This condition has not been improved by the covid-19 pandemic or the ageing population. All this poses challenges for the health system. The next part of the text places medical spa treatments and characterizes Polish spa law. The last part presents areas of spa law which seek for urgent change. The whole is finished with conclusions and list of resources.

In recent years, there has been a growing global interest in spa tourism, as well as a significant increase in social awareness of the need to care for health, physical fitness and well-being. Apart from spa tourism, ‘spa & wellness’ tourism is also very popular. Kołobrzeg, in addition to being a town largely geared towards patients, also attracts tourists who take advantage of ‘spa & wellness’ treatments. The purpose of this article is to define the essence and characteristics of spa tourism based on the example of Kołobrzeg. Spa activities are carried out in health care entities operating in the zone of the spa, places where patients are undergoing treatment or rehabilitation. These benefit from the healing natural conditions of the areas in which they operate and their microclimates. The main part of the article presents the history of spa tourism in Kołobrzeg along with an analysis of its spa offer and therapeutic profile. In addition, the empirical part discusses the results of an analysis among patients using the survey method; a large proportion of respondents were over 65, mainly female. During the study, the respondents rated various aspects of their spa stay (on a scale from 1 to 5) at a level above 4.0, which indicates the healthy condition of the spa itself and general satisfaction among patients.

Spa treatment, which constitutes an integral part of health care, is an organized activity consisting in providing health care services in the field of spa treatment or spa rehabilitation carried out in a spa by spa treatment facilities. In order to ensure the proper and efficient operation of this form of treatment in specially adapted facilities that are medical entities, this treatment is subject to professional supervision. Supervision over health resort treatment entails the control and evaluation of health resort treatment carried out in health resort treatment establishments. This issue is regulated primarily in the Act of 28 July 2005 on spa treatment, health resorts and health resort protection areas and in health resort communes, as well as in the Act of 15 April 2011 on medical activity. The study contains an analysis and evaluation of the legal regulations concerning the supervision of spa treatment. It discusses the basic terms related to spa issues and presents some concepts of control and supervision in terms of the doctrine. Spa supervision is characterized by specific regulations and the degree of complexity. This applies to individual issues that allow the reconstruction of the essence of supervision. These are the supervisory authorities, subject of supervision, the supervised entities, criteria and scope of supervision exercised and legal means of supervision. The authorities supervising the health resort treatment include the Minister of Health, the Voivode, the Minister of National Defense and the Minister of the Interior. In this article, in the analysis of the scope of his competences and control and supervisory powers great attention is paid to the Minister of Health as the central body of government administration in the field of matters belonging to the department of health administration managed by him. Due to the specific nature of supervision of this treatment carried out in the voivodeship, the legal position of the chief physician of the health resort, with whose help the voivode exercises this supervision, was analyzed. Since spa treatment is carried out in spa facilities in a health resort, the study contains the problem of separate control procedurescarried out in this area, within which special attention is paid to internal, management and ad hoc control.

The spa treatment facility located in the health resort is distinguished by its specificity due to the fact that it conducts spa treatment in this type of medical entity. For the proper performance of the healing function and offering the health services for which a given spa is intended, the human factor plays an important role, taking into account the specificity of the health resort. This applies to those constituting the authorities of a health resort treatment facility, namely the manager and social committee (which in this study are limited to non entrepreneurs), as well as medical professionals and other employees. The special powers of the authorities and staff of spa treatment facilities towards the people using the health services provided there are reflected in the sources of law, which include the statute and organizational regulations of this type of medical facility. The article contains an analysis and assessment of legal regulations relating tothe scope of the activities of the authorities of this type of spa treatment facilities, with particular emphasis on the manager and social council and staff, especially person body plays a fundamental role in managing a medical facility, with responsibility for management and for all facility employees. On the other hand, the social committee, which is the collegiate body of this institution, is appointed only ina non-entrepreneurial medical facility, and this body is characterized by a specific legal nature that performs various tasks. The efficient operation of the plant is also ensured by professional medical staff, other medical workers and other employees. The legal status of company bodies and personnel is presented in terms of generally applicable regulations, as well as in the context of the organizational regulations and the statute of the spa treatment facility.

