The article is divided into two main parts. It refers to selected data on hate crimes recorded in Poland and Police effectiveness regarding preventing, investigating and combating such kinds of crimes. Based on available sources there is no problem with extremist activity in a large-scale in Poland nowadays, but for sure there is an urgent one with the increasing number of hatemotivated incidents, both with its social impact. Awareness-raising and educational campaigns that aim at promoting respect for human rights and tolerance for diversity are much needed in this matter. Also, law enforcement agencies, including Police, play a key role while tackling racism and bias. An uncontrolled and unpunished manifestation of hate, both with the lack of an appropriate and unequivocal state response to such incidents, also quiet, social approval to hate-motivated behaviours, seem to be the main components of extreme movements growing. Thus, the main aim of the article was to describe the phenomenon of hate-motivated incidents that were reported in Poland within the past years and to diagnose Polish police officers’ skills, knowledge and qualification in this field, both qualitative analyses of accessible training programmes. Selected terms (racism, discrimination, intolerance, xenophobia and hate speech) and symbols (the Celtic Cross, the SS-Totenkopf and the Triskele) that promote hate were defined (part 1) both with Police officers’ identification accuracy. Research results presented in this article were gathered by using a variety of methods and techniques, both theoretical and empirical (part 2). The data that refers to Police competence in the context of preventing, investigating and combating hate crimes was mainly collected as a part of a doctoral research conducted by the author in 2012–2014.

The aim of this article is to draw attention to an issue that has a long history: the problem of hate crimes in the United States of America. There is no doubt that hate crimes are the type of crime that attack the very principle of individuality that is an entitlement under the equal protection of the law (in the U.S.). Bearing the foregoing in mind the above, and that the number of such crime has increased at an alarming rate, this article describes and discusses types of hate crimes such as: Racist and Religious Hate Crimes, Sexual Orientation-Based Hate Crimes and Disability Hate Crimes as an extended projection of the analysis, several solutions have been proposed to mitigate tensions and combat the prevalence and severity of hate crime in all its forms.

This study aims to examine the underlying causes of the hate against Asian Americans in relation to coronavirus disease 2019 (COVID-19). Using discourse analysis, the author analyzes interview data collected before the outbreak of the pandemic in the Bay Area of the United States. Anti-Asian sentiment did not start after the beginning of the outbreak. Rather, it has existed in American society, and people in the Asian community have faced prejudice and hate incidents before the outbreak as well. This study examines the discourse in two ways: discourse as practices and discourse as language in use. Through the analysis of interview data, this study aims to 1) shed light on Asian Americans’ experiences and reveal the racism Asians are subjected to; 2) examine how the discourse affects the identity and situation of Asians under a certain dominance; 3) analyze how discourse reproduces systemic violence against Asian Americans. The analysis shows that the same discourse which has positioned Asians as the “other” is reproduced both socially and politically and that is a reason for violence against Asian Americans. However, it is further revealed that Asian people construct their identity through these discourses, by either internalizing or opposing them.

Since 2012, the United Kingdom government has annually published data relating to the number of hate crimes recorded by police forces across England and Wales. Over the past half-decade, the number of hate crimes has increased year on year and are currently at record levels. Some have referred to this as a crisis. This article seeks to investigate the drivers and causes for this, to try and better understand what hate crime looks like in the UK today. First, this article considers and contextualises what is currently known about hate crime in the UK. Having identifi ed some correlations, it explores the relationship between increases in hate crime numbers and the UK’s withdrawal from the European Union (Brexit), terror attacks, COVID-19 and Black Lives Matter. In trying to explain these relationships, Perry’s ‘permission to hate’ model is used. In conclusion, this article argues that while hate crime numbers are currently at record levels it is highly likely that they will continue to increase for at least the foreseeable future. A timely and contemporarily salient study, this article puts forward new thinking about hate crime in the UK and the correlation that is clearly evident with occurrences that take place in the country’s socio-political spaces.

This paper examines expert testimony advocating the inclusion, in proposed hate-crime legislation, of crimes motivated by gender bias. The design and rhetoric of such testimony evidences formal properties. Precisely because these properties are formal properties, not limited to specific cases or issues, their explication will contribute not only to the understanding of hate crimes discourse, but to social problems research and theory more broadly. Arguments for the expansion of rights to previously unprotected categories (1) can be designed with an emphasis on generic or formal principles, which allow for the inclusion of previously unprotected groups whose victimization constitutes additional social problems not yet institutionally recognized. Such arguments (2) can emphasize parallelism between protected categories and unprotected categories, and between recognized social problems and as-yet-unrecognized social problems, making similar institutional treatment seem rational, and making disparate treatment seem unjustifiable or insensitive. And such arguments (3) can propose limits to the desired expansion of rights, as a means of pre-empting “floodgate” arguments against expanding the scope of existing protections. More generally, membership categorization analysis is employed to study social identity and inter-group relations as these are constituted in social problems discourse. Special reference is made in this case to “hate crimes” and how they might be addressed by membership categorization analysis in the context of constructionist social problems analysis and qualitative sociolegal studies.

