Opis:
Jean-Jacques Rousseau is primarily a social philosopher. His theories of a social contract, of sovereignty of the people, and of general will are basic concepts in the philosophy of law and political and economic thought. Although associated with the Enlightenment as an epoch in which the achievements of the sciences based on reason and experiment were paid tribute, Rousseau appeared as a thinker trying to undermine this fact. From the very beginning of his work, he has been building a worldview that can be seen as a manifestation of rebellion against the uncritical domination of the rational. He does not accept the negation of irrational factors, to which he proposes to give their rightful place, both in the individual’s educational process, and on the social and political level. He considers the proper development of the emotional and volitive sphere to be the best medicine that can help solve all the problems of life of people with which our intellect is unable to cope.

It is legitimate to speak about two philosophies of education as presented by Jean-Jacques Rousseau. The first of the philosophies was elucidated in Emil, or on Education and its aim was to provide principles governing the process of upbringing of the man. Philo-sophical grounds for the second one were comprised in The Social Contract, however description of the education itself is delivered by Considerations on the Government of Poland. This concept refers to the civic education, education of the political community mem-ber. Alexis de Tocqueville depicts vision of education that varies fundamentally from the both grounded in Rousseau’s writing. Toc-queville’s vision stays at odds with the philosophy given in Emil, because it concerns civic aspects of the education. It is also not com-pliant with the concept stemming from Considerations, due to the fact that it stresses the role of other than state subjects in the edu-cation. The article comments on all three concepts of education out-lined above and finally relates them to the concept of positive and negative liberty provided by Isaiah Berlin.

Opis:
The aim of this paper is to demonstrate the role Rousseau’s doctrine of general will played in the thought and writings of Gilbert Keith Chesterton. The article begins with the characterization of the doctrine of general will as understood by Rousseau. Then, an overview of the existing critique of Chesterton’s heritage and what it had (or did not have to) to say about the matter in question is conducted. Next, the fact that Chesterton accepted the doctrine of general will is demonstrated by means of textual analysis. The paper ends with a section devoted to drawing some practical conclusions from the results of the analysis, with special stress laid on the fact that acknowledging the role the doctrine of general will played in Chesterton’s thought might not only serve as a “hermeneutical key” to the more controversial of his ideas (his democratism and his alleged anti-Semitism taken as examples), but also serve as the means to change the overall perception of him as a political thinker from a Catholic integrist to a Catholic pluralist.

Celem opracowania jest dowiedzenie, że angielska myśl dystrybucjonistyczna, reprezentowana przez Hilaire Belloca i Gilberta Keitha Chestertona, stanowi oryginalny wariant konkretnego ideału historycznego nowej cywilizacji chrześcijańskiej, jaki opracował w dziele Humanizm integralny francuski filozof tomistyczny, Jacques Maritain. Pierwsza, krótsza część artykułu stanowi zarys koncepcji nowej cywilizacji chrześcijańskiej jako konkretnego ideału historycznego, ujętego w trzech zasadniczych wymiarach: politycznym (demokracja personalistyczna), ekonomicznym (pluralizm gospodarczy) i kulturowym (chrześcijańskie państwo świeckie). Druga poświęcona jest wykazaniu, że te wszystkie trzy elementy znajdują analogiczne odzwierciedlenie w tradycji dystrybucjonistycznej. Trzecia, najkrótsza, poświęcona jest prezentacji podstawowych różnic zachodzących między koncepcjami Maritaina a dystrybucjonistów, ze względu na które nie można mówić o pełnej identyczności, a jedynie o podobieństwie, i które otwierają perspektywy dalszych badań.
The aim of the work is to present English social philosophy of distributism as a variant of a concrete historical ideal of the New Christian Civilization, as proposed by a French Thomist, Jacques Maritain, in his Integral Humanism. The first part of the text present the idea of the New Christian Civilization in three important dimensions: political (personalist democracy), economic (economic pluralism) and cultural (Christian secular state). Second one's aim is to prove that all these three elements are analogically present in the structure of distributist thought. Third part, the shortest of all, presents differences that occur between English distributism and the thought of Jacques Maritain, due to which the two system can be compared not in the terms of identity, but only similarity, and which open perspectives for further research.

