    This scientific study is dedicated to the legal aspects and practical problems in the Bulgarian legislation of access to healthcare for women with disabilities. Its relevance comes from the growing need to understand the legal construction linked to the right to health of one of the vulnerable groups in society. Attention herein is directed to the existing legal framework in the People with Disabilities Act, the Health Act, the Health Insurance Act and the Medical-Treatment Facilities Act, as well as separate provisions in other legal acts. The analysis is accompanied by conclusions and suggestions for optimising practice and legislation.

    This article aims to discuss issues of "Medical tourism" within the European Union countries. The author in his publication presented the trends of medical tourism and considered the cause of this phenomenon. The article makes reference to the history of migration in medical purposes. The role of freedom of movement and freedom to provide services as the base of the economic system of the European Union for the development of medical tourism. The publication presents the basic regulations on this subject in terms of Polish law and European law. The author based on reports and scientific publications tried to in this article to assess after the presentation of both positive and negative effects of this phenomenon, and also provide potential opportunities and threats flowing from it.
    W artykule przedstawiono podstawowe zagadnienia dotyczące turystyki medycznej i transgranicznej opieki medycznej w kontekście prawa Unii Europejskiej. W artykule uwzględniono orzecznictwo Europejskiego Trybunału Sprawiedliwości, a także częściowo dorobek doktryny. Autor przedstawił pozytywne i negatywne efekty zjawiska turystyki medycznej oraz transgranicznej opieki medycznej oraz okazje i zagrożenia płynące z obu tych zjawisk.

    Opis:
    One or more forms of advance directives are regulated in the majority of legal systems. However, people generally do not create advance directives. The main reason for this problem is that people do not have enough information about this legal institution, and it is too difficult or expensive to create one. Furthermore, it is also questionable if someone has an advance directive whether it will be able to achieve the aimed legal effect. Similarly, the enforcement of the advance directives could be problematic, especially if litigation is required to enforce these wills. The situation of advance directives is more or less the same in the majority of legal systems. Our aim is to show that these problems could be solved using the already existing, e.g. in Austria or Hungary, digital health databases and by introducing a non-litigation legal dispute framework.
    Większość systemów prawnych reguluje jedną lub więcej form testamentu życia. Generalnie jednak ludzie ich nie sporządzają. Główną przyczyną tego problemu jest niedoinformowanie o tej instytucji prawnej oraz fakt, że sporządzenie takiego aktu jest zbyt trudne lub zbyt kosztowne. Ponadto nawet w sytuacji, gdy ktoś sporządził taki akt woli, rodzą się wątpliwości, czy wywoła on zamierzony skutek prawny. Podobnie problematyczna może być egzekucja testamentów życia, zwłaszcza gdy wymaga postępowań sądowych. Sytuacja dotycząca testamentów życia jest mniej więcej podobna w większości systemów prawnych. Naszym celem jest wykazanie, że można rozwiązać te problemy z wykorzystaniem już istniejących (np. w Austrii lub na Węgrzech) baz danych medycznych oraz poprzez wprowadzenie nieprocesowych rozwiązań w zakresie rozstrzygania sporów prawnych.

    Opis:
    The National Strategy for Quality and Safety in Healthcare 2022–2031, drafted in November 2021 from the Slovenian Ministry of Health, sets out, i.a., the basic foundations of a no-fault compensation model for medical errors. No-fault compensation is a new concept in Slovenian (medical) tort law. Therefore, the purpose of this paper is to determine whether a no-fault compensation regime, as set out in the Strategy, is at all necessary and reasonable in the light of the existing tort law regime and, in particular, whether such a regime would actually improve the patient’s position in tort legal relationships due to medical errors and facilitate their options. By our findings, the Strategy does not provide a sufficiently compelling rationale for intervening in the existing compensation legal regime. The Slovenian case law has already established measures to compensate for the disturbed parity between the legal positions of the patient and the healthcare organization in the assessment of medical errors.
    Narodowa Strategia Jakości i Bezpieczeństwa w Opiece Zdrowotnej na lata 2022–2031, sporządzona w listopadzie 2021 r. przez słoweńskie Ministerstwo Zdrowia, określa m.in. podstawy modelu kompensacji z tytułu błędów medycznych w systemie no-fault. Kompensacja no-fault jest nowym pojęciem w słoweńskim prawie deliktowym (medycznym). Celem artykułu jest określenie, czy reżim kompensacji no-fault wskazany w Strategii jest w ogóle konieczny i uzasadniony w świetle istniejącego systemu prawa deliktowego, a w szczególności czy taki reżim w istocie może poprawić pozycję pacjenta w stosunkach prawa deliktowego wynikających z błędów medycznych i ułatwić mu wybór. Zgodnie z naszymi obserwacjami Strategia nie podaje dostatecznie przekonującego uzasadnienia dla ingerencji w istniejący reżim odszkodowawczy. Słoweńskie orzecznictwo już ustaliło środki zrównoważenia naruszonej równości pozycji prawnej pacjenta i podmiotu opieki zdrowotnej przy ocenie błędów medycznych.

