The use of telemedicine had notably been developed in Brazil after the beginning of the public emergency period caused by the pandemic of COVID-19. With the new data protection law in force in Brazil, which is similar to the GDPR, health data are in the spotlight. The purpose of this article is to exam what measures Brazil has adopted to guarantee the data protection for health data in view of this scenario, taking the EU as a perspective for comparison reasons. For the Brazilian analysis, not only the formal legislation was considered, but also the guidance of the Federal Council of Medicine, which is the competent authority to supervise and issue orders on the development of medicine in Brazil, including the telemedicine. The comparison with the EU was chosen due to the similar data protection regulation, since the LGPD presents similar provisions and regulations to those established in the GDPR, and because the European Commission has issued a study on February 11, 2021, assessing the implementation of the GDPR and the domestic regulations for health data in each of the EU countries. This article has found out Brazilian regulation still presents flaws and points for clarification, which are fundamental to guarantee the necessary legal security in operations.

Punktem wyjścia dla tego typu rozważań stała się teoria umowy społecznej T. Hobbesa, która omawia powinności człowieka wobec społeczeństwa oraz wolności przysługujących człowiekowi. Dyskurs analityczny został wsparty koncepcjami filozoficznymi L. Floridiego oraz A. Dawsona. Te dwa paradygmaty pomagają zakreślić nowoczesne problemy i terminologie, które starają się uchwycić zmieniające się aspekty technologiczne dzisiejszego świata.
Endlessly changing European society actively faces ethical problems that transpire through every part of life. This article aims to present the problem of managing and utilizing medical data and proposes a concept for justifying these types of research and developmental activities from the perspective of the European Union. By selecting appropriate texts from different areas within philosophy and bioethics, the author aims to show a cohesive and innovative approach. He utilizes the concept of a social contract from the works of T. Hobbes in order to highlight the duties of humans toward their society and the liberties that are available to them. Moreover, the philosophical concepts of L. Floridi and A. Dawson help capture the modern problems and terminologies that try to explain the everchanging technological aspects of modern society.

Wprowadzenie EDM jako obowiązującej formy dokumentacji medycznej stawia przed świadczeniodawcami konieczność podjęcia kluczowych decyzji dotyczących systemu przetwarzania elektronicznych danych medycznych. Osoby zarządzające podmiotami świadczącymi usługi zdrowotne mają dwa wyjścia: decydują się na przetwarzanie danych na terenie swojej firmy (podmiotu leczniczego) i w związku z tym godzą się na wykonywanie wielu czynności wynikających w przepisów prawa lub przekazują dane na podstawie odpowiednich umów do podmiotów profesjonalnie zajmujących się przetwarzaniem danych w innej lokalizacji, niż firma medyczna i cedują jednocześnie na podmiot otrzymujący dane wszelkie obowiązki związane z zabezpieczeniem danych. Jedną z alternatyw mogą być, bardzo prężnie rozwijające się rozwiązania chmurowe (cloud computing). Uregulowano możliwość korzystania z usług podmiotów zewnętrznych w zakresie przetwarzania danych o stanie zdrowia. Jest nią powierzenie danych medycznych podmiotowi zajmującemu się profesjonalnie przetwarzaniem danych. Ostateczną formą powierzenia danych podmiotowi zewnętrznemu i jedyną dopuszczalną jest zawarcie z nim umowy. Bardzo istotnym elementem powierzenia danych medycznych jest odpowiedni wybór firmy świadczącej takie usługi oraz dokładne sprecyzowanie umowy ze szczególnym podkreśleniem mechanizmów zabezpieczenia danych o stanie zdrowia pacjenta zgodnym z obowiązującymi regulacjami krajowymi i unijnymi.
The introduction of EMD as a mandatory form of keeping medical records results in the necessity for health service providers to make key decisions as regards the processing systems of digitized medical data. The managers of health care entities have two options: either to process the data on premises (of a health care entity), which results in their consent to proceed in compliance with legal regulations or to transfer the data under adequate agreements to entities that professionally process data in other location than the health care entity and consequently to delegate to them all responsibilities as regards the security of data. Cloud computing – a rapidly developing solution – may be one of the options. The use of external entities to process health data has been regulated. Medical data can be entrusted to entities that professionally process them. Signing a contract for data processing is the final - and the only acceptable - form of entrusting data to an external entity It is crucial that a proper choice of a cloud services provider is made and a precise agreement is signed that includes security measures for the protection of health data that comply with local and European regulations.

