    Aleksander Antoni Sapieha has gone down in the history of Polish science, he is one of the episodic figures in the political history of our country in the Napoleonic era; and in the history of Polish literature he appears as the author of the Enlightenment travelogue. The reading of Journey around the Slav countries in the years 1802 and 1803 and the semantically defined narrator-hero-real author on the basis of hermeneutic interpretation is an attempt to supplement the ways in which both, the travel book and its creator, are discussed in Polish scientific and popular science literature about those aspects that can be derived from the text itself. Among them, attention is paid to the specificity of a research attitude stretched, so to speak, between its two complementary pars, rational and idealistic, combined in a particular pragmatism of knowledge, in which the pursuit of cognition accompanies the pursuit of common good. The result of the hermeneutic experience of reading Sapiehaʼs travelogue is an attempt to capture his scientific and social heritage which takes into consideration the plane of this internally doubled, yet coherent research attitude, which in a broader sense seems to be surprisingly fresh and inspiring.

    Pointing to the subjective nature of human life, theorists argue that only in a dialogue with another person does the human disclose meanings important to him or her. The interpretation and analysis of stories with regard to the included subjective meanings included in them as manifestations of human subjectivity seem to be the most effective when undertaken in the hermeneutic approach where psychology and philosophy meet. In the paper advantages of a self-narrative method based on the principles of hermeneutic psychology have been presented. This method has been applied to analyse the stories told by ten persons of senior age and obtained through a narrative interview. This analysis has served to verify the mentioned method, to recognise the respondents’ subjective world of meanings as well as to deepen the reflection on the subjective nature of human life. The exemplary analysis of two out of ten self-narratives obtained in the research have been presented in the article. Similarly to the theoretical reflection included in the text, the research results join the ongoing discussion in contemporary psychology over the legitimacy of the use of qualitative methods.

    The Barcarolle, Op. 60 is a late (1846) Chopin masterpiece. The shrewdest interpreters (Maurice Ravel, Jarosław Iwaszkiewicz) immediately understood that this miniature represents something much deeper than just a skilful stylisation based on Italian (Venetian?) melody. The author presents and discusses in detail several hermeneutic attempts at interpreting the meanings of the Barcarolle, devoting particular attention to Iwaszkiewicz’s sketch ‘Barkarola Chopina’. He also draws attention to the peculiar rhetoric of the text (strongly marked aquatic motifs, accentuated polyvalence and the shimmering of meaning). He goes on to reveal striking connections between the semantics of Iwaszkiewicz’s essay on the Barcarolle and his texts devoted to Venice. In the final section, he puts forward the hypothesis that the Barcarolle can be interpreted as a musical portrait of Venice - a portrait made of sounds, and so by definition vague, allusive and symbolic; a portrait in which the rocking and shimmering of the notes is also the shimmering of meaning.

    W artykule została poddana ocenie monografia Krytyka hermeneutycznego rozumu. Preliminaria Andrzeja Przyłębskiego (Universitas, Kraków 2016). Autor porządkuje swój wywód wokół trzech celów. 1) omówienie głównych tez przedstawionych w książce; 2) przedstawienie je w szerszym kontekście współczesnej hermeneutyki oraz 3) zainicjowanie dyskusji nad problematyką filozofii hermeneutyki, jej statusem i podstawami teoretycznymi. W rozważaniach został położony nacisk na sposoby definiowania relacji między rozumieniem a wyjaśnieniem (ze względu na ich dialektyczne powiązania).
    The paper presents a critical approach to Krytyka hermeneutycznego rozumu. Preliminaria by Andrzej Przyłębski (Universitas, Cracow 2016). It aims to:1) discuss the main theses presented in the book; 2) depict them in a larger context of contemporary hermeneutics and 3) start a discussion over the issues of hermeneutic philosophy, its status and theoretical background. The article emphasizes the manners of defining relations between understanding and explaining (due to their dialectic connections).

G. Jung’s analytical psychology, as well inspirations taken from ritual studies, archetypal literary criticism, and transcendental hermeneutics. This combination of interpretational practices shall be applied to the reading and analysis of Wisława Szymborska’s poem Pamięć nareszcie / Memory at Last. My chief aim is to analyse the ritual dimension of the poem (without disregarding, however, the work’s stylistic features). Wiersz Pamięć nareszcie Wisławy Szymborskiej. Interpretacja transestetycznaNiniejszy esej jest próbą połączenia kilku elementów pełniących ważną rolę w takich praktykach interpretacyjnych jak hermeneutyka, eksplikacja tekstu, teoria aktów mowy, psychologia analityczna C. G. Junga, a także inspiracji płynących z badań nad rytuałem i archetypami, wreszcie z hermeneutyki transcendentnej. Połączenie wymienionych praktyk interpretacji będzie służyło lekturze i analizie wiersza Wisławy Szymborskiej Pamięć nareszcie. Moim głównym celem jest analiza rytualnego wymiaru wiersza (choć także jego cech stylistycznych).

