    Opis:
    Genetic research allows not only for precise diagnosing of diseases, but also for selecting therapy and appropriate medicines, and for insight into future health condition. Genetic information obtained as a result of genetic research is related not only to patients, but to their relatives, too. In this context a threat arises of abuse, infringement of human rights and unauthorised access to genetic data. The audit of NIK was aimed, in the first place, to examine whether genetic research in Poland is conducted with due care for safety requirements, that is whether Polish legal regulations keep up with the development of modern technologies in medicine.

    Postępujący progres cywilizacyjny doprowadził do wzmożonego zainteresowania społeczeństwa czynnikami wpływającymi na ukształtowanie natury człowieka, jego cech fizycznych, stanu zdrowia, predyspozycji intelektualnych, skłonności i upodobań. Określenie zapotrzebowania bądź zainteresowań poszczególnych grup czy narodowości napędza wszystkie gałęzie przemysłu, gospodarki, oferowanych usług. Szczegółowa wiedza o człowieku posiada obecnie istotne znaczenie – począwszy od nauk medycznych aż po sferę ekonomiczną czy handlową. W naturalny sposób implikuje także progres w obszarze genetyki oraz nauk pokrewnych. Uzyskanie informacji o anatomicznym profilu człowieka zyskało istotne znaczenie także w działalności ubezpieczeniowej. W niniejszym artykule omówione zostały warunki dopuszczalności wykorzystania wyników badań genetycznych dla oceny ryzyka ubezpieczeniowego w kontekście systemu polskiego prawodawstwa oraz czynniki wpływające na zainteresowanie zakładów ubezpieczeń profilem genetycznym człowieka, a także prognozowane skutki tak dalece idącej ingerencji w sferę prywatności jednostki.
    Human progress has led to a growing interest in factors shaping the human nature, physical features, tendencies. Determining the demands of particular nations or social groups influences all industry sectors, the economy, the goods. As this comprehensive sum of the human knowledge plays such a vital role in a modern world, the progress in the field of human genetics and other related sciences will also be accelerated. The wealth of knowledge positively impacts many aspects of life and various types of human activity such as healthcare, the economy, trade. It is evident that the ability to create a detailed analysis of each individual greatly affected the wider insurance sector. The following article will discuss the conditions of admissible use of genetic testing results by the insurance sector for the purpose of risk assessment in the context of the Polish legislative system; the factors contributing in an increased interest by the insurance companies in this new field and the predicted consequences arising from an extensive privacy interference of each person.

    Opis:
    The aim of the study is to analyze the case law of the European Court of Human Rights on genetic information in the scope of international biomedical law, as expressed in the International Declaration on Human Genetic Data and the Convention on the Protection of Human Rights and Human Dignity in the Field of Application of Biology and Medicine. The Court held that the genetic information is protected under the law of the Convention on Human Rights and Fundamental Freedoms. The model of the right to respect for private life is reflected in its shape, as the Court noted in the Van der Velden v. The Netherlands and S. and Marper v. The United Kingdom cases. It leads to the conclusion that the provision of Article 8 of the Convention provides the protection of genetic information, subject to certain restrictions that are “in accordance with law” and “necessary in a democratic society”. Such conclusion is in compliance with art. 12, art. 17 (b) art. 21 (c) of the International Declaration on Human Genetic Data, and art. 11 of the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine.
