Financial crime was one of the recurring themes in crime stories written in the period of socialist Poland. The writer who first undertook this subject was Leopold Tyrmand in his book “The Man with the White Eyes” (1955). The publication of this book is considered one of the symptoms of the cultural “thaw” and the end of real socialism. Tyrmand shows crime which develops when the state, cooperative and private businesses meet, but also the corruption and powerlessness of Citizen’s Militia. During Władysław Gomułka’s administration (1956–1970), this problem often recurred e.g. in the books written by Anna Kłodzińska and Barbara Gordon. Very often the villain was the “fraudulent director”. Both the meat scandal and the leather scandal were described in crime novels. Edward Gierek’s administration (1970–1980) was the time when the theme of financial crime was abandoned, but it returned after the introduction of martial law in 1981. This time, it was pointed out that it was the previous administration that had committed frauds. Crime novels accurately described the economic abnormalities of socialist Poland, the hampering of individual initiatives and the omnipresent corruption, but they also reflected the state’s policy towards the people in power who were illegally gaining wealth.

The paper will concentrate on theft in industrial plants and its motivations. This text also discusses the speed with which these negative – both for the economy and the Polish society – phenomena were shaped in the times when the experience of occupation and the new political experiences created unique circumstances their emergence.

Nationalization and the introduction of state-controlled economy led to the emergence of abnormal social phenomena, including system-specific crimes. Economic transformations were the foundation of the systemic revolution carried out in the first decade after the Second World War, therefore they were the subject of interest for the Ministry of Public Security. That is why financial crimes were treated just like political crimes, which was also justified by legal provisions, as no specific definition of this type of crime existed. This allowed the authorities (secret police, prosecutor’s office, courts, media) to interpret the events according to their will and current political needs, and, as a result, to administer various overt or covert repressions (death penalty, imprisonment, forced cooperation with the secret police).

The purpose of the article is to present the fraudulent behaviour observable in the financial industry, which is the financial pyramid phenomena, through a detailed description of such occurrences together with the damage and consequences generated. This paper will include a solid piece of knowledge about this behaviour, and will also distinguish the similarities and differences between financial pyramids. Methodology of this paper is the critical analysis of the literature and comparative analysis of selected pyramids according to the criteria to compare and distinguish similarities and differences. Results of the research confirm that the phenomenon of the financial pyramids is very harmful to the financial industry but also to the participants and society as a whole. The losses generate every year are enormous, but on the other hand, there is suffering of the victims as well. To conclude, the financial pyramids are inseparable elements of the financial industry and moreover, they are very dangerous and destructive. The knowledge of the specificity of pyramids increases the safety of financial consumers in the financial market.

The article describes a failed attempt to attribute financial crime – embezzlement of the money belonging to the Greater Poland Headquarters of the Local Council of the Polish Scouting and Guiding Association – to scoutmaster Jan Poplewski. However, from the very beginning, the security services were interested in his anti-systemic activity, i.e. inspiring illegal activities among young scouts in the Stalinist period. This story serves as an example for exploring the underresearched problem of attributing various crimes to the opponents of the system, in order to discredit them and use this fact for propaganda purposes. The scale of this problem is impossible to estimate at present, but sometimes it is possible to describe individual cases – for example the case of scoutmaster Jan Poplewski.

It might seem natural to think that the socialist model of the economy, and a reality where collective property prevailed, eliminated the problem of financial crime. But did it really? This paper, which presents the scale of this type of crime as reflected by GUS (Polish Central Statistical Office) statistics, is an attempt at answering this question. At the same time we would like to present the “3 Cs” model (circumstances, character, chance), in which all the “C” factors occurred simultaneously, but on each occasion each of these had a different impact on the particular criminal act.

