The article is devoted to the presentation of metaphysical ideas about the free will of the individual, hidden in political ideologies, through conceptual analysis and the thesaurus of analytical philosophy. In this paper, we analyze the extent to which the metaphysical postulates of the most famous ideological projects of modernism (communism, Nazism and liberalism) are compatible with modern theories of freedom in analytical metaphysics, and show their poor compatibility. At the same time, we have proposed an alternative to modern ideologies in the form of republicanism, which does not seem to have unsolvable metaphysical problems in its own definition of freedom. In this article we have demonstrated that the fundamental metaphysics of individual freedom is a legitimate criterion for assessing the relevance, validity and relevance of political ideologies, as it is not an abstract detached theorizing, but the founder of our ideas about the constitution of normative in terms of personal responsibility.

This article deals with the question of the incompatibility of a sold object with the contract. Before the act of consumer’s rights of 30 May 2014 entered into force, the term in use had been warranty and responsibility on the basis of incompatibility of the consumption item. At present, the regime of responsibility has been unified. One of the main changes included in the act of consumer’s rights is indeed the new form of the hitherto used definition of a physical defect. In the present law state, the priority is given to contractual arrangements, which were made by the parties while concluding the contract. In case no as such agreements are drawn, one should be guided by the objective occurrence included in Art. 5561 §1 c.c., which enables to state if a physical defect of the sold object has occurred. In comparison with the former legal statement of Art. 5561 c.c., the amendment is far more expanded and brings out a plethora of doubts con cerning its interpretation. This article discusses particular subsections and paragraphs of Art. 5561 c.c. simultaneously including research on realistic possibilities of using the laws mentioned above. An attempt to assess the changes has been made. Doubts arise with reference to Art. 5561 §2 c.c. and 5561 §3 c.c., where one is not able to state clearly the accuracy of solutions implemented from the directive 1999/44/WE of the European Parliament and the Committee of 25 May 1999 in terms of certain aspects of consumption items of trade and connected with these, warranties of 25 May 1999 on the basis of Polish law.

Opis:
Many species of Cuphea genus show promise as rich natural sources of valuable seed oils for commercial utility. Among them are C. lanceolata and C. viscosissima which seed oils contain medium-chain fatty acids. Reciprocal crosses were made between these species to assess their usefulness for Cuphea breeding program. The degree of crossability between C. lanceolata and C. viscosissima was determined by pollen grain germination and pollen tube growth observed using fluorescence microscopy in addition to capsule formation and seed number per capsule. Treatment of the pollen grain with a laser microbeam reduced the number of germinated pollen grains, tubes growth in the pistil and seed set when C. viscosissima plants were used in the crosses as a female form. In the cross C. lanceolata (female form) × C. viscosissima the pollen treatment with a laser microbeam improved pollen tube growth but reduced seed set. Crossability evaluated on the basis of pollen tube growth and seed set showed unilateral interspecific incompatibility in crosses involving C. lanceolata plants as a female form.

Opis:
A danger of conflict of interests in case of election to a legislative or an executive body of an auxiliary unit exists both with regard to executive positions and all local self-government employees (including councillors). A prohibition of standing for a position in the legislative (or executive) body of the auxiliary unit by a local self-government officer is not admissible, because regulating human rights may be exclusively regulated by statutes. Introducing statutory provisions concerning a formal incompatibility may prevent such conflict of interests. Such problem (conflict of interests) does not exist in case when the local government officer resides and works in different communes.

Opis:
Making a complex analysis of the problem in order to identify the root of its occurrence, is the process burdened with the risk of uncertainty. This risk is in case of the quality analysis, in which the choice and making a decision is not confirmed by reliable information (number). But these techniques do not include the risk of uncertainty, so their sequence should be expanded about the appropriate method, to take this into account. It was considered beneficial to demonstrate that this method is the Fuzzy Analytic Hierarchy Process method (FAHP). The aim of the study to implement the FAHP method in the sequence of traditional quality management techniques (Ishikawa diagram and 5Why method) and proposition new, not practiced yet the method to complex analysis of the problem and identify the root of its root cause. The subject of the study was the furniture front, on which the incompatibility was identified (shortened foil). From the categories to which the potential causes of the inadequate foil were assigned, by using the Ishikawa diagram and the FAHP method in an integrated manner, were defined the most important categories (method and machine) in a precise (numerical) way. Next, using the same tools, the relationship between the potential causes was analysed and selected the main causes of the problem. Then, by using the 5Why method the root of the problem was defined (lack of the new machine and failure to comply with labor standards). The obtained results could differ depending on the subjectivity, however, the method itself proved to be effective and can be used to solve other types of the problem.

