Art. 48 of the Constitution of the Russian Federation guarantees everyone the right to qualified legal assistance. The question of the means and methods it should be provided with has been debated between lawyers for a long time. A number of scientists talk about the need for legislative consolidation of the ‘advocate monopoly’. Others consider it appropriate to license the legal services market. These disputes remain relevant today. However, in 2019, Russia has undergone a reform of procedural law, which lawyers have called a ‘process revolution.’ Many rules of procedural codes have undergone major changes. In particular, as a result of the reform, the requirements for persons who may act as representatives in civil matters have been substantially changed. In the framework of this article, an attempt is made to analyse the reform of the institution of representation. Based on a systematic analysis of procedural legislation and law enforcement practice, the author comes to the conclusion that legislative consolidation of the need for higher legal education for representatives can be called one of the positive aspects of the reform. This article provides an analysis of the development trends of the institution of representation in the historical aspect. The author concludes that it is maintaining logical and consistent movement along the path of becoming an‘advocate monopoly’ in Russia. It seems that subject to its competent and phased introduction, as well as the reform of the corps of the bar itself, not only by increasing its number but above all by increasing the professionalism of its members, it can and should become an effective tool in the civil process.

In a dynamically changing World, the process of educating students at universities must also change. The changes implemented, however, should be well thought out. The events of the last two years related to the pandemic have caused a global revolution in teaching methods, which have had to be modified to transfer knowledge remotely. Such ad hoc changes are contributing to a change in how higher education is viewed, especially in the context of traditional fields of studies such as the law, which have so far been reluctant to embrace new trends in curriculum design and educational methods. Because of their natural attachment to national legal systems, these faculties have been slower than others to undergo internationalisation, i.e. student exchanges in the educational process (due to difficulties with subjects being recognised abroad). For years, the Nordic countries, and especially Finland, have been among the leading countries in the world with regard to shaping effective and innovative systems of education, including higher education.

Significant changes in the field of education observed in recent years under the influence of economic, political and social processes, as well as Ukraine’s entry into the global, in particular European, educational space, have become the basis for the implementation of educational reforms at all levels – from preschool to adult education. That is why there is an urgent need for professionals in various fields to have a high level of legal culture, because ignorance of the law does not absolve one from responsibility. In addition, the goal of all reform processes in our country is to achieve compliance with the European architecture in the relevant fields – legal, educational, medical, etc. Regulations are the main means of regulating and implementing legal policy in the field of education. Formation of legal culture of all participants in the educational process is a guarantee of the rule of law, a guarantee of fostering respect for the law and the state as a guarantor of law and order in the exercise of the right to education by every citizen. Accordingly, the legal competence of students, regardless of their field of study, is no longer just a requirement of modern society, but also a basic need of every person. The category of «legal culture» is one of the main characteristics of the country’s legal system, which helps to determine the quality of the legal life of society. The level of legal knowledge is an indicator that reveals the quality of the legal life of a higher education student, which allows the latter to evaluate both his or her own actions and/or inaction and the actions of other members of society and to distinguish legal relations in different branches of law. Structural components aimed at improving the level of legal culture of higher education students can be divided into informative components (regulatory framework of a higher education institution, charter, collective agreement, internal regulations, provisions and procedures governing the educational process, etc.), an evaluative component is the direct attitude of a higher education student to law in general (teaching general legal disciplines to understand the importance of legal knowledge and skills) and an organizational component is the activities of research and teaching staff. The issue of forming legal culture in higher education students should be prioritized during higher education, since knowledge of and compliance with the rules of law at the present stage of European development is unconditional.