Systemic transformation in Poland after the Second World War led to deep transformations within the economy. It did not, however, change the way people thought. Despite the chaos of the post-war period, in which all the negative features shaped in the period of occupation manifested themselves, it seemed that the conceptual leaders of the Polish political and economic life would create new quality. However, it soon turned out that old habits die hard and the system created by communists opened a field for many abuses. This was accompanied by a sense of impunity, as the most prominent personalities in a given region were also involved in economic scandals. All this resulted in the creation of “cliques” in which both prominent Party activists and people put by the Party in high positions (usually also members of the Polish United Workers’ Party, PUWP) played important roles. On the one hand, after 1956, surveillance by the Security Office (UB) or Security Services (SB) was not that strict anymore, and on the other, the so-called “private initiative” started to develop fast – therefore the more “entrepreneurial” individuals started to exploit the situation and gain wealth. Abusing one’s position to organize large-scale thefts was considered relatively normal. This happened in various forms: sometimes directly, but more often by supporting or even organizing private projects with the use of the national, though unsupervised, supply of raw materials or products. This way, the Party members grew richer at the expense of the companies they worked for. This business was relatively widely tolerated by ordinary citizens, who saw it as an excuse to also “organize” goods individually for their own purposes in the companies which employed them. This common belief that “everybody steals” allowed people to justify their own dishonesty. Any attempts to fight this problem failed to produce satisfactory results. The diagnosis, even if correct, had to face reality, in which the pursuit of a better quality of life by the Party elites collided with the officially promoted ascetic lifestyles of the “ideological communists”, who, like Władysław Gomułka, did not understood the new times.

The pivotal motive behind financial crime in the real socialist states was the chronic shortage of goods and services. In the case of Poland under the Gomułka administration (1956-1970), a factor which contributed to the prevalence of practices considered economically criminal was, ironically, the liberalization of the government in the period following Władysław Gomułka’s rise to power. The procedure of issuing new licenses to private and co-operative manufacturing businesses fostered illegal practices, because the new businesses needed supplies of deficit resources. Private trade businesses struggled with similar problems. The authorities tried to prevent financial crime by concentrating on publishing new laws which allowed heavy punishment for those behind the biggest economic scandals. In this field, the penal policy was shaped by the top authorities of the communist party, and their decisions were binding for the institutions of the justice system. Such decisions of the top authorities of the Polish United Workers’ Party (PUWP) were behind the death sentence for Stanisław Wawrzecki, who was charged with fraudulence in meat trade in Warsaw. Poles’ attitude towards financial crime was not clear-cut. One the one hand, in their letters to authorities, many Poles expressed their support for severe punishment for those responsible for the biggest fraud, while others objected towards capital punishment for Wawrzecki. The information we have on the dynamics of confirmed financial crimes does not provide a clear answer whether it was actually related to the severity of the punishments.

Being of the European Union Member States, Poland is benefitiary of a financial support provided by the European Union. The international law fully regulates the rules of awarding and accounting grants, bailouts and other programmes fulfilled by the European Union. The Member State component authotrities take responsibility for the proper course of the process. In Poland, Police is kind of authority that realized this obligation in cooperation with many organizations and insitutions. By virtue of the knowledge and experience, these entitles constitute a significant element in Police actions organized in order to prevent and fight against crime that impacts negatively on the European Union interests. Without an efficient and effective fight against this kind of lawlessness, the future of Poland and other European Union countries will face a variety of danger which affect the security of socities.

This paper presents important and pending risks to the stability of the banking industry arising from the impact of money-laundering practices. The major focus is placed upon the proper organization of the terms typically employed in relation to the issue under study, supported by critical literature analyses and complete with an attempted evaluation of the potential effects of money-laundering processes. The paper provides an overview of the issue at hand without aspiring to form any exhaustive judgements. The marked dynamics of changes, both in the banking segment and its immediate environment, requires constant evaluation and observation, and this postulate applies also to processes associated with money-laundering. The wealth of the presented data may serve as the basis for further research of analytical approaches to the study of money-laundering practices.
Artykuł przedstawia ważną i aktualną problematykę wpływu procesów prania brudnych pieniędzy na stabilność systemu bankowego. Celem artykułu było uporządkowanie terminologii omawianego zagadnienia, krytyczna analiza literatury oraz próba identyfikacji potencjalnych skutków prania brudnych pieniędzy. Artykuł ma charakter przeglądowy i nie wyczerpuje omawianego problemu. Dynamika zmian zarówno w systemie bankowym, jak i w jego otoczeniu wymaga stałej obserwacji procesów w nim zachodzących, w tym także procesów związanych z praniem brudnych pieniędzy. Zebrane przez autora dane stanowią podstawę do prowadzenia dalszych badań w zakresie opracowywania sposobów analizowania tych procesów.

