The conflict in Ukraine since the beginning of 2014 has been the important in the history of Ukraine as an independent state. Despite the danger of economic collapse, the loss of Crimea, and war in its most industrialized region, Ukraine is still trying to conduct reforms and implement Western standards. Through persistent work Ukraine has been moving forward, despite all the difficulties. The society is staying together with the government to save the economy and defend the integrity of the whole country. This article outlines key processes in the Ukrainian reforms during 2014 and describes the cooperation of Ukraine with the European Union and international organizations in the field of financial support and reforms. The main goal of the article is to present the situation in various spheres of the country’s development, but it is also an attempt to present a wider perspective on both the achievements and shortcomings in the process of reforms. The authors focus on those aspects having a significant impact on the Ukrainian economy after February 2014.

Opis:
The granting of financial assistance from the European Agricultural Fund for Rural Development is performed by means of either an administrative decision or a civil law contract. From the legal perspective, the refusal to grant assistance under a contract is not a typical administrative decision. It has the form of an administrative act in the meaning of Article 3 section 2 point 4 of the Law on Proceedings before Administrative Courts. The above mentioned provision guarantees the person interested in financial assistance the judicial-administrative protection equivalent to that in a case of administrative decision. Furthermore, in some cases this protection is even wider; e.g. when the administrative Court recognises the entitlement to financial assistance in a judgment passed pursuant to Article 146 section 2 of the above mentioned Law. This kind of entitlement is accompanied by the obligation of a State Agency to grant the assistance to the farmer. In a case when fulfilling of the obligation has the form of a contract, the beneficiary can claim its conclusion, e.g. pursuant to Article 64 of the Civil Code.

The article shows the process of formation of Soviet scientists’ social status and the relationship between the scientific intelligentsia and the authorities. It studies the creation and activity of the Petrograd Commission on the Improvement of the Welfare of Scientists (PCIWS) in the 1920s, which has been subordinated and financed by the People’s Commissariat of Education of the RSFSR and has had its information press agency. It is established that the Soviet authorities, liquidating the bourgeoisie, have added to its number all the free professions of intellectual labor, including scientists. Petrograd Commission on the Improvement of the Welfare of Scientists (PetroCIWS) has served as a liaison between the authorities and the scientists, and its activities reflect the process of formation of these relations. The main task of PetroCIWS has been to support scientists, writers, artists, and their families who had financial difficulties. The commission has managed to provide scholars with academic rations and to assist in solving their problems of material standards and living conditions. It is proved that an important achievement of PetroCIWS has become the creation of the House of Scientists, its various forms of work have been analyzed. Owing to the organization and activities of the House of Scientists, Petrograd scientists have been able to implement interdisciplinary contacts and meet their cultural needs. Coverage of Petrograd House of Scientists activities has demonstrated the experience of cultural and civic self-organization of the scientific community.

Opis:
This article is dedicated to the influence help may have on entrepreneurs and how it is perceived by them as affecting the effectiveness of their operations. This analysis is based on examples illustrating the various forms of assistance and how these are perceived by their beneficiaries. The article suggests criteria for judging whether a given activity is of a helpful nature, regardless of how a beneficiary may see it. It also attempts to explain the commonly observed phenomenon of entrepreneurs banishing from their minds all recognition of the fact that they are taking advantage of assistance, based on the well-known theory from social psychology called the „Theory of cognitive dissonance”. This points to the possibly negative effect of the tendency by the businessman to banish from his mind objective facts on the various aspects of his firm's operations, such as assessment of investment decisions or the fulfillment of obligations. This article also applies to practices applied by many organizations specializing in the distribution of assistance for entrepreneurs that fail to attach any importance to their beneficiaries understanding the assistance nature of their offer, thus fostering an incorrect and harmful interpretation by entrepreneurs.