    This study provides an overview of the legal aspects of long-term care (LTC) and institutional care for the elderly. It investigates whether LTC services for seniors could be recognized as a distinct human right, possibly through a United Nations convention. The study explores the existence and core components of the right to LTC and examines the minimum standards for its investigation, implementation, and enforcement. Additionally, it analyzes the specific rights of seniors that contribute to the right to care for dependent persons while also considering the intersectionality of this right and its relationship with other human rights. The study investigates the legal frameworks for protecting the right to LTC in various countries and assesses legal solutions derived from general legal instruments and special standards, particularly those concerning individuals with disabilities. Furthermore, it discusses proposed laws aimed at preserving the dignity of seniors and preventing unnecessary examinations and abuse. The study ultimately evaluates whether the right to LTC is an independent right or an extension of the rights to healthcare and social security.

    Opis:
    The purpose of this paper is to verify the hypothesis that a debt write-off implemented recently by Polish authorities in favour of public hospitals constitutes State aid within the meaning of Article 107(1) of the Treaty of the Functioning of the European Union. The paper contains a detailed description of the nature of the measure – its historical background, regulatory context, as well as its construction. It presents an in-depth analysis of the fulfilment by the measure of the conditions stipulated in Article 107(1) TFEU. As a preliminary issue, the analysis addresses the problem whether Polish public hospitals can be considered as undertakings within the meaning of EU competition law, particularly, as to their activity financed by the sickness fund organized under the principle of social solidarity. The answer to this question seems to be affirmative and in line with the landmark Hoefner and Elser judgments where the ECJ held that the way in which an entity is financed is irrelevant for its classification as an undertaking. The paper argues in favour of the thesis that the debt write-off must be considered as affecting trade between Member States and competition. Consequently, and contrary to the official position of the Polish government, the measure in question is classified as State aid.
    Le but de cet article est de vérifier l’hypothèse selon laquelle l’amortissement total des dettes effectué récemment par les autorités polonaises en faveur des hôpitaux publiques constitue une aide publique au sens de l’Article 107(1) TFUE. L’article contient une description détaillée de la nature de cette mesure – son histoire, contexte législatif aussi que sa construction. Il présent une analyse profonde de l’accomplissement par cette mesure des conditions indiquées par l’Article 107(1) TFUE. Comme question préliminaire, l’analyse a pour objectif de vérifier si les hôpitaux publiques polonais peuvent être considérés comme entreprises au sens de la loi de concurrence de l’EU par rapport à son activité financée par le fonds de maladie organisé en accord avec le príncipe de la solidarité sociale.

    Opis:
    This paper discusses the gradual steps leading to the legal establishment of pastoral care in the health care system of the Czech Republic. It is written both from the position of confessional law and from the position of the theology of the Catholic Church. The Czech model was formed gradually and does not fully correspond to the definition of the healthcare chaplain in canon law. Its starting point is a superconfessional approach, focused on the patient, on his loved ones, but also on hospital staff, which in the Czech environment is not confessionally uniform (or predominantly Catholic). This model has worked better in this environment than the model focused solely on the provision of sacraments to Catholics. This is mainly because it deals with environments that do not encounter disease (or death) and because it is set up as a combination of spiritual care, some kind of psychological accompaniment and personal human accompaniment, especially in understanding life-threatening situations and seeking encouragement that can result in the context of the biopsycho-socio-spiritual model of man in holistic healing.
    Artykuł omawia stopniowe kroki prowadzące do prawnej bazy duszpasterstwa w systemie opieki zdrowotnej w Republice Czeskiej. Jest napisany zarówno ze stanowiska prawa wyznaniowego, jak i ze stanowiska teologii Kościoła katolickiego. Model czeski kształtował się stopniowo i nie odpowiada w pełni kanoniczno-prawnej definicji kapelana szpitalnego. Punktem wyjścia jest „superwyznaniowe” podejście, skoncentrowane na pacjencie, na jego bliskich, ale także na personelu szpitala, który w czeskim środowisku nie jest wyznaniowy (lub w przeważającej mierze katolicki). Model ten sprawdził się lepiej w tym środowisku niż model skupiony wyłącznie na udzielaniu sakramentów katolikom. Głównie dlatego, że interweniuje w środowisku, które nie spotyka się z chorobą (lub śmiercią) i ponieważ jest traktowany jako połączenie opieki duchowej, pewnego rodzaju psychologicznego i osobistego towarzyszenia ludzkiego, zwłaszcza w zrozumieniu sytuacji zagrażającej życiu i szukaniu zachęty, która w kontekście „bio-psycho-społeczno-duchowego” modelu człowieka skutkuje jego holistycznym uzdrowieniem.