The chief aim of this paper is to demonstrate beyond reasonable doubt how, through an essential misunderstanding of the nature of philosophy, and science, over the past several centuries, the prevailing Western tendency to reduce the whole of science to mathematical physics unwittingly generated utopian socialism as a political substitute for metaphysics. In short, being unable speculatively, philosophically, and metaphysically to justify this reduction, some Western intellectuals re-conceived the natures of philosophy, science, and metaphysics as increasingly enlightened, historical and political forms of the evolution of human consciousness toward creation of systematic science, a science of clear and distinct ideas. In the process they unwittingly wound up reducing contemporary philosophy and Western higher education largely into tools of utopian socialist political propaganda.

Opis:
The article is dedicated to the matters of succession in the Agreement of 1993 on Legal Aid concluded between Poland and Ukraine. The author touches upon a number of issues. First, he discusses the role of the “general compatibility clause” provided for in Article 97 of the 1993 Agreement. He concludes that the clause does not produce effects with regard to the Regulation (EU) No 650/2012. Under the “general compatibility clause”, in all situations where the 1993 Agreement does not provide for a rule being the equivalent of the rules laid down in the Hague Convention of 1961 determining the law applicable to the form of a testamentary disposition, in Poland, in relations between Poland and Ukraine, the law applicable to the form of a testament is to be determined pursuant to the provisions of the Hague Convention of 1961.Second, the author discusses the conflict-of-laws rules set out in the Agreement which designate, as the applicable law, either Polish or Ukrainian law. He contends that where the deceased is a Polish and Ukrainian national, in order to determine which of those nationalities have to be taken into account for the purposes of Article 37 (1) of the 1993 Agreement, the criterion of the most effective (more closely connected) nationality should be relied on. However, the situations that involve a deceased of Polish or Ukrainian nationality, who is also a third-State national, do not fall within the scope of the 1993 Agreement. The application of the 1993 Agreement is, on the other hand, not barred by the fact that an immovable property in a third State forms part of the estate. Jurisdiction and the law applicable to the succession of such immovable property must be determined, both in Poland and in Ukraine, pursuant to their general conflict-of-laws regulations on matters of succession. The author explains also that the drafters of the 1993 Agreement (in Articles 37 (1) and (2)) ruled out the principle of unity of succession in favour of the principle of scission, employing the connecting factors of nationality and of location of the immovable property. This results in numerous complications in the determination of the applicable law and in its application. However, the law applicable to succession determined on the basis of Article 37 (1) and (2) of the 1993 Agreement of 1993 governs the succession as a whole, with the exception of issues covered by other rules provided for in that agreement (for example, Article 39) and of the issues that do not fall within its scope of the 1993 Agreement. Although Article 39 (1) of the 1993 Agreement expressly mentions only consequences of defective consent, there is no doubt that the said rule also covers the legal requirements for effective declaration of consent.Third, the author addresses the function of Article 38 of the 1993 Agreement, which is a substantive law provision on the estate without a claimant. This provision enjoys priority over Article 33 of the Regulation No 650/2012. Article 38 solely determines the State (Poland or Ukraine) acquiring the estate without a claimant. The concerned State enjoys the competence to designate the entity that will become the subject of rights and obligations forming part of the estate without a claimant.Finally, the author comments on the pending case resulting from the preliminary question posed by the Opole District Court (Sąd Okręgowy, case no II Czz. 438/21). The Opole Court requested from the European Court a ruling on whether a Ukrainian national residing in Poland may, under Article 22 of the Regulation No 650/2012, choose Ukrainian law. The author suggests, that — although not without a doubt — it is tempting to answer this question in the affirmative. The argument here is that the freedom to choose the applicable law in matters of succession falls entirely outside the ambit of the 1993 Agreement and so the Agreement does not preclude the choice.