Dane o stanie zdrowia ze względu na swoją specyficzność i ważność są regulowane w wielu prawno-strategicznych dokumentach. Wdrożenie Koncepcji Jednolitej Europejskiej Przestrzeni Danych daje możliwość wymiany danych pomiędzy krajami pozostając tym samym transparentna i z prawem użytkowników do zarządzania własnymi informacji. Dane dotyczące zdrowia wprowadzone do elektronicznej dokumentacji medycznej powinny nadawać się do odczytu maszynowego w takim zakresie, w jakim jest to konieczne z uwagi na ponowne wykorzystanie tych danych. W odpowiedzi na rozwiązania cyberbezpieczeństwa z innych krajów UE zainicjowała projekt GAIA-X, celem uniezależnienie się od podmiotów amerykańskich i chińskich w zakresie usług chmurowych. Zadaniem projektu jest przede wszystkim wsparcie innowacji i transformacji cyfrowej na terenie UE.
Due to their specificity and significance, health data are regulated by numerous legal strategic documents. The implementation of the concept of a Single European Data Space provides countries with the opportunity to share data, to be transparent and to guarantee the users the right to have control over their own data. Health data in electronic medical records should be machine-readable to the extent necessary for the re-use of the data. In response to the cybersecurity solutions that are applied in other countries, EU initiated the GAIA-X project whose aim is to become independent from American and Chines cloud computing service providers. The objective of the project is mainly to support innovation and digital transformation in EU.

The protection of individuals regarding to the processing of personal data is one of the fundamental rights. The General Data Protection Regulation (GDPR) lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data. Data concerning health is one of the areas the GDPR defines as special personal data, the so-called sensitive data. With regard to these data, the GDPR allows their processing only on an exceptional basis, in certain situations. According to Art. 6 sec. 1 let. e GDPR and art. 9 sec. 2 let. b GDPR, data processing is allowed, inter alia, when such processing is necessary for the purposes of meeting the obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law. In turn, Art. 9 sec. 2 let. h GDPR permits the processing of health data that is necessary for the purposes of providing health or social care or treatment, or for managing health or social care systems and services on the basis of European Union or Member State law. The article discusses the national legal regulations regarding the collection and processing of personal data concerning health in the light of the organization of the health care system and the tasks of the National Health Fund (NFZ) as a placeholder, whose task is only to manage financial resources and conclude health care contracts on its own behalf with independent healthcare providers and their accounting. Against the background of the GDPR, the author discusses the provisions of the acts on health care services financed from public funds and on the information system in health care. Finally, specific regulation regarding the COVID-19 pandemic are presented.

Aim/purpose – Estimation of the model of interdependent demand for health insurance and health care utilisation involves issues of stochastic dependence between health insurance and health care utilisation. This study explored a count data estimation technique to determine the most appropriate estimation method for the interdependence of health insurance and health care demand in Nigeria. Design/methodology/approach – The study employed Hidayat and Pokhrel (2010) framework to choose among the six alternatives of two classes of count data model. The data for the study were collected using a purposive sampling survey in the six geopolitical zones in Nigeria. Findings – The results showed that the general method of moments (GMM) estimator is preferable to model the determinants of medical care consumption with health insurance. Price of health care services is positively related to medical care consumption with health insurance and social health insurance. The income-medical care relationship indicated that medical care services are inferior good under private health insurance and a normal good with social health insurance during sick period. Research implications/limitations – The implication of this study is that the estimation method that accommodates endogenous regressors is the appropriate estimation technique for the interdependence of health insurance and health care utilisation. The limitation of this study is that the recall period was just six months prior to the survey. Originality/value/contribution – The study revealed that the estimation techniques for the interdependence of health insurance and health care utilisation must recognised the influence of individual and household characteristics on the decision to purchase health insurance and health care consumption. Hence, diagnostics tests are require to choose the most appropriate estimation technique.