    The article focuses on the issue of proper interpretation of the Second Vatican Council’s inheritance. Benedict XVI believes a “hermeneutic of reform” is an alternative to a “hermeneutic of rupture”. Nevertheless, the expected “hermeneutic of reform” has received different interpretations. That’s why a relevant hermeneutic of the “hermeneutic of reform” must be applied. The author presumes that an issue of the Bible interpretation, which is in accord with the postulated by Benedict XVI “hermeneutic of faith”, is a practical expression of applying the “hermeneutic of reform”. Therefore, the „hermeneutic of reform” has been interpreted in the light of the “hermeneutic of faith”.

    W niniejszym artykule analizuję polityczność interpretacji i polityczność teorii interpretacji prawniczej z perspektywy neopragmatyzmu Stanleya Fisha. W pierwszej części tekstu definiuję pojęcie polityki i polityczności, zapożyczając się u Chantal Mouffe. Wyraźnie odróżniam polityczność, politykę i the policy; w mojej analizie wykorzystując pierwsze ujęcie (polityczność). W drugiej części artykułu charakteryzuję hermeneutyczny uniwersalizm, jako jedno z podejść do problematyki interpretacji prawniczej. W trzeciej części tekstu, po charakterystyce koncepcji wspólnot interpretacyjnych u Stanleya Fisha, wyprowadzam wnioski dotyczące politycznego charakteru wykładni prawa i teorii wykładni prawa. W ostatniej części tekstu zastanawiam się nad możliwościami budowy teorii interpretacji prawniczej, która uwewnętrzni inherentną polityczność wiedzy analizując koncepcję filozofii postanalitycznej, zaproponowanej w literaturze przez Andrzeja Batora.
    In this paper, I analyse the political character of the interpretation of law and the political nature of the theory of legal interpretation from Stanley Fish’s neo-pragmatist perspective. In the first part of the text, I define the concept of politics and the political, borrowing from Chantal Mouffe. I clearly distinguish between the political, politics, and policy; this article uses the first concept (the political). In the second part of the article, I characterize hermeneutic universalism as one of the approaches to the problem of legal interpretation. In the third part, following the characteristics of the concepts of interpretive communities as defined by Stanley Fish, I draw conclusions about the political nature of the interpretation of law and the theory of the interpretation of law. In conclusion, I analyse the possibilities of building a theory of legal interpretation that internalises the inherently political character of knowledge by analyzing the concept of post-analytical philosophy proposed in literature by Andrzej Bator.

    Opis:
    An attempt to compare the epistemological positions of two thinkers coming from different philosophical traditions requires turning to the sources of both philosophical programs. This will allow us to reveal the common and differentiating features of the described projects. On the one hand, we have Cassirer, the heir to neo-Kantianism and the creator of symbolism, on the other, we are rooted in the tradition of reflective philosophy and phenomenological hermeneutics, Ricoeur. Despite many differences in epistemological assumptions, we can find similar positions in both philosophers. The concurrence of the three Cassirerow base phenomena with three hermeneutic horizons manifests itself - as we will try to demonstrate - in the concept of the Work. The hermeneutic intuition of Cassirer turns into Ricoeur's reflection on self-understanding in the face of a work that affects our perception of the world and thinking about ourselves.In the article, we will consider how the contemporary philosophy of culture developed by Cassirer is taken up by contemporary hermeneutics. Is the convergence of the three base phenomena with the three horizons that combine with each other in the process of interpretation in the juxtaposition of the philosophy of culture with contemporary hermeneutics? Do we have the right to compare Cassirerow's base phenomena, I - You -Work is with hermeneutic communication which is presented on the line Author (Creator) -Text (Work) - Reader (Receiver)?

