The article explores directions of possible changes to be made to the model of monument protection. It not only recommends specific provisions but also focuses on a model understood as a structure of definitions and relations existing among them. This allows for rough description of a selected aspect of reality. The analysis comes down to deliberations on monument protection system, including necessary duties and competences of government and local government administration bodies. Effects of the principle of subsidiarity and decentralisation of Polish historic preservation administration were brought into special focus. Additionally, narrow scope of duties was determined for state and local government administration bodies.

Participants of the Polish episcopal conference and members of Diocesan synods made a considerable number of legal regulations. a church system of historic preservation service has been developed for years; an abundance of works are carried out to historic monuments and sites; there are church institutions collecting and listing properties and sites as well as supervising protection-related activities and cooperating with selected government bodies.

The article describes the system of historic preservation care provided to the architectural complex of outstanding historical value located on the Wawel Hill. The historic preservation supervision is organised in a very particular way, i.e. responsibilities of the Regional Historic Preservation Officer are delegated to the Head of the Wawel Royal Castle acting as Historic Preservation Officer of the Wawel Hill. His area of competence covers the entire Wawel Hill within the boundaries set forth in the register of historic monuments and sites (A-7), i.e. not only the museum premises and the land on which it is located (owned by the State Treasury) but also church facilities (including Wawel Cathedral) and hill slopes for which Cracow Municipality is responsible. It seems that there are sound reasons behind the scope of historic preservation supervision covering both movable (exhibit items) and immovable (architecture) properties. With regard to Wawel, it is also particularly important to keep this ensemble of great historical significance under joint historic preservation supervision. It is therefore not recommended for three separate bodies, i.e. the museum, the church, and the municipality, to be responsible for this group of historic monuments. This results from the fact that a standardised and uniform concept needs to be defined for this ensemble and a great number of problems pertaining to technical and conservation issues need to be solved comprehensively. Furthermore, this article details duties carried out by Historic Preservation Officer of the Wawel Hill and explores matters for which Regional Conservation Officer is responsible. The author is of the opinion that the organisation of the discussed historic preservation supervision may be a role model for other residences of great historical value and other protected ensembles used as museums.

Article 25 of the Act on the Protection and Care of Historical Monuments (hereinafter: u.o.z.o.z.) imposes some obligations on owners or property holders of listed immovable historic monuments that have been adapted for utility functions. These obligations include holding conservator’s documentation and having a programme of the preservation works and program of the development of the monument and its surroundings (both programmes shall receive the consent of the voivodeship historic preservation officer). This provision is the only one in the Act that strictly concerns the adaptation of historic monuments. Despite this fact, it is not fully applied in practice. The first reason for this is that there is no sanction if somebody does not hold the required documentation. Secondly, regulations are insufficiently precise, for example, the procedure for reaching an agreement with preservation officer is not specified. The article is based on empirical research carried out in selected voivodeship historic preservation offices. The text focuses on the problem of how article 25 of u.o.z.o.z. is applied in practice. It transpires that some voivodeship historic preservationofficers do not apply this provision at all, while in other voivodeships agreements are rare or are not reached as an autonomous activity but within the framework of other procedures (e.g. connected with allowances for performing some work). The analysis of documents prepared on the basis of article 25 u.o.z.o.z. leads to the conclusion that such documents are often incomplete or mistaken for other similar documents that are also obligatory, but on a different legal basis. What is more, the practice in the terms of the form and procedure of agreements is uneven – ordinarily, it takes the form of a letter, although there are also cases when a formal decision or opinion is issued. The results of empirical research served as a basis for de lege lata and de lege ferenda postulates.

