Zagadnienie analizowane w poniższym artykule dotyczy rozwoju zrównoważonego miejscowości, na przykładzie gminy uzdrowiskowej Szczawnica. Gminy uzdrowiskowe to taka kategoria gmin na obszarze których położone są uzdrowiska, i których aktywność gospodarcza została mocno ograniczona przede wszystkim w celu ochrony walorów uzdrowiskowych. Do niedawna uzdrowiska kojarzyły się wyłącznie jako obszary specjalnej ochrony, na których może być przede wszystkim prowadzone leczenie uzdrowiskowe, a w niewielkim stopniu inna działalność taka jak turystyka, rekreacja czy sport. Tak jednostronnie wykształcony i utrwalony przez lata model funkcjonowania miejscowości uzdrowiskowych doprowadził w rezultacie do olbrzymich problemów związanych z funkcjonowaniem gmin uzdrowiskowych. Nie były one bowiem przygotowane do nowych wyzwań gospodarki rynkowej, otwarcia rynku europejskiego i wzrastającej konkurencji. Na szczęście większość gmin uzdrowiskowych szybko dostrzegła istniejące zagrożenie, i od połowy lat dziewięćdziesiątych zaczęła gwałtownie przebudowywać swoją ofertę uzdrowiskową, starając się wielokierunkowo rozwijać swoje miejscowości, ale w zgodzie z zasadą rozwoju zrównoważonego. Przykładem uzdrowiska, które buduje swoją pozycję w oparciu o zasady rozwoju zrównoważonego jest Szczawnica. Gospodarka miasta Szczawnica od lat kojarzona jest z dobrze rozwiniętą sferą usług uzdrowiskowych i turystycznych. Gmina konsekwentnie realizuje zadania z zakresu sfer społecznej, uzdrowiskowej, gospodarczej, turystycznej, kulturalnej czy sportowej będących wyrazem wielowymiarowości lokalnego rozwoju zrównoważonego w myśl zasady mówiącej, iż wszystkie działania i decyzje podejmowane przez lokalne władze samorządowe mają swoje skutki pośrednie i bezpośrednie oraz bliskie i odległe zarówno w czasie jak i przestrzeni.
The issue scrutinized in the article mentioned below concerns the balanced growth of mountain resort on Szczawnica example. Spa boroughs are selected places because of their special quality as protected health resorts. Their economic growth is limited due to environmental protection. Until recently spas have been associated to the areas under special protection devoted only to health treatment and slightly recognized as tourist, sport or recreation attractions. Such narrow and one-sided point of view has caused a lot of problems connected with spa boroughs functioning. They haven’t been prepared to the new challenge of the market economy, open European market and growing competition. Luckily the majority of spas boroughs have quickly perceived the tendencies of the changing times and the following menace and since late eighties of the 20-th century they have been rebuilding their spa offers according to the balanced growth. Szczawnica is the proper example of the site emerging its position based on sustainable development.The town economy is regarded as fully developed and well- organized in the aspect of spa and tourist services. The policy of Szczawnica borough consequently fulfils economic and social, spa and tourist, cultural and sport tasks and demands. Thanks to the local government such multidimensional balanced growth can give long term results and effects. All the decisions and promising actions undertaking by the local government have promotion and development of Szczawnica in view.

Artykuł porusza problematykę aktywizacji prouzdrowiskowej historycznych obszarów małomiejskich, odznaczających się wyraźnie ukształtowanym krajobrazem kulturowym. Istotą problemu jest rola małego miasta w rozwoju nowego modelu funkcji uzdrowiskowej, a także próba wstępnej analizy przekształceń, jakim podlegają zasoby kulturowe na rzecz podnoszenia atrakcyjności miasteczka, awszczególności wpływ funkcji uzdrowiskowej na strukturę historycznego centrum. Tak postawiony problem należy także postrzegać jako punkt wyjścia dla dalszych badań zmierzających do opracowania rozwiązań, wspomagających ochronę krajobrazu i tożsamości miasta, w warunkach współczesnych przekształceń prouzdrowiskowych. Badania, prowadzone metodą indukcyjną, objęły polskie miasta uzdrowiskowe omiejsko-zdrojowej strukturze, w których obszary miejskie ukształtowały się przed rozwojem funkcji zdrojowych. Analizie poddano cechy przestrzenne małego miasta pod kątem ich przydatności dla potrzeb funkcji uzdrowiskowej, charakter relacji funkcjonalno-przestrzennych pomiędzy obszarem staromiejskim i zespołem zdrojowym, a także znaczenie tożsamości kulturowej miasta dla budowania atrakcyjności uzdrowiska. Przeprowadzone badania pozwalają stwierdzić, że aktywizacja funkcji uzdrowiskowej, ukierunkowanej na profilaktykę i zintegrowanej z turystyką kulturową jawi się jako szansa na rewitalizację zespołów miejskich towarzyszących założeniom zdrojowym. Miasta uzdrowiskowe, wykorzystując swój potencjał kulturowy, mają szansę na realizację innowacyjnych produktów turystycznych, które mogą przyczynić się do ich rozwoju gospodarczego i społecznego.
The article discusses the problem of activation of spa functions in the historic areas of towns, which have clearly shaped the cultural landscape. The essence of the problem is the role of a small town in the development of a new model of spa function and it is an attempt to identify ways to use cultural resources to the achievement of competitive advantage of the town, and in particular to determine the impact of the spa functions on the structure of the historical centre. This issue should also be seen as a starting point for further research to develop solutions that will help protect the identity of these towns. Inductive research concerned the Polish spa towns with a complex structure in which urban areas were created before the development of the spa. Analyses include the spatial characteristics of a town considered in terms of their suitability for the function of the spa, the nature of functional and spatial relationships between the areas of the old town and spa, as well as the importance of the cultural identity of the town to build the attractiveness of the spa. The study allows us to conclude that the activation of spa function, which is integrated with cultural tourism, is seen as an opportunity to revitalize the spa towns. In addition, the spa towns which use its cultural potential can realise innovative investments that can become an important element of economic and social development.

