Opis:
The aim of this study is to examine the importance of the decision in Engelhart CTP (US) LLC v Lloyd’s Syndicate 1221 with regard to the insurance of economic losses and non-existent goods in the context of all-risks cover. It also strives to analyse to what extent the principles of construction described in this decision are applicable to the interpretation of all risks cover in marine insurance disputes subject to Polish law. Assureds and beneficiaries of cargo policies are defrauded into taking up false documents for non-existent goods yet Polish law fails to address the questions which arise in such situations. It is thus important not only to investigate and evaluate the answers provided by English law but also to explore if and how Polish law may employ them. It follows from this study that Engelhart may be used in construction of all-risks policies subject to Polish law in most scenarios.
Celem niniejszego opracowania jest zbadanie znaczenia wyroku w sprawie Engelhart CTP (US) LLC v Lloyd’s Syndicate 1221 w odniesieniu do ubezpieczenia szkód ekonomicznych i ładunków nieistniejących w kontekście polis „all risks”. Próbuje ono także przeanalizować w jakim zakresie zasady wykładni przedstawione w tym wyroku można zastosować w interpretacji polis „all risks” w sporach ubezpieczeniowych opartych o prawo polskie. Ubezpieczający i ubezpieczeni w zakresie polis ładunkowych w wyniku oszustw przyjmują fałszywe dokumenty na nieistniejące towary, jednak prawo polskie nie odnosi się do wątpliwości, które wówczas powstają. Jest zatem istotne nie tylko, aby zbadać i ocenić rozwiązania oferowane w tym zakresie przez prawo angielskie, ale także aby wyjaśnić czy i jak prawo polskie może je wykorzystać. Niniejsze opracowanie wskazuje, że wyrok w sprawie Engelhart może w większości przypadków zostać zastosowany przy wykładni polis „all risks” poddanych prawu polskiemu.

The author of this article analyses the way in which dance and the dancer function within the prose works of Milan Kundera. Preceded by an introduction which analyses the figure of homo saltans from a cultural perspective, this review of the topic of dance (understood phenomenologically) presents four literary aspects in which it reveals itself. These perspectives are not conflicting, but neither are they complementary. The first relates to ritual rites of dancing in a circle, and their (crooked) reflection can be seen in the socio-political experience of the 20th century. The second presents dance as a narrative element, which asks questions about its own nature, and therefore has an autotelic and universalising character. The third aspect presents a metaphorical understanding of dance movement, while the fourth relates to philosophies of the dance and the dancer, as proposed by one of the protagonists in Slowness, leading this persona away from aesthetics towards the experience of public life. According to the author of this article, dance is used by Kundera to discover more interesting layers of the human condition, but much here depends on the reader.

Kazimierz Świegocki’s Blues o Wielkim Ptaku from point of view of hermeneutic reading In this article I presented a general assumption of hermeneutics as a theory of literature and a research attitude. I used its various elements in my interpretation of the poem Blues o Wielkim Ptaku of the modern Polish poet, Kazimierz Świegocki. I put the general hypothesis of interpretation and then I verified it by examining the specific elements of the text. I discussed the role of the title and date of creation, the way of speaker’s creation and the lyrical hero, the importance of symbolism and shape of the world presented. I described this poem as referring to issues of cosmogony, ontology, metaphysics and hermeneutics as explaining the order of the universe.

The essay is devoted to Krzysztof Hoffmann book dubitatio o poezji Eugeniusza Tkaczyszyna-Dyckiego [dubitatio on poetry by Eugeniusz Tkaczyszyn-Dycki]. The author discusses the critic’s interpretative strategies, as well as his theoretical and metatheoretical assumptions. The author demonstrates how deconstructionist philosophy influences the modes of reading of poetical languages proposed by the young critic and his critical consciousness shaped by doubt and uncertainty. This distinguishes him from modern scientific strategy (structuralism) that treats interpretation as a way to reach the truth of a work. Hoffmann writes about the difficult, rhetorically sophisticated poetry by Eugeniusz Tkaczyszyn-Dycki, and more specifically, about its early stage before 2005. The story is built around four words: home, friendship, schizophrenia, disbelief. The most important problem, however, is the language of the poetry: its status, problematic referentiality, and difficult link to existence. The author, thus, reads dubitatio as a metaphorical discussion of theory and practice of poetry interpretation in general, and Tkaczyszyn-Dycki’s poetry in particular.

