    The subject of the opinion is providing answer to a question whether, in a view of the indicated Constitutional Tribunal’s judgement, a housing cooperative has the right to deprive a pending person – who paid housing contribution in the shape of saved cash from a housing passbook on account of a flat – of membership of the cooperative. It flows from the Constitutional Tribunal’s judgement that only such natural persons who are entitled to cooperative tenant law for the apartment, cooperative ownership law for the apartment, separate ownership or the promise of separate ownership can be members of the housing cooperative. Admission to the housing cooperative of a person, who does not possess one of the rights indicated in the judgement is not admissible.

    A housing cooperative that owns a real estate or a construction object and a perpetual usufructuary of land is a taxpayer regarding the real estate tax, except that it is paid according to different rates. In case of land and buildings related to business operations, the tax is calculated at higher rates. In the author’s opinion, the statutory phrase “buildings related to conducting business activities” should be understood as a fact of an actual use of a residential building for such activities.

    The paper discusses plant breeding in the flats of the Warsaw Housing Cooperative during the interwar period.     Opis:
    The advertisements of new housing estates convince us of a new quality of the flat environment. The aim of the text is to present a cultural image of new housing estates of blocks of flats built after 2000. A dominant organizational form are housing cooperatives there. They were described through the prism of the organizational culture. The analysis of the content of opinions on the housing cooperative Internet fora was made, namely the analysis of the topics important for inhabitants, methods of their joint actions, norms binding in these communities and ways of taking social control. The studies included 30 opinions from the housing cooperative Internet fora from Gdańsk, Poznań, Warsaw, Wrocław and Łódź.

    Artykuł przedstawia pojęcie społecznego budownictwa oddolnego, ze szczególnym uwzględnieniem kooperatyw mieszkaniowych w kontekście miasta Zurych, oraz opisuje współpracę jej członków z władzami miasta w celu stworzenia dostępnej i atrakcyjnej zabudowy mieszkaniowej, dopasowanej do konkretnych potrzeb przyszłych lokatorów. Proces tworzenia budynków kooperatyw mieszkaniowych został przeanalizowany na podstawie dwóch unikatowych przykładów osiedli w Zurychu. Celem artykułu jest przedstawienie czynników definiujących wysoką jakość zamieszkania w mieście oraz prezentacja procesu realizacji kooperatyw mieszkaniowych. Przyjęta metodologia polegała na połączeniu analizy tekstów źródłowych oraz ocenie empirycznej.
    The article presents the concept of bottom-up social housing, emphasising on housing cooperatives in the context of the city of Zurich and describes the cooperation of its members with the city authorities in order to create accessible and attractive housing, tailored to the specific needs of future tenants. The process of creating housing cooperatives has been analyzed on the basis of two unique examples of housing estates in Zurich. The aim of the article is to present the factors that define the high quality of living in the city and to present the process of implementing housing cooperatives. The adopted methodology was based on a combination of the analysis of source texts and empirical evaluation.

    This article focuses on the design of cohousing estates. The idea of building these estates is based primarily on creating permanent social bonds between residents and, among others, including them in the design process. Despite numerous advantages, cohousing remains regarded in Poland as niche. The conclusions from the research presented in the article show why.
    Tematem poruszanym w artykule jest projektowanie osiedli mieszkaniowych typu cohousing. Idea budowy tych osiedli opiera się przede wszystkim na wytwarzaniu trwałych więzi sąsiedzkich między mieszkańcami oraz m.in. włączaniu ich w proces projektowania. Mimo wielu zalet, formuła cohousing’u wciąż uchodzi w Polsce za niszową. Przedstawione w artykule wnioski z przeprowadzonych badań wykazują dlaczego.

    Niniejszy artykuł poświęcony został nowelizacji art. 3 ust. 5 ustawy o podatkach i opłatach lokalnych dotyczącej opodatkowania gruntu oraz części budynku stanowiących nieruchomość wspólną. Przedstawione zostały w nim rozwiązania funkcjonujące do dnia 31 grudnia 2015 r., jak i nowy stan prawny, obowiązujący od dnia 1 stycznia 2016 r. Autor wskazuje na podstawowe problemy w stosowaniu znowelizowanego przepisu w zakresie opodatkowania podatkiem od nieruchomości części wspólnej, w szczególności problemy spowodowane brakiem przekazania przez wspólnotę mieszkaniową informacji o jej powierzchni.
    This publication applies to amending Art. 3 sec. 5 of The Local Taxes and Fees Act which pertain to taxation of land and parts of the building posing a common property. It presents solutions in both the old legal status, before of the 31st of December 2015 and the new legal status, from the 1st of January 2016. The author presents the current problems applying the new tax regulation about of real estate taxation common property, especially problems caused by the lack of information from the housing cooperative (condominium) about the area of common property.

    Od czasów transformacji ustrojowej, zaspokajaniem podstawowej potrzeby mieszkańców miast, jaką jest zamieszkiwanie, zajmują się w Polsce przede wszystkim firmy deweloperskie, budujące mieszkania na sprzedaż. Zjawisko to ma wielorakie konsekwencje, m.in. społeczne, funkcjonalne i przestrzenne. Tymczasem w wielu rozwiniętych krajach ważnymi organizatorami rynku mieszkaniowego są, poza firmami deweloperskimi, także spółdzielnie (kooperatywy) oraz lokalne samorządy, a powszechną formą zamieszkiwania jest najem długookresowy. Kryzys ekonomiczny końca pierwszej dekady XXI wieku, związany z kredytami na zakup domów i mieszkań, skłania do refleksji na temat alternatywnych form finansowania i realizowania domów mieszkalnych jutra.
    Since the time of political transformation, habitation, which is a basic need of city dwellers, has been satisfied mainly by development companies that build flats for sale. This phenomenon has multiple consequences, including social, functional and spatial ones. Meanwhile, in many developed countries, in addition to development companies, housing cooperatives and local authorities are also important players in the housing market, and long-term tenement leasing is a common form of habitation. The economic crisis of the end of the last decade of the 2000s, which was connected to mortgages, provokes reflection on alternative forms of financing and ways of providing the housing of tomorrow.

