Opis:
Repeatedly raised demands for the need to draw up the lists of directories (liturgical calendars) and schematisms became an incentive to produce a catalogue of directories and schematisms of male and female religious orders existing in the territory of the Polish Republic. This work is based on part of a collection of these kinds of printed documents stored in the University Library KUL and covering the years 1690-2008. Its size is estimated to be around 600 titles, which places it among the largest collections of this type in academic libraries in Poland. The entire bibliographic material was divided into two parts, the first of which includes male religious orders and congregations and the other female religious orders and congregations. Titles are listed chronologically according to administrative units which were part of various religious orders. A short description of religious orders includes mainly administrative divisions, which facilitates the identification of individual printed documents. The Catalogue ... was preceded by an introduction, in which attempts were made to introduce general characteristics of the presented part of the collection: its internal structure, size, and various elements of bibliographic description.

Opis:
Pismo neonarodowo-demokratyczne, jeśli traktować je jako źródło, stało się ważnym dokumentem historii politycznej Europy i Polski w XX i na początku XXI wieku, obejmującym myśl polityczną, wydarzenia i ludzi zaangażowanych w procesy komunikacji we współczesnej Polsce. Mogło odzwierciedlać wzajemne oddziaływanie ruchów politycznych i społeczeństwa.
If regarded as a source, the neo-National Democratic journalism became an important document on the political history of Europe and Poland in the 20th and early 21st centuries, including the political thought, events and people involved in the processes of communication in the contemporary Poland. It could reflect how political movements and society interacted. It was a stimulus to reconstruct political events or indicate their political importance. Also, the neo-National Democratic journalism enabled the recorded content to be analysed following the rules adopted in the literature of subject. The created category of “a righteous Jew” was based on stereotypes and related political myths, feelings and emotions. The adopted associative model helped recall archetypal qualities of personality, behaviour and attitudes associated with the Jewish people. Pieces of information about individuals or events were associated according to historical associa-tions to be later generalised and applied to the entire community. The established contras-tive features of “a righteous Jew” and “an unrighteous Jew” followed the scheme of useful and expected versus negative and disapproved features. The clear comparisons made pre-sented “a righteous Jew” as dignified, honest, dutiful, responsible, diligent, trustful where-as “an unrighteous Jew” as shameful, negligent, dishonest, unreliable, deceitful.

Opis:
The first half of twenty years of 17th Century is a period of gradual normalization of Polish and Turkish relations after the Great War of 1620-1621. Challenging the issue of Zaporowscy Cossacks and their looting expeditions in the Black Sea effectively was regarded as the pre-condition of success for this normalization process. The Republic of Poland tried to achieve both targets by means of the mission of Priest Krzysztof Zbaraski to Stambul in the years of 1622-1623, and the commission, as well as the subsequent military encounter with the Cossacks in 1625. Members of political elites were also sometimes directly involved in achieving those targets. This article presents three letters from Cracow Bishop Marcin Szyszkowski to the Governor of Kiev Tomasz Zamoyski. The letters being kept in custody of Zamoyski Archive affiliated to the Central State Historical Archives in Warsaw. Those letters were written in the years of 1623-1626 and referred to political issues. Apart from the factual content, they allow to learn about the attitude of Senator Marcin Szyszkowski, being the clergyman, to the said political and military events. They also expose personal relations between magnates and politicians. Therefore the letters incorporate themselves into the research on military and political history as well as the philosophy of life and the position of people of the Church as far as public life is concerned in the Republic of Poland of 17th Century.

The article seeks to establish whether the November Rising was — or was not — duly acknowledged in the Centenary Year 1930 in the Cracow press. But the point is not merely to take note of the coverage of the anniversary celebrations and the commemorative articles, but rather to fi nd out if these texts were infused with current political concerns. We ask further to what extent the latter came to dominate the ostensible historical theme and what other functions may have been served by the Centenary journalism of 1930. Of course, the article also considers the manner in which the Cracow press took up the role of a popular historical educator.