The right to use health services, including spa treatment, is one of the basic patient rights. The specificity of the issues undertaken stems from at least two sources. First of all, patients are a special category of people, because human health, as the highest value possessed by every human being, is subject to legal protection and requires their rights and freedoms are guaranteed. Secondly, spa treatment, which is an integral part of the health care system, corresponds to art. 68 of the Polish Constitution, assuming the fundamental principle according to which every citizen has the right to health care. On the other hand, this treatment means providing health services, which are conducted only in a separate area of the spa commune – a spa and in specially adapted medical entities – spa treatment centers. The study covers the concise genesis of patient rights and the notion of the patient in terms of doctrine and legislation. Moreover, it contains the basic concepts related to spas. Recognition of the health needs of society is associated with a presentation of the individual types of spa treatment centers and spa treatment facilities, as well as the necessary conditions that they should meet. Due to the existing different status of patients in spa treatment institutions, the analysis covers the basis for admission, for referring and qualifying patients to these centers, and also the rules for using services guaranteed in the field of spa treatment. The patient’s right to health services is also examined in the context of using these services. Despite the fact that patients’ interest in this form of treatment increases every year, as is shown by the available data, there are a number of legal and organizational problems related to access to treatment as part of spa services.

A health resort treatment facility is a particular medical entity that performs therapeutic activities because it is located in a health spa resort municipality which has the status of a spa health resort. Only the spa health resort municipality implements its own tasks related to the maintenance of health spa functions, and creates the conditions for this type of health facility to function and to develop the municipal infrastructure in order to meet the needs of people staying in the municipality for spa resort treatment. The basic, but not the sole, purpose of establishing and maintaining a health resort treatment facility is medical activity consisting in providing spa patients with health services performed as part of spa treatment integrated into the health care system. The study focuses on how the definition of this type of facility has evolved in the legislation and the directions of changes that have occurred as a consequence of the change in the legal status, as well as other important terms referring directly to the spa treatment facility. The presentation of its various types and tasks performed by these establishments enables the identification of numerous interpretation problems related to their qualification. Due to the diversified ownership structure of these medical entities, reference is made to their organizational and legal forms, with a demonstration of the possible consequences that result from transforming these establishments into health resort companies. The current epidemic in Poland allows the scope of limitations in the operation of spa treatment facilities to be shown and, consequently, changes in the organization of some types of these facilities.

This paper deals with the problems relating to the obligation to return the sickness benefit in the event when an insured person takes up paid employment during confirmed incapacity for work due to illness. The reason for this analysis is the non-uniform or inconsistent practice of the Supreme Court. In the majority of its issued verdicts, the opinion of the Supreme Court is that the the claim for returning the undue bene-fit paid ought to be withdrawn and cancelled if there was no information provided in the instruction about the circumstances that may lead to the forfeiture of the entitlement to statutory sickness benefit under Article 17(1) of the Act of 25 June 1999 on cash benefits from social insurance in case of sickness and maternity. However, there is also a different standpoint according to which the lack of instruction is not a sufficient basis for adjudicating that the insured party is not obliged to return this benefit. In its judgments, the Supreme Court emphasises the importance of the way in which the insured person acts. Submitting a sick leave and performing paid work is tantamount to misleading the disability pension body as to the circumstances that determine the right to a sickness be-nefit. Divergences in the judicial decisions of the Supreme Court have an impact on the judgments issued by common courts, which results in different decisions in cases of identical factual status. The non-uni-form case law of common courts has a direct impact on the situation of individual beneficiaries. Despite the same factual circumstances some insured individuals have to return the benefit whereas others are exempted from this obligation. This creates secondary inequality of the insured persons who constitute a group of similar subjects and is inconsistent with the principle of equality expressed in Article 32 of the Constitution of the Republic of Poland.