Opis:
Effective quality management of the product is an element that allows profit within the enterprise. Identifying unconformity and establishing their source enables quality. However, identifying unconformity is sometimes neglected. Such was evident in the analysis of the service-manufacturing enterprise located in Podkarpacie. In the enterprise, quality was assessed via non-destructive testing (via fluorescence), but decisions on sources of non-compliance were made without utilizing additional methods that allow source identification. Hence, the way of recognizing unconformity was not precise. Therefore, method sequence (Ishikawa diagram and 5Why method) approaches were proposed to enable this. The aim of this paper is to show the effectiveness of such approaches in identifying sources of unconformity. The subject of study was tubing that is used in aircraft engines. Via the applied analysis, the unconformity in production and the source cause was traced to material supplied from outside. The proposed method sequence approach can be used in other enterprises for quality analyses purposes.

Opis:
Meeting customers’ requirements and achieved the right level of product quality is key action of enterprises. It is being done by controlling the product, using for example non-destructive testing (NDT). But the NDT not indicating what is the root of incompatibility. Additionally, previous research does not include the decision methods, which would be related the identify the causes of the problem as part of improving the product quality. Therefore, the aim is supporting the process of improving the product quality level in the context of precisely identify the incompatibility and the root of their occurrence with including the solve decision problem. In this aim, it was assumed that using after the NDT research in connection way: brainstorming, cause and effect diagram, AHP method (Fuzzy Analytic Hierarchy Process) and the 5Why method, will be allowed on effective identify the root of the problem. The method test was carried out for the porosity on a welded mechanical seal made of steel 410, which was identified by the fluorescence method (FPI) in Podkarpacie enterprise. The analysis has shown the effectiveness of using after NDT the combined methods as part of identifying the incompatibility and precisely identifying the root of its occurrence in context of solving the decision problem. The proposed method can be used to improving the quality of other products, for example from the aviation and automotive industry, as part of meeting customer requirements. Originality is the combined NDT research with quality management techniques and supported the process of improving the quality level of the product by implementing in this sequence the fuzzy multicriteria decision method.

Purpose: The aim of the work was to propose the integrated decision method with quality techniques to precision identify the root of the problem. Design/methodology/approach: The proposed method was integrated methods as the Ishikawa diagram, 5Why method and AHP method. An idea of the proposed method was improving the process of identifying the problem by using a new mixed-method, ie. after Ishikawa diagram the methods 5Why and AHP. Findings: It was demonstrated, that it is purposeful using the proposed mixed method (ie. qualitative and quantitative) to expand the horizon of identifying the root cause. Research limitations/implications: The limitation is the subjectivism of the entity using the method, which is revealed during assessing the causes of a problem. Therefore, future works will be based on the minimalization of subjectivism by using the fuzzy Saaty scale. Practical implications: The proposed method is a new approach to analyse different types of problems and support the process of solve decision problems. Therefore, this method can be practice in service and production enterprises to identify the root of product incompatibility. Social implications: Using the method allows improving the process of making the decision about causes of the problem, and limits the possibility of wrong decision about the source of the problem. Originality/value: The proposed method was used a new proposal of mixed-method, ie. it was used integrated the Ishikawa diagram, 5Why method and AHP method. The presented method is some kind of a new approach to identify the root of the problem.

Purpose: The effectiveness of the NDT tests is to identify the incompatibility of the products without their destruction, but NDT tests do not point out the root of incompatibility. The aim of the study was to identify the incompatibility in the product (the mechanical sealer) using the fluorescent method (FPI) and to identify the root of this incompatibility using quality management techniques (5W2H method, Ishikawa diagram, 5Why method). Design/methodology/approach: To identify the root of incompatibility in the product the quality management techniques were used, i. e. 5W2H method, Ishikawa diagram and 5Why method. The subject (the mechanical sealer) on which being incompatibility (porosity cluster) was identified, was made from 410 steel. The problem in which the porosity cluster was identified after the fluorescent method (FPI). Findings: It has been shown that integrating NDT with the selected quality management techniques is an effective way to identify the problem and the root of its creation. Practical implications: This approach can be used in enterprises to analyze different types of products and incompatibilities. Originality/value: It was proposed to integrate the NDT tests with the selected quality management techniques. This integration allows identify the root of the problem and achieving the needed quality of the product.