Only recently has the contemporary witness become the subject of academic study. The emerging scholarship views this figure as belonging to a specific historical period, namely the post-Holocaust era. Today, the narrations of the contemporary witness are commonly understood as constructs, as stories developed synchronously in the course of the interview. The article takes a closer look at the formative period of the German Oral History studies around 1980, a field deeply informed by post-dictatorial sensibilities. It locates the figure of the contemporary witness, the interviewer and the interview methods employed within the historical context in which they emerged. Moreover, if we consider other Oral History approaches developed elsewhere and compare the German approach to Fritz Schütze’s narrative interview method for the social sciences, it can be identified as a genuinely historical, diachronically operating approach.  By letting the interviewees talk about their memories uninterrupted, they were encouraged to reflect on their lives as a whole. A the same time, pioneers of the field such as Lutz Niethammer and Alexander von Plato developed ways to verify the narrations’ plausibility and thus to evaluate the reliability of the interview as istorical source. This combination of empathy and skepticism, of unconditional interest in a person’s full life-story and its critical verification became the hallmark of German Oral history Studies, not least because emerged in a post-dictatorial society. Rather than studying memories as mere constructions of the past, they developed a methodology aimed at enabling historians to get access to the actual past experiences which they believed are contained in the retrospective testimonies of individual human beings.

This paper examines the history and contemporary practice of the edition of privileges in the context of the term “source of law”. In all legal systems, the term “source of law” has a quality of normative power or of authority for the decision-making processes. In this sense, the research question decides about their property as sources of law. This raises the question of the content and function of privileges in the history of law. While the individual and special privilegia form a contrast to common law or general legislation as leges privatae, on the other hand, they are also part of the greater category of law and legislation in general. This accounts for their enormous instrumentality in the creation of legal systems. Privileges may extend to all matters of private and public law (economy, trade, invention, jurisdiction, constitution, rights of estates etc.). They have appeared as a mass phenomenon since the Middle Ages. The different characteristics of the sources in turn connote both problems and possibilities for their edition, both in the past and the present. Different forms and functions of their publication and edition can be distinguished for the Ancien Régime. Publications of privileges of estates often served political interests, the publication of private-law privileges, thus, served to protect individual legal positions and their probability in court. Today, the edition of privileges is determined by the research objectives in European legal history and, in the face of the mass phenomenon of this type of source, is hampered by the problem of criteria for their selection. Editions on the jurisdiction and economic development in the Old Reich have been published in Germany and Austria in recent years (1980, 1981). They attest to the traditional power of privileges and show the important meaning for the ordering and shaping of law up until the 19th century.

Opis:
The paper explains the methodology applied in the edition of historical legal sources of major importance for the 19th and 20th centuries Slovakia – the edition of the Provisional Judicial Rules (“PJR”) of the Judex-Curial Conference of 1861. At the Conference, legal scholars and politicians adopted a decision to abandon the previous twelve years of neoabsolutism and centralism introduced by the Austrian law, and opted for a renewal of the traditional Hungarian legal system with some changes introduced by the laws of March 1848 (the March Constitution of 1848). At the same time they retained some rules of Austrian origin and created some rules that were entirely new, particularly in the field of civil procedural law and inheritance law. While evaluating the legal nature of the PJR, the literature used to claim that they never became law because Parliament of 1861 was not created legally (representatives were not elected under the electoral law enacted as part of the March Constitution of 1848) and because the monarch, Francis Joseph I, had not yet been crowned (his coronation took place in 1867). Therefore the legislative process could not be successfully completed. The only solution that was reported to was the recognition of the exceptional situation which dominated in Hungary between 1861–1867 – it was the period between neoabsolutism and another provisorium, a period of “limited constitutionalism”. Under such conditions it was not possible to meet the formalities of official legislation process. Thus PJR could become binding only de facto – through the power of persuasion. However, after a corpus of case law began to consolidate during several years, it could be argued that the PJR was transformed from the actual source of judicial decision-making into customary law.

