A Deputy may perform the function of vice-president of the association established abroad, unless it combines some kind of broadly understood employment in government or local government institution, with the aim of being a representative of the province in this association. However, a Deputy cannot perform such a function, if that association is an entrepreneur and a municipal legal person is its member or if in the course of its economic activity the association uses state or municipal property. Deputies are obliged to inform the Marshal of the Sejm about his/her additional activities, and to disclose obtained remuneration in the Register of Interests. Such remuneration may affect the amount of a Deputy’s salary

the State Sanitary Inspection is a part of government administration. Hence, regardless of the strong competence relationship with the governor of the county (starosta powiatu), the function of director of a county sanitary-epidemiological station should be regarded as belonging to the segment of government administration. The author concludes that, according to the law in force, there is no incompatibility of the function of county councillor and the function of director of the county sanitaryepidemiological station. It is therefore admissible.

Admissibility of treating the reception of proceeds from the property under a lease agreement as business activity is dependent on its connection with business activity of the lessor or enterprise owned by him. In the event that the object of joint ownership put into use under the lease agreement is part of the state or municipal property, in the light of Article 34 para. 1 of the Act on the Exercise of the Mandate of a Deputy or Senator, this is the circumstance that prevents the exercise of the mandate of a Deputy simultaneously with the drawing profits from such an object of joint ownership. Membership in the company management, control and inspection bodies or the status of the commercial representative of such a company cannot be held jointly with the exercise of the Deputy’s mandate only in relation to companies with the participation of state or municipal legal persons or with businesses involving such persons. We must find it inadmissible to perform jointly the functions of Vice-Marshal (Deputy Speaker) of Sejm with the membership of a board of commercial companies, regardless of whether he/she started running a business.

Opis:
Payable medical services and other separate (non-therapeutic) activity of independent public health care institution can be classified as business activity, if they are provided as an organized, ongoing and for-profit activity (Article 4, para. 1 of the Act on Freedom of Economic Activity). Therefore, running by the Deputy of an independent health care institution, carrying out operations with the use of state or municipal property, may violate Article 34 para. 1 of the Act on the Exercise of the Mandate of a Deputy or Senator.

Opis:
A person employed as secretary of the commune (county, province), who has been granted unpaid leave in connection with the assumption of a seat in parliament, is still subject to the statutory prohibition on the creation of, and membership in, political parties. Membership in a political party of a person who is in this situation, existing at the end of unpaid leave must be considered as the basis for the refusal to allow such a person to perform the duties for the position held and for recruitment to other equivalent position. If membership in a political party would expire before returning to his/her duties in the office of the commune, it could be by the employer as a basis for changing conditions employment (change in position), but there is no such necessity.

Opis:
Istotę incompatibilitas stanowi zakaz łączenia przez jedną osobę dwóch lub więcej funkcji publicznych, przy czym niedopuszczalność kumulowania przez dany podmiot tych funkcji zachodzi wówczas, jeśli pomiędzy wynikającymi z nich kompetencjami występuje wewnętrzny konflikt. Konflikt ten wpływa z kolei negatywnie na jakość, efektywność i bezstronność wykonywanych zadań. W celu eliminowania ujemnych następstw realizacji przez osoby pełniące funkcje publiczne rozbieżnych kompetencji, nieodzowne stało się zatem ustanowienie zakazów łączenia określonych funkcji z innymi funkcjami lub stanowiskami państwowymi, a także ze sprawowaniem mandatu przedstawicielskiego. Adresatami tych zakazów są, między innymi, radni i pracownicy samorządowi.
The essence of incompatibilitas is a ban on combining by one person of two or more public functions. The inadmissibility of accumulation by a given operator of these functions takes place if an internal conflict occurs between competences arising from those. This conflict, in turn, has a negative impact on the quality, efficiency and impartiality of tasks carried out. Thus, in order to eliminate negative consequences of the implementation by public officials of divergent competences it became necessary to establish prohibitions of combining certain functions with other functions or public positions, as well as with a representative’s office. The addressees of these prohibitions are, inter alia, councillors and local government staff.