The legislator’s fee and spa subsidy established a source of income for a local government unit that has the status of a spa (health resort) municipality. The health resort municipality may collect the health resort fee from natural persons staying more than one day for health, tourist, leisure and training purposes in the area of the health resort, applying the allowances and preferences indicated in the relevant act implementing the own tasks in the scope of preserving the spa functions of health resort for the award of a spa subsidy from the state budget. Both sources of financing of the health resort municipality are the compensation for the lost income of the health resort municipalities due to statutory restrictions on the economic and investment development of this type of local government unit. Often there are conflicts of interpretation concerning the adoption and implementation of the collection of the health resort fee, as well as in matters concerning the rules, manner and purpose of the use of the fee and the health resort subsidy by the health resort municipalities. The aim of the article is to present the most important aspects of the essence and legal nature of the fee and spa subsidy. The legal basis defining the functioning of the fee and spa subsidy has been discussed in historical perspective, from the late nineteenth century to the present, in the context of the income component of the spa commune under the provisions of administrative and tax law. The research considerations were based on the review of legislative acts regulating this matter in the aspect of the repealed and applicable law and positions presented in the literature on the subject. Proposals for legislative changes in this area have been presented, simultaneously indicating the purpose and effects of the amendment.

Abstract: The author has undertaken to classify the legal instruments of environmental protection of in a health resort municipality (a spa commune) in Poland, regarding the aspect of their impacting the state of protection of natural environment. A spa commune has at its disposal a catalogue of its own tasks, which is complemented by those connected with maintaining medicinal functions of the spa and with meeting the requirements of the environment. The analysis of the content of regulations of law on environmental protection allows concluding that in relation to spas there are no – in principle – separate legal norms which regulate questions connected with protection of environment. While identifying the legal instruments of environmental protection, it was necessary to take into account a few normative areas, on the basis of which the following groups of instruments were distinguished: regulatory and “police” type, planning, control and financial. In the study, some selected legal and comparative aspects were also taken into consideration.

Background: Determining the relationship between health behaviors and life satisfaction in patients who use health spas as an accurate measure of well-being (subjective well-being reflecting health condition) can be the basis for implementing preventive activities, setting trends for behavior modification, and monitoring changes in health-promoting practices. Aim of the study: To determine an empirical verification of the relationship between health behaviors and life satisfaction. Material and methods: The study included 123 women and men aged 32–80 years – all of whom were health spa patients. The Health Behavior Inventory (HBI) by Juczyński, and the Polish adaptation of the Satisfaction With Life Scale (SWLS) by Diener, Emmons, Larsen, and Griffin were used to measure health behavior and life satisfaction, respectively. Results: There was a significant positive correlation between health behavior indicators and the level of life satisfaction in patients, as well as an increase in the practice of health behaviors with age. Gender appears to differentiate the frequency of the performance of health behaviors in the subjects. A higher overall rate of health behaviors was observed in females compared with males. For instance, females attached greater importance to healthy eating habits compared with males. However, a higher level of life satisfaction is associated with more intensified preventive behaviors in males. Conclusions: A health education program should take into account both the age and gender of health spa patients. It should also aim to not only develop health awareness, but also to include psychological factors, such as a sense of life satisfaction, which can strengthen patients’ beliefs in the importance of health-promoting activities.

Istotnym instrumentem kształtowania struktury rynku turystycznego są innowacje. Wysoką podatność na innowacje ma rynek turystyki zdrowotnej. Wynika to z jego wysokiej dynamiki rozwojowej w wymiarze globalnym, a przede wszystkim z zaangażowania wielu grup podmiotów, będących uczestnikami tego rynku. Obok podmiotów rynku turystycznego decydujący wkład w zakresie podejmowania rozwiązań innowacyjnych mają podmioty rynku medycznego. Celem opracowania jest identyfikacja podmiotów rynku turystyki zdrowotnej odpowiedzialnych za wprowadzanie innowacyjnych ofert na tym rynku. W kolejnych częściach omówiono zagadnienia teoretyczne dotyczące: innowacji na rynku turystycznym oraz struktury rynku turystyki zdrowotnej. W efekcie umożliwiło to identyfikację obszarów innowacyjności na rynku turystyki zdrowotnej. Przeprowadzone badania mają charakter koncepcyjny.
Innovation is an important instrument for shaping the structure of the tourism market. The health tourism market is highly susceptible to innovation. It results from its high development dynamics in the global dimension, and above all the involvement of many groups of entities that are participants in this market. In addition to the tourism market entities, the entities involved in the medical market make the decisive contribution to innovative solutions. The aim of the study is to identify entities of the health tourism market responsible for introducing innovative offers on this market. The following sections discuss theoretical issues concerning: innovation on the tourism market and the structure of the health tourism market. As a result, it enabled the identification of innovation areas on the health tourism market. The conducted research is of conceptual nature.