    Opis:
    Celem studium jest przebadanie możliwości zastosowania metody hermeneutycznej do analizy motywu światła na wybranych obrazach Michelangela Merisi da Caravaggio o tematyce religijnej. Artysta oświetlał modeli znajdujących się w ciemnym pokoju światłem padającym z umieszczonej wysoko lampy lub wpadającym przez okno. Jak dotąd, światło w jego kompozycjach traktowano jako środek wzmacniający dramatyzm scen, jako nośnik Bożej mocy, a w wypadku jego skorelowania z realnym oświetleniem wpadającym do wnętrza kaplic – jako środek zacierania granicy między sceną a przestrzenią widza i urealniania przedstawienia. Według hermeneutyki interpretacja dzieła dokonuje się w wymiarze indywidualnym, czyli w procesie aktu odbiorczego, a rozumienie dzieła prowadzi do lepszego samopoznania widza. Hermeneutyczna metoda interpretacji obrazów opiera się na założeniu, że dzieło sztuki prezentuje swoisty sens ikoniczny, różny od wiedzy czerpanej ze źródeł pozaobrazowych. Podstawą tego sensu jest całościowa struktura dzieła, czyli sposób optycznego zespolenia ze sobą wszystkich jego elementów. Swoistość i autonomiczność tego zespolenia wynikają z rozpoznawanego przez widza w oglądzie dzieła odniesienia struktury do płaszczyzny obrazu. Z tego względu płaszczyzna w doświadczeniu oglądowym jest obecna w każdym elemencie świata przedstawionego i zarazem nie jest jednym z nich – wykracza poza nie, a obraz zyskuje zdolność uzmysławiania stanu transcendowania poza ukazany świat. W metodzie hermeneutycznej światło jest więc, jak każdy składnik przedstawienia, traktowane jest jako część całościowej struktury dzieła. Na przykładzie wybranych prac religijnych Caravaggia zostało pokazane, w jaki sposób światło skupia uwagę widza na danym miejscu świata przedstawionego, które inicjuje logikę oglądową. Jej prześledzenie pozwala zrozumieć sens ikoniczny dzieła. Kluczowym elementem tej logiki jest wskazanie przez główne postaci na granicę obrazu – horyzont poznawczy transcendujący ich świat. Oglądowe doświadczenie tej relacji przekłada się na uwewnętrznienie przez widza sensu ikonicznego. Uwewnętrznienie to wynika z niemożności adekwatnego przełożenia tego sensu na język relacji między przedstawieniem a granicą obrazu. Granica zarówno przynależy do świata przedstawionego, jak i wykracza poza ten świat. Jest to sytuacja, której język werbalny nie może zgłębić. Wypowiedź musi bowiem wyodrębnić świat przedstawiony i granicę obrazu. Ta niewypowiadalna jednoczesność (zarówno-jak) jest jednak rozumiana w naszym widzeniu. Zarazem rozumienie to jest komunikowalne. Utrzymuje możliwość hermeneutycznej interpretacji, a więc przekładu doświadczenia oglądowego w medium języka. Sensem tego przekładu jest przy tym uzmysłowienie jego nieadekwatności wobec obrazowej rzeczywistości.
    The goal of the present study is to examine the insights the hermeneutic method enables once applied to an analysis of the motif of light in Michelangelo Merisi da Caravaggio’s religious paintings. The source of light the artist used in order to bring out the models he painted in an otherwise dark room was either a lantern put high above them or a window. The light in Caravaggio’s paintings has been diversely interpreted: as a means either to heighten the impact of the dramatic scenes he depicted, or to convey the power of God, or—whenever the light used in the painting was correlated with real light emanating from the windows—to blur the demarcation line between the scene the painting represented and the space of the viewer. The latter gave the painting an air of reality. Within the hermeneutic approach, the interpretation of a work of art is accomplished individually, in the process of the spectator’s perception. Comprehending a work of art is in turn tantamount to the spectator’s gaining a better self-knowledge. The hermeneutic method of the interpretation of paintings rests on the assumption that a work of art conveys its particular iconic meaning which is essentially different from knowledge derived from other, non-iconic sources. The iconic meaning results from the overall structure of a work of art, or from the way in which all its elements are optically combined. The particular character of this unity, as well as its autonomy recognized by the spectator, is a consequence of the way the structure of the painting is referred to its plane. Therefore, in the spectator’s perception, the plane of the painting is present in every element of the depicted world without simultaneously being one of these elements. Yet the plane of the painting goes beyond them, thus giving the spectator the impression of the painting transcending the depicted world. According to the hermeneutic method, the light, as any other element of the painting, is interpreted as part of the overall structure of the work. The hermeneutic analysis applied to selected paintings by Caravaggio shows how, in particular paintings, the light focuses the spectator’s attention on given parts of the depicted world, thus initiating the logic of perception which ultimately enables the spectator to grasp the iconic meaning of the painting. The key element of this logic is that the main figures in the painting point to its boundary, and thus to a cognitive horizon that transcends their world. The spectator’s experience of this relation is then translated into an internalization of its iconic meaning. The internalization in question results from the spectator’s inability to adequately translate this meaning into the language fully grasping the relation between the representation and the boundary of the painting. The boundary of the painting both belongs to the represented world and goes beyond it, which cannot be fathomed by the verbal language, since any verbal statement would imply a clear identification of the represented world as well as of the boundary of the painting. Yet this inexpressible simultaneity (‘as well as’) is grasped in an act of perception which is communicable, thus providing the possibility of a hermeneutic interpretation, or a translation of a visual experience into the medium of language.     Opis:
    The article attempts to analyse the status of the theory of legal interpretation that emerges from the contributions of one of the representatives of critical legal studies (CLS). Legal interpretation is analysed by using concepts drawn from hermeneutic universalism and the post-structural philosophy of politics. The concepts of Duncan Kennedy, an American philosopher of law, are subjected to analysis, and his concept of adjudication, the indeterminacy thesis and the hermeneutic of suspicion is addressed. The paper puts forward the thesis that the political nature of law – alongside factors closely related to social structure – is also determined by factors which pertain to the cognitive subject. This fact has crucial importance for determining the status of the theory of legal interpretation.
    Celem niniejszego artykułu jest dokonanie analizy statusu teorii interpretacji prawniczej, jaki wyłania się z koncepcji przedstawicieli ruchu studiów krytycznych nad prawem (critical legal studies, CLS). Interpretacja prawnicza jest badana przy wykorzystaniu koncepcji hermeneutycznego uniwersalizmu oraz poststrukturalnej filozofii polityki. Analizie poddane zostały koncepcje amerykańskiego filozofa prawa, jednego z najbardziej znanych przedstawicieli CLS – Duncana Kennedy’ego – jego koncepcja orzekania, teza o niezdeterminowaniu oraz hermeneutyka podejrzeń. Niniejszy tekst stawia tezę, że polityczność prawa – poza przyczynami związanymi ściśle ze strukturą społeczną – uwarunkowana jest również przyczynami leżącymi po stronie podmiotu poznającego. Ten fakt ma kluczowe znaczenie dla określania statusu interpretacji prawniczej.

