The article identifies determinants influencing the share of Fixed Rate Mortgages (FRM), Adjustable Rate Mortgages (ARM) (including Variable Rate Mortgages, VRM) based on market structure, institutional-legal factors, and macroeconomic conditions with emphasize on emerging markets. In emerging markets, the product offering in banks may be underdeveloped for reasons distinct from those in developed economies. The article concludes with considerations about which factors are the most crucial to increase market share of ARM. The article takes into consideration secondary research and emphasizes about risks associated with different types of interest rates on mortgage loans for households.

Over the past few decades, anaerobic-aerobic wastewater treatment systems have been widely used in industrial and municipal wastewater treatment. This study was conducted to examine the effects of combined anaerobic-aerobic bioreactors in the removal of chemical oxygen demands (COD) while reducing phosphate concentrations in synthetic wastewater. In this project, a bioreactor with the dimensions of 10 cm × 10 cm × 80 cm with respective Kaldnes packing ratios of 90 and 30% for the anaerobic and aerobic sections was designed. A combined anaerobic-aerobic reactor’s structure made changing hydraulic retention times only possible by adjusting the volume of its aerobic and anaerobic sections. In the first case, the anaerobic and aerobic sections of the reactor occupied 30 and 50 cm of its height, respectively. The height of the anaerobic section decreases to 12.5 cm in the second case. In aerobic and anaerobic sections, pH was within a neutral range, temperature was 37°C. MLSS (mixed liquor suspended solids) was 1220 and 1030 mg/L, and attached growth was 743 and 1190 mg/L respectively. In order to evaluate COD in the wastewater, three different initial phosphorus concentrations were tested: 12.8, 32.0 and 44.8 mg/L, as well as four COD: 500, 1000, 1200 and 1400 mg/L. Considering the results, COD removal is greater than 80% when the valve 2 is in the anaerobic section outlet regardless of the concentration of phosphate. In this case, the best result is for inlet COD of 500, where the reactor can eliminate more than 90%. When the COD concentration reaches 1000 to 1400 ppm, the reactor’s COD removal efficiency declines to 60%.

Suicide rates in Europe have in the recent years reached a disturbingly high level, sparking frequent discussions on the topic of mental health and suicide prevention, which significantly affect not only individuals but also their environment. The aim of this paper was to analyse the impact of the socio-economic situation on suicide rates using panel data analysis. The study presents an overview of the related literature and the definitions of essential terms concerning suicide, as well as the socio-economic factors determining suicide rates. The parameters of a fixed effects model were estimated, interpreted and compared with the results of earlier research. The analysis of the selected dataset showed that GDP per capita and the Gini coefficient have a negative and statistically insignificant impact on suicide rates. On the other hand, the conducted research showed that high divorce and unemployment rates, risk of poverty, social exclusion and excessive alcohol consumption proved to be statistically significant, thus increasing suicide rates.

This paper presents a comparative study among methods of allocation of fixed costs in Distribution Networks (DNs). The application of these methods allows obtaining distribution use-of-system charges. Three pricing mechanisms composed of two part tariffs are evaluated. In the three mechanisms, the first part is obtained by the Long Run Incremental Cost (LRIC) method. The second one is determined by the following methods: Postage Stamp (PS), MW-Mile (MWM) or Ramsey-Boiteux (RB). The characterization and comparison of each method are performed from the point of view of regulatory principles that define guidelines on network pricing. The results allow identifying the adherence of the methods in compliance with the regulatory principles. Conflicting character between different principles is observed. The methods are tested and validated in the IEEE13-node distribution network. A study along these lines points to the proposition of new alternatives in pricing the use of DNs in the face of the growth of Distributed Energy Resources.