W artykule dokonano analizy zjawiska agresji werbalnej (inaczej, mowy nienawiści) oraz tzw. „przestępstw z nienawiści” w ujęciu kryminologicznym. Do psychologicznych źródeł mowy nienawiści zaliczono emocje, takie jak gniew i nienawiść. Charakteryzując socjologiczne źródła przestępstw popełnianych z nienawiści, zwrócono uwagę na problematykę stereotypów, ignorancji oraz kategoryzacji społecznej oraz deindywidualizacji. Za istotne czynniki w inicjowaniu zachowań agresywnych, takich jak mowa nienawiści, uznano również konflikty międzygrupowe oraz uprzedzenia kierowane wobec określonych grup społecznych oraz osób. Zasadniczym problemem związanym ze ściganiem przestępstw popełnianych z nienawiści jest identyfikacja sprawców tych przestępstw popełnionych za pośrednictwem Internetu. Kwestia ta ma mniejsze znaczenie w odniesieniu do czynów polegających na pobiciu, uszkodzeniu ciała czy naruszeniu nietykalności cielesnej, albowiem w takich wypadkach sprawca jest z reguły znany pokrzywdzonemu lub też możliwe jest jego ustalenie na podstawie zeznań pokrzywdzonego czy świadków. Oceniono, iż podstawą słabych efektów walki z mową nienawiści w sieci jest zarówno nieodpowiednie egzekwowanie istniejących przepisów prawa, jak również brak właściwych regulacji.
The article analyses the phenomenon of verbal aggression (in other words, hate speech) and the so-called hate crimes from the criminological point of view. Psychological sources of hate speech include emotions such as anger and hatred. Characterising sociological sources of hate crime, the author draws attention to the issue of stereotypes, ignorance and social categorisation, and deindividuation. Inter-group conflicts and prejudice addressed to particular social groups and people are also recognised to be important factors in initiating aggressive conduct like hate speech. The main problem connected with the prosecution of hate crime is identification of perpetrators of those offences committed via the Internet. The issue is less significant in relation to acts of battery, injury or violation of bodily integrity because in such cases a victim usually knows a perpetrator or he/she can be identified based on a victim’s or witnesses’ description. It is assessed that the basic reasons of poorer results in the fight against hate speech in the web include inadequate enforcement of the existing provisions of law and the lack of appropriate regulations.

The article draws attention to the problem of permanent conflict between freedom of speech (freedom of expression) and hate speech used in communication by politicians and ordinary people in a democratic state, not only to strenghten the importance of civil rights and freedom, but often to antagonize specific social groups. They attempt to evaluate legal tools in the fight against hate speech and their effectiveness in combating this social pathology, but also stress further need for changes in criminal law in this area to facilitate those experiencing hate speech and discriminatory justice. It should be noticed that the problem of excluding hate speech from social life is extremely complex and difficult to implement in practice. Each interference of the legislator with civil rights and freedom should be proportionate and carefully thought out and can not lead to an unjustified limitation of these rights.

The Court of Appeal in Bialystok in its judgment of 30 October 2014 (II AKa 221/14, LEX No. 1602865) stated that the use of violence, unlawful threat or insult solely on the grounds of someone’s national, ethnic, racial or religious affiliation can not find any rational and widely accepted explanation. This is in the meaning of Article 115 § 21 of Polish Criminal Code an action for no reason or, of course, a trivial reason. According to the court, the qualification of the act under Article 119 § 1 of Polish Criminal Code or from Article 257 of Polish Criminal Code does not preclude the application of the provision of Article 57a § 1 of Polish Criminal Code. The author explains the terms “reason”, “trivial reason” and “no reason”, as well as “motivation that deserves special condemnation”. The author critically refers to the submitted thesis, considering that the legislator, by making the mark of the type discussed for the reasons, considers it important. Lack of rationality in wrong-doer act cannot be identified with a inconsequential reason or lack of reason.
Sąd Apelacyjny w Białymstoku w wyroku z dnia 30 października 2014 r. (II AKa 221/14, LEX nr 1602865) stwierdził, że używanie przemocy, groźby bezprawnej lub znieważanie wyłącznie z powodu czyjejś przynależności narodowej, etnicznej, rasowej albo wyznaniowej nie może znajdować żadnego racjonalnego i powszechnie akceptowanego wytłumaczenia. Jest to w rozumieniu art. 115 § 21 k.k. działanie bez powodu, względnie z oczywiście błahego powodu. Zdaniem sądu kwalifikacja czynu z art. 119 § 1 k.k. lub z art. 257 k.k. nie wyklucza zastosowania przepisu art. 57a § 1 k.k. Autorka wyjaśnia pojęcia „powód”, „błahy powód” oraz „bez powodu”, a także „motywacja zasługująca na szczególne potępienie”. Krytycznie odnosi się do glosowanej tezy, uznając, że ustawodawca, czyniąc z omawianych powodów znamię typu, uznaje je za istotne. Braku racjonalnego uzasadnienia zachowania sprawcy nie można utożsamiać z błahym powodem lub jego brakiem.

