Labour compliance is essential to protect workers’ rights and promote sustainable, responsible and effective business development. It necessitates continuous preparation of preventive compliance reports on occupational risks, usually requiring studies and their timely updates, risk analysis, training oriented resource management, and training of workers and managers. Greater self-regulation, such as compliance, can help mitigate risk of penal sanctions for individuals who fail to comply with risk prevention regulations, seriously endangering health and safety at work. A robust and effective compliance programme in this area aims to ensure legal and contractual obligations are met, particularly with respect to protecting the life and health of workers. W rozdziale poruszono zagadnienia związane z zakresem obowiązku pracodawcy wynikającym z art. 207 § 2 Kodeksu pracy, czyli koniecznością wykorzystywania odpowiednich osiągnięć nauki i techniki w celu ochrony zdrowia i życia pracowników. Na podstawie analizy źródeł prawa, orzecznictwa oraz aktualnej literatury autorzy udzielają odpowiedzi na następujące pytania badawcze: 1) Jak definiować odpowiedni poziom wykorzystania osiągnięć nauki i techniki w praktyce bhp, kiedy aktywizuje się obowiązek pracodawcy do poszukiwania nowych rozwiązań minimalizujących zagrożenie? 2) Czy pracodawca ma obowiązek wykorzystać wszystkie dostępne środki profilaktyczne? Nadto wskazano przegląd wybranych rozwiązań współczesnej nauki i techniki, które mogą być implementowane w celu spełnienia omawianej dyrektywy, ze szczególnym uwzględnieniem rozwiązań obejmujących automatyzację i robotyzację procesów.
The chapter deals with issues related to the scope of the employer’s obligation resulting from Article 207 § 2 of the Labor Code, i.e. the need to use appropriate achievements of science and technology in order to protect the health and life of employees. Based on the analysis of the sources of law, jurisprudence and current literature, considerations were made that concern the practice of all enterprises and aim to answer the following questions: how to define the appropriate level of use of science and technology in OHS practice and when the employer's obligation to seek solutions to minimize the risk is activated. In addition, an overview of selected solutions of modern science and technology that can be adapted to improve the level of security in enterprises has been indicated, with particular emphasis on solutions related to the automation and robotization of processes, their impact on occupational health and safety, both in terms of benefits and risks resulting from their application.

The intense development of nanotechnology in recent years poses the basic question about the safety of employees who work with nanomaterials. The study attempts to determine how employers should regulate health protection when working with nanoparticles. Employers should be aware of the importance of the risks associated with nanotechnology and their responsibility for worker health and safety. The study is a continuation of the author’s previous analyses of ways to regulate occupational safety and health in the use of nanomaterials. The author examines the theory of responsive regulation in the context of health and safety with nanomaterials and the importance of dialogue in this regulatory process. The regulatory agencies should intervene in this area depending on the attainment of the assumed objectives of the law. The sense of responsibility for the effect could improve the quality of OH&S with nanomaterials.

The article addresses the topic of alternative legal models for pursuing out-of-court claims for medical damages, taking as its starting thesis the inefficiency of the Polish model stemming from its faulty legal construction. The purpose of the article is to conduct a legal analysis of the Polish alternative model of medical damage compensation, with particular attention to de lege ferenda postulates presented in the legal doctrine. In addition, in order to show the possible directions of legislative changes, the article presents the characteristics of selected foreign alternative models of medical damage compensation, including the model operating in New Zealand, which is an example of a model that can be classified as ‘no-fault’, the German model and the French model. The article culminates with an analysis of the draft of the Law on Quality in Health Care and Patient Safety to the extent that the draft provides for a new legal regulation of the alternative model for the out-of-court settlement of medical damage claims. The purpose of this analysis was to see whether the legislator has recognized the demands for change articulated in the legal doctrine, and whether the draft law on quality in health care and patient safety is inspired by solutions adopted in foreign legislation in terms of the legal construction of the alternative model of compensation for medical damages. The analysis here confirms the initial thesis of the work and leads to the conclusion that the draft law on quality in health care and patient safety takes into account many proposals constructed in the legal doctrine in connection with regulating an alternative model for the compensation of medical damages. It is also clear that the proposed model is inspired by some solutions that have been successful in other countries. Nevertheless, the article distinguishes proposed regulations that may still raise doubts and reservations.