Opis:
The influence of potentially erroneous, incomplete or inaccessible aeronautical data and information on the occurrence of an accident or serious incident in air traffic and transport is enormous. Those data and information quality has a direct impact on flight operations’ safety. Moreover, much of the information provided, is the basis for planning and safe conduct of the flight and is used to achieve safety, regularity and efficiency of Air Traffic Management, so they must always be up to date and ready to use. In this paper the aeronautical data chain, described in one of the Eurocontrol specifications, was analysed. Then a proceeding diagram, compliant with holding true requirements, was elaborated, pointing out its weaknesses in terms of diagnosis of potential non-compliance that may occur during data request, origination, evaluation, preparation, distribution as well as its end use. In order to facilitate the detection of potential errors, diagnostics of potential incompatibilities’ effects and causes the risk analysis using FMEA method was conducted, giving as an output a rating of non-compliance importance based on the risk priority number (RPN).
Wpływ przyczynowy potencjalnie błędnych, niekompletnych lub niedostępnych danych i informacji lotniczych na wystąpienie wypadku lub poważnego incydentu w ruchu lotniczym jest ogromny. Jakość tych danych i informacji ma bezpośrednie znaczenie dla zapewnienia bezpieczeństwa wykonywania operacji lotniczych. Ponadto większość dostarczanych informacji stanowi bazę do planowania i bezpiecznego wykonania lotu, jak również jest wykorzystywana do zapewnienia bezpieczeństwa, regularności oraz efektywności zarządzania ruchem lotniczym (ATM), stąd też informacje te muszą zawsze być poprawne, aktualne i gotowe do użycia. W niniejszej publikacji przeanalizowano łańcuch danych lotniczych, przedstawiony w jednej ze specyfikacji Eurocontrol. Następnie opracowano schemat postępowania, zgodny z obowiązującymi wymaganiami, wskazując jego niedoskonałości w aspekcie diagnostyki potencjalnych niezgodności, które mogą wystąpić podczas zamówienia, tworzenia, ewaluacji, przygotowania, publikacji czy też końcowego wykorzystania danych i informacji lotniczych. Aby ułatwić wykrycie ewentualnych błędów oraz diagnostykę skutków i przyczyn potencjalnych niegodności, przeprowadzono analizę ryzyka z wykorzystaniem metody FMEA, uzyskując jako efekt zestawienie wag niezgodności w oparciu o liczbę priorytetu ryzyka (RPN).

SummaryIn 2011 a heated debate flared up on a controversial issue in the doctrine of Polish commercial law: which of the two kinds of proceedings prescribed by the Polish Commercial Companies Code (k.s.h.) was applicable for action to have a company’s resolution declared invalid on grounds of its incompatibility with a non-mandatory provision? It was triggered when Michał Romanowski put a provocative question in the specialist commercial law periodical Przegląd Prawa Handlowego – was a resolution a company’s shareholders adopted which was incompatible with a non-mandatory provision in breach of the law? Romanowski’s article evoked a large amount of criticism. This paper consists of two parts. The first part is descriptive and gives an account of the debate in 2011-2012 and the opinions of its main contributors. In the second part I examine the arguments put forward and present my own opinion on the matter.
StreszczenieW 2011 r. w doktrynie prawa handlowego rozgorzała żywiołowa dyskusja w przedmiocie tego, jakie powództwo z dwóch rodzajów środków zaskarżenia przewidzianych w k.s.h. powinno służyć zakwestionowaniu uchwały sprzecznej z normą dyspozytywną. Zapoczątkowana ona została postawieniem przez Michała Romanowskiego na łamach «Przeglądu Prawa Handlowego» prowokacyjnego pytania, czy uchwała organu właścicielskiego spółki sprzeczna z normą dyspozytywną jest sprzeczna z prawem. Artykuł ten spotkał się z licznymi głosami krytycznymi w doktrynie. Niniejszy artykuł składa się z dwóch części. W pierwszej, „sprawozdawczej” czy też „deskryptywnej” przedstawiony zostaje przebieg zaistniałej w latach 2011-2012 dyskusji i najważniejsze wypowiedzi jej uczestników. W drugiej natomiast podniesione w dyskusji argumenty poddane zostają analizie, prowadząc do zajęcia przez autora własnego stanowisko w przedmiotowej materii.

It has turned out that all voting rules fail on some intuitively plausible desiderata. This has led some political scientists to argue that the notion of the will of the people is profoundly ambiguous and the absence of voting equilibria a generic state of affairs. As a constructive remedy to this some authors have introduced the idea of deliberative democracy. This view of democracy has much to recommend itself, most importantly the emphasis on individuals in devising the decision alternatives. Some empirical evidence also suggests that the deliberative institutions provide an escape from some of the most notorious incompatibility results in social choice theory. We shall critically examine this suggestion. The view emerging from this examination is that social choice theory and deliberative democracy are complementary, not competing approaches to democratic decision making.
