Opis:: In this paper I thoroughly discuss the possibility of committing crimes which would fall under the Rome Statute, with regards to the very notion of cybersecurity. I conclude that we need extensively empirical research and solution to many aspects pointed out in my paper. First, we need to find an acceptable definition of cybersecurity to work with this process, and in order to understand the world and possibilities it creates for us. Furthermore, the 1998 Rome Statute needs an update, because the world of the internet creates opportunities never seen before, and the international case law is unable to cope with such distinct acts. Therefore, I believe that we need to find the next „Nuremberg Trials”, the next generational solution to a world and crimes never seen before. We need the theoretical and legal revolution which did come after the World World II, and after the ICTY, ICTR and Sierra Leone ad hoc Courts. I truly hope that this short and hence mashup summarizing paper is just an indicator of papers and conferences to come, with solutions and more and more ideas on how we solve these two phased problems, namely having to find 1. An ultimate definition for cybersecurity 2. Having a solution of how to interpret it to the classical notion of International Criminal Law. if we conclude that we are unable to handle this issue, I suggest to create a panel on international or V4 level on either the reorganization of customary international criminal law under the Rome Statute or on the ever-changing definition of cybersecurity.

Opis:: This paper on Socio-Cultural Values and Children’s Rights in Calabar analyses the history and value system associated with child upbringing in the city of Calabar. Communalism, which ensured child socialisation from birth, was a common practice in Calabar like in other areas of Africa and Nigeria until European incursion and eventual introduction of capitalism during colonial times. This change resulted in the diminishing of communal lifestyle and reduction of family sizes to nuclear forms. It also necessitated the population increase and related social problems. Although historical in content and analysis, the paper adopted the multidisciplinary approach of reconstruction with data gleaned from primary and secondary sources. Findings showed that right from pre-colonial times, inhuman practices that abused children’s rights like child pawning and killing of twins characterised this study area. Population increase and the rise of urban poor and slums resulted in the breeding of abused children, with most homeless on the streets of Calabar. Witchcraft labelling and child trafficking were also highlighted as other significant and recurring causes of child abuse in Calabar. This paper concluded by reiterating that as Calabar flouts its status as a ‘restful city’, children must not be denied of this ‘restful’ lifestyle. Child rights must be implementable and child right violators prosecuted.

Opis:: This article elaborates on the non-refoulement principle regarding deportation procedure, security, and entry to the country (Turkey) under the 2014 Temporary Protection Regulation, and the 2013 Law on Foreigners and International Protection. According to the document presented by the United Nations Human Rights Office of the High Commissioner “(…) the principle of non-refoulement guarantees that no one should be returned to a country where they would face torture, cruel, inhuman, or degrading treatment or punishment and other irreparable harm. This principle applies to all migrants at all times, irrespective of migration status”.1 The rights of refugees and asylum seekers in mass influx situations are recognized by UNHCR Executive Committee resolutions and general international law.2 Thus, it is necessary to analyze the non-refoulement rule as inseparable part of globally accepted principles: the right to life and the freedom from torture and inhuman or degrading treatment or punishment. The article describes the development and violations of the said rule, focusing on the pertinent current Turkish legislation.

Opis:: In the opinion of Jan Wawrzyniak, the attitude of humans towards other non-human persons is characterised by ethological falsehood. In relations with other creatures humans show species-oriented chauvinism. On the basis of a survey study concerning the colloquial understanding of the symptoms of “inhuman”, “bestial” or “animalistic” behaviour we may describe the functioning of these notions among average users of the Polish language. The paper aims at presenting the results of the survey concerning the colloquial functioning of the notions: inhuman, bestial and animalistic. Fifty people, students of the first-degree university course in Philology took part in the research, with the use of the because-test and free association method.
По мнению Яна Вавжиняка, отношение человека к другим личностям, не являющимся людьми (non-human persons) характеризуется этологической ложью. В отношениях к личностям, не являющимся людьми, человек проявляет видовой шовинизм (species chauvinism). На основании опроса, касающегося способов разговорного понимания «бесчеловечного», «скотского», «звероподобного» поведения, можно описать функционирование этих понятий среди среднестатистических пользователей польского языка. В статье представлены результаты этих исследований. В опросе участвовали 50 человек, студентов и студенток бакалавриата по специальности филология. Исследования были проведены с использованием теста на причинно-следственные связи (because-test) и свободных ассоциаций.

Opis:: The article focuses on the case of Gäfgen v. Germany, which con-cerns the restrictions imposed on police offi cers who work on cases involving terror and violence posing a risk to human life, and on the ones who have to make decisions protecting victims’ lives. The choice of measures serving the protection of the highest value, i.e. human life, is not easy. At the same time, police offi cers are assessed in terms of criminal law as regards the protection of the basic human rights enjoyed by perpetrators who pose a risk to other people’s lives. The case of Gäfgen v. Germany regards the choice of values, and the criminal liability of police offi cers, connected with thereof, as well as the problem of the admissibility of evidence obtained in breach of the law in criminal proceedings, and the limitations of the fruit of the poisonous tree doctrine.

