The aim of the article is to draw attention to the direct nature of the legal interest and to try to answer the question about the sources (grounds) of this interest. The analysis is carried out from the perspective of understanding individual interest in administrative law and focuses on the issues of qualifying legal interest, including law from the perspective of the nature of the relationship between individual interest and its normative basis, and from the perspective of the normative foundations forprotecting this interest. It also refers to the issue of the axiological determinants of directness legal interest in administrative law. The analysis here justifies the conclusion that the source of legal interest in administrative law comprises substantive norms belonging to the entire system of generally applicable law, which objectify the individual interest, and only the close relationship between individual interest and the legal norm which is the source of this interest allows such interest to be defined as a legal interest. The lack of a close relationship between the individual interest and the legal norm, which is considered as the source of this interest, allows such an interest to defined, from the perspective of administrative law, only as a factual interest. The close bond that must exist between an individual interest and the legal norm on which it is based in order for such an interest to be classified as a legal interest is expressed by the characteristic defined as the directness of the legal interest. The article also presents arguments to justify the thesis that the mere need to protect a legal interest, or even real protection provided to a legal interest in the area of civil law, does not constitute a source of legal interest in the area of administrative law. Just as the source of the legal interest should be sought in the norms of generally applicable law, the legislator decides on the protection and the degree of protection for this interest by establishing appropriate separate legal norms in this respect.

This paper does not aspire to offer an overall presentation of Prof. Jan Boć’s contribution to the concept of interest, but is intended to point out several views of this author on the design of legal interest in administrative law, including an attempt to assess their validity.Some of these views now require revising, others give them a fresh look. Professor Jan Boć commented on the relationship between public law and private law, made successful attempts to define the relationship. In the area of Professor Jan Boc’s academic interests, there has always been the individual, and therefore the Professor devoted considerable space in his work to the construction of legal interest of the individual, which went beyond the traditional definition describing the conceptof public interest.

The current phase of low interest rates poses major challenges for banks. A continuous decline in the interest result, which is so important for the profitability of banks, has been observed for years, as it is becoming increasingly difficult for banks to generate sufficient income from the interest margin. This is partly due to the European Central Bank’s expansive monetary policy. However, other factors, such as advancing digitization, also play a role here. The structure of the German banking market and the mostly strong focus of German banks on interest-bearing business are also increasingly becoming a problem. Still, the question arises, whether the current phase of low interest rates is actually a serious threat to banks or whether they are complaining at a high level.

Nowadays public interest clause is taken as indissolubly connected with public administration and its activity. Among other things it is used to describe, to qualify and define what is public administration itself and in what kind of matters its essence consist in. Public interest is a fundamental, pivotal notion in administrative law, but still – in spite of attempts undertaken even by the legislator to define this notion – it is not understood univocally. Public interest clause is a normative structure, it is a reference general clause. The most generally speaking, it is a directive applied to public administration organs, which should accomplish their tasks in the public interest. Public interest clause is reckoned among fundamental clauses for administrative law (meta-clauses), but it does not mean an ackowledgement of absolute primacy for public interest in public administration activity. One should remember about adequate weigh of public interest and interest of citizen (particularistic interest, interest of individual, individual interest), because there are specified, fundamental human rights and even there is an opinion that the notion of public interest acquires importance and gathers full of its content only if it is set together with the right/interest of individual.
Klauzula interesu publicznego jest współcześnie traktowana jako nierozerwalnie związana z administracją publiczną i jej działaniami. Wykorzystuje się ją między innymi podczas prób określenia, czym jest sama administracja publiczna i na czym polega jej istota. Interes publiczny jest pojęciem kluczowym na gruncie prawa administracyjnego, lecz nadal – mimo podejmowanych nawet przez ustawodawcę prób zdefiniowania tego pojęcia – nie jest ono rozumiane jednoznacznie. Klauzula interesu publicznego jest konstrukcją normatywną, o charakterze generalnej klauzuli odsyłającej. Najogólniej rzecz ujmując, jest ona dyrektywą kierowaną do organów administracji publicznej, które swoje zadania powinny wykonywać w interesie publicznym. Klauzula interesu publicznego jest zaliczana do klauzul zasadniczych dla prawa administracyjnego (meta-klauzul), co nie oznacza przyznania absolutnego prymatu interesowi publicznemu w działaniach administracji publicznej. Należy pamiętać o odpowiednim ważeniu interesu publicznego interesem obywatela (interesem jednostki, interesem indywidualnym), istnieją bowiem określone, zasadnicze prawa człowieka, a nawet można spotkać poglądy, iż pojęcie interesu publicznego nabiera pełnej treści dopiero wtedy, gdy zostanie on zestawiony z prawem poszczególnej jednostki.

Aim. The study intends to determine the influence of socio-economic status on academic interest of secondary school students in Meghalaya. The study was conducted in two districts of Meghalaya i.e., in East Jaintia Hills and West Jaintia Hills Districts. Method. The researcher used sequential explanatory design for collecting the necessary information. The procedure of data collection was that the researcher constructed a semi-structured interview schedule whereby it was validated by the experts in the field of education. In order to determine the influence of socio-economic status on academic interest of secondary school students, the researcher conducted an in-depth interview on 50 secondary school students who were studying in class X. These students were selected purposively from two districts of Meghalaya. The interview was conducted at school premises and the necessary information collected from students was recorded and transcribed to obtain the results. Results. Based on the interview conducted, the study found that socio-economic status did not influence the academic interest of the secondary school students; however, student’s high aspirations, their interest in various subjects, their ambitions, determination and will power to work hard in their studies influence their academic interest. Conclusion. Socio-economic status was not found to have influences on the academic interest of the secondary school students and on the whole the present study suggested for teachers and parents to work cooperatively in order to help students realize their goals and desires.