This article deals with the issue of incorporating security issues into framework educational programmes in the Czech Republic. Inter-ministerial discussions between the Ministry of Education, Youth and Sports, the Ministry of the Interior, the Ministry of Defence, the Ministry of Health, and the Ministry of Transport pay marginal attention to the views of the instigators of changes themselves, teachers in practice. The article presents data from a research survey conducted among primary and secondary school teachers who are actively involved in teaching security topics in practice with security issues as part of their qualifications.

Wstęp Obecność sztucznej inteligencji (artificial intelligence – AI) w wielu dziedzinach życia społecznego staje się powszechna. Wykorzystuje się ją m.in. w medycynie, handlu, motoryzacji, obsłudze klienta, rolnictwie i produkcji w warunkach fabrycznych. Roboty pojawiły się w środowisku pracy po raz pierwszy w latach 60. XX w. – od tego czasu inteligentne systemy stały się dużo bardziej zaawansowane. Rozszerzanie funkcjonalności AI w środowisku pracy pogłębia ryzyko zagrożeń dla zdrowia człowieka. Mogą mieć one charakter fizyczny (brak odpowiedniej kontroli nad maszyną, wypadki) lub psychiczny (technostres, automatyzacja prowadząca do wykluczenia zawodowego, zmiany na rynku pracy, pogłębiające się różnice społeczne). Materiał i metody Celem artykułu jest wskazanie, na podstawie wybranej literatury, możliwych zastosowań AI oraz potencjalnych korzyści i zagrożeń dla człowieka w kontekście współczesnego środowiska pracy. W artykule podkreślono wagę odpowiednich przepisów unijnych gwarantujących poszanowanie praw zatrudnionych. Wyniki Głównym obszarem zainteresowań autorek było współczesne środowisko pracy oraz konsekwencje zdrowotne związane z dostępem do inteligentnych technologii wynikające np. ze zwiększonej kontroli pracownika. Wnioski Autorki uważają, że nowa rzeczywistość z powszechnym wykorzystaniem AI wymaga analizy jej wpływu na sytuację psychospołeczną i zdrowotną człowieka. Tym samym konieczne są ramy prawne określające zakres monitoringu i zbierania wrażliwych danych.
Background The presence of artificial intelligence (AI) in many areas of social life is becoming widespread. The advantages of AI are being observed in medicine, commerce, automobiles, customer service, agriculture and production in factory settings, among others. Workers first encountered robots in the work environment in the 1960s. Since then, intelligent systems have become much more advanced. The expansion of AI functionality in the work environment exacerbates human health risks. These can be physical (lack of adequate machine control, accidents) or psychological (technostress, fear, automation leading to job exclusion, changes in the labour market, widening social differences). Material and Methods The purpose of this article is to identify, based on selected literature, possible applications of AI and the potential benefits and risks for humans. Results The main area of interest was the contemporary work environment and the health consequences associated with access to smart technologies. A key research area for us was the relationship between AI and increased worker control. Conclusions In the article, the authors emphasize the importance of relevant EU legislation that guarantees respect for the rights of the employed. The authors put forward the thesis that the new reality with the widespread use of AI, requires an analysis of its impact on the human psycho-social and health situation. Thus, a legal framework defining the scope of monitoring and collection of sensitive data is necessary.