    Opis:
    Vattimo is an author of so-called radicalized hermeneutics. In it he refers creatively to the counter-metaphysical nihilism of Nietzsche and Heidegger. He is accompanied by an intention of radicalization (weakening) both these positions with hope for clearing them of the remains of metaphysical thinking. The nihilistic accomplishment of hermeneutics Vattimo combines with its transition to the ethical position. However he polemizes with approaches, which develop “an ethical vocation” of hermeneutics either in the direction of the ethics of communication (like Habermas), or in the direction of the ethics of redescription (like Rorty), or in the direction of the ethics of continuation (like Gadamer). In their place Vattimo suggests the ethics of interpretation, which is rather ethics of goods than ethics of obligations. It is a kind of a retrospective (historical), pluralistic, relativistic ethics with a preference for the value of freedom.

    Benedict’s theological work shows his deep interest of the findings of historical and critical biblical scholarship. This article attempts to show a part of Pope Benedict’s thought at this field. The keyword for this theme is “the hermeneutic of faith”. There are a few steps to understand this. First: the critique of historical criticism as beginning the search for a new synthesis. Second: a question about new hermeneutic based on the historical structure of Christian faith. Third: an asking about a new language (authors of Scriptures as normative theologians). Benedict points out that Scriptures are inseparable united with Church. He represents a deep understanding of the inner logic and necessity of reading of Scriptures from the heart of the Church.

    Celem niniejszego artykułu jest przedstawienie metod wykładni (konkretyzacji) konstytucji oraz zbadanie ich oddziaływania na normatywny charakter postanowień konstytucji. Punktem wyjścia jest założenie, iż ogólnikowość przepisów konstytucji oraz ich syntetyczne ujęcie sprawia, że klasyczne reguły wykładni stosowane przy interpretacji ustaw zwykłych okazują się niewystarczające dla wykładni konstytucji. Ze względu na swoją otwartą strukturę przepisy konstytucji wymagają nie tylko wykładni eksplikacyjnej, lecz przede wszystkim interpretacji konkretyzującej. Elementy normy, które nie zostały wyraźnie wysłowione w tekście konstytucji, odkrywane są w procesie argumentacji przy uwzględnianiu rzeczywistości społecznej oraz poglądów podmiotu dokonującego wykładni. Proces ten z trudem poddaje się dyrektywom metodologicznym, dlatego w celu zakreślenia granicy swobody interpretatora oraz stworzenia gwarancji obiektywnego charakteru wykładni niezbędne jest odwołanie się do teorii konstytucji w jej tekście.
    The article discusses some methods of interpretation of the constitution aimed at concretization of its precepts and analyzes their implications for the normative character of the constitution. The author departs from the assumption that traditional directives of interpretation designed for the interpretation of statutory laws prove insufficient for the construction of constitutional precepts. Due to their general character, synthetic wording and structural openness constitutional provisions require not only an explicatory but also a concretizing construction. The elements of a norm which have not been explicitly expressed in the text of the constitution are discovered in the process of argumentation in which elements of social reality as well as subjective stances of an interpreter play a considerable role. This process can be subjected to methodological directives only with difficulty that is why in order to define the scope of the interpreter’s latitude and to ensure the objective character of the interpretation there is a need to resort to a theory of the constitution enshrined in the text of the constitution.