Until recently, negative nominal interest rates of the central bank were in the sphere of theoretical considerations. In 2009, the Swedish Central Bank was the first to implement a negative interest rate policy (NIRP). Since then, the NIRP has been implemented by the National Bank of Denmark, the European Central Bank, the Swiss National Bank and the National Bank of Japan. Unfortunately, due to the large number of simultaneous factors affecting the economy, it is extremely difficult to determine the long-term effects of NIRP implementation. Furthermore, the magnitude of the impact and the global extent of the coronavirus pandemic would have a significant impact on the dilatation, so the focus was on pre-pandemic issues. This paper is a literature review and it aims to synthetize information about the impact of negative interest rates on the market – in financial and real spheres. In this paper, both the results of scientific research and the opinions of experts were used, then the impact of negative nominal interest rates on the financial and real sectors was assessed. The results show that most authors highlight an adverse impact of negative interest rates on the stability of the banking sector regardless of the country. The greatest fear of the NIRP implementation by central banks is that the potential behavior of economic entities cannot be predicted with certainty, especially when it comes to cash deposit withdrawals from banks.

Artykuł dotyczy rzeczywistej rocznej stopy oprocentowania (RRSO) – wskaźnika, którego wyliczanie i publikację przez instytucje kredytowe narzuciły dyrektywy unijne oraz ustawa o kredycie konsumenckim. Celem badań jest wykazanie, że przyjęta w języku polskim nazwa tej miary jest nieprawidłowa oraz wyjaśnienie, że nie informuje ona o rzeczywistym koszcie ponoszonym przez pożyczkobiorcę. Wynika to z faktu, że matematyczna formuła wykorzystywana do jej obliczania bazuje nie na nominalnej, a na efektywnej stopie procentowej, tj. stopie uwzględniającej kapitalizację odsetek, która w umowach kredytowych nie występuje. W ten sposób RRSO zniekształca (zawyża lub zaniża) faktyczny koszt kredytu i powinna być nazywana efektywnym rocznym kosztem kredytu (ERKK) lub efektywnym rocznym kosztem długu (ERKD), a ustawowa definicja jednoznacznie wskazywać, że RRSO jest stopą efektywną i nie odzwierciedla prawdziwego kosztu kredytu ponoszonego przez konsumenta. W artykule wykazano również, że lepszym rozwiązaniem (choć nie idealnym) dla określenia prawdziwego kosztu, jaki ponosi kredytobiorca, byłoby zastąpienie obecnej formuły obliczania RRSO (dającej w wyniku stopę efektywną uwzględniającą kapitalizację odsetek) dobrze znaną w finansach formułą 86 Magdalena Redo, Piotr Prewysz-Kwinto nominalnej wewnętrznej stopy zwrotu – IRR (ang. Internal Rate of Return), podobnie jak ma to miejsce od ponad pół wieku w USA.
The article examines the problem of the “rzeczywista roczna stopa oprocentowania – RRSO” (i.e., the annual percentage rate of change, APRC) indicator, the calculation and publication of which was imposed on credit institutions by EU directives and the Polish Act on Consumer Credit.The purpose of the research is to prove that the name of this measure adopted in Polish is incorrect and to explain that it does not inform about the actual cost incurred by the borrower. This is due to the fact that the mathematical formula used to calculate it is not based on the nominal but on the effective interest rate, i.e., the rate taking into account the capitalization of interest, which is not applicable in loan agreements. In this way, the RRSO distorts (overestimates or underestimates) the actual cost of the loan and should be called the effective annual cost of loan (efektywny roczny koszt kredytu – ERKK) or the effective annual cost of debt (efektywny roczny koszt długu – ERKD), and the statutory definition should clearly indicate that the RRSO is the effective rate and does not reflect the true cost of the loan paid by the consumer. The article also shows that a better solution (though not ideal) for determining the true cost of loan would be to replace the current formula for calculating the APRC (resulting in the effective rate taking into account the compound interest) with the well-known formula for the nominal internal rate of return (IRR) – used for more than half a century in the US.

In this article the issue of sectoral interest groups in contemporary Poland is examined. Public restructuring programmes significantly contributed to development of tripartite sectoral social dialogue. Evolution of that type of social dialogue provides a dramatic illustration of how the mechanisms of group interests conflict shaped the course of industrial restructuring. Experiences accumulated over the years of conducting sectoral social dialogue may now serve as a benchmark for regional modernization initiatives.

The article addresses the theoretical issues of the protection of the state interests in the Ukrainian law. The protection of the state interests, being an objective necessity from the perspective of the development of the state and the civil society, requires legal measures to be applied by the state. The core aspect in the analysis of the process of the protection of the state interests by such measures is the theoretical understanding of the state interests concept, including their definition and the requisite qualifications. Based on the approaches of the domestic as well as of the international law on human rights the state interests are proposed to be viewed as objective interests, public in nature, comprising the underlying general social needs, acknowledged by the state. The state interest include, further, the appropriate legal means by which such interests are capable of being protected. Such measures should be relevant to the respective state interests as well as to the specific social relationships in which such measures are to be applied.