Pracownicy wykonujący zawód medyczny w sytuacji zagrożenia życia pacjenta nie mogą powstrzymać się od wykonywania pracy z powodu niebezpiecznych warunków pracy. W związku z tym egzekwowanie prawa do bezpiecznych i higienicznych warunków pracy jest szczególnie istotne, żeby pracownicy bez dodatkowych obciążeń mogli udzielać świadczeń opieki zdrowotnej. Celem niniejszego badania jest ustalenie, w jaki sposób społeczny inspektor pracy może reagować na zagrożenia bezpieczeństwa i higieny pracy (bhp) i czy aktualne uprawnienia społecznej inspekcji pracy jako organu wewnętrznej kontroli bhp u pracodawcy są wystarczające. W badaniu dokonano analizy regulacji prawnych i wykorzystano odpowiednią literaturę, w tym najnowsze badania na temat egzekwowania prawa. Ponadto przeprowadzono badanie ankietowe wśród przedstawicieli związków zawodowych osób wykonujących zawód medyczny w zakresie oceny działań społecznego inspektora pracy i zagrożeń bhp podczas epidemii COVID-19. W tym czasie, który charakteryzował się wieloma zagrożeniami bhp w podmiotach leczniczych, ujawniły się trudności występujące u pracodawców w zakresie realizowania przez nich obowiązku ochrony zdrowia pracowników. System kontroli wewnętrznej z udziałem społecznej inspekcji pracy wymaga w tym kontekście zmian, ponieważ jest wykorzystywany nieefektywnie. Przyczyną tego stanu rzeczy są przede wszystkim niekompletne regulacje prawne. Ustawodawca powinien zagwarantować społecznemu inspektorowi pracy prawo do stosowania zarówno metod nagradzania pracodawcy jako zachęty do prawidłowego wykonywania obowiązków, jak i środków odstraszających od naruszania prawa. Chociaż polskie prawo pracy gwarantuje mechanizmy kontroli bhp przez społecznego inspektora pracy, to należałoby rozszerzyć katalog środków przez niego wykorzystywanych w celu skutecznego zmotywowania pracodawców do ochrony zdrowia pracownika. Niniejsze badanie stanowi wstęp do szerszej dyskusji na temat monitorowania stanu bhp w kontekście zagrożeń bhp występujących w podmiotach leczniczych.
Employees in the medical profession in a situation where the life of a patient is at risk cannot refrain from working due to unsafe working conditions. Therefore, enforcing the right to safe and hygienic working conditions is particularly important so that employees can provide health care services without additional burdens. The purpose of the study is to determine how the social labour inspector can respond to Occupational Health and Safety (OHS) hazards and whether the current powers of the social labor inspectorate as the employer’s internal OHS control body are sufficient. The study conducted a regulatory analysis and used relevant literature, including recent studies on law enforcement. In addition, a questionnaire survey was conducted among trade union representatives of medical professionals on the evaluation of social labour inspector activities and OHS hazards during the COVID-19 epidemic period. In this period characterized by many OHS risks in medical entities, the difficulties faced by employers in carrying out their duty to protect the health of their employees became apparent. The system of internal control with the participation of the social labour inspection in this context needs changes, due to the fact that it is used in an inefficient manner. The reasons for this are primarily incomplete legal regulations. The legislator should guarantee the social labour inspector the right to use both methods of rewarding the employer as an incentive for the proper performance of duties and measures to deter violations of the law. Despite the fact that Polish labour law guarantees mechanisms for OHS control by the social labour inspector, it would be appropriate to expand the catalog of measures used by him to effectively motivate employers to protect worker health. This study is a prelude to a broader discussion of OHS monitoring in the context of OHS hazards occurring in healthcare entities.

Research background: Despite a dynamically growing exploration of broadly understood employee participation, there is still space left for more in-depth or new analyses in this area, and occupational health and safety (OHS) serves as a good example in this respect. In empirical studies, employee participation in the field of occupational health and safety is not treated as a separate element of ensuring safety in the organisation, but only as a minor element of occupational health and safety management, or as just one of the elements building a safety culture. Purpose of the article: The aim of the paper is to propose a synthetic measure of active employee participation in OHS taking into account the depth and scope of this participation. A comparative analysis of the level of active participation of OHS at medical facilities and in other sectors of the economy was also performed. Methods: The theoretical model for active employee participation in OHS was tested by means of a survey using the PAPI (Paper & Pen Personal Interview) method. Exploratory factor analysis (EFA) and confirmatory factor analysis (CFA) were used. The developed construct (characterised by an adequately high level of validity and reliability) was used in a comparative analysis of medical institutions with other sectors of the economy with the use of the Mann?Whitney U test. Findings & value added: This research fills the theoretical gap in the model approach to participation in OHS. It has been found (EFA and CFA analyses) that active employee participation in OHS consists of one dimension (15 items). The model for active employee participation in OHS and the universal measurement scale developed and validated in this study represent a step forward towards the effective and reliable measurement of employee participation. In addition, the research has shown that the level of active employee participation in OHS at medical facilities is lower than in other sectors of the economy. The added value of this paper results from the approach to measuring employee participation in OHS which takes into account the depth and scope of this participation. The tool is consistent with international regulations and standards in the field of OHS, and thus can be used in other countries to assess active employee participation in OHS, regardless of the size and profile of the company or the sector of the economy.

