The text is addressed at first to young historians and historians of law. It stresses the peculiar importance of the science of the history of law and legal education in Polish historical science, especially in the period between 1850–1914. The science of history of law has been strongly connected with historical science, and law was a phenomenon shaped par excellence by history. In 19th century Poland, when the partitioners were replacing Polish law and Polish institutions by their own legal systems, Polish historians of law had to struggle to preserve national legal traditions. That is why the strong position of F. K. von Savigny’s historical school of law is presented in Polish Romanticism. The article describes the achievements of Polish historians of law in the field of national history science. It points out that many of the historians in this period were lawyers by education (Szymon Askenazy, Tadeusz Korzon, Władysław Smoleński, Marceli Handelsman, Władysław Konopczyński). Nowadays the role of the science of history of law is underestimated, although the cooperation of historians of law with the representatives of other historical disciplines is fruitful.

Legal history in Poland is imperiled by a few threats. One of them is a model of the university education, promoted by the heads of faculties, which is devoted to strictly legal subjects. It may happen, that historical subjects will be eliminated or vastly limited in the course of the implementation of this model. Such kind of pressure inclines legal historians to emphasize their utility to contemporary legal science. However, it is worth noticing, that there are different dangers that lie in wait for Roman law and for Polish legal history. Basing instruction upon incomplete sources in showing a distant genesis of contemporary legal institutions causes an excessive simplification, which is a serious threat to the reliability of scientific research. The Polish legal history researcher will be helpful to a specialist of contemporary law only occasionally and in most of those rare cases his research will be used to point out the birth of a certain legal institution in Polish law. Another threat to Polish legal history is an intensive interest in mostly recent history. Although, after years of censorship in the state of real socialism, this situation is intelligible, as it resulted in abandoning the research of old-Polish times, nowadays conducted by only a few scholars. As far as the group of Romanists is concerned, they tend to indicate the Roman roots of almost all past, present and future legal institutions. However, this is cannot be done when applying all rigors of scientific research. A drop of the scientific level of publications may be observed as well. Authors do not investigate sources of the practice of the law, the use of legal history literature is insufficient and the publications of historians of other specializations are used only to a minimal degree. Legal historians in Poland have to deal with these main problems, if they hope for the further development of their discipline.

The third partition of Poland, and thus the collapse of the Polish state, spontaneously forced a situation in which the legal orders of the partitioning states came into force almost immediately on Polish lands. In the lands divided between Prussia, Russia and Austria, legal acts of the partitioning states came into force with a strong influence of models derived from French legislation. The Polish lands which came under Austrian rule found themselves in the reality, in which the Austrian legislator conducted codification works on the new penal code, which resulted in the fact that in 1787 the penal code of Joseph II, called Josephine, became binding. As early as 1803, a penal code was introduced in Poland, which was under Austrian rule, under the name of the Book of Laws on Crimes and Serious Police Crimes called Franciscan. In the German annexation there was the Prussian Landrecht, which was characterized by a current far removed from the European science of law. On the territory of the former Duchy of Warsaw a Penal Code for the Kingdom of Poland was introduced. In Russia in 1903, the Tagantsev’s Code came into force, which in its systematics divided crimes according to their gravity into crimes and misdemeanours and clearly separated minor offences. The characteristics of criminal legislation until 1918 made it possible to show the enormity of the work of the Codification Commission, the aim of which, after Poland regained independence, was to create a uniform and coherent Polish legal system, not only in terms of social life standards, but also in the area of the catalogue of its areas.

Opis:
Franciszek Ksawery Bohusz (1746—1820), Jesuit and diocese priest after the dissolution of the monastery, was a man educated in philosophy, theology, and law. Between 1777—1778 and 1781—1782, he made long journeys abroad, during which he got to know Czechia, Germany, France, England, Austria, Italy, and Switzerland. These were the journeys of an intellectual, typical of the period of Enlightenment. Not only did he admire edifices worthy of interest, visit museums and libraries, but he also tried to gain knowledge of the political regimes, social and economic relations in the visited countries. His observations were diligently noted down in travel journals and finally edited upon his return to the country. A lot of comments concern court law: civil and criminal, particularly procedural law. The traveler was also interested in the administration of punishments. The references to law vary from extensive, comprehensive discussions of whole branches of law to prevailing brief mentions of particularly interesting legal institutions. The author attempts to offer a possible objective view of legal solutions he became familiar with, yet, does not always fully succeed. It is worth noting his commentaries on English law, which are not only exceptionally extensive, but also filled with not always well-justified praise. On the other hand, his evaluations of other legal systems, for instance Swiss, seem to be rather harsh and stereotypical. Nevertheless, Fr. Bohusz’s observations on court law in the visited countries deserve a thorough analysis since they let us assess their accuracy and the degree to which some foreign legal solutions found appreciation in his eyes.