The article attempts to present the legislative changes relating to the so called Act 2.0, i.e, the law on higher education together with its implementary regulation on studies as well as the proposed university apprenticeship, which has not as of yet been made into law of any kind. These changes may have a considerable impact on legal education in Poland, and, hence, on the public administration sector in the context of its needs. For it seems justified to assume that the two research areas, i.e. the public administration sector and legal education are both interrelated and that they exert reciprocal influence upon each other. For public administration, in order to function properly, requires a supply of lawyers whereas the latter, in turn, considerably affects its practices – for instance, by way of academic activities and jurisprudential construction or judicial review. The text focuses, above all, on outlining the postulate of the so called good administration. Subsequently, selected issues are presented in the areas of legal education that are related to such administration and can serve to either implement the postulate or to weaken it. Presented are also the assumptions of the draft of the, so called, academic apprenticeship as well as the draft law together with its implementary regulation. Moreover, attention is paid to the phenomenon of mythologisation of practical education presenting a desired direction of legislative action in that respect.

Aim. The purpose of the study is to research the career of Professor Ioannikii Malynovskyi in higher education, his contribution to its development, the goals of the university education. Methods. In the study several different methods were used in the system and interaction. A dialectical method, which boils down to the fact that all phenomena in society have a beginning and an end. The historical method was used to take into account historical traditions, socio-cultural roots of the state and law. A logical-semantic method was also used to help define the conceptual apparatus used in the study. Formal-legal method was used to analyse and disclose legal concepts. Results. The research showed that Malynovskyi conducted scientific researches in the chosen field and by getting acquainted with the heritage of national and world culture. The professor made considerable efforts in education to democratise higher education, in particular, by admitting women to higher education in Western Siberia. He defined the goals of university teaching: 1) to learn to acquire knowledge, the method of scientific research and, 2) to get acquainted with the current state of science. The scientist was the first to create a chronologically consistent, comprehensive subject course on the history of Rus’ law. Conclusions. Malynovskyi’s contribution to the democratisation of higher education already belongs to history, but his scientifically based recommendations on the goals of university education and means of achieving it are not without relevance today, but especially on the practical side in training future legal practitioners  which are topical for today.

The model of educating lawyers, just as the model of university itself, undergoes constant changes. The search of new lawyer teaching paradigms seems to be a necessity on the one hand, but on the other one – it may be an opportunity to give a satisfying answer to all expectations from both higher education system as well as students. Exploitation of the potential of human creativity based on knowledge, because of the amount of external stimuli, requires the use of tools which allow its arranging. One of the techniques which may be of use here is mindmapping, since its basic purposes are: selection, arranging and remembering information, as well as supporting creative skills. Taking above into consideration, the aim of this article is both to make an attempt to show the mindmapping itself as well as to draw the reader’s attention to the opportunities given by using this technique in the teaching of law as well as the history of political-legal doctrines in particular. The article’s main part deals with the hypothesis based on the assumption that one of the elements of new legal education paradigms may be application of mind maps which allow not only increasing the attractiveness but, what is even more important – raise the effectiveness of teaching of law. Moreover, the ability to create and then to use mind maps can be a favourable factor in education of the so-called “soft skills”, such as: creativity, choice and selection of information, managing oneself at work or team work. To illustrate the contents, the author presents examples of his mind maps created with the use of specialized licensed software iMindMap.

This article analyses the methodological essence of the definition of “pedagogical condition” and “legal competence”. The essence of the phenomenon of “legal competence” of junior bachelor in the field of humanities of higher educational institutions is clarified and scientifically proved. The content of the concept “legal competence” is revealed; the basic components of legal competence (axiological, cognitive, humanitarian, acmeological, empirical) are revealed; the efficiency of pedagogical conditions in forming the legal competence of junior bachelors of higher education institutions is scientifically proved. It has been established that higher education institutions in the humanities provide a specialist with a “junior bachelor” degree with certain knowledge, skills and abilities of a legal orientation, which forms legal competence during certain pedagogical conditions. The article also presents the most effective pedagogical conditions designed to develop legal competence in junior bachelors of higher education, namely: organisation of education aimed at stimulating positive motivation for professional activity of specialists of education and qualification level of a junior bachelor; reflection in the content of professional disciplines of the specificity and originality of integration of legal knowledge with the disciplines of the humanities cycle; directing undergraduate self-study to develop self- -reflection skills and an understanding of the role of research work and varied practice in it; encouraging undergraduate students to volunteer. The pedagogical model of legal competence formation for junior bachelors in the humanities contains four blocks: purposeful, content, operation-activity and evaluation-result. It has been found that to successfully develop students’ legal competence, it is necessary to create pedagogical conditions in a higher education institution for teachers to use innovative methods and techniques (research methods, projects, cases, debates, presentations, etc.). It is precisely innovative teaching methods that effectively contribute to the quality of education by developing the creative abilities of individuals. According to the results of the empirical research method, it was found that the effective forms, methods and means of implementing the pedagogical conditions of junior bachelors in higher education was the organisation of independent and scientific work.