Autor podejmuje problematykę przestępczości na rynku finansowym, charakteryzując ogólnie założenia, co do kwestii bezpieczeństwa ekonomicznego, uwarunkowań ekonomicznych tego stanu oraz przeprowadza szczegółową charakterystykę przestępczości na rynku finansowym.  Bezpieczeństwo ekonomiczne jest warunkowane – zdaniem Autora – zachowaniem odpowiednich parametrów ekonomicznych, stanowiących jednocześnie gwarancje stabilności rynku finansowego. Nie bez znaczenia istotne pozostaje zagadnienie przestępczości o charakterze ekonomiczno-finansowym na tym rynku i strat z tego tytułu. Na podstawie analizy danych statystycznych Autor charakteryzuje skalę i dynamikę tych przestępstw oraz  dokonuje interpretacji danych. Metoda badawcza ilościowa pozwala na określenie skali oraz wielkości danych badanego zjawiska. Autor przeprowadza przy tym typologię tych przestępstw oraz omawia obowiązujące regulacje prawnokarne. W konkluzji Autor wskazuje na znaczny i dynamiczny wzrost przestępstw prania pieniędzy, co – zdaniem Autora – może świadczyć o wykorzystywaniu rynku finansowego do legalizacji środków pochodzących z przestępczej działalności.
The author addresses the issue of crime in the financial market, providing general characteristics of the premises of economic security, economic conditions of security, as well as conducting a thorough analysis of the crime in question. In the author's opinion, economic security is conditioned by the maintenance of appropriate economic criteria, which at the same time constitute a guarantee of financial market stability. What is of significance is the issue of economic and financial crime on this market and losses resulting from such crime. Based on the analysis of statistical data, the author characterises the scale and dynamics of the crime and interprets the data. The quantitative research method makes it possible to determine the scale and data volume of the phenomenon under study. Moreover, the author provides a typology of the crime and discusses the applicable criminal law regulations. In conclusion, the author points to the significant and dynamic increase in money laundering offenses, which - according to the author - may indicate the use of the financial market to legalise the proceeds of criminal activity.

Cel: Przegląd podstawowych, tak praktycznych, jak i teoretycznych zagadnień związanych z praniem brudnych pieniędzy, z uwzględnieniem inwestycji w nieruchomości jako jednego ze sposobów legalizacji środków pieniężnych pochodzących z prawnie sankcjonowanych źródeł. Celem artykułu jest również przybliżenie pojęć związanych z praniem brudnych pieniędzy i zagadnień z tym procesem związanych, które mogą być przedmiotem dalszych badań. Metodyka/podejście badawcze: W opracowaniu autor posłużył się klasyczną analizą literatury obejmującą źródła tradycyjne i internetowe oraz przeglądem przepisów prawa. Wyniki: Pranie brudnych pieniędzy jest jednym z powszechnie występujących, choć nie-pożądanych, aspektów życia gospodarczego. Zdobycie środków pieniężnych z nielegalnych źródeł wiąże się z trudnością ich legalizacji, a to powoduje, że organizacje przestępcze nieustanne poszukują sposobów, które to umożliwią. Jednym z tych sposobów są inwestycje na rynku nieruchomości. Wstępny przegląd zagadnień dotyczących omawianego tematu pozwala poznać istotę zjawiska i problemy z nim związane od strony teoretycznej jak i praktycznej, a także wskazuje na potrzebę dalszych badań oraz na ich możliwy kierunek. Oryginalność/wartość: Niezbyt często, szczególnie w Polsce, w literaturze naukowej analizowane jest zjawisko prania brudnych pieniędzy. Analiza tego zjawiska i związanych z nim pojęć, może przyczynić się do skuteczniejszej walki z praniem brudnych pieniędzy, dzięki zrozumieniu jego mechanizmów. Jak każde inne zjawiska gospodarcze również te o charakterze kryminalnym i patologicznym powinny być badane, choćby ze względu na dobór instytucji i metod do walki z nimi.
Objective: An overview of the basic, practical and theoretical issues related to money laundering, including real estate investment as one of the ways to legalize money from legally sanctioned sources. The aim of the article is also to introduce concepts related to money laundering and issues related to this process that may be the subject of further research. Methodology/research approach: In the study, the author used a classic analysis of the literature, including traditional and internet sources, and a review of legal regulations. Results: Money laundering is one of the common, though undesirable, aspects of economic life. Obtaining funds from illegal sources is associated with difficulty of legalizing them, which means that criminal organizations are constantly looking for ways to make it possible. One of these ways is real estate investment. A preliminary overview of the issues related to the discussed topic allows to get to know the essence of the phenomenon and the problems associated with it from the theoretical and practical side, and also indicates the need for further research and its possible direction. Originality/value: Money laundering is not very often analyzed in the scientific literature, especially in Poland. The analysis of this phenomenon and related concepts can contribute to a more effective fight against it thanks to the understanding of its mechanisms. Like any other economic phenomena, those of a criminal and pathological nature should be investigated, if only because of the selection of institutions and methods to combat them.