Opis:: The article investigates the relationship between human beings and technology, as depicted in modern Silesian street art iconography. The author presents the esoteric worldview of the famous Janowska group of painters, based on RoseCross anthroposophy, as well as the group’s connection with the contemporary Silesian street art scene represented by the artists Raspazjan and Mona Tusz. The matter of biotechnological interaction as the narration of modern Silesian street art is raised in the light of Rudolf Steiner’s anthroposophical reflection on technology and its resemblance to the modern neomaterialist standpoint. Finally, a selection of murals is analyzed, as the examples of an embodied, local, materialdiscursive practice, exploring the dualism of the biotechnological world.
Artykuł poświęcony jest zagadnieniu ikonografii współczesnego śląskiego street artu w kontekście relacji człowiek – technologia. Autor, odwołując się do światopoglądu ezoterycznego ruchu Różo – Krzyża, wskazuje na jego wpływ na twórczość współczesnych śląskich artystów miejskich, Raspazjana oraz Mony Tusz, z uwzględnieniem pośrednictwa malarzy Grupy Janowskiej. Podniesiona zostaje kwestia relacji pomiędzy światem natury a technologii w kontekście antropozoficznych poglądów Rudolfa Steinera oraz współczesnej filozofii nowego materializmu. Autor poddaje analizie wybór murali, wskazując na ich funkcję jako rodzaju praktyk materialno – dyskursywnych, które nakierowane są na eksplorację dualizmów bio-technologicznego świata.

Opis:: Despite the universal condemnation of torture, the prevention of appalling practices of ill-treatment has not been achieved in the 21st century. The repugnant practice persists and even increases because of the disingenuous interpretations of the definition of torture and the lack of effective enforcement mechanisms. Notwithstanding the cogency of the absolute and non-derogable prohibition of torture, particularly regarding the treatment of detainees, nowadays corporal punishment as a punitive measure is arguably a recurring phenomenon in several former British colonies and in States where the legal system is based on Islamic Sharia. While several legally binding universal and regional instruments prohibit torture in general terms, with no specific definition, the scope of the Convention against Torture’s definition was narrowed down by the lawful sanctions clause. The universality of the definition has been undermined by the inclusion of this clause, since different States have different practices when it comes to lawful and unlawful sanctions. The intractable problem of the interpretation of the definition by the State-Parties and the lack of effective control mechanisms has perennially posed the greatest challenge with respect to compliance with International Human Rights Law. In light of the above, this article seeks to critically dissect the lawful sanctions clause within the context of corporal punishment.

Opis:: Zagadnienia związane z ochroną przed torturami lub innym nieludzkim czy poniżającym traktowaniem uregulowane są w systemie europejskim nie tylko w Europejskiej Konwencji Praw Człowieka, ale również w Europejskiej Konwencji Przeciw Torturom, którą Komitet Ministrów Rady Europy przyjął 26 czerwca 1987 r., ratyfikowanej obecnie przez wszystkie 47 państw Rady Europy. Jest ona ważnym uzupełnieniem przede wszystkim w zakresie mechanizmu kontroli. Uznano, że system ochrony oparty na skargach indywidualnych i skargach między państwami należy wzmocnić środkami o charakterze prewencyjnym. Wiele sytuacji, w których na państwie ciążą poważne obowiązki, aby nie doszło do naruszenia art. 3 Konwencji, ma miejsce w związku z postępowaniem karnym prowadzonym przez organy uprawnione do realizowania zasady legalizmu. W tym miejscu podnieść niestety należy, iż pomimo ratyfikowania przez nasz kraj powyżej wskazanych aktów prawnych, właśnie w trakcie prowadzonych postępowań przygotowawczych w sprawach karnych najczęściej dochodzi do naruszeń praw człowieka w kontekście nakazu godnego i humanitarnego traktowania osób podejrzanych, czy już oskarżonych. Państwo musi zapewnić, aby postępowania te odbywały się w warunkach wskazujących na poszanowanie ludzkiej godności, a procedury i metody pozyskiwania dowodów obciążających podejrzanych nie powodowały u świadków czy też podejrzanych udręki lub cierpienia, których skala i intensywność przekraczałyby potrzeby procesowe osobistego zabezpieczenia osoby podejrzanego dla celów postępowania karnego, przy zachowaniu wymogów procedury karnej dotyczącej zatrzymania oraz stosowania środka zapobiegawczego w postaci tymczasowego aresztowania.
Issues connected with protection against tortures or other forms of inhuman or degrading treatment are regulated in the European law not only in The Convention for the Protection of Human Rights and Fundamental Freedoms, but also in The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which was adopted by The Committee of Ministers of the Council of Europe on June 26, 1987 and later ratified by all 47 countries of The Council of Europe. It is a key element in amending the control system. It has been agreed that the system based on individual and international pleas should be supported by preventive measures. Various situations in which the state has serious obligations so as to protect art. 3 of the Convention, take place following criminal proceedings by organs entitled to act according to legislation. It ought to be mentioned that despite our country’s ratification of the above mentioned legal acts, while conducting pre-trial proceedings in criminal cases, the violation of basic human rights and inhumane treatment of the suspects or the accused happen the most often. The state is responsible for securing proper conditions that would grant respect for one’s dignity and the procedures and methods of obtaining incriminating evidence are not to cause suffering whose scale and intensity would surpass needs of personal security of the accused or suspects during the proceedings in criminal trials, with respect to the legal procedures regulating the arrest and the use of preventative measures in form of a detention order.

Opis:: The article provides an analysis of the legal aspects of expulsion of an alien suffering from a serious physical or mental illness to a country where treatment options for this illness are less accessible than those available in the country of residence (particularly in the case of HIV/AIDS, HCV, various forms of cancer, etc.). The article indicates the legal basis under European law (especially Article 3 of the European Convention on Human Rights on the prohibition of inhuman treatment), and the case law of the European Court of Human Rights relating to this issue. The author emphasizes that the ECHR has adopted a very restrictive approach concerning the expulsion of seriously ill non-nationals, and the national courts of States parties to the ECHR must ensure protection against expulsion to foreigners.