Włoski sąd krajowy wystąpił z odesłaniem prejudycjalnym, kwestionując zgodność prawa krajowego z prawem UE. Naruszenie prawa UE miało wynikać z nadużywania kolejnych umów o pracę na czas określony i braku skutecznych środków przeciwdziałania dyskryminacji włoskich katechetów ze względu na religię. Trybunał Sprawiedliwości Unii Europejskiej, dokonując wykładni prawa, potwierdził, iż normy krajowe wykluczające nauczycieli religii katolickiej w szkołach publicznych z zakresu stosowania przepisów mających na celu wyciągnięcie konsekwencji z nadużywania kolejnych umów na czas określony – gdy w wewnętrznym porządku prawnym nie istnieje żaden inny skuteczny środek pozwalający na osiągnięcie tego celu – stanowią naruszenie prawa UE. Stwierdził także, że obowiązek posiadania misji kanonicznej nie stanowi przesłanki znoszącej zakaz dyskryminacji pracowniczej. Glosowane orzeczenie stanowi jedną z wielu spraw dotyczących nadużyć praw pracowniczych we włoskim sektorze publicznym, w którym to obszarze TSUE zasadniczo kontynuuje dotychczasową linię orzeczniczą. Novum w komentowanej sprawie stanowi wykładnia zakazu dyskryminacji ze względu na religię w dostępie do zatrudnienia i pracy. Wbrew wykładni dokonanej przez sąd krajowy, TSUE nie potwierdził istnienia bezpośredniej dyskryminacji ze względu na religię, która jest zakazana na mocy dyrektywy 2000/78 i art. 21 Karty praw podstawowych Unii Europejskiej. Wydaje się, że wyjątkowo wyważone i wstrzemięźliwe stanowisko TSUE wynika z chęci zachowania możliwie szerokiej neutralności w obszarze ściśle związanym z pozycją prawną kościołów i innych wspólnot religijnych, której kształtowanie pozostaje w wyłącznej kompetencji państw członkowskich, zgodnie z art. 17 Traktatu o funkcjonowaniu Unii Europejskiej.
This commentary analyzes the preliminary ruling of the Court of Justice of the European Union in the case C-282/19, YT and Others v. MIUR and Ufficio Scolastico Regionale per la Campania, issued 13 January 2022. The referring court made a request for a preliminary ruling, questioning the compliance of Italian law with EU law. The infringement of EU law was allegedly due to the abuse of successive fixed-term employment contracts and lack of effective measures to prevent discrimination of Italian Catholic religion teachers on the grounds of religion. When interpreting the law, the Court of Justice confirmed that the national norms excluding Catholic religion teachers in public education establishments from the scope of the provisions intended to penalise abuse of successive fixed-term contracts – where there is no other effective measure in the domestic legal system – constitute a breach of EU law. The Court also stated that the obligation to hold missio canonica cannot constitute an objective reason precluding the prohibition of employment discrimination. The commented judgment is one of many cases concerning the abuse of workers’ rights in the Italian public sector, in which the Court basically continues the previous line of jurisprudence. A novelty in the commented case is the interpretation of the prohibition of discrimination based on religion in employment and occupation. Contrary to the interpretation made by the national court, the Court of Justice did not confirm direct discrimination based on religion, which is prohibited under Directive 2000/78 and Article 21 of the Charter of Fundamental Rights. The extremely balanced and restrained position of the Court seems to result from the desire to maintain the broadest possible neutrality in the area closely related to the status of churches and other religious communities, which remains within the exclusive competence of member states, as established by Article 17 of the Treaty on the Functioning of European Union.

Fixed beds were adopted for removal of organic dye from water by photocatalytic decomposition or adsorption. To this end, macroporous titania or silica micro-particles were synthesized from emulsions as micro-reactors and packed in the bed. During feeding aqueous methylene blue solution, UV light was irradiated for generation of active radicals for removal of dye by photocatalytic decomposition. Porous silica particles were also used as adsorbents in the bed for continuous adsorption of organic dye. For regeneration of the porous titania or silica particles, rinsing with fresh water was carried out before repeated cycles.