Wykorzystując naturalne umiejętności interpretacji i reinterpretacji mamy możliwość nadawania ”drugiego życia”, zarówno przedmiotom, obiektom jak i zjawiskom. Tworząc je nie zawsze musimy projektować nowe, dotąd nieznane nikomu formy. Definicje, nazwy, funkcje mogą stanowić jedynie punkt wyjściowy, do dalszego procesu tworzenia. Tego rodzaju postepowanie uczy i rozwija – pokorę i wyobraźnię. Artykuł jest próbą odpowiedzi na szereg pytań, związanych z powyższym tokiem myślenia: Czy raz nadana definicja, jest jedyną właściwą ? Czy warto próbować ”patrzeć inaczej” ? Jakie konsekwencje może przynieść tworzenie ”drugiego życia” ? Jaką rolę pełni piękno i jak o nie dbać ? W końcu – gdzie w tym procesie łączy się sztuka z techniką i czy technika może być już, sama w sobie, postrzegana jako sztuka ? Nasze przemyślenia zilustrowane zostały kilkoma przykładami z różnych dziedzin działalności artystycznej. Przegląd prac umożliwi wysnucie odpowiedzi jednak nie jednoznacznych, a pozwalających na indywidualne przemyślenia i wnioski, wobec relacji między sztuką i techniką.
Using the natural skills of interpretation and reinterpretation, we are able to give "the second life" to items, architectural objects and phenomena. When creating it, we do not always have to design new forms that have never been known to anyone. Definitions, names, functions can be only a starting point for the further creation process. This way of thinking teaches and develops – humility and imagination. Our article is an attempt to answer several questions related to the above train of thought: Is the once given definition, the only proper one ? Is it worth trying to ”look at something differently” ? What are the consequences of creating ”the second life” ? What is the role of beauty and how to care for it ? And finally – where art and technology are connecting in this process. Can the technique be perceived as an art itself ? Our thoughts have been illustrated with several examples from various fields of artistic activity. The review of the works will allow to find answers not unequivocal, but the ones giving an opportunity for individual thoughts and conclusions about the relationship between art and technology.

The paper reflects on the specificity of the translation of texts belonging to the religious and theolog- ical literature. Religious and theological texts have been translated for millennia, many of them - originating in the sphere of Judeo-Christianity - lie at the core of Western culture. Their trans- lation, especially the translation of the Bible, was accompanied by theoretical reflection (see, for example, Jerome of Stridonium, Martin Luther or Eugene Nida), which permanently influenced the way of thinking about translation in general. The present study answers the question of how the translation of religious and theological texts differs from the translation of other texts and what the translator must or should take into account, translating religious and theological texts. The paper discusses, among others, the role of the word in Christianity, spiritual preparation, openness to the Holy Spirit, tradition and inculturation.

Celem tego artykułu jest prześledzenie rozwoju interpretacji motywu tajemniczej „gwiazdy z Jakuba”, poczynając od tekstu masoreckiego Lb 24,17, przez starożytne tłumaczenia, aż po egzegezę wczesnych Ojców Kościoła. 
Among the various interpretations of “The Star out of Jacob” (Numbers 24:17), the messianic reading, present in both the Jewish and the Christian traditions, has played an enormous role. The purpose of this study is to review the development of different interpretations of “The Star out of Jacob”, starting from the Masoretic Text of Numbers 24:17, proceeding through the ancient versions, and ending up with the exegesis of the early Church Fathers.

Genesis 49 shows the scene that takes place at the deathbed of the patriarch Jacob. In the face of his upcoming death, Jacob calls on all of his sons that they may listen to and accept his words of valediction. The patriarch addresses each of them individually. This piece of text serves an example of the biblical poetry in which metaphors play an important role. In the Hebrew text there are words and phrases that raise many doubts and questions. Not only contemporary translators and biblical scholars contend with these difficulties, but ancient and medieval commentators did as well. The Aramaic Targums testify to the early Jewish exegesis and interpretation of Gen 49. This article presents the paraphrase and discusses a few selected verses of the Aramaic version of Torah (Tg. Onq., Tg. Neof., Frg. Tg(s)., Tg. Ps.-J.). Based on the above examples, the development of principal Jewish views on eschatology (49:1-2) and of Messianic expectations in context of Jacob’s blessing of the tribe of Judah (49:8-12) is portrayed. The last part of this article comprises the rendering and the meaning of the Targumic animal metaphors based on the examples of Issachar (49:14-15) and of Benjamin (49:27) that significantly differ from the Hebrew text.

Elfriede Jelinek to ważna i znana autorka w Polsce, ikona dla wielu pisarzy i pisarek, które odczytują i interpretują jej twórczość na własnych zasadach, co prowadzi do licznych refrakcji. Niniejszy artykuł jest próbą przyjrzenia się, jak Michał Witkowski (rocznik 1975) odczytuje teksty noblistki i wykorzystuje jej image w swej twórczości literackiej, wywiadach i nowych mediach (portalach społecznościowych itp.). Szczególnie w powieści Zbrodniarz i dziewczyna pisarz poświęca wiele uwagi symbolowi/ikonie Elfriede Jelinek, a nie jej działalności twórczej. Działalność artystyczna i pozaartystyczna Witkowskiego stanowi przykład interesującego trybutu literackiego i rodzaj niedoczytania (misreading).
Elfriede Jelinek is a well-known author in Poland, she is an icon for many polish male and female writers, who read and interpretate her books in their own ways, with many refractions. This paper is a case study about how Michał Witkowski a young polish writer (1975) reads her books and uses her image in his literary works, interviews and new media. Especially in his novel Zbrodniarz i dziewczyna [A criminal and a girl] he is interested in a symbol/icon Elfriede Jelinek, not really in her writings. His work is an interesting literary tribute and an example of misreading.
Elfriede Jelinek fungiert in Polen als eine wichtige und berühmte Autorin, eine Ikone für viele SchriftstellerInnen, die ihre Texte auf eine eigentümliche Art und Weise lesen und interpretieren, was zu vielen Refraktionen führt. Insbesondere Michał Witkowski (Jahrgang 1975) beruft sich auf Jelineks Schaffen und ihr Image, sowohl in seinem literarischen Schaffen, als auch in zahlreichen Interviews und in neuen Medien. Sein Roman Zbrodniarz i dziewczyna [Der Verbrecher und das Mädchen] ist ein Paradebeispiel für seine Strategien: im Mittelpunkt steht das Symbol Elfriede Jelinek und nicht ihr literarisches Schaffen. Witkowskis Herangehensweise ist eine interessante literarische Hommage und eine Art misreading zugleich.