The article discusses the problem of evolution and the premises used in applying the English concept known as promissory estoppel. The birth of this legal concept has been discussed on the example of the most important court cases, the so called leading cases, such as, among others, that of High Trees (1947) and Combe v. Combe (1951), in which it was lord Denning who adjudicated. In the article, the author also analyzes the general principles of invoking promissory estoppel. He indicates that in the course of a court trial it is necessary to prove the existence of a promise, on the basis of which the person who was promised something, while acting in accordance with the common sense, decided to withdraw and by undertaking certain definite steps ultimately suffered a loss, whereas withdrawal on the part of the person making a promise would be unjustified. The author of the paper made an effort to try to answer the question whether the abuse of right clause mentioned in Art. 5 of the Civil Code may be regarded as the Polish equivalent of promissory estoppel.

The West Galician Code (Ustawy Cywilne dla Galicyi Zachodniey) was a codification of law created under rule of Franz Joseph I and it was in force on the whole area of the former Polish-Lithuanian Commonwealth which had earlier became part of the Habsburg Monarchy. The code dealt with every aspect of civil relations, including parental, to which chapter IV was devoted. According to the act, the main role in the process of child-upbringing was given to a father whose parental responsibility for offspring remained crucial. However, the child was able to act against his/her parents’ will if the court granted him/her the permission. The issue of parental responsibility and status of illegitimate children also gained complex regulation. In that matter, the most important of father’s duties was providing financial support for the offspring. The regulations included in the above-mentioned code cannot be seen as revolutionary but need to be considered as a result of the evolution of law that occurred during the modern age. Some state’s interference with parental authority was, however, a sign of upcoming great European codification movement of the 19th century.
Ustawy Cywilne dla Galicyi Zachodniey to zbiór praw wydanych przez cesarza Franciszka I, które obowiązywały na terenach Rzeczypospolitej przyłączonych do państwa Habsburgów. Regulowały one całokształt stosunków cywilnych, w tym relacje pomiędzy rodzicami a dziećmi. Kwestiom tym został poświęcony rozdział IV. Ustawy kluczową rolę w procesie wychowania dziecka pozostawiały ojcu, który miał daleko idącą władzę nad potomkiem. Dziecko miało jednak możliwość przeciwstawienia się rodzicowi w najważniejszych kwestiach przez zwrócenie się do sądu. Kompleksowo zostały także uregulowane kwestie dotyczące władzy rodzicielskiej i statusu dzieci nieślubnych. W ich przypadku najważniejszym zadaniem ojca było utrzymanie potomka. Regulacje zawarte w prezentowanym zbiorze praw nie mają charakteru rewolucyjnego i stanowią ewolucję praw obowiązujących w epoce nowożytnej. Pewne ingerencje we władzę rodzicielską można uznać za zapowiedź wielkich kodyfikacji XIX w.

The recent studies on the relations between humanism or humanists and jurisprudence convince that Reneaissance, especially in XVIth century, when the national states began to raise, belonged to the periods of increased interest in the issue of law. Although Erasmus was not a layer, nor he introduced in any of his works a complete theory of law, he maintained close relations with many leading theoreticians of the law and jurists (Alciati, Budé, Cantiuncula, Zasius) and sometimes spoke in the legal discussions of his age. Among hist most important works concerning the matter of law were: Institutio principis Christiani, Ratio seu Methodus verae theologiae, Christiani matrimonii institutio, De interdicto esu carnium and Ecclesiastes. In the paper I’m going to concentrate on this latter work, in which Erasmus discusses the significance of preaching, preacher and widely understood Christian rhetoric. In the Ecclesiastes Erasmus touches the law subject with the special emphasis on historical character of law and relations between the divine law, the law of Christ and the law of Nature. After a short discussion about his understaning of law I will concentrate on the essential differentiation between the letter of law and the spirit of law, and I will point at proposed by Erasmus ways of introduction of law into human life. Erasmus, on the one hand, escaped a rigidity and abstraction of law and, on the other, he neutralised an aspect of the coercion of law. In his solution Erasmus appreciated the political dimension of preaching and acknowledged preacher as a more important guide of the people, than ruler. I’m going to interpret the Erasmian concept of preaching as an rhetorical mean of introduction of law in analogical way to “introduction” proposed by Plato in his Nomoi.

The modern methods of calculating income and expenses using statistical data is sometimes attributed to the period of the Enlightenment. However, an analysis of the surviving sources (constitutions passed by the Sejm and registers of taxable income) suggests that the first attempts to create a balanced budget in the Kingdom of Poland can be dated between 1530–80. At that time action was taken to improve the functioning of the treasury, accompanied by the creation of new types of treasury documentation: tax returns and income tax registers. Both the form and content of the income tax registers indicate that they were used to calculate future years’ tax inflows and to seek the reasons for the periodical drops in revenue. Discontinuing the preparation of tax registers at the end of the 16th century was probably related to changes in the rules for preparing the state budget, which manifested itself in calculating lump-sum taxes or leasing out their collection. In place of planning the future budget, the treasury administration began to concentrate mainly on satisfying current state requirements and paying tax arrears.