The number of mining operations is increasing in the Canadian North, where extreme weather conditions govern. Currently, many mine development projects are also in progress in this region. These mines’ working atmosphere and employment circumstances are highly different from regular mines. One of the main differences is the special safety issues of the Canadian North. The primary sources of these special issues are: the difficulty of finding skilled employees; high employee turnover rate; insufficient training and certification requirements; delicate employment circumstances affecting the psychological well-being of employees; permafrost; mine inspection challenges; inventory and logistic hardship; and the legislative and regulative necessities corresponding to the particular working environment. This paper aims to set forth specific safety cases in the mines located in the Canadian North. Then, it argues the characteristics of safety organizations and management required to deal with these cases. Furthermore, how the current frameworks can be improved is discussed. Safety issues stemming from cold weather conditions and location remoteness of mines add further challenges to the viability and implementation of projects. The paper underlines that mining operations need certain safety organizations, management approaches, and specific regulations for the mines operated in remote areas and under severe weather conditions.

Dzięki wykorzystaniu wirtualnego środowiska do prowadzenia szkoleń pracownik może dokładnie zobaczyć, poczuć i „przeżyć” określone scenariusze, sytuacje wypadkowe i poznać, jakie mogą nastąpić konsekwencje w przypadku nieprawidłowego zachowania się w środowisku pracy. W artykule przedstawiono wyniki badań ankietowych dotyczących możliwości zastosowania wirtualnej rzeczywistości w szkoleniach w dziedzinie bezpieczeństwa i higieny pracy w budownictwie.
Virtual reality is a world created using computer techniques to create simulations of real-world phenomena and is increasingly used in many industries. Thanks to the use of the virtual training environment, an employee can see, feel and ‘survive’ certain scenarios, accident situations in detail and learn what the consequences may be if they behave incorrectly in the work environment. This paper presents the results of a survey on the feasibility of using virtual reality in health and safety training in the construction industry.

Współcześnie bezpieczeństwo pracy związane jest z identyfikacją zagrożeń i oceną ryzyka, nowoczesnym podejściem do ochrony przeciwporażeniowej oraz coraz dynamiczniej rozwijającej się techniki prac pod napięciem - PPN. Przedstawiono dorobek polskiego podejścia do bezpieczeństwa pracy i techniki prac pod napięciem wraz z instytucjami i wybranymi osobami, głównie związanymi z działalnością w Stowarzyszeniu Elektryków Polskich. Bezpieczeństwo pracy elektryków jest jednym z priorytetów działalności władz SEP, Polskiego Komitetu Bezpieczeństwa w Elektryce oraz licznych oddziałów i sekcji SEP. W tej działalności uwzględnia się dorobek specjalistycznych organizacji międzynarodowych np. ISSA.
Historical overview of human activity aiming at subduing the forces of nature and shaping the working conditions. SEP, from the earliest times in its more than 100-year history, always took into consideration the interest in safe work processes BHP (Occupational Health and Safety) - that was manifested in construction of electrical devices and various forms of their operation and maintenance. Nowadays working safety is connected with hazard identification and risk assessment, modern approach to electric shock protection and the dynamically growing with every year live work technologies - PPN. Presented are achievements of the Polish approach to working safety and live work technologies including institutions and selected persons connected mainly with the activity within the Association of Polish Electrical Engineers. Occupational safety of electricians is one of the priorities of SEP authorities activity, Polish Committee for Safe Operation of Electric and Electric Power Equipment and numerous SEP branches and sections. Account was also taken of the achievements of international specialist organizations like ISSA.

Transformacja do Przemysłu 4.0, której wynikiem ma być nie tylko wzrost produktywności, lecz także poprawa warunków materialnego i psychospołecznego środowiska pracy, wymaga odpowiedniego zarządzania zmianą, a ta wiąże się z wprowadzaniem nowych technologii. Dzięki rozpoznaniu czynników wpływających na warunki środowiska pracy podczas transformacji można uwzględnić w procesie zarządzania zmianą dobre praktyki, skierowane na wzmocnienie pozytywnego i ograniczenie negatywnego wpływu tych czynników. W artykule przedstawiono czynniki o potencjalnym wpływie na warunki środowiska pracy w przedsiębiorstwach wdrażających technologie Przemysłu 4.0 i omówiono dobre praktyki, które można wykorzystać w procesie zarządzania zmianą w celu osiągnięcia poprawy warunków środowiska pracy.
Transformation to Industry 4.0, which is expected to result not only in an increase in productivity, but also in an improvement of the material and psychosocial work environment conditions, requires appropriate change management, which is related to the introduction of new technologies. Recognition of the factors influencing the conditions of the work environment during the transformation makes it possible to include in the change management process good practices aimed at strengthening the positive and limiting the negative impact of these factors. This article presents factors with potential impact on working environment conditions in companies implementing Industry 4.0 technologies and good practices that can be used in the change management process to achieve better working environment conditions.

