Opis:
Operations under the auspices of the Security Council mandate span over 70 years. Repeatedly involved in resolving armed conflicts, they have made a significant contribution to ensuring security and stability around the world. In practice, they have taken the form of operations by individual states, coalitions, other international organizations or simply as United Nations missions composed of contingents provided by Troop Contribution Countries (TCC). While operations under the auspices of the United Nations have been involved on several occasions in offensive activities under Chapter VII of the Charter of the United Nations, and the question of responsibility for these actions has been the subject of many legal analyses and judgments, missions organized by the United Nations are always recognized as neutral, and their activities as conciliatory and focused on monitoring the cessation of hostilities, or supervising the disengagement between the parties of the conflict, with the use of force limited to self-defence. Thus, such operations benefited from legal protection, and any action against them was considered a violation of international law. The current engagement of United Nations goes far beyond the traditional understanding of peacekeeping operations. UN missions are frequently authorized to employ all necessary means, up to and including the use of lethal force or even neutralization of the armed group. This creates a situation where in the light of International Humanitarian Law, such actions can be recognized as involvement in armed conflict. This article is intended to show the problems that the international community will soon face to in using United Nations’ missions as an instrument for resolving armed conflicts and as a tool for restoring peace and providing stability and securityin the area of operations. It presents the processes of decision-making and subordination, which in some circumstances might result in the United Nations missions being deprived of legal protection and, in addition, made liable for non-compliance with the provisions of International Humanitarian Law.

This article is an attempt to identify the essence of new positivism, described by Ludwik Ehrlich as a method of interpretation of international law. The evolution of his views on international law is examined with respect to the place of this method from the beginning of 1920s until his retirement in 1961. The article expounds on both the theoretical and methodological aspects of new positivism, according to which judicial decisions should be taken into account in addition to international treaties and customs for the determination of international law. The question of the obligatory force of international law is discussed as being related to the principle of good faith, which is at the core of Ehrlich’s views on international law. The article offers suggestions on how the method of new positivism might be used and what tasks it can fulfil today. It also makes an attempt to critically analyse Ehrlich’s method and to characterize it both in general and in the context of the theory of international law.

The concept of long-term sustainability of outer space activities is based on rational assumptions regarding outer space as a limited resource, which will inevitably shrink in the long term if States do not take appropriate preventive measures. The arguments for this are all the stronger as it concerns a real threat to the safety of space operations, and what is more, to their continuation in the future. The legal status of outer space determines the responsibility of States for the activities of both governmental and non-governmental entities. The UN COPUOS Guidelines for the Long-term Sustainability of Outer Space Activities strongly remind of this. This is an important element of this document, which should be considered not only in the context of liability for damage caused as a result of space activities, but also in the context of liability for violating the principles adopted in the key treaty of international space law, which is the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies of 27 January 1967. The main purpose of this article is to present the assumptions of the concept and, in their light, to refer to its structural treaty connotations in the field of generally recognized international responsibility of the State for space activities. The study is also intended to show workable solutions adopted in national law that implement the COPUOS Guidelines, as a necessary and inevitable direction of national activity of countries wanting to explore and use outer space safely and responsibly.

The aim of the article is to compare the way in which the issue of responsibility for violations related to the acts of unrecognized authorities claiming to be States is treated by the European Court of Human Rights and other international courts, particularly the International Court of Justice and the International Criminal Tribunal for the former Yugoslavia. The article considers in detail the relations between jurisdiction and responsibility, responsibility of parent States (including the concept of “positive obligations”) and responsibility of States which provide assistance to unrecognized regimes (with emphasis put on the concept of “effective control”). The results of the study indicate that the jurisprudence of the European Court differs in several important aspects from decisions of other international courts. These differences, while undoubtedly enhancing the protection of human rights in Europe, contribute to the process of fragmentation of the law of international responsibility.