W pracy przedstawione zostały korzyści oraz środki finansowania, jakie wynikają z przystąpienia Polski do Unii Europejskiej, na przykładzie trzech powiatów województwa podlaskiego. Opisany został Program Rozwoju Obszarów Wiejskich na lata 2007–2013, który jest podstawowym narzędziem realizacji polityki rolnej UE . Jego głównym zadaniem jest pomoc w rozwiązaniu problemów strukturalnych polskiego rolnictwa oraz poprawa jakości życia na obszarach wiejskich. Na Program Rozwoju Obszarów Wiejskich na lata 2007–2013 przeznaczonych zostało 17,42 mld euro i jest to kwota ponad trzy razy większa niż na lata 2004–2006 (budżet 5,38 mld euro), świadczy to o coraz większym wykorzystaniu środków unijnych w Polsce. Poziom wykorzystania środków przeznaczonych na poszczególne działania był zróżnicowany. Najwyższy odsetek wykorzystania limitu środków dotyczy działań Modernizacja gospodarstw rolnych oraz Ułatwienie startu młodym rolnikom. W przypadku pozostałych działań PROW zrealizowano mniej projektów, przez co limit z dotacji nie został wykorzystany.
The advantages of the EU funds use and financial means resulted from Poland’s access to the European Union are presented in the article. They are presented on the example of three districts in Podlaski Region. Rural Development Programme for the years 2007–2013, which was a fundamental tool of the implementation of the EU agricultural policy, was also described. Its main purpose was the support in solving structural problems of Polish agriculture and the improvement of life quality in rural areas. 17,42 billion euro were allocated to Rural Development Programme in the years 2007–2013. This amount is three times higher than in the years 2004–2006 (the budget 5,38 billion euro). This indicates the higher use of the EU funds in Poland. The rate of the EU funds allocated to specific measures was diverse. Such activities as The modernization of agricultural holdings and Setting up of young farmers had the highest percentage of the funds limits use. As for the other activities within Rural Development Programme, fewer projects were implemented, as a result, the limit of the fund was not reached.

The subject of discussion in the article is the problem of changes in the functioning of the deposit guarantee scheme in Poland in the context of covering with guarantees cooperative and credit unions’ sector. Particular attention will be devoted to instruments of financial assistance that Bank Guarantee Fund may use to support unions which are in a difficult financial situation.

The full-scale invasion of Russian troops into Ukraine has created new challenges for the National Bank of Ukraine (NBU). In the article the authors have used system analysis to study the efficiency of the direct methods of the NBU in regulating the money market. It was established that the NBU took timely measures to ensure uninterrupted functioning of the country's economy by introducing military refinancing to maintain the liquidity of the banking system, set a fixed exchange rate and low restrictions on the foreign exchange market to restrict the rapid devaluation of the national currency. The activities of the NBU to fill the economy with money to finance significant military expenditures by buying and selling military bonds of Ukrainian Government, transferring profits to the State Budget, establishing relations with international financial organizations. In order to achieve a rapid effect of preventive measures, the NBU provides direct lending to the Government through the purchase of military bonds on the primary market. In the long run, the NBU should abandon its subordination to the Government and move to market-based monetary governance.

У статті на основі широкого кола архівних документів вперше комплексно проаналізовано питання матеріального забезпечення українських студентів у міжвоєнній Польщі. З’ясовано, що матеріальну допомогу вони отримували із різних джерел: міжнародних фондів, українських організацій та польської влади. Але коштів на всіх не вистачало. І тому студенти змушені були працювати під час канікул, а також під час навчання, що часом негативно впливало на їх академічну роботу. Завдяки історико-порівняльному методу було розглянуто особливості надання матеріальної допомоги різними організації та з’ясовано її ефективність.
Autorka niniejszego artykułu dokonuje kompleksowej analizy kwestii wsparcia materialnego dla ukraińskich studentów w międzywojennej Polsce, przy czym dodajmy, że jest to pierwsza taka próba, bazująca na podstawie szerokiej gamy dokumentów archiwalnych. Po przeanalizowaniu licznych dokumentów archiwalnych można stwierdzić, że ukraińscy studenci otrzymali pomoc finansową z różnych źródeł: funduszy międzynarodowych, organizacji ukraińskich i od polskich władz. Niemal wszystkie cytowane źródła stwierdzają, że środków finansowych nie wystarczało dla wszystkich. Dlatego studenci byli zmuszeni do pracy zarówno podczas wakacji, jak i podczas trwania nauki, co niekiedy miało negatywny wpływ na ich pracę naukową. Charakter udzielanej pomocy finansowej różnym organizacjom, a także jej skuteczność zbadano przy użyciu metody historycznej i porównawczej.
In the article, based on the numerous archival documents, for the first time was analyzed in complex the problem of Ukrainian students’ aid in the interwar Poland. It was found out, that they gained financial assistance from different sources: international funds, Ukrainian organizations and Polish authorities. But still there were no enough money for all. That’s why students had to work during vacations or even instead of classes, that caused negative on to their academic work. Due to historical comparative method were described peculiarities of financial assistance from different organizations and it effectiveness.