W opracowaniu zbadano ofertę turystyczną trzech wybranych, najpopularniejszych w Czechach uzdrowisk tj. Karlowych Warów (czes. Karlovy Vary, niem. Karlsbad), Mariańskich Łaźni (czes. Mariánské Lázně, niem. Marienbad) i Franciszkowych Łaźni (czes. Františkovy Lázně, niem. Franzensbad), określanych także mianem Lazurowego Wybrzeża Europy Środkowej. W kontekście układu komunikacyjnego zlokalizowane są one bardzo blisko siebie, nieopodal granicy z Niemcami. Ich oferta turystyczna jest niezwykle bogata i różnorodna. Każdy znajdzie coś dla siebie, zarówno kuracjusz, jak i szeroko pojmowany turysta, o każdej porze roku, o zróżnicowanej zasobności portfela, zwłaszcza ze względu na rozwiniętą wielofunkcyjność tych kurortów. Przeprowadzone analizy pozwoliły bliżej poznać badane uzdrowiska, porównać je i wyciągnąć stosowne wnioski. Należy dodać, iż te trzy miejscowości zabiegają o miejsce na Liście Światowego Dziedzictwa UNESCO (legitymując się najcenniejszymi miejscami i obiektami w skali całego świata). Wartym podkreślenia jest fakt, iż są to najstarsze i prawdopodobnie najczęściej odwiedzane kurorty Europy Środkowej (od czasów rzymskich tj. od ponad 2000 lat wykorzystuje się występujące tu wody lecznicze, czego dowodem są licznie znajdowane w pobliżu źródeł monety rzymskie i celtyckie). Przeprowadzone badania w wymienionych ośrodkach uzdrowiskowych dały także odpowiedź, na pytania zawarte w postawionej tezie badawczej „Co jest przyczynkiem tak wspanialej kondycji tych uzdrowisk? Dzięki czemu mają znaleźć się na liście UNESCO? Czego w tych uzdrowiskach brak? W jakim kierunku miałyby pójść w najbliż- szej przyszłości, by pozyskiwać nowych turystów, inwestorów, poszerzać swoją dotychczasową wielofunkcyjność?. Przeprowadzone badania miały udowodnić, iż zasadnie, bądź nie, te trzy miejscowości starają się o zaszczytną, najwyższą ocenę międzynarodowych gremiów. Prace badawcze mogą okazać się przydatnymi, także badaczom zajmującym się miejscowościami uzdrowiskowymi w innej części Europy i świata.
The study is focused on the tourist offer of three selected, most popular Czech spas, i.e. Karlovy Vary, (Karlsbad), Mariánské Lázně, (Marienbad) and Františkovy Lázně, (Franzensbad), also referred to as the French Riviera of Central Europe. In the context of communication system they are located in close vicinity to each other and not far from the German border. Their tourist offer is abundant and diversified. Everyone can find there something for him/herself, both a bather and a broadly approached tourist, in each season of the year, having various financial resources at the disposal, primarily due to a well-developed multi-functionality of these spa resorts. The conducted analyses allowed learning more about the studied locations, comparing them and drawing adequate conclusions. It should be added that all three places are applying to be included on the UNESCO World Heritage List (as having the most valuable places and objects on the global scale). It is worth emphasizing that they are the oldest and probably the most frequently visited resorts in Central Europe (their therapeutic waters have been used since Roman times, i.e. for over 2000 years, which is confirmed by numerous Roman and Celtic coins found near spa water springs). The carried out research in the aforementioned spa centres also provided answers to the questions included in the put forward research thesis: “What contributes to such an excellent condition of these resorts?, For what reason they should be on the UNESCO list?, What are they lacking? What should be their development direction in the coming future to attract new tourists, investors and expand their existing multi-functionality?” The conducted analyses were to indicate whether these three towns were rightly seeking the highest, honorable rating of international bodies. There can also turn out useful for the researchers studying spa resorts in different parts of Europe and the world.