Background: Hate speech is a very important problem nowadays. One can meet it in one’s immediate surroundings (conversations with friends), the media, the Internet, or in the so-called public space (for example, inscriptions on the walls). One form of hate speech is online hate speech, which, together with certain other phenomena, is referred to as hejt in the Polish language. The authors of the article focus on presenting online hate speech in relation to various age and social groups. Objectives: The aim of the article is to present the phenomenon of hate speech on the web and its impact on the safety of Internet users. Methods: The article uses basic theoretical and empirical methods. Content published on the Internet is analyzed and case studies are described. Interviews with experts (psychologists, police officers, sociologists, media and hate speech specialists) were also conducted and their views are presented. Conclusions: In the discussion about hate speech, prevention is extremely important. According to the authors, broad prevention consisting of professionally prepared content, enriched with film materials, presented by an expert or a trained teacher, should be included in the core curriculum of schools as one of the mandatory issues raised during the lessons.

The phenomenon of hate speech and hate crimes is not easily captured in the legal definitions and is often described as controversial due to the difficulties with identifying the “hateful element” of words and deeds. Another significant reason for the difficulties concerning penalisation in the area in question is the strict (and for many unjustified) limitation imposed on freedom of speech, assembly and association, which are the freedoms most often affected by the anti-hate provisions of law. Nevertheless the obligations included in the international human rights law oblige Polish legislators to introduce and implement proper mechanisms of counteracting these extremely negative and socially dangerous phenomenon. However, many questions arise: Are the international standards of human rights law fully reflected in the Polish legal provisions and practice? How are the areas demanding alteration and endorsement being defined? What are the obstacles that unable the process of protecting all groups particularly endangered by hate speech and hate crimes? Are the provisions of law a sufficient and effective barrier against spreading hatred in the public sphere? This article seeks to answer all the questions posed above. It also attempts to demonstrate the complexity of the analysed problems, placing them in the centre of the gene-ral discussion on tolerance, minorities protection and the functions of the antidiscrimination law within democratic state and society.

Celem artykułu jest zbadanie dyskursu medialnego związanego z nowymi formami prezentacji symboli religijnych i ze społeczną reakcją na to zjawisko. Symbole religijne są wykorzystywane przez środowiska zainteresowane zaznaczeniem swojej obecności w społeczeństwie. Jednym z pytań badawczych jest pytanie o to, czy przykłady happeningów, uznawanych przez grupy katolików za skandaliczne i obraźliwe, mogą być dowodem na nową formę „mowy nienawiści” w sferze publicznej. Miałaby ona ewoluować ze sfery językowej w sferę wizualnych znaczeń i odgrywać ważną rolę w „wojnie kulturowej” na światopoglądy i wartości w naszym społeczeństwie. Diagnoza zjawiska związanego z happeningami odbieranymi jako „prowokacje” prowadzi do przekonania, że mamy do czynienia z nowym problemem społecznym. Angażuje on osoby związane z Kościołem katolickim, policję, sąd i prokuraturę, ponieważ autorzy inicjatyw są oskarżani o obrażanie uczuć religijnych, co zgodnie z art. 196 kodeksu karnego jest w Polsce przestępstwem.
The main purpose of this article is to analyse the medial discourse connected with new ways of presenting religious symbols and social reactions to this. Religious symbols are used by communities that want to stand out in society. The research questions consider whether these events, treated by Catholics as scandalous and offensive, could be examples of a new form of hate speech in the Polish public sphere. If so, this would involve an evolution from the language sphere to the visual sphere and, therefore, would be a crucial shift in a cultural war in our society. The diagnosis of phenomena related to events perceived as “provocations” indicates that we are dealing with a new social problem. This problem involves people associated with the Catholic Church, the police, the court, and the prosecutor’s office because the authors of initiatives are accused of offending religious feelings, which, according to Art. 196 of the Criminal Code is a crime in Poland.

Opis:
The article presents the problem of stalking and cyberstalking and offenses arising from hate speech and attempted evaluation of the acquired legislation criminalizing these phenomena. In the modern world stalking, cyberstalking, and hate speech are considered behaviors thaat constitute a serious violation of human rights including the right to liberty, privacy and dignity. Especially hate crime (hate crimes) are a serious problem for the development of society. Feeling of indulgence society can not tolerate behavior marked by tormented victims, their persecution on the Internet or the real world. We can not be indifferent to the promotion of racial, ethnic, religious hatred. General spread of intolerance towards other people undermines the idea of democracy, security and pluralism. Also, law enforcement agencies can not remain passive in relation to such offenses as violence and threat unlawfuly motivated by prejudice (art. 119 of the Penal Code), stalking (art. 190 a of the Penal Code), promotion of fascism and totalitarianism (art. 256 of the Penal Code), racism ( art. 257 of the Penal Code), insult of religious feelings (art. 196 of the Penal Code), defamation (art. 212 of the Penal Code) and insult (art. 216 of the Penal Code), although much depends on the attitudes of victims.