Pranie brudnych pieniędzy to zjawisko, które posiada negatywny wpływ na bezpieczeństwo finansowe podmiotów gospodarczych. Wpływa także destabilizująco na funkcjonowanie rynku finansowego. W artykule poruszona została problematyka prania brudnych pieniędzy jako jednego z rodzajów przestępstw gospodarczych. Proceder został przedstawiony z uwzględnieniem obowiązujących przepisów prawnych oraz literatury przedmiotu dotyczącej badanego zjawiska. Celem artykułu była prezentacja zagadnienia przeciwdziałania praniu pieniędzy oraz finansowania terroryzmu, z uwzględnieniem obowiązujących przepisów prawa, definicji prezentowanych w literaturze przedmiotu, a także zasad funkcjonowania krajowego systemu przeciwdziałania praniu pieniędzy.
Money laundering is a phenomenon that has a negative impact on the financial security of business entities. The article discusses the issue of money laundering as one of the types of economic crimes. The procedure was presented taking into account the applicable legal regulations and the literature on the subject of the studied phenomenon. The aim of the article is to present the issue of counteracting money laundering and financing of terrorism, taking into account the applicable law, definitions presented in the literature on the subject, as well as the rules of operation of the national anti-money laundering system.

Celem artykułu jest analiza zmian normatywnych i charakterystyka działalności Bankowego Funduszu Gwarancyjnego w Polsce w latach 1995-2020. Analizy prowadzone są na podstawie aktów normatywnych i dokumentacji BFG, ze szczególnym uwzględnieniem Raportów rocznych za kolejne lata analizowanego okresu. W ocenie jakościowej działalności Funduszu i jego organów wykorzystuje się przede wszystkim wieloletnią obserwację uczestniczącą autora w związku z wykonywaniem obowiązków członka Rady Funduszu, a ponadto konsultację z byłymi członkami Zarządu Funduszu. Artykuł kończy sformułowanie 15 cech lub tendencji w działalności BFG w minionym ćwierćwieczu.
in Poland in the years 1995-2020. The analyses are based on normative acts and BGF’s documentation, including in particular annual reports of the given years under scrutiny. Qualitative assessment of the activities of the Fund and its bodies is based in substantial part on the author’s participant observation as a member of the Fund’s Council and consultations with former members of the Fund’s Management Board. The article finishes with formulating 15 qualities, or tendencies, of the BGF’s activity over the past 25 years.