This paper examines the growing trend of employing international and human rights law in domestic climate change lawsuits as a strategic tool for legal action. Using a qualitative and comparative analysis of seminal case law, such as Urgenda Foundation v the Netherlands and R (Friends of the Earth and others) v Heathrow Airport Ltd and Held v State, this paper aims to explain the juridical trajectories and methodologies employed in rights-based climate litigation. The primary objective is to critically evaluate the potential regulatory impact of this emergent jurisprudential paradigm on both domestic legislation and international climate change treaties. The study posits that when traditional enforcement mechanisms enshrined in international environmental law treaties prove ineffective, domestic litigation grounded in human rights claims serve as a catalyst for transformative jurisprudence. This, in turn, can exert substantial pressure on state and non-state actors, compelling them to adopt more strict regulatory measures to mitigate the effects of climate change. The aim of this paper is twofold: first, to elucidate the effectiveness and development of rights-based jurisprudence in climate litigation, and second, to assess its potential for influencing the creation of stronger regulatory mechanisms at both state and international levels. The paper argues that when international treaties fail to take adequate climate change action, domestic lawsuits based on human rights claims start to serve as a lever of change, pressuring both state and non-state actors into adopting more ambitious measures. The study underscores the importance of this rights-based approach not merely as a legal strategy but as a multifaceted tool for effectuating systemic regulatory advancements and fostering climate justice.

The results of the analyses presented in this paper allow formulation of the following conclusions: of the key importance seems to be the answer to the question of what happens when a resolution is taken in violation of the provisions of the constitution of an organisation regarding the competence of making laws. It is worth noting that the possibility of bearing responsibility by international organisations for their acts contrary to international law is accepted without reservation. Therefore, the ultra vires acts, if contrary to international law, may be attributed to the organisation, and may subsequently give rise to liability.
Niniejszy artykuł stanowi przegląd wybranych zagadnień analitycznych powiązanych z problematyką nieważności uchwał organizacji międzynarodowych. Kluczowa wydaje się w kontekście prowadzonych rozważań odpowiedź na pytanie, co się dzieje, gdy uchwała zostaje podjęta z naruszeniem postanowień statutu organizacji dotyczących kompetencji do podejmowania aktów prawnych. Warto dodać, że bez zastrzeżeń akceptuje się możliwość ponoszenia odpowiedzialności przez organizacje międzynarodowe za swoje akty sprzeczne z prawem międzynarodowym. W związku z tym także akty ultra vires, jeżeli są sprzeczne z prawem międzynarodowym i można przypisać je organizacji, mogą stanowić podstawę odpowiedzialności.

The Responsibility to Protect (R2P) was created in the hope of overcoming the barrier that state sovereignty, as a principle, had become to actions of humanitarian intervention. It was imagined that as mass atrocity crimes were coming to the attention of the international community, that, on the whole, they were willing, able and eager to intervene in order to stop the violence in question. Holding them back was sovereignty as both a legal and normative barrier. This was always a bad explanation for the pervasive lack of humanitarian intervention; accordingly R2P, as a bad solution, has failed almost entirely. The problem is, and always has been, that when faced with mass atrocity crimes, the international community is plagued by a near-permanent lack of political will to action.

This article assesses the impact of legal rules aimed at preventing genocide. The specific features of the legal obligation to prevent genocide are analyzed in light of the current debate on the “responsibility to protect” and the ICJ’s stance on the issue in Bosnia v Serbia. While the content of positive obligations such as the one under discussion is usually elaborated through the case law of judicial or quasi-judicial bodies, the ICJ refrained from doing so, stating that only manifest breaches of the obligation to prevent genocide give rise to international responsibility. The author seeks an explanation for the reasons underlying such an approach, and tries to identify other ways in which legal standards in the field of genocide prevention could be developed.

In the light of existing international law it is not possible to hold the Minister of Defense of the Russian Federation criminally or civilly responsible before the courts of other countries (except for an action before the Russian courts) or the International Criminal Court. Claiming compensation from the Russian Federation for shooting the Malaysia Airlines aircraft is available before the Russian in compliance with Russian law, or before international courts only through interstate litigation, provided that the parties agree to accept the jurisdiction of the International Court of Justice or international arbitration and that the preconditions of responsibility are fulfilled. Claiming is also possible in the context of diplomatic protection, and – in case of actions by individuals against Russia – only before the European Court of Human Rights, after exhaustion of domestic legal remedies and demonstrating that Russia has committed a violation of the rights protected by the European Convention of Human Rights of 1950.

Responsibility in international law is more and more difficult to enforce due to complicated procedures and the multiplicity of various factors affecting the occurrence of a given event. There is no doubt that the stability of the MTS jurisprudence line helps to clearly distinguish what is subject to and what will not be an international tort. In view of the unstable situation on the international arena, and more often than before to incidents that constitute the premise of state responsibility, the more in the context of acquisitive prescription, the author decided to analyze this important issue. Discussed will be the premises of the existence of the tort together with the factors that set the state’s responsibility for their appearance.