Since 1989, the system of monument protection in Poland has been adapting to the changes occurring in the Polish political system. Defining the scope of power and duties of historic preservation services is not only a tremendously important element of these changes. It is also a key factor in how the monument protection system functions. The nature of the changes results in stakeholders playing increasingly significant role in protection of monuments and sites – they become major partners to historic preservation services. Moreover, these services may find regional government bodies having broad scope of duties pertaining to monument protection particularly useful. Increasing significance of the role that local government bodies have been playing results in the scope of power and duties of regional historic preservation offices being broadened. Local government bodies are therefore going to participate more actively in the protection of historic monuments and sites. At the same time, their actions should be inspired, planned, and coordinated by regional historic preservation services. Support and supervision, on the other hand, should be provided by state historic preservation service being independent of local government bodies. The state and local government services cannot be therefore considered an alternative – they should fully and closely cooperate with each other. For this reason, cooperation among these services should be promoted and encouraged.

Under the Act of 23 July, 2003 on the Protection and Guardianship of Monuments, employees of historic preservation offices supervise works carried out to historic monuments and sites as well as determine their scope. The scope of works depends on the form of legal protection and it is conditional on the decision pertaining to legal protection, i.e. listing a property or site in the register or municipal/communal record of historic monuments and sites; providing area-wide protection: defining historic preservation area in a local zoning plan. Members of staff of historic preservation offices are responsible for assessing documents pertaining to renovation, restoration, and conservation works carried out to monuments and sites as well as make administrative decisions on all actions, regardless of the level on which they are taken: issuing conservation guidelines, permits for conducting research on historic monuments and sites, making decisions on commencing conservation works, supervising the works until their completion. Quality of works carried out to historic monuments and sites depends on individual experience and skills that the members of staff of historic preservation offices demonstrate. The higher the rank of a monument or site, the heavier responsibility historic preservation offices shoulder.

The article concerns research on the history of the conservation of architectural monuments in Poland in the interwar period. A comparison of the first postindependence resolutions covering the protection of Polish monuments shows that the content of the provisions is based on the findings and assumptions developed while the partitions were still in progress. Undoubtedly, the work of societies and conservationist groups, for the purpose of popularizing knowledge about historical objects and making the public aware of the need to undertake conservation activities, became the foundation for the organization of future conservation services. The article presents an analysis of the process of forming Polish conservation structures in the independent state and presents the methods of work of district conservators adopted at that time. This paper pays attention to the attitude of the clergy, scientific circles and the general public to the formed concept of conservation. It should be emphasized that many of the organizational assumptions and legal regulations of the time have influenced the practice and methods of contemporary conservators today.

This article explores the relations between the provisions of the Act on the Protection and Guardianship of Monuments and Sites and the Construction Law from the perspective of modern historic preservation. Particular emphasis is placed on the forms of direct historic preservation in the context of the record of historic monuments and sites, which, in spite of being mentioned in the said Act, is not referred to as a form of ‘preservation’. What is also highlighted in this article is the necessity to make amendments to legal acts pertaining to classification and categorisation of historic monuments and sites. The author of this article is of the opinion that this can be achieved only by standardizing administrative regulations and deleting contradictory regulations from legal acts.

In Poland there are 70 facilities recognised as monuments of history, 14 of which are listed on the UNESCO World Heritage list. From the point of view of the effects in terms of national recognition for the historical monument, it has a prestigious meaning. Given the distinction of cultural monuments as a separately governed issue by article. 7 of the Polish Act on Antiques’ Protection and Care, a question is raised debating the ratio legis of this institution. The possibility to apply for entry onto the UNESCO list is the only result of this legal regulation. However, what is the most problematic – the entry of such historic monument onto this exclusive List also does not constitute a change in terms of the legal status of such an object. The aim of this paper is to analyse the issue of the real and effective judicial protection of, both historic monuments as well as the facilities included in the list of World Heritage.