Separating Roman law from the theory of applicable private law inspires - from the beginning of 20th century – the questions pertaining to the meaning, aims, and methods of researching Roman law. This article analyses these issues in the context of the changes of the evaluation of research resulted from the Polish higher education and science act enacted in 2018. The core of this analysis is the comparison of the traditional understanding of the internationalization of the study of Roman law by Polish researchers and the understanding of world-class research according to the new Polish law. The tension between traditional approach of Romanists and bibliometric criteria of evaluation has significant implication for whether and how the Roman law should be studied and taught on the Polish faculties of law. The paper stresses the role of the impact of Polish researches of Roman law on the European debate about basic problems of private law and legal method today. The future of Roman law in Polish legal education interacts with today’s fundamental dispute about what is Western civilization and how it is to be understood.

Ustawa Prawo o szkolnictwie wyższym i nauce z lipca 2018 (ustawa 2.0) wprowadziła istotne zmiany ewaluacji jakości badań naukowych. Największy wpływ na wynik tej oceny mają publikacje naukowe. Zasadą jest, że uwzględnia się artykuły w czasopismach indeksowanych w bazach Scopus lub Web of Science. Liczba punktów przypisanych czasopismom w wykazie ogłoszonym przez ministra jest uzależniona od wyliczeń bazy co do oddziaływania pisma. Rozciągnięcie tych kryteriów bibliometrycznych na czasopisma prawnicze było przełomem w ich dziejach. W artykule podjęte zostały pytania: w jakiej mierze reprezentatywne jest stosowanie kryteriów bibliometrycznych do oceny czasopism prawniczych? Czy ogłoszony przez ministra wykaz i ranking czasopism prawniczych jest podobny do instrumentów i praktyk ewaluacyjnych w innych krajach? Co jest wyjątkowego w cezurze wyznaczonej przez ustawę 2.0 w historii polskich czasopism prawniczych względem wcześniejszych cezur w tych dziejach? Jakie zmiany w zakresie uwzględniania czasopism prawniczych w ewaluacji nauki są uzasadnione? Przypisanie kluczowej roli bazom Scopus i WoS autor ocenia jako wymuszoną rewolucję. Stosując metodę porównawczą, historyczną i argumenty pragmatyczne, autor formułuje postulaty zmierzające do przekształcenia tej rewolucji w pożądaną zmianę ewolucyjną. Kluczowe dla niej powinno być pełne poszerzenie zakresu czasopism prawniczych uwzględnianych przy ewaluacji o włączone do baz ERIH PLUS , HeinOnline lub zagranicznych oficjalnych wykazów czasopism wykorzystywanych do oceny badań naukowych, a także całkowite zastąpienie przy ocenie prestiżu czasopism prawniczych kryteriów bibliometrycznych przez ocenę ekspercką.
The Law on Higher Education and Science adopted by the Polish parliament in July 2018 madeextensive changes to the model of the institutional evaluation of research. The evaluated outputconsists mainly of papers published in scientific journals. In principle, the journals eligible for theevaluation procedure are those indexed in Scopus or WoS. The official Polish ranking of journalsshould reflect the metrics from these databases. The statutory enlargement of bibliometric dataon the evaluation of legal papers constitutes a fundamental breach in the history of Polish legaljournals. The article deals with a few questions: how representative is the application of the bibliometricsfor legal publications? Is the Polish ranking of legal journals consistent with the evaluationpractices in other countries? What is unique in the caesura in the history of Polish legaljournals marked by the law from 2018, when compared to earlier turning points in this history? What recommendations to change the evaluation legal journals in Poland are justified? The author sees the evaluation of legal journals focused on Scopus and WoS as an unwanted revolution. Using comparative,  historical and pragmatical arguments, he recommends the transformation of the revolution into evolutive modifications. This reasonable evolution should be based on two things. Firstly, replacing bibliometric evaluation with expert evaluation. Secondly, more legal journals should be eligible in the evaluation process: journals indexed in ERIH+ and HeinOnline, and journals included in the official journal lists of countries other than Poland, should be taken into account.