This purpose is realized in two steps. First, a brief history of permissive natural laws in the tradition of medieval philosophy is discussed, and the historical context, in which Paul Vladimiri developed his theory of natural law, is outlined. Next, some excerpts from Vladimir’s writings are analysed, in which he uses phrases indicating the presence of the concept of permissive law in his philosophy.

Teofila Konstancja Morawska came from a powerful Lithuanian family of Radziwiłł dukes. However, her husband, Ignacy Feliks Morawski, was a much lower ranked nobleman. In 1773, Teofila Morawska and a small group of her companions set off on a journey through Europe. The route of this journey led through Prussia and other German countries, France, Switzerland, and finally numerous Italian countries. The return journey led, among others, through Austria and the Czech lands. The result of this journey was a diary written by Morawska, in which she described not only the landscapes and monuments visited, but also events connected with the law of the countries where she was allowed to stay. The observations made by her concern the systems of states, administrative regulations, especially those directly affecting travellers, customs and passport regulations, as well as court law. The traveller was particularly interested in the execution of sentences, she described prisons and places of execution. The observations recorded in the diary are usually precise and do not contain gross errors. The traveller above all recorded what she saw or heard, but from time to time she also added her own comments. Some of these remarks may indicate that the traveller was no stranger to the ideas of the Enlightenment.

W poniższym artykule postaram się przedstawić sprawę Niemieckiej Listy Narodowościowej na Górnym Śląsku widzianą z trzech perspektyw historyczno-prawnych razem z krótkim omówieniem jak wpłynęła ona na los Górnoślązaków oraz kształtujące się w jej świetle relacje polsko-niemieckie. Po krótkim opisie najważniejszych skutków wprowadzenia Niemieckiej Listy Narodowościowej na Górnym Śląsku oraz jej wpływu na relacje ludności polskiej i niemieckiej przejdę do opisu pierwszej części historyczno-prawnej, w której zaprezentuję  literalne brzmienie czwartej konwencji haskiej (ze szczególnym uwzględnieniem działu trzeciego traktującego o wykonywaniu okupacji) wraz z przykładem jej zastosowania po pierwszej wojnie światowej. W kolejnej części przedstawię polską wykładnię jej postanowień w kontekście oceny legalności wprowadzenia Niemieckiej Listy Narodowościowej na Górnym Śląsku. W ostatniej części przedstawię odmienne stanowisko prawników niemieckich, aby możliwe stało się osiągnięcie mojego głównego celu badawczego, jakim było przedstawienie (w sposób porównawczy) jak ważną rolę w prawie międzynarodowym odgrywa jego wykładnia – chociaż teksty konwencji są najczęściej formułowane w jasny sposób i po pierwszym zetknięciu się z ich brzmieniem nie budzą w interpretatorze wątpliwości, to mimo wszystko stwarzają możliwość szerokiej, często jawnie godzącej w fundamenty całego porządku międzynarodowego wykładni. Choć sam przykład jest historyczny, tematyka różnic w wykładni prawa międzynarodowego jest w dzisiejszych czasach, przy postępującej globalizacji oraz integracji międzynarodowej, szczególnie ważna. W artykule wykorzystane zostały zarówno teksty aktów prawnych (czwartej konwencji haskiej i paktu Brianda-Kellogga), jak i ich późniejsze interpretacje przez prawników polskich oraz niemieckich. W części dotyczącej stosunków polsko-niemieckich w świetle Niemieckiej Listy Narodowościowej.
In the following article, I will attempt to present the matter of the German Nationality List in Upper Silesia from three historical and legal perspectives, as well as a brief overview of how it influenced the fate of the Upper Silesians and the Polish-German relations. After a short description of the most important results of the introduction of the German Nationality List in Upper Silesia and its impact on the relations between the Polish and German people, I will present the literal wording of the Fourth Hague Convention (with particular emphasis on the third chapter including the exercise of occupation) and show an example of its use after the First World War. In the next part, I will present the Polish legal interpretation of its provisions in the context of assessing the legality of introducing the German Nationality List in Upper Silesia. In the last part, I will present the different standpoint of German lawyers to achieve my main research goal, which was to present (in a comparative way) the importance of the legal interpretation in international law - although texts of the conventions are most often formulated clearly and initially their wording does not raise any doubts in the interpreter, they create the possibility of a broad interpretation, often openly undermining the foundations of the entire international order. Although the example itself is historical, the subject of differences in the interpretation of international law is particularly important nowadays, with the advancing globalization and international integration. The article uses both the texts of legal acts (the Fourth Hague Convention and the Briand-Kellogg Pact) and their subsequent interpretations by Polish and German lawyers. In the part concerning Polish-German relations in the light of the German Nationality List in Upper Silesia, the memories of witnesses of history were also used.