This work aimed to observe the influence of calorific value and proximate properties in the fabrication of rice husk (RH) and coffee shell (CS) briquettes composite. Rice and coffee husks contain cellulose, hemicellulose, and lignin. These contents are necessary for the adhesive to bind the briquette (amylose and amylopectin). The raw materials were carbonized at 400 °C for 60 minutes. Variations of sieving size (60, 80, and 100 mesh) and the composition ratio of raw material CS:RH were reviewed to study their effect. Tests of density, moisture content, volatile matter content, ash content, fixed carbon content, shatter index, combustion rate, and calorific value were carried out to determine the optimum composition. The results were obtained with the best quality at a particle size of 60 mesh with the highest calorific value of 17.422 MJ/kg. It showed that the briquettes have good quality and are comparable with the standard briquette.

Within this work, we discuss the existence of solutions for a coupled system of linear fractional differential equations involving Caputo-Fabrizio fractional orders. We prove the existence and uniqueness of the solution by using the Picard-Lindel ̈of method and fixed point theory. Also, to compute an approximate solution of problem, we utilize the Adomian decomposition method (ADM), as this method provides the solution in the form of a series such that the infinite series converge to the exact solution. Numerical examples are presented to illustrate the validity and effectiveness of the proposed method.

In the paper finite-dimensional semilinear dynamical control systems described by fractional-order state equations with the Hilfer fractional derivative are discussed. The formula for a solution of the considered systems is presented and derived using the Laplace transform. Bounded nonlinear function f depending on a state and controls is used. New sufficient conditions for controllability without constraints are formulated and proved using Rothe’s fixed point theorem and the generalized Darbo fixed point theorem. Moreover, the stability property is used to formulate constrained controllability criteria. An illustrative example is presented to give the reader an idea of the theoretical results obtained. A transient process in an electrical circuit described by a system of Hilfer type fractional differential equations is proposed as a possible application of the study.

Celem artykułu jest przedstawienie aktualnych wyzwań metodycznych związanych ze statystyką mieszkaniowego majątku trwałego oraz jego reprodukcji, czyli strumieni oddziałujących na jego wartość. Z przeprowadzonych rozważań, opartych na przeglądzie informacji udostępnianych przez Główny Urząd Statystyczny i literatury przedmiotu dotyczącej problematyki polskiej, wynika, że statystyka publiczna nie dysponuje wystarczającymi informacjami, które umożliwiałyby wnioskowanie – zwłaszcza długookresowe – na temat kształtowania się mieszkaniowego majątku trwałego oraz jego miejsca w ogólnym układzie społeczno- -gospodarczym. Brakuje zwłaszcza danych niezbędnych do określania rzeczywistych rozmiarów (wolumenu), stopnia zużycia i proporcji zasobu mieszkaniowego majątku trwałego oraz strumieni wartości tego majątku przekazywanego do użytkowania lub likwidowanego, a także wartości nakładów na remonty oraz eksploatację zasobu. Wprowadzenie zmian w statystyce mieszkaniowego majątku trwałego zgodnie z zaproponowanymi wskazówkami mogłoby się przyczynić do lepszego ilustrowania przez statystykę trendów i innych gospodarczych zależności strukturalnych, decydujących o społecznym obliczu problematyki mieszkaniowej.
The aim of the article is to present the current methodological challenges related to the statistics of residential fixed capital and its reproduction, i.e. streams affecting its value. Our research, based on information from Statistics Poland and the literature relevant to the Polish experience, demonstrates that official statistics does not have enough information to draw conclusions – especially long-term ones – regarding the current shape of residential fixed capital in Poland and its place in a larger, socio-economic system. What is missing in particular are the data necessary to define the actual volume, degree of wear and tear and the proportion of the housing stock of fixed capital, as well as the value streams of this capital made available for use or liquidated. It is also impossible to determine the value of outlays on the renovation and operation of the housing stock. The implementation of changes in the statistics of residential fixed capital according to the guidelines proposed in this paper is likely to improve its ability to illustrate more accurately the trends and other economic structural dependencies that shape the social dimension of the housing problem.