Opis:
Purpose: To develop a system of automated protection of employees from Covid-19 and other infections, it is implemented through minimizing the risks of contracting the SARS-CoV-2 virus and other respiratory viral infections within the enterprise. Design/methodology/approach: Analysis of legal normative documents and scientific and technical literature – to update the scientific problem and formulate the research tasks; methods of system analysis - to build the overall structure of the system and to establish relationships between its elements; simulation methods - to develop the algorithms of functioning and interaction of sensors and actuators of the corresponding subsystems; methods of decision theory and data mining - to develop the training programs and testing the knowledge of employees on epidemic safety. Findings: The system of automated protection of employees from Covid-19 and other infections was developed, which, due to the connection of functionally independent elements according to a certain scheme, allows minimizing the risk of contracting the SARS-CoV-2 virus and other respiratory viral infections of employees at the enterprise and increasing their protection from the occurrence of the corresponding infections by implementing a complex of anti-epidemic measures within the system and providing and constant support of the quarantine regime at the enterprise in accordance with WHO recommendations. The developed system was implemented and pilot tested at the industrial enterprise "Odessa Experimental Plant" (Odessa, Ukraine). Based on the results of the development of the system, an application was filed for obtaining a patent for invention No. a 202105894 dated 20.10.2021. Research limitations/implications: The number of system elements can change (increase/decrease) depending on the number of workplaces, as well as areas requiring control. Practical implications: The implementation of the proposed system allows increasing the level of economic sustainability of the enterprise in a complex epidemiological situation of the state or world level by minimizing the risks of enterprise shutdown as a result of the need to limit social and labour connections between employees due to implementation a full range of antiepidemic measures (in accordance with WHO recommendations) at the enterprise and constant compliance with the established quarantine regime by the employees at enterprise. Originality/value: For the first time, the system of automated protection of employees from Covid-19 and other infections was developed and proposed for use at enterprises, institutions and organizations, which, unlike others, allows the implementation of a full range of appropriate anti-epidemic measures at the enterprise (according to WHO recommendations) and ensure compliance with the established quarantine regime by the employees, due to the constant management of the sanitary-epidemic control modes of admission to the enterprise, disinfection of surfaces, ventilation and air decontamination of industrial premises etc.

Opis:
Dokumentacja budowy nakłada określone obowiązki na uczestników procesu budowlanego: inwestora, inspektora nadzoru inwestorskiego, projektanta, kierownika budowy (kierownika robót). Czynności i zadania przypisane poszczególnym uczestników procesu wymagają od nich właściwego rozumienia i interpretowania prawa, ponieważ nieznajomość przepisów nie zwalania od odpowiedzialności. W artykule zdefiniowano i scharakteryzowano dokumentację wymaganą podczas realizacji budowy, która jest dowodem na to, że wszelkie prace w trakcie wykonania obiektu budowlanego były prowadzone w sposób bezpieczny i zgodny z wymaganiami.
The construction documentation imposes certain obligations on the participants of the construction process: investor, investor’s supervision inspector, designer, construction manager (works manager). The activities and tasks assigned to individual participants in the process require them to properly understand and interpret the law, because ignorance of the provisions does not exempt them from responsibility.

The aim of the paper is to present issues related to the implementation of innovative solutions in the field of occupational health and safety in the enterprise and in the position of quality controller. By presenting the instrumentation of the OHS management system and the "new approach" to issues related to the implementation of the PN-ISO 45001:2018-06 standard, it is possible to define a new paradigm of the management system also in occupational risk assessment. When discussing the effects and actions of arduous and harmful factors at a given workplace, the methods of occupational risk assessment and analysis should be specified.