Abstract: The author has undertaken to classify the legal instruments of environmental protection of in a health resort municipality (a spa commune) in Poland, regarding the aspect of their impacting the state of protection of natural environment. A spa commune has at its disposal a catalogue of its own tasks, which is complemented by those connected with maintaining medicinal functions of the spa and with meeting the requirements of the environment. The analysis of the content of regulations of law on environmental protection allows concluding that in relation to spas there are no – in principle – separate legal norms which regulate questions connected with protection of environment. While identifying the legal instruments of environmental protection, it was necessary to take into account a few normative areas, on the basis of which the following groups of instruments were distinguished: regulatory and “police” type, planning, control and financial. In the study, some selected legal and comparative aspects were also taken into consideration.

Spa treatment, which constitutes an integral part of health care, is an organized activity consisting in providing health care services in the field of spa treatment or spa rehabilitation carried out in a spa by spa treatment facilities. In order to ensure the proper and efficient operation of this form of treatment in specially adapted facilities that are medical entities, this treatment is subject to professional supervision. Supervision over health resort treatment entails the control and evaluation of health resort treatment carried out in health resort treatment establishments. This issue is regulated primarily in the Act of 28 July 2005 on spa treatment, health resorts and health resort protection areas and in health resort communes, as well as in the Act of 15 April 2011 on medical activity. The study contains an analysis and evaluation of the legal regulations concerning the supervision of spa treatment. It discusses the basic terms related to spa issues and presents some concepts of control and supervision in terms of the doctrine. Spa supervision is characterized by specific regulations and the degree of complexity. This applies to individual issues that allow the reconstruction of the essence of supervision. These are the supervisory authorities, subject of supervision, the supervised entities, criteria and scope of supervision exercised and legal means of supervision. The authorities supervising the health resort treatment include the Minister of Health, the Voivode, the Minister of National Defense and the Minister of the Interior. In this article, in the analysis of the scope of his competences and control and supervisory powers great attention is paid to the Minister of Health as the central body of government administration in the field of matters belonging to the department of health administration managed by him. Due to the specific nature of supervision of this treatment carried out in the voivodeship, the legal position of the chief physician of the health resort, with whose help the voivode exercises this supervision, was analyzed. Since spa treatment is carried out in spa facilities in a health resort, the study contains the problem of separate control procedurescarried out in this area, within which special attention is paid to internal, management and ad hoc control.

In recent years, there has been a growing global interest in spa tourism, as well as a significant increase in social awareness of the need to care for health, physical fitness and well-being. Apart from spa tourism, ‘spa & wellness’ tourism is also very popular. Kołobrzeg, in addition to being a town largely geared towards patients, also attracts tourists who take advantage of ‘spa & wellness’ treatments. The purpose of this article is to define the essence and characteristics of spa tourism based on the example of Kołobrzeg. Spa activities are carried out in health care entities operating in the zone of the spa, places where patients are undergoing treatment or rehabilitation. These benefit from the healing natural conditions of the areas in which they operate and their microclimates. The main part of the article presents the history of spa tourism in Kołobrzeg along with an analysis of its spa offer and therapeutic profile. In addition, the empirical part discusses the results of an analysis among patients using the survey method; a large proportion of respondents were over 65, mainly female. During the study, the respondents rated various aspects of their spa stay (on a scale from 1 to 5) at a level above 4.0, which indicates the healthy condition of the spa itself and general satisfaction among patients.