Artykuł ma na celu opisanie powstania Parku Miejskiego w Zamościu i pokazanie go w nowym ujęciu badawczym. Powstanie tego założenia parkowego jest tematem stosunkowo słabo znanym w historii sztuki polskiej, a jednocześnie pozostaje pierwszą ważną inwestycją miejską, która rozpoczęła proces rewitalizacji Zamościa i kreacji go na miasto-zabytek w okresie międzywojennym. Miejsce to było już wcześniej badane, ale nie rozpatrywano go nigdy w kontekście myśli konserwatorskiej, która rozpoczęła okres zainteresowania dziejami miasta.Na podstawie zgromadzonego materiału archiwalnego, a szczególnie korespondencji między projektantem, architektem, radą miejską, konserwatorem, a także ministerstwami wyłania się ciekawy obraz miasta i jego społeczności, zaczynającej rozumieć, po latach niewoli, czym jest historyczna przestrzeń i jak zachować ją dla pokoleń. Co istotne, powstanie parku w Zamościu nie jest dziś należycie doceniane, nie zauważa się w nim pierwszych ważnych głosów konserwatorskich, które sprawiły, że Zamościem zaczęto interesować się na szerokim polu badań artystycznych.
The aim of this article is to describe the creation of the Municipal Park in Zamość and show it in a new research approach. The topic of the origins of this park’s plan is relatively unknown in the Polish art history, while it is worth mentioning that in fact it is the first Polish municipal investment that includes the process of revitalizing Zamość and making it a monument-city during the inter-war period. This place had been previously explored, but the conservatorial context which initiated the period of interest in the history of the city, was never considered before.On the basis of the collected archival material, and especially the correspondence between the designer, architect, city council, conservator and ministries, an interesting image of the city and its community emerges – community which begins to understand, after years of captivity, what a historical space is and how to preserve it for next generations. What is important, the creation of the park in Zamość is not properly appreciated today, because the first important conservators’ voices are not noticed – voices which made Zamość the object in artistic research.

This article discusses the issue of adaptation of immovable historic monument and sites in light of the legal requirements and from the point of view of heritage protection authorities being one of the participants of the adaptation process. The initial aim is to define the concept of monument adaptation and delineate the conditions in which such a process occurs. The article describes a series of initial actions taken prior to the actual preservation and restoration works – as part of the adaptation process. These works include e.g. detailed research on a historic monument or site, including historical (historical-preservation studies), preservation, architecture, and in many cases also archaeological research. The aim of these activities is to acquire a fullest possible picture of the monument. The results of this research then constitute a basis for preparation of project documentation of the intended works. The article underlines importance of assigning an appropriate purpose to the asset undergoing the process of adaptation, which should be merged with a monument or site, i.e. respect all of its historical values and ensure the optimal utility of the asset, avoiding a series of potential negative consequences. The paper then discusses the applicable legal framework concerning protection of immovable monuments and competences of monument protection authorities resulting from the said framework. The paper’s conclusion postulates that the activities of all personnel working on historic monuments and sites should be guided by their inner conviction that monuments need to be looked after and that they have a social duty to maintain them for the sake of future generations. This duty is actually applicable to all citizens, just as the cultural heritage is the primary building block of the nation’s historical identity.

This article discusses practices of classification of historic monuments and sites which have been adopted in Poland so far. The author of this article presents criteria pertaining to categorising and making inventory of historic monuments and sites developed in the first half of the twentieth century by Jan Zachwatowicz, Zdzisław Bieniecki, and Michał Witwicki. Furthermore, what is also presented is classification of materials that are relevant by their use or invention, classification of modernism monuments, and classification of historic monuments and sites which was carried out in the years 19590–1962, at the time when classes 0 and 1–4 were introduced. In future, historic monuments and sites should be classified by members of different expert teams cooperating with each other on different levels (regional and supralocal). The lists must be verified by academic authorities from various communities (art and architecture historians, conservators, etc.) and all works must be carried out in compliance with currently binding regulations. The criteria should be developed in accordance with the regulations set forth in the Polish Act on Protection and Guardianship of Monuments and Sites of 23 July 2003, unless major amendments are made to it. The author of this article suggests the following criteria, compliant with the legal regulations in force: – artistic merit (art. 3.1): the form of a property or a group of properties (quality and scope of their influence – European, supraregional, and local) – scientific and academic merit (art. 3.1): authenticity of the idea, material, function as well as construction, material, and innovation on local and supraregional scale. – historical merit (art. 3.1): the value and significance of the site, people and events - European, supraregional, and local scale It is necessary to define the significance and value of historic monuments and sites of European (supranational), regional, and local importance. Classification of both single historic monuments and sites and their groups should be clear, simple, and include the smallest possible number of valuing criteria. Furthermore, it should be compliant with Polish laws in force. When applied, the classification should result in factual selection of properties and sites - not on creating new groups of properties and sites of great historical importance and new categories of values being difficult to define. It is not possible to have standardised cirtieria matching all requirements and assigning high rank to each historic monument and site.