Opis:
The implementation of public tasks may be entrusted by local municipalities to specific entities, which include water companies. These entities are often established on the initiative of local government units which, by becoming members of water companies, aim to ensure that the tasks they carry out are fulfilled and, for the benefit of the general public, take all steps to equip those entities with the necessary fixed assets. The functioning of water companies is not given much space in the doctrine, especially in the context of the acquisition of property rights and mutual relations between the municipality and the water company. Water companies created on the basis of the Water Law Act, of which local government units are often members, are mistakenly treated by their creators, members and beneficiaries as equal to budgetary establishments carrying out obligatory tasks for the residents. Misinterpretation of the legal conditions of a water company can lead to the implementation of legal actions that cause irreversible property consequences for both parties. At this point it is worthwhile to analyze the effects of a legal action consisting in the transfer of real estate by a municipality for free use to a water law company. The doctrine devotes relatively little space to explaining the phenomena related to the performance by water law companies of tasks commissioned by local governments units and the legal problems arising in this area. The study was carried out using a dogmatic-legal method in order to determine the legal status of an entity of a water company under the current legislation, in particular the provisions of the Water Law Act, the Act on Entrepreneurs and the Act on Real Estate Management. The findings in this regard allowed to answer the question: does the transfer of a municipality’s assets to a water company for use free of charge for an indefinite period of time constitute a transfer of ownership rights? An analysis was made of the consequences of concluding an agreement for the transfer of real estate by a municipality to a water company for use free of charge and of the impact on ownership rights and property consequences for both entities.
Realizacja zadań publicznych może być powierzana przez gminy specyficznym podmiotom, do których zalicza się spółki wodne. Podmioty te powstają często z inicjatywy jednostek samorządu terytorialnego, które stając się członkiem spółek wodnych, dbają o zapewnienie realizowanych przez nie zadań i dla dobra ogółu społeczeństwa podejmują wszelkie czynności mające na celu wyposażenie tych podmiotów w niezbędny majątek trwały. Funkcjonowaniu spółek wodnych nie poświęca się w doktrynie wiele miejsca, zwłaszcza w kontekście nabywania praw majątkowych i wzajemnych relacji pomiędzy gminą a spółką wodną. Tworzone na podstawie ustawy Prawo wodne spółki wodne, których członkami są często jednostki samorządu terytorialnego, zarówno przez ich twórców, członków, jak i beneficjentów mylnie traktowane są na równi z zakładami budżetowymi wykonującymi obowiązkowe zadania na rzecz mieszkańców. Błędna interpretacja uwarunkowań prawnych spółki wodnej może prowadzić do realizowania czynności prawnych, wywołujących nieodwracalne skutki o charakterze majątkowym dla obu stron. Warto w tym miejscu dokonać analizy skutków czynności prawnej polegającej na przekazaniu nieruchomości przez gminę w nieodpłatne użytkowanie spółce prawa wodnego. W doktrynie stosunkowo mało miejsca poświęca się wyjaśnianiu zjawisk związanych z wykonywaniem przez spółki prawa wodnego zadań zleconych jednostek samorządowych i wynikających w tym obszarze problemów natury prawnej. Badanie przeprowadzono metodą dogmatyczno-prawną, a jego celem było ustalenie podmiotowości spółki wodnej na gruncie obecnie obowiązujących przepisów, a zwłaszcza przepisów ustawy Prawo wodne, ustawy Prawo przedsiębiorców oraz Ustawy o gospodarce nieruchomościami. Ustalenia w powyższym zakresie pozwoliły na uzyskanie odpowiedzi na pytanie: czy przekazanie majątku gminy spółce wodnej w nieodpłatne użytkowanie na czas nieokreślony stanowi przeniesienie prawa własności? Przeprowadzono analizę skutków zawarcia umowy przekazania w nieodpłatne użytkowanie przez gminę nieruchomości spółce wodnej oraz jej wpływu na prawa właścicielskie i skutki majątkowe dla obu podmiotów.

In this paper we prove the exact controllability of a time varying semilinear system considering non-instantaneous impulses, delay, and nonlocal conditions occurring simultaneously. It is done by using the Rothe’s fixed point theorem together with some sub-linear conditions on the nonlinear term, the impulsive functions, and the function describing the nonlocal conditions. Furthermore, a control steering the semilinear system from an initial state to a final state is exhibited.
