    The rules for the organisation of health policy on immunization are defined by each state in relation to its citizens. The laws of individual EU countries make the possibility of vaccinating minors dependent on, among other things, the age of the person to be vaccinated and the consent of one or both parents or other legal guardians. The analysis presents the requirements for parental consent and the age limits in each country from which minors can decide for themselves to be vaccinated.

    Opis:
    The article discusses mechanisms of social immunisation in the context of the Polish ‘March 1968’. Whereas immunising strategies are a normal part of sociality, I argue that around 1968 a growing anxiety about the mechanisms of being-in-common led to an autoimmunitarian dissociation of the Polish society, which I conceptualise as an atmosphere of minusivity. Strategies to counter exclusions and discriminations were trapped in this immunitarian paradigm as well. A crisis of communication arose from the dissonance between the reality created by the official language surrounding March 1968, and the reality experienced by many people, as this latter reality was silenced and repressed. Mistrust in language resulted in an immunitarian retreat from affective communication, which was replaced by impersonal communicative scripts. This communicative crisis widely pre-vented the March experiences from being conveyed in the cul-tural production of the time; nonetheless, I will try to retrace some of the immunitarian and counter-immunitarian strategies in literature, film, and retrospective accounts.

    Zbliża się kolejna fala pandemii Covid-19, w związku z tym uzyskanie „odporności zbiorowej” należy uznać za priorytet w polityce prozdrowotnej państwa. Z uwagi na to, że nie osiągnięto w naszym społeczeństwie owego „progu bezpieczeństwa”, objęto dobrowolnym i nieodpłatnym szczepieniem (w ramach Narodowego Programu Szczepień) dzieci od dwunastego roku życia. Budzi to wiele kontrowersji w społeczeństwie, jak też w niektórych wąskich kręgach naukowców i lekarzy przede wszystkim z uwagi na stosunkowo krótki, jak twierdzą, okres prac nad szczepionką i możliwość wystąpienia w związku z tym dalekosiężnych (jak dotychczas niezbadanych) negatywnych skutki immunizacji. Artykuł ten stanowi próbę odpowiedzi na pytanie: czy poddanie dziecka w ramach realizacji władzy rodzicielskiej immunizacji na Covid-19 jest obowiązkiem rodziców/a wynikającym z treści stosunku prawnego, czy też tylko powinnością? Celem wszechstronnej analizy tej problematyki uznano za konieczne przedstawienie skutków pandemii, a także związanego z nią lockdownu w kontekście socjopsychologicznym; negatywnych konsekwencji e-learningu z perspektywy uczniów; istoty powszechnej immunizacji oraz preparatów przeciwko Covid 19; zagadnienia szczepienia uczniów w ramach realizacji kolejnego etapu Narodowego Programu Szczepień (pozytywne i negatywne aspekty); treści stosunku prawnego władzy rodzicielskiej, z eksplikacją obowiązków/uprawnień rodziców stanowiących wyznacznik w świetle regulacji prawnych ich kompetencji w zakresie poddania dziecka szczepieniu z uwzględnieniem 16-latków i ich sui species statusu w tym obszarze. Analiza istoty stosunku prawnego władzy rodzicielskiej prowadzi niewątpliwie do wniosku, że poddanie dziecka szczepieniu na Covid-19 należałoby traktować jako obligatio wynikające z jego treści zgodnie z ideą dobra dziecka i interesem społecznym, a nie powinności. Do paradygmatu powinności można by odwołać się rozpatrując realizację tej władzy z perspektywy ogółu społeczeństwa.
    Another wave of the Covid-19 pandemic is approaching. Therefore, obtaining “collective immunity” should be considered a priority in the pro-health policy of the state. In view of the fact that the “safety threshold” has not been reached in our society – children from the age of twelve years have been covered by voluntary and free vaccination (as part of the implementation of the National Vaccination Program). This raises a number of controversies in the general public as well as in some narrow circles of scientists and physicians – mainly due to the relatively short period of development of the vaccine, as they claim, and the possibility of far-reaching (and yet unexplored) negative consequences of immunisation. This article attempts to answer the question: Is the immunisation of a child against Covid-19 a duty of the parents arising out of a legal relationship as part of the exercise of parental authority or merely a duty? In order to comprehensively analyse this issue, it was deemed necessary to present: the effects of the pandemic, as well as the lockdown associated with it in the socio-psychological context; the negative consequences of e-learning from the perspective of students; the essence of universal immunisation and preparations against Covid-19; the issue of immunisation of students as part of the implementation of the next stage of the National Vaccination Program (positive and negative aspects); the content of the legal relationship of parental authority, with an explication of the duties/privileges of parents as a determinant in the light of legal regulations of their competence to have their child vaccinated, taking into account 16-year-olds and their sui species status in this area. The analysis of the essence of the legal relationship of parental authority undoubtedly leads to the conclusion that subjecting the child to vaccination against Covid-19 should be treated as an obligation arising from its content in accordance with the idea of the child’s welfare and social interest, rather than a duty. The paradigm of duty could be referred to when considering the exercise of this power from the perspective of society at large.