Regional Historic Preservation Officers are of the opinion that monument protection system in Poland needs to be modified. According to them, however, these changes need to be preceded by in-depth analysis of the existing situation, e.g. the condition in which historic monuments and sites are preserved in Poland, the sources of financing works carried out to monuments and sites, the role that historic preservation offices play in administration combined with regional governors, and the current financial and HR situation in specific government bodies. Changes made to the monument protection system should result in improving the conservational state of historic monuments and sites as well as improving functioning of historic preservation service in competence-, organisation-, and finance-related aspects. Furthermore, as a consequence, local government bodies and the society should become more aware of their responsibilities pertaining to historic monuments and sites. The role of local government historic preservation service should be also taken into consideration. According to Regional Historic Preservation Officers, the changes should be aimed at the following: strengthening the office of General Historic Preservation Officer who will shape historic preservation policy in Poland and coordinate actions taken by state and local historic preservation service; subordinating Regional Historic Preservation Officers directly to the General Historic Preservation Officer (within structures of the Ministry of Culture and National Heritage); improve the organisational and financial situation in Regional Historic Preservation Offices and adapt it to their needs; developing a model of local government historic preservation service in terms of their competences, organisational structure, and subordinance (control- and meritrelated) to Regional Historic Preservation Officers. It is necessary to make legislative changes to the monument protection law not only by issuing clear, uniform, and adoptable regulations but also by correlating regulations pertaining to protection of historic monuments and sites with other existing acts of law. It is also essential to perform comprehensive analysis of the list of Polish monuments and sites (register and record of historic monuments and sites) as well as develop and implement a financial support system for taking care of historic monuments and sites and include properties owned by the state treasury into this system. It must be also emphasised that there is a strong need for increasing social importance of guardianship of monuments and sites and making the society aware of limitations and benefits pertaining to monument protection.

Opis:
New additions in a historical context can take many forms, such as additions to existing buildings and new subsidiary additions like garages, sheds, and outbuildings. There are two main reasons for introducing new additions to historic buildings. These are the loss of original functions, the resultant need for new spaces to serve the given secondary function, and the need to integrate the physically damaged parts of historic buildings with new designs. Therefore, in this study, a model proposal based on a rating system developed with international standards as the main guiding principle is proposed to analyze and evaluate the compatibility of new additions with historic buildings. It was then tested in nine historic baths, where different facilities were added, in Turkey. The study provides an important contribution to determining the suitability of new additions to existing buildings before and during the design phase and can serve as a guiding model for the supervisory authority responsible for the necessary permits.
Dobudowy mogą przybierać różne formy w historycznym kontekście, przykładowo jako rozbudowy istniejących budynków oraz dobudówek, takich jak garaże, szopy czy oficyny. Istnieją dwa główne powody dobudowywania nowych części do obiektów historycznych. Są to utrata funkcji pierwotnej i wynikająca z niej potrzeba nowej przestrzeni do korzystania z nowej funkcji oraz konieczności integrowania fizycznie uszkodzonych części budynków zabytkowych z nowymi. Proponowany model oparty na systemie ocen, stworzony na podstawie międzynarodowych standardów jako głównej zasady, może zostać użyty do analizowania i oceny kompatybilności dobudów do budynków historycznych. Model przetestowano na dziewięciu zabytkowych łaźniach w Turcji, do których dobudowano różne lokale. Badanie to stanowi ważny przyczynek do ustalania poprawności dobudów do budynków istniejących zarówno przed, jak i w trakcie fazy projektowej, i może być wzornikiem dla urzędów.