Aim: The paper aims to study and present the case study of the health sector of India. The paper also aims to identify the opportunities for the application of Big data in the health sector. The major stakeholders of the system viz. doctors, hospitals, clinics, insurance companies, pharmaceutical companies, research, and development organizations, industries manufacturing medical instruments, laboratories, medical data analysts, and many more are utilizing big data and predictive analytics in their critical decision making. The predicted revenue was expected to reach 280 billion by 2020 as per the statistics given by the Indian Brand Equity Foundation. Research methods: A critical review has been conducted using electronic sources between 2015 and 2020, limited to English language articles and reports published from 2015 onwards. The reviews will be classified to identify the opportunities for future application of Big Data. Conclusions: The paper presents a trend in the use of Big Data Analysis in the health sector. The paper also explores and identifies the areas of future application of big data to increase the efficacy of the system. Originality/value of the article: This is an original piece of article in the context of India in terms of documenting the big data applications in the health sector and identifying the opportunities for the future application of the same.  Implications of the research: This research holds a significant contribution towards the implications of the application of Big Data in the health sector. The newly identified areas of the health sector, which can be improved by using the big data analytics, are important for the policy makers of the organizations, including the Government.  Limitations of the research: The research has been conducted based on the secondary data, which area available in the public domain. However, due to COVID 19, there could have been more innovations in the health sector in terms of using the big data, which may not have been published or are available in the public domain. Also, collection of the primary data in terms of an interview with the administrators/management can be explored in the future study.

Telecommunications technology is making its way into operating rooms by new developments in e-health. However, conflicts arise with existing legal principles regarding data protection. This paper deals with key elements of the interactions between data protection and evolution in e-health. The scope will be the digital operating room, where different health services and activities converge through networked technology, raising a number of privacy-related issues. For instance, the patient's health records and tools for recording surgical procedures could be integrated within the same platform, potentially leading to sensitive personal data linkage. Also the possible duration and reason of storage of surgical recordings, is a matter that remains largely unresolved in current practice. First, this paper will analyze the data exchanges of the digital operating room. As these will include personal patient data, it must be assessed whether and how the European framework on data protection can apply. Second, the regulatory regime of the manufacturers of the devices of the digital operating room will be analyzed. Can the current legal framework relating to e-health provide for suitable regulation for such devices? Drawing from experience gained in research projects, this paper aims to provide practical answers to often theoretical questions.

Africa is regarded as the least developed continent in terms of overall development and specifically in terms of human capital development (HCD) efforts. Research on the determinants of HCD in Africa is scanty, as the literature is dominated by country-specific studies as well as group of country studies that primarily focus on the effect of human capital on growth and other economic development parameters. Therefore, this paper investigates the determinants of human capital development in 33 African countries over a 14-year period from 2000 to 2013. The empirical analysis is predicated on Sen’s capability approach that was modified following Binder and Georgiadis (2011) in order to explicitly account for the role of health, infrastructure and institutions as potential drivers of HCD. This is a departure from previous studies that focused primarily on the role of education. In addition to preliminary tests such as line plot, descriptive statistics and correlation analysis carried out, the data is analysed using panel unit root, co-integration and causality techniques. Findings show that all the variables are integrated of order one while HCD and its determinants have a stable long-run equilibrium relationship. Specifically, all the variables significantly influence HCD in the long run, whereas the contemporaneous models suggest that only institutions matter. Utilizing alternative estimators as well as estimation of subsamples, robustness tests reinforce our findings. Therefore, African governments may consider supporting HCD through sustained investment in the education and health sectors. At the same time, short-term gains may be attained through enhanced institutional quality and infrastructure development.

Background The unexpected outbreak of the COVID-19 pandemic has led huge impact on health and safety of employees. Although now the epidemiological situation has improved, but it remains a challenge, especially in light of the emergence of new threats. The aim of the work is to present an epidemiological analysis of data on COVID-19 as an occupational disease in Poland. Material and Methods The analysis covered all cases of occupational diseases sent by state sanitary inspectors to the Central Register of Occupational Diseases. The years 2020–2022 and such available data as: age, gender, activities and territorial differentiation were analyzed. The data were presented as absolute numbers and incidence rates per 100 000 employed persons and for healthcare workers also per 100 000 persons authorized to practice. Results In the period 2020–2022 in Poland 7030 diseases recognized as occupational diseases were recorded, of which almost half were infectious diseases (47%). Among infectious diseases, dominated COVID-19 in number of 2059 cases. In this period 98.6% of all cases of COVID-19 were concentrated in the health care and social activities. According to workplaces, most diseases were caused by working in hospitals – 1825 cases (88.6% of all COVID-19 cases in the healthcare workers). Most cases concerned nurses – 1355 cases (65,8%) and doctors – 212 cases (10,3%). The incidence of COVID-19 in the group of physicians per 10 000 persons entitled to practice ranged from 2.6 in 2020 to 68.3 in 2022, while among nurses and midwives the rates were 7.9 and 194.9, respectively. Conclusions The COVID-19 pandemic changed the picture of occupational diseases in Poland. Therefore, it is very important to understand the key contributions of people working in environments where workers are at increased risk of contracting COVID-19 due to the nature of their work, and to promote the recognition of COVID-19 as an occupational disease.
