekonomicznego populizmu i nacjonalizmu. W pierwszej kolejności dokonana została rekonstrukcja podstawowych sposobów rozumienia nacjonalizmu ekonomicznego – jego elementów konstytutywnych, jego historyczności, periodyzacji, jak również podstawowych kategoryzacji. Następna część koncentruje swoją uwagę na populizmie, eksponując jednocześnie jego wymiar ekonomiczny. W części konkludywnej, podobnie jak w całym tekście, autor uwypukla zachodzące relacje pomiędzy nacjonalizmem i populizmem ekonomicznym, ich wzajemnie nachodzące na siebie elementy oraz elementy rozbieżne. Początki populizmu (jako ruchu) były z natury ekonomiczne. Populizm ekonomiczny (jako swego rodzaju “pusta” ideologia) przenika nacjonalizm, kreując wiele z jego współczesnych (re)inkarnacji. Zarówno ekonomiczny populizm, jak i nacjonalizm gospodarczy stają się coraz bardziej istotnymi kategoriami analitycznymi, w związku z rosnącym znaczeniem sił nacjonalistycznych i populistycznych, i z tego powodu wymagają zaawansowanej refleksji naukowej.
    The objective of the paper is to analyse two very closely related categories, economic nationalism and economic populism. They intertwine both in the lived politics on the ground and in intellectual debates. Despite a rich interdisciplinary discourse, scholars interested in economic nationalism and economic populism still disagree not only how to explain them, but more fundamentally – about what they are and what their relation is. This paper answers this deficit by addressing the question of the intertwining connections between economic nationalism and populism. In the first instance it reconstructs the basic definitions of economic nationalism – its constitutive elements, its historicity and periodization as well as its main categorisations. The next section focuses on economic populism, it starts with reconstructing the general definitions of populism and then consequently emphasises its economic dimension. In the conclusive part, as well as in throughout the argumentation of whole text, the author highlights the relations between economic nationalism and populism, their overlapping components and elements that they do not share. The origins of populism (as a movement) were economic in nature. Economic populism (as an empty-hearted ideology) is intertwined with nationalism in many of its contemporary (re)incarnations. Both economic nationalism and populism are increasingly important due to their raising political popularity and they require a closer look and scholarly attention.

    This paper will be devoted to the most acute point of intersection between sector specific regulation and the enforcement of competition law – a parallel scrutiny of the market position and behaviour of EMITEL TP, an incumbent infrastructure holder in the Polish broadcasting transmission field, by the national telecoms regulator and the antitrust authority. After presenting the relevant EU background, the discussion will focus on four basic factors that have influenced the relationship between antitrust and regulation in this case. The peculiarities of national legislation transposing the EU liberalisation package will be considered first, followed by the state of competition in Polish telecoms and the potential existence of prohibited market practices. Emphasis will be placed here on the use of the antitrust concept of relevant market definition in the framework of sector-specific regulation. The analysis will continue with an assessment of the differences between the two types of market intervention noted by the authorities in the context of a potential competence dispute. In conclusion, the need will be presented to shift the current focus placed on the separation of antitrust enforcement and regulation, which has made them both ineffective in achieving their purpose, towards that of their combination in order to facilitate the emergence of competition in the Polish broadcasting transmission services field.
    L’article concerne le point le plus aigu d’intersection entre la réglementation sectorielle et le renforcement de la loi de concurrence – le contrôle parallèle de la position sur le marche et le comportement de EMITEL TP, le propriétaire d’infrastructure dans le domaine de la radiodiffusion en Pologne, par le régulateur national des télécommunications et l’autorité chargée de la politique de concurrence. Après avoir présenté le contexte de l’UE, la discussion se concentrera sur quatre facteurs clés qui ont influencé les relations entre les politiques de concurrence et la réglementation sectorielle dans ce cas-là. Les particularités de la législation nationale transposant le train de mesures de libéralisation de l’EU seront considérées d’abord, suivies par l’état de concurrence dans les télécommunications en Pologne et l’existence potentielle des pratiques du marche interdites. L’emphase sera mise ici sur l’usage de la définition du marché en cause aux fins du droit de la concurrence, dans le cadre de la réglementation sectorielle. Dans la partie suivante, l’analyse sera centrée sur l’évaluation de la différence entre les deux types d’intervention sur le marche notés par les autorités dans le contexte d’ un conflit possible en matière de compétence. Dans la conclusion, le besoin de tourner l’attention mise actuellement sur la séparation du renforcement de la loi de concurrence et la réglementation sectorielle, qui les avait faits inefficaces en atteignant leurs objectifs, vers la combinaison de les deux, afin de faciliter l’émergence de la concurrence dans le domaine des services de radiodiffusion.