After the analysis of the Standing Orders of the Sejm, it was found that because of the fact, that a Deputy elected to the Committee on Removal of Legal Consequences of Illegal Reprivatisation Decisions concerning Real Estates in Warsaw begins to perform duties of a secretary of state, there exists a problem of incompatibility of this function with being a member of Sejm’s. It has turned out that all voting rules fail on some intuitively plausible desiderata. This has led some political scientists to argue that the notion of the will of the people is profoundly ambiguous and the absence of voting equilibria a generic state of affairs. As a constructive remedy to this some authors have introduced the idea of deliberative democracy. This view of democracy has much to recommend itself, most importantly the emphasis on individuals in devising the decision alternatives. Some empirical evidence also suggests that the deliberative institutions provide an escape from some of the most notorious incompatibility results in social choice theory. We shall critically examine this suggestion. The view emerging from this examination is that social choice theory and deliberative democracy are complementary, not competing approaches to democratic decision making.

In the opinion of the author, the occupation and income resulting from the function of a tax collector should be indicated in the Register of Benefits and the statement regarding the financial status. If the village administrator collected taxes as a part of his business activity, he would have to cease from performing such activity. An additional occupation in the form of tax collection by a village administrator does not affect the Deputy’s salary.

This article deals with the question of the incompatibility of a sold object with the contract. Before the act of consumer’s rights of 30 May 2014 entered into force, the term in use had been warranty and responsibility on the basis of incompatibility of the consumption item. At present, the regime of responsibility has been unified. One of the main changes included in the act of consumer’s rights is indeed the new form of the hitherto used definition of a physical defect. In the present law state, the priority is given to contractual arrangements, which were made by the parties while concluding the contract. In case no as such agreements are drawn, one should be guided by the objective occurrence included in Art. 5561 §1 c.c., which enables to state if a physical defect of the sold object has occurred. In comparison with the former legal statement of Art. 5561 c.c., the amendment is far more expanded and brings out a plethora of doubts con cerning its interpretation. This article discusses particular subsections and paragraphs of Art. 5561 c.c. simultaneously including research on realistic possibilities of using the laws mentioned above. An attempt to assess the changes has been made. Doubts arise with reference to Art. 5561 §2 c.c. and 5561 §3 c.c., where one is not able to state clearly the accuracy of solutions implemented from the directive 1999/44/WE of the European Parliament and the Committee of 25 May 1999 in terms of certain aspects of consumption items of trade and connected with these, warranties of 25 May 1999 on the basis of Polish law.

Celem pracy było określenie podobieństwa genetycznego 16 zróżnicowanych populacji lucerny za pomocą markerów molekularnych RAPD — PCR oraz ocena stopnia ich samoniezgodności. Badane obiekty utworzyły cztery grupy podobieństwa genetycznego, które wynosiło od 42% do 75%. Populacje o podobnym stopniu samoniezgodności nie znalazły się w tej samej grupie podobieństwa genetycznego. W celu zbadania samoniezgodności obserwowano wnikanie łagiewek pyłkowych do zalążni przy pomocy mikroskopu fluorescencyjnego. Na tej podstawie wyróżniono 4 populacje o wysokiej samoniezgodności (populacja Syn 7-3, linia F, mieszaniec F × B10, mutant ‘tf’) i 5 populacji o niskiej samoniezgodności (populacja Syn 9-3, linia B10, mieszaniec B10 × F, odmiana Ulstar i mutant ‘lp’).
The study purpose was to analyse genetic similarity between 16 populations of alfalfa using RAPD molecular markers and to describe their self-incompatiblity. The examined objects formed four groups of genetical similarity, which ranged from 42% to 75%. The populations with similar level of self-incompatibility were not in the same group of genetical similarity. To study the self-incompatibility effects, penetration of pollen tubes into the ovaries was observed with the use of fluorescence microscope. According to this, four populations with high self-incompatibility (population Syn 7-3, line F, hybrid F × B10, mutant ‘tf’) and five populations with low self-incompatibility (population Syn 9-3, line B10, hybrid B10 × F, Ulstar and mutant ‘lp’) were distinguished.

Opis:
Effective quality management of the product is an element that allows profit within the enterprise. Identifying unconformity and establishing their source enables quality. However, identifying unconformity is sometimes neglected. Such was evident in the analysis of the service-manufacturing enterprise located in Podkarpacie. In the enterprise, quality was assessed via non-destructive testing (via fluorescence), but decisions on sources of non-compliance were made without utilizing additional methods that allow source identification. Hence, the way of recognizing unconformity was not precise. Therefore, method sequence (Ishikawa diagram and 5Why method) approaches were proposed to enable this. The aim of this paper is to show the effectiveness of such approaches in identifying sources of unconformity. The subject of study was tubing that is used in aircraft engines. Via the applied analysis, the unconformity in production and the source cause was traced to material supplied from outside. The proposed method sequence approach can be used in other enterprises for quality analyses purposes.