The legislator’s fee and spa subsidy established a source of income for a local government unit that has the status of a spa (health resort) municipality. The health resort municipality may collect the health resort fee from natural persons staying more than one day for health, tourist, leisure and training purposes in the area of the health resort, applying the allowances and preferences indicated in the relevant act implementing the own tasks in the scope of preserving the spa functions of health resort for the award of a spa subsidy from the state budget. Both sources of financing of the health resort municipality are the compensation for the lost income of the health resort municipalities due to statutory restrictions on the economic and investment development of this type of local government unit. Often there are conflicts of interpretation concerning the adoption and implementation of the collection of the health resort fee, as well as in matters concerning the rules, manner and purpose of the use of the fee and the health resort subsidy by the health resort municipalities. The aim of the article is to present the most important aspects of the essence and legal nature of the fee and spa subsidy. The legal basis defining the functioning of the fee and spa subsidy has been discussed in historical perspective, from the late nineteenth century to the present, in the context of the income component of the spa commune under the provisions of administrative and tax law. The research considerations were based on the review of legislative acts regulating this matter in the aspect of the repealed and applicable law and positions presented in the literature on the subject. Proposals for legislative changes in this area have been presented, simultaneously indicating the purpose and effects of the amendment.

This paper deals with the problems relating to the obligation to return the sickness benefit in the event when an insured person takes up paid employment during confirmed incapacity for work due to illness. The reason for this analysis is the non-uniform or inconsistent practice of the Supreme Court. In the majority of its issued verdicts, the opinion of the Supreme Court is that the the claim for returning the undue bene-fit paid ought to be withdrawn and cancelled if there was no information provided in the instruction about the circumstances that may lead to the forfeiture of the entitlement to statutory sickness benefit under Article 17(1) of the Act of 25 June 1999 on cash benefits from social insurance in case of sickness and maternity. However, there is also a different standpoint according to which the lack of instruction is not a sufficient basis for adjudicating that the insured party is not obliged to return this benefit. In its judgments, the Supreme Court emphasises the importance of the way in which the insured person acts. Submitting a sick leave and performing paid work is tantamount to misleading the disability pension body as to the circumstances that determine the right to a sickness be-nefit. Divergences in the judicial decisions of the Supreme Court have an impact on the judgments issued by common courts, which results in different decisions in cases of identical factual status. The non-uni-form case law of common courts has a direct impact on the situation of individual beneficiaries. Despite the same factual circumstances some insured individuals have to return the benefit whereas others are exempted from this obligation. This creates secondary inequality of the insured persons who constitute a group of similar subjects and is inconsistent with the principle of equality expressed in Article 32 of the Constitution of the Republic of Poland.

Objectives: The present study was aimed at evaluating microbiological contamination of air in Ciechocinek and Inowrocław – Polish lowland spa towns. Additionally, the impact of open-air inhalatoria on the quality of air was evaluated. Material and Methods: Air samples were collected seasonally in the urban areas, in the recreation areas and in the vicinity of inhalatoria in both towns using impaction. The numbers of mesophilic bacteria, staphylococci, hemolytic bacteria and actinomycetes were determined on media according to the Polish Standard PN-86/Z-04111/02. The number of moulds was determined on media according to the Polish Standard PN-86/Z-04111/03. Results: While the highest numbers of microorganisms were noted at the sites located in the urban areas, the lowest numbers were noted in the vicinity of the open-air inhalatoria. In all the investigated air samples the values of bioaerosol concentrations were below the recommended TLVs (≤ 5000 CFU×m⁻³ for both bacteria and fungi in outdoor environments). Location of the sampling site was invariably a decisive factor in determining the number of microorganisms in the air. Conclusions: The aerosol which is formed in the open-air inhalatoria has a positive influence on microbiological air quality. Owing to a unique microclimate and low air contamination, Ciechocinek and Inowrocław comply with all necessary requirements set for health resorts specializing in treating upper respiratory tract infections.

A health resort treatment facility is a particular medical entity that performs therapeutic activities because it is located in a health spa resort municipality which has the status of a spa health resort. Only the spa health resort municipality implements its own tasks related to the maintenance of health spa functions, and creates the conditions for this type of health facility to function and to develop the municipal infrastructure in order to meet the needs of people staying in the municipality for spa resort treatment. The basic, but not the sole, purpose of establishing and maintaining a health resort treatment facility is medical activity consisting in providing spa patients with health services performed as part of spa treatment integrated into the health care system. The study focuses on how the definition of this type of facility has evolved in the legislation and the directions of changes that have occurred as a consequence of the change in the legal status, as well as other important terms referring directly to the spa treatment facility. The presentation of its various types and tasks performed by these establishments enables the identification of numerous interpretation problems related to their qualification. Due to the diversified ownership structure of these medical entities, reference is made to their organizational and legal forms, with a demonstration of the possible consequences that result from transforming these establishments into health resort companies. The current epidemic in Poland allows the scope of limitations in the operation of spa treatment facilities to be shown and, consequently, changes in the organization of some types of these facilities.