    After 1945, the principles of operation of the cooperative movement were radically changed and it was completely subordinated to state policy. In the dozen or so years after the war, this activity was subjected to top-down processes, as it was defined, of etatyzacja, centralizacja and biurokratyzacja. It should be emphasized that the cooperative movement encompassed a huge number of areas of trade, production, banking, etc. In Poland, such cooperatives have developed as: labor, agricultural production cooperatives, the disabled, agricultural circles, dairy, housing, horticulture and beekeeping, social, military, publishing, farmers, agricultural producers, banks, savings and credit unions, supplies and sales of "Samopomoc Chłopska", as well as consumers. Just before the outbreak of World War II, housing cooperatives had approximately 10,000 members. The worst time for housing cooperatives was the post-war period - out of 192 cooperatives, only 73 remained. Cooperatives did not have the right to manage cooperative housing, they could not also take out loans and buy materials at wholesale prices. The breakthrough came in 1956, when the Spółdzielczy Fundusz Budowlany, Społeczne Przedsiębiorstwo Budowlane and Bank Spółdzielczy were established. It was then that the state's policy towards housing cooperatives changed. Principles of construction and apartment area standards have been established. Many solutions were introduced that facilitated the functioning of the cooperative and led to their development. As a result, at the end of the 1960s, the number of housing cooperatives in Poland increased to 1,130 and continued to increase. Currently, there are over 2,000 of them (data from the Central Statistical Office for 2016).
    Po 1945 r. zasady działania spółdzielczości zostały diametralnie zmienione i całkowicie podporządkowano ją polityce państwa. W ciągu kilkunastu lat po wojnie działalność ta została poddana odgórnym procesom, jak to określono, etatyzacji, centralizacji i biurokratyzacji. Należy podkreślić, iż spółdzielczość obejmowała ogromną liczbę dziedzin handlu, produkcji, bankowości itp. działalności. W Polsce wykształciły się w szczególności takie spółdzielnie, jak: pracy, rolnicze spółdzielnie produkcyjne, inwalidów, kółek rolniczych, mleczarskie, mieszkaniowe, ogrodniczo-pszczelarskie, socjalne, wojskowe, wydawnicze, rolników, producentów rolniczych, banki, kasy oszczędnościowo-kredytowe, zaopatrzenia i zbytu „Samopomoc Chłopska”, a także spożywców. Tuż przed wybuchem II wojny światowej spółdzielnie mieszkaniowe zrzeszały około 10 tysięcy członków. Najgorszym czasem dla spółdzielni mieszkaniowych był okres powojenny – ze 192 spółdzielni pozostały jedynie 73. Spółdzielnie nie miały praw do zarządzania mieszkaniami spółdzielczymi, nie mogły także zaciągać kredytów i kupować materiałów w hurtowych cenach. Przełom nastąpił w 1956 r., kiedy powstały Spółdzielczy Fundusz Budowlany, Społeczne Przedsiębiorstwo Budowlane oraz Bank Spółdzielczy. Wtedy też zmieniła się polityka państwa w stosunku do spółdzielni mieszkaniowych. Ustalono zasady budowy oraz normy powierzchni mieszkań. Wprowadzono wiele rozwiązań, które ułatwiały funkcjonowanie spółdzielni i doprowadziły do ich rozwoju. W związku z tym pod koniec lat 60. liczba spółdzielni mieszkaniowych w Polsce wzrosła do 1130 i stale się zwiększała. Obecnie jest ich ponad 2000 (dane GUS na rok 2016).

    The article concerns issues of legal nature of legal relation between a housing cooperative and its member resulting from building agreements and agreement of establishing cooperative residents’ right to accommodation. They can have prospectively corporative (cooperative), obligational or mixed legal nature. In my opinion, crucial for further considerations in this scope is the distinction included in German writing between freedom of contracting and freedom of establishing associations. Therefore, vital importance has the issue which of the freedoms underlines legal relations between a housing cooperative and its member. The further part of the article includes discussing arguments vital at assessment of the legal nature of discussed legal relations. The article closes with conclu- sions that the discussed relations are characterized by cooperative character and therefore they are not typical obligational relations.

    The article is a review of housing cooperative law in the last 100 years. The aim is to approximate one of the limited real rights contained in article 244 of the Civil Code, a cooperative ownership right to a flat. Indication of the most important changes in the cooperative ownership right to housing, made since the independence of Poland. Starting from the first Polish legal act on housing cooperatives, the act on cooperatives from 1920, passing to the Act of 17 February 1961 on cooperatives and their unions, then the Act of 16 September 1982 – Cooperative Law, as well as to the Act of 15 December 2000 on Housing cooperatives. The current provisions of the cooperative ownership right to the premises were presented, which were compared to a fully-fledged right which is the property right. The basic differences between these rights are approximated. The analysis of cooperative law is conducted from the point of view of the need for the existence of a cooperative ownership right to a flat.