Analiza kryminalna to skuteczne narzędzie wykorzystywane przez organy ścigania do zwalczania przestępczości, zwłaszcza o charakterze gospodarczym. W opracowaniu autorka przedstawia definicję oraz typologię pojęcia analiza kryminalna. Jako przykład wykorzystania tego typu analizy szerzej opisuje jej specyficzny rodzaj – metodę analityczną – jakim jest analiza przepływów finansowych. Analizę przepływów finansowych można zdefiniować jako wykonywanie wielu czynności ukierunkowanych na wykorzystanie i przetworzenie danych pochodzących najczęściej z różnego rodzaju instytucji finansowych, w celu wyodrębnienia, identyfikacji i oznaczenia, a w efekcie wskazania transakcji, które są lub powinny zostać objęte zainteresowaniem w ramach prowadzonych czynności operacyjnych lub procesowych.
Criminal analysis is an effective tool used by law enforcement agencies in the fight against criminality, especially of an economic character. The author presents the definition and the typology of criminal analysis. As an example of the use of criminal analysis the author presents its specific type, which is the analysis of financial flows. Analysis of financial flows can be defined as the realization of a series of activities focusing on use and processing of data derived mostly from various types of financial institutions, in order to isolate, identify and marking, and ultimately so as to indicate transactions that are or should be covered by the interest of the law enforcement within operational activities or criminal proceedings.

The Polish Financial Supervision Authority (hereinafter: KNF) is the key element of the economic security system of the Polish State. By establishing the KNF, the Polish legislator applied the concept of integrated financial supervision (covering bank supervision, insurance supervision and capital market supervision) located outside the central bank. The KNF has been vested with a broad mandate, including powers to supervise authorised entities. However, the scope and nature of measures available to the KNF in the prevention of economic crime are determined by the institutional position of the KNF, which has not been established as a law enforcement authority or a uniformed or special service but rather an institution engaged in the fight against economic crime by providing expertise, supporting other state services specialised in this area. The KNF and the Office of the Polish Financial Supervision Authority (hereinafter: UKNF) actively support, among others, the police units that fight crime in the financial market and work to increase the economic security of the Polish State. Therefore, it is imperative to ensure broad and efficient cooperation between the police and the KNF. However, such collaboration must not be limited to relations between the institutions’ management; it should also involve, as far as possible, working and operational activities carried out at both institutions by individuals responsible for day-to-day tasks. This paper provides a closer perspective on the formal and organisational framework of said cooperation and discusses its examples.

The digital transformation of public relations has become possible with the introduction of artificial intelligence, the Internet of Things, cloud computing, immersive technologies, and data analytics. These technologies make it possible to create a metaverse where communication, knowledge acquisition, work, business, investment, creativity, and much more are available to everyone. The article offers an in-depth analysis of the institutional legal framework governing the international financial architecture within the realm of digital transformation. It explores regulatory mechanisms and developmental trends within the legal and financial systems of both the European Union and the Republic of Poland. The study delves into instances of commercial fraud involving digital assets, thoroughly examining their implications on the traditional financial system. In the virtual world, the capital market has no borders and jurisdictions. False and unreliable information has become an instrument of manipulation by society and is actively used by market participants. The conventional financial system experiences a loss of control over its functions, particularly in the process of converting fiat funds into digital assets. Decentralized finance regulated by cryptocurrency can replace the Bretton – Woods system. Blockchain is “a technology of utmost honesty” in data transmission. The task of society is to be guided by ethical, social, moral, and environmental aspects in the initial placement of information. The effectiveness of legal regulation of the digital environment is possible only with the adoption of regulations, rules, and recommendations of international organizations in the legislation of each country. A single principle of legal regulation will allow us to build a more just world and its sustainable development.