W Krakowie, jednym z najlepiej turystycznie rozwijających się miast europejskich, gdzie występuje nasilona konkurencja, hotele nie poprzestają na ofercie podstawowej, ale poszukują możliwości wyróżnienia się poprzez dodatkową usługę turystyczną, stwarzając nowe propozycje spędzania wolnego czasu. Jedną z nich, zgodną z ogólnoświatowym trendem dążenia do poprawy zdrowia, oferowaną przez krakowskie obiekty noclegowe, jest umożliwienie korzystania z zabiegów spa i wellness. Hotele oferujące tego typu usługi zwiększają obłożenie i szansę wyróżnienia się z bogatej infrastruktury turystycznej Krakowa. Celem opracowania jest diagnoza liczby krakowskich hoteli oferujących usługi spa i wellness na terenie miasta Krakowa w wybranych hotelach. Opracowanie ukazuje kształtowanie się „przemysłu zdrowotnego”, a także dalsze możliwości rozwoju rynku krakowskiego hotelarstwa związanego z tymi usługami.
Promoting a healthy lifestyle, increasing health awareness and an aging society caused changes in the tourism services market. Each year new hotels appear offering beauty treatments and services improving well-being. In Krakow, one of the best developing European cities in terms of tourism, where there is intense competition, hotels do not stop at the basic offers, but look for opportunities to stand out through additional tourist services, creating new proposals for spending free time. One of them, consistent with the global trend of improving health, offered by Krakow hotels, is to provide Spa & Wellness treatments. Hotels offering this type of services increase their occupancy rate and the chance to stand out among the rich tourist infrastructure of Krakow. The aim of the study is to diagnose the number of hotels offering Spa & Wellness amenities in selected hotels in Krakow. The study shows the shaping of the “health industry”, as well as further opportunities for the Krakow hospitality market associated with these services to develop.

Obecnie szacuje się, że liczba zgonów w Polsce z powodu chorób układu krążenia w roku 2020 przekroczy 200 tysięcy. Z tego powodu należy zwrócić uwagę na kwestię profilaktyki zarówno pierwotnej jak i wtórnej. Leczenie Uzdrowiskowe oferuje kompleksową fizjoterapię, która jest łączona z balneologią specyficzną dla danego regionu. W artykule przedstawiono oceny uzyskane od kuracjuszy na temat walorów zdrowotnych, atrakcyjności turystycznej i dostępności komunikacyjnej uzdrowiska Nałęczów. Zaprezentowano również charakterystykę regionu Nałęczowa a także samego Uzdrowiska Nałęczów, uwzględniając rodzaje zabiegów wykonywanych w ośrodku. Zwrócono również uwagę na położenie geograficzne i szczególny rodzaj obecnego mikroklimatu korzystnie wpływające na zdrowie kuracjuszy Celem artykułu jest analiza jakości usług świadczonych w Uzdrowisku Nałęczów w opinii respondentów. Badania przeprowadzono metodą sondażu diagnostycznego z wykorzystaniem techniki ankietowej.
Currently, it is estimated that the number of deaths in Poland due to cardiovascular diseases in 2020 will exceed 200,000. For this reason, attention should be paid to the issue of primary prevention and secondary prevention. Health resort’s treatment offers comprehensive physiotherapy, which is combined with balneology specific to the region. This article presents the results obtained from the patients on the health, tourist attractiveness and accessibility of the Nałęczów health resort. The characteristics of the Nałęczów region as well as the Nałęczów resort itself were also presented, taking into consideration the types of treatments performed at the resort. Attention was also paid to the geographic location and the particular type of present microclimate that is beneficial to the health of the patients. The aim of the article was to evaluate the service spectrum and communication accessibility of the Nałęczów Health Resort. The study was carried out using the diagnostic survey method, using the author's own method.