Il papa Benedetto XVI, nella sua allocuzione pronunciata in occasione dell’inaugurazione dell’anno giudiziario del Tribunale Apostolico della Rota Romana il 21 gennaio 2012 al Collegio dei Prelati Uditori, agli officiali, agli avvocati e agli altri collaboratori, ha sviluppato il tema riguardante l’aspetto primario del ministero giudiziale, ovvero l’interpretazione della legge canonica in ordine alla sua applicazione.Il Sommo Pontefice ha fatto ricordare che l’ermeneutica del diritto canonico è strettamente legata alla concezione stessa della legge della Chiesa. In particolare ha rilevato il valore dell’unità nell’interpretazione e nell’applicazione delle leggi che è richiesta dalla giustizia, indicando i mezzi giuridicamente vincolanti che tendono ad asicurare quell’unità. Dopo aver presentato il discorso papale, l’autore fa qualche osservazione sul tema intrapreso dal Benedetto XVI.

The aim of this paper is an attempt to understand the provenance of various contemporary adaptations and interpretations of the poem Locomotive by Julian Tuwim. Selected and discussed examples of literary works based on Tuwim’s Locomotive deviate so much from the original that they are considered not in terms of adaptation or intersemiotic translation, but as inspiration, artistic creation and reinterpretation. One of the reasons for this approach to Tuwim’s legacy is the use of right to quote for artistic purposes guaranteed by Polish copyright law, which makes it possible to refer to someone’s work without an obligation to ask for authors’ or their inheritors’ permission. The article also briefly recalls the history of the poem Locomotive and basic interpretations of its original form.

Opis:
W artykule dokonano przeglądu odwołań do literatury współczesnej w pracach naukowych Mariana Maciejewskiego. Wskazano dwa rodzaje nawiązań. W publikacjach dotyczących romantyzmu zauważono wiele wskazań na kontynuację tej tradycji w literaturze współczesnej, zwłaszcza liryki lozańskiej (m.in. Cz. Miłosz, T. Różewicz, E. Bryll) i gawędy szlacheckiej (M. Wańkowicz, K. Brandys, A. Kijowski, M. Białoszewski i in.). Natomiast w pracach poświęconych zaproponowanej przez Maciejewskiego „interpretacji kerygmatycznej” zwrócono uwagę na większą frekwencję tekstów współczesnych, szczególnie poetyckich. Więcej miejsca poświęcono jedynemu opublikowanemu przez Badacza artykułowi, w całości dotyczącemu literatury XX wieku, tj. Kerygmatycznej interpretacji przesłania Pana Cogito.
In the article a review is done of references to modern literature in academic works by Marian Maciejewski. Two kinds of references are indicated. In publications concerning Romanticism many indications have been noticed to a continuation of this tradition in modern literature, especially of the Lausanne lyric (among others, works by Cz. Miłosz, T. Różewicz, E. Bryll) and of the gentleman's tale (M. Wańkowicz, K. Brandys, A. Kijowski, M. Białoszewski and others). On the other hand, in works devoted to the “kerygmatic interpretation” proposed by Maciejewski the reader's attention is drawn to a greater frequency of modern texts, especially poetical ones. More space is devoted to the only article published by the researcher, that is solely concerned with literature of the 20th century, namely, “Kerygmatic interpretation of Mr Cogito's Message”.

Artykuł jest interpretacją dwóch opowiadań Brunona Schulza Nawiedzenia i Ptaków. Kluczowym kontekstem tego odczytania jest teoria matriarchatu Johanna Jakoba Bachofena. W tekście Schulza patriarchat ustanawiany przez ojca jest systemem wtórnym wobec dominującego w opowiadaniach porządku matriarchalnego utożsamianego przez Adelę. Ojciec jest w tym ujęciu samotnym bohaterem, owładniętym misją nazwaną przez Schulza „metafizyczną”.
The article is the interpretation of two Bruno Schulz’s stories: Visitation and Birds. The key context for this reading is matriarchate theory by Johann Jakob Bachofen. In the Schulz’s text the patriarchate established by the father is a secondary system to the dominating narrative of matriarchal order identified by Adela. The father is a lonely hero in this spin, overpowered by a mission called by Schulz as “metaphysical“.
