    Książka jest kompendium zawierającym najistotniejsze międzynarodowe instrumenty gwarancji praw człowieka do zabezpieczenia społecznego. Zawiera podstawowe konwencje i zalecenia przyjęte przez MOP od 1952 roku. Syntetycznie przedstawiono także proces ich uchwalania, wskazując na wzajemne powiązania i uwarunkowania zewnętrzne procesu ich stanowienia. Jak wskazuje wydawca: publikacja może pełnić rolę nietypowego przewodnika w procesie budowania spójnych systemów krajowych w tym zakresie.
    The article reviews a compendium of the most important international instruments that guarantee human rights in the fifi eld of social security. It contains basic conventions and recommendations adopted by the ILO since 1952. The process of their adoption was also synthetically presented, indicating the interrelationships and external conditions of their establishment. As indicated by the publisher: the book may act as an unusual guide in the process of building coherent national systems in this area.

    Opis:
    Both in the Universal Declaration of Human Rights (Art. 16) and in the European Convention on Human Rights (Art. 12), the right to marriage is perceived and defined as a fundamental human right, as it was in fact enounced both by jus divinum and by jus naturale. Among other things, from the texts of the legal instruments, of prime importance to the nations of the world, one can note that a marriage can be concluded only between a man and a woman, and only if the following indispensable conditions are met, namely: a) the marriageable age laid down in the national law; b) the mutual consent of the future spouses; c) that the race, nationality or religion of the future spouses are not taken into account. Therefore, a valid marriage is concluded only by the persons of different sex (man and woman), and not by the people of any sex, as the Treaty of Nice (2000) stipulated. In the article, we also highlighted the fact that the right of a man and a woman to have a family is ontologically bound with the marriage. This reality proves in fact, once more, that the marriage and the family were and remain “two main institutions of the mankind.”

    Artykuł traktuje o wymiarze prewencji zawartym w koncepcji „odpowiedzialność za ochronę”. Analizie poddano najważniejsze dokumenty R2P. Przedstawiono dyskusję międzyrządową, która odbywała się głównie na forum Zgromadzenia Ogólnego ONZ, ewolucję podejścia instytucji ONZ do R2P oraz rosnącą zgodę państw na rozwój wymiaru prewencji. Dokonana została systematyzacja i analiza międzynarodowych instrumentów zapobiegania masowym zbrodniom: wczesnego ostrzegania, dyplomacji prewencyjnej, instrumentów ekonomicznych i wojskowych. W artykule wskazano najważniejsze trudności, z którymi borykają się państwa i organizacje międzynarodowe podejmujące się zapobiegania masowym zbrodniom.
    The article deals with the prevention aspect of the concept of Responsibility to Protect. The analysis performed by the author covers the most important R2P documents. The author presents the intergovernmental debate that took place mainly at the UN General Assembly, as well as the evolution of the approach of the UN institutions to R2P and the growing acceptance of the development of the prevention aspect. The article systematises and analyses the international instruments of prevention of mass atrocities: early warning, preventive diplomacy, economic and military instruments. Moreover, it identifies the main difficulties experienced by countries and international organisations that have decided to take action towards preventing mass atrocities.

    Obecny model praw człowieka przyjmuje optymistyczne założenie, że ustalony katalog praw jest w pełni realizowany, bez wielu aktów i środków wykonawczych. Poszczególne, ważne prawa w praktyce są jednak słabo chronione, a niedostatek instrumentów nie zapewnia pełnej, dostępnej i skutecznej ochrony. Także w porządku UE przyjmuje się założenie skuteczności unormowanych praw. Powyższe oraz priorytetowy obowiązek państw płynący z zasady zwierzchnictwa narodu implikuje potrzebę nowego ujęcia i regulacji praw człowieka.
    The current model of human rights (HR) protection includes optimistic supposition, that HR catalogue is to be easy and effectively realized, so it needs a few executive acts and measures. In practice single but important rights are weakly protected and insufficient instruments don’t give them guarantee of complete, effective & accessible protection. Also in the EU legal order it supposes effectiveness of regulated rights. All above mentioned as well as principal obligations of HR protection deriving from supremacy (& sovereignty) of nation are to implicated the need of a new approach and regulations of HR.