W artykule podjęto próbę zaprezentowania zmian legislacyjnych związanych z tzw. ustawą 2.0, tj. ustawą Prawo o szkolnictwie wyższym wraz z rozporządzeniem wykonawczym w sprawie studiów, jak i projektem tzw. aplikacji uniwersyteckiej, która aktualnie nie została jeszcze ujęta w jakiekolwiek ramy normatywne. Zmiany te mogą mieć wymierny wpływ na kształcenie prawnicze w Polsce, a co za tym idzie, także na sektor administracji publicznej w kontekście jego potrzeb. Wydaje się bowiem zasadne przyjęcie, że te dwa obszary badawcze, tj. sektor administracji publicznej i kształcenie prawnicze, są ze sobą wzajemnie powiązane jak i wzajemnie wpływające na siebie; administracja publiczna dla funkcjonowania potrzebuje bowiem kadr prawniczych, a te z kolei w wymierny sposób kształtują jej praktykę – przykładowo poprzez działalność naukową i wykładnię doktrynalną czy też sprawowanie nadzoru sądowego. Unikając przy tym odpowiedzi na pytania badawcze o charakterze generalnym, jak np. „jakie powinno być »dobre« kształcenie prawnicze?” czy też o optymalny model funkcjonalny administracji publicznej w Polsce, w tekście skupiono się w pierwszej kolejności na zarysowaniu postulatu tzw. dobrej administracji. W dalszej kolejności zaprezentowano wybrane zagadnienia z zakresu kształcenia prawniczego, które z taką administracją są związane i mogą służyć realizacji postulatu albo ją osłabiać. Zaprezentowano też założenia projektu aplikacji uniwersyteckiej oraz projekt ustawy wraz z rozporządzeniem wykonawczym. Zwrócono także uwagę na zjawisko mitologizowania kształcenia praktycznego, prezentując w tym zakresie pożądany kierunek działalności prawodawczej.
The article attempts to present the legislative changes relating to the so called Act 2.0, i.e, the law on higher education together with its implementary regulation on studies as well as the proposed university apprenticeship, which has not as of yet been made into law of any kind. These changes may have a considerable impact on legal education in Poland, and, hence, on the public administration sector in the context of its needs. For it seems justified to assume that the two research areas, i.e. the public administration sector and legal education are both interrelated and that they exert reciprocal influence upon each other. For public administration, in order to function properly, requires a supply of lawyers whereas the latter, in turn, considerably affects its practices – for instance, by way of academic activities and jurisprudential construction or judicial review. Avoiding addressing more general research questions, such as “What should ‘good’ legal education be like?” or about the optimal functional model of public administration in Poland, the text focuses, above all, on outlining the postulate of the so called good administration. Subsequently, selected issues are presented in the areas of legal education that are related to such administration and can serve to either implement the postulate or to weaken it. Presented are also the assumptions of the draft of the, so called, academic apprenticeship as well as the draft law together with its implementary regulation. More over, attention is paid to the phenomenon of mythologisation of practical education presenting a desired direction of legislative action in that respect.