Belgium became independent in 1830. In this constitutional monarchy, legal norms would find their place in a hierarchy of norms of which the constitution formed the pinnacle. In practice, the country renewed only a part of its legal norms. Many sources predating 1830 remained in force. Which ones? Which measures did they include? With the aim of putting these anciennes lois et ordonnances in order, a Royal Decree of 18 April 1846 established a royal Commission for Old Laws and Ordinances of Belgium (Commission royale des anciennes lois et ordonnances de Belgique), which was composed of politicians and professors of law faculties. Initially, the Commission was at the service of judicial practice. Its activities were considerably diminished by the First World War and it was only in 1950 that it took up its full range of activities again. At that time, the Commission was invested in exclusively by legal historians, who reoriented it to serve the science of legal history. Since 1846, the Commission has decided to divide the publication of legal texts into three collections: the ordinances, the customaries, and the treaties. In each division, it distinguished between acts regarding the old Netherlands and those regarding the Principalities of Liège, Stavelot, and Bouillon. The volumes concerning Liège, Stavelot, and Bouillon were finished in 1878. The publication of the ordinances of the other territories were organised into three series: (1) the Burgundian period (1381–1506), (2) the Habsburg and Spanish period (1506–1700), and (3) the Austrian period (1700–1794). The series concerning the Austrian period was completed in 1942. For the second series, the ordinances of Philip II are still being dealt with. Work on the first series was only begun in the twentieth century and the editors have reached the period of Philip the Good (who died in 1467). The publication of customaries was divided into thirteen series according to the old principalities of the Southern Netherlands which were situated in the current territory of Belgium. The jurisprudence of the courts of justice that were submitted to the homologation of the Great Council of Malines between the seventeenth and eighteenth centuries was edited first. Currently, eighty quarto volumes have been published. Two volumes of homologated customaries remain to be published. In the meantime, the Commission has added older documents to its field of action, which allow the following of the evolution of customary law at the end of the Middle Ages. There are, for example, volumes dedicated to appeals to the Parliament of Paris against the Council of Flanders, published starting from Parisian files. The third series has never been started, as the Commission provisionally abandoned the publication of the treaties of the old principalities. The Commission also edits the Bulletin of the Royal Commission for Old Laws and Ordinances of Belgium (Bulletin de la Commission royale des anciennes lois et ordonnances de Belgique), which appears sporadically. In this Bulletin, one finds preparatory studies concerning the editing of legal sources and the editions of texts which are too short to merit an entire volume. Without the Bulletin, the entire set of the Commission’s publication consists of about two hundred and fifty quarto volumes and about twenty octavo volumes.

The biographical account of Barbara Gołajewska-Chudzikiewicz was recorded in 2007 as a part of the documentary project “The Forgotten Witnesses to the 20th century” run by the KARTA Centre and the History Meeting House. The narrator tells the story of her life, as well as the story of her family, starting in 1918. As the material is very extensive, in this publication only the fragments regarding the years 1918–1945 are presented. The narrative, in a manner typical for landed gentry of the Kielce region, contains a description of Ms Gołajewska-Chudzikiewicz’s childhood and family life in a small landed estate of Bieganów in the times of the Second Polish Republic. It gives insight into the course of her education, upbringing of children and young people in a landowning family, relations between the servants and the landowners, everyday life in the manor house, along with civilization difficulties, celebrating of holidays, the manor-village relations, and finally the general way the landed family functioned between the countryside and the city. The next important part of the narrative starts with the outbreak of WWII and conveys the everyday life of the manor under German occupation in the General-Government. The narrator describes the functions of the Polish manor in occupation conditions: helping and giving shelter to those displaced from the territories incorporated to the Third Reich, helping the Warsaw Uprising fugitive fighters, active participation in the Home Army structures, and relations with the German invader, as well as food and clothes extortions run by armed groups of unknown provenance, and confrontation with the Soviet army entering from the East.

Till the end of the war the three of them wandered all over Silesia searching for a safe place to stay. When the war ended, they found themselves in Bad Kudova, a place where many Silesian refugees found shelter. This was also the place where they were rejoined with the father. On 9th June, 1945, in accordance with the Potsdam agreement, the whole family were resettled to the British Zone of Occupation in Germany. Professor Scholze often underlines how lucky his family were throughout this time.

Opis:
Leszek Wisłocki is a famous music theorist and composer. For many years he has been a Professor at the Academy of Music in Wrocław. However, before he started working for the Academy, he spent some time living in Jelenia Góra, where for 4 years he attended the Stefan Żeromski Co-educational Gymnasium and Grammar School. These school years are the subject of Wisłocki’s account. It is a detailed description of Professor’s pre-war life, as well as his and his family’s war experience, and in particular of his father’s military service. Wisłocki clearly explains the reasons for his family coming to Lower Silesia and settling in Jelenia Góra. Equally clearly Wisłocki recalls his teachers, school friends and important events which influenced the school life as well as the life of the local society, such as existence of the underground independence movement in 1949. He tells anecdotes about excursions to the mountains or his first performances as a musician staged at school. Wisłocki underlines the importance of this first, post-war period – not only for him, but also for his friends who later, having graduated from grammar school, went on to become professors or achieved other socially significant posts. Finally, Professors pays a lot of attention to returns and school relations – still vivid and close after more than seven decades. Annual school reunions and extensive correspondence exchanged by the ex-pupils serves as a proof that the short period of education, which lasted only 4 years, had a great impact on the life of this generation.