Celem artykułu jest charakterystyka zmian w regulacjach dotyczących gwarantowania depozytów. Ewolucja regulacyjna ukazana jest na tle historii Bankowego Funduszu Gwarancyjnego, który jest instytucją gwarantującą od 25 lat depozyty w polskim sektorze bankowym. Dla pełniejszego zobrazowania miejsca systemu gwarancji depozytów w infrastrukturze stabilizującej sektor bankowy, w artykule przedstawiono także skróconą syntezę historii sektora bankowego w Polsce. Przypomniano procesy towarzyszące odradzaniu polskiej bankowości w warunkach gospodarki rynkowej po 123 latach braku państwowości oraz działalności w niesprzyjających warunkach w II RP, a także w gospodarce nakazowo-rozdzielczej po II wojnie światowej. Zarysowano także uwarunkowania międzynarodowe, a w szczególności rolę USA we wdrażaniu w życie idei gwarantowania depozytów oraz rozwój systemów gwarancyjnych na świecie. Szczególną uwagę poświęcono rozwojowi systemu gwarantowania depozytów w Polsce i roli BFG w tym systemie. Ukazano dylematy regulacyjne i kolejne nowelizacje przepisów dyrektywy w sprawie gwarantowania depozytów. Artykuł omawia także korekty infrastruktury stabilności systemów bankowych i ochrony depozytów, zarówno na poziomie Unii Europejskiej, jak i na poziomie krajowym.
The aim of the article is an analysis of the changes in regulation on deposit guarantees. The evolution of the regulation is shown against the background of the history of the Bank Guarantee Fund, an institution which has been responsible for deposit guarantees for the past 25 years in the Polish banking sector. In order for a fuller picture of the role deposit guarantees schemes play in stabilising the banking sector to emerge, the article also presents a short summary of the history of the banking sector in Poland. It describes the rebirth of the Polish banking sector in market economy after 123 years of lack of state independence and its subsequent operation in unfavourable conditions in the interwar period, as well as in planned economy. International circumstances are also taken into account, in particular the role of the United States in implementing the idea of deposit guarantees and the development of guarantee schemes in the world. Particular focus is put on the development of deposit guarantee schemes in Poland and the role of the Bank Guarantee Fund in that system. The article also shows regulatory dilemmas and subsequent novelisations of the directive on deposit guarantee schemes. It also discusses improvements of the banking systems’ stability and deposit protections, both on the level of the European Union and of the state.

This problem brings into question the issue of how to prevent such infringements of the rules applicable to EU expenditure. Against this backdrop, this article investigates how Poland worked to prevent irregularities during the 2014–2020 programming period. Specifically, the focus is on whether prevention measures enhanced Poland’s financial compliance performance. For this purpose, a novel model of ‘non-compliance financial rate’ (NCFR) is proposed and triangulated with qualitative findings from semi-structured interviews and documentary analysis, which has shown encouraging results that might be relevant also for other Member States.

Opis:
The aim of the research is to verify the admissibility of granting financial and material aid to territorial units from Ukraine by Polish cities with poviat rights. Consideration was also given to the state and scale of cooperation between cities with county rights (i.e. Bydgoszcz, Toruń and Włocławek) from the Kujawsko-Pomorskie Voivodeship and their partners from Ukraine during the period of Russian aggression. The paper uses the method of content analysis, in addition, own research was carried out involving local governments from the Kuyavian-Pomeranian Voivodeship and the results are presented. The results of the research in this paper proved that there is a legal possibility on the basis of the Act on local self-government (at the same time bearing in mind the provisions of the Act on public finances) to provide financial support from one’s own budget in the form of financial aid and in-kind support in the form of aid in kind to “local and regional communities” in Ukraine, including during the period of Russia’s aggression against Ukraine. In addition, the article found that all surveyed Polish local governments implemented international cooperation focused on humanitarian aid to Ukrainian partners. The article is original in nature and was devoted entirely to the issue of international cooperation during the period of Russia’s aggression against Ukraine.
Celem badań jest zweryfikowanie dopuszczalności udzielania pomocy finansowej i rzeczowej jednostkom terytorialnym z Ukrainy przez polskie miasta na prawach powiatu. Podjęto również rozważania dotyczące stanu i skali współpracy miast na prawach powiatu (tj. Bydgoszczy, Torunia i Włocławka) z województwa kujawsko-pomorskiego z partnerami z Ukrainy w okresie rosyjskiej agresji. W artykule wykorzystano metodę analizy treści, ponadto przeprowadzono badania własne, obejmujące samorządy z województwa kujawsko-pomorskiego i przedstawiono ich wyniki. Wyniki badań zawarte w tej pracy dowiodły, iż istnieje prawna możliwość na gruncie ustawy o samorządzie gminnym (mając zarazem na uwadze przepisy ustawy o finansach publicznych) udzielania z własnego budżetu wsparcia finansowego w formie pomocy finansowej oraz wsparcia rzeczowego w formie pomocy rzeczowej „społecznościom lokalnym i regionalnym”, w Ukrainie w tym w okresie agresji Rosji na Ukrainę. Ponadto w ramach artykułu ustalono, że wszystkie badane polskie samorządy realizowały współpracę międzynarodową ukierunkowaną na pomoc humanitarną dla partnerów ukraińskich. Artykuł ma charakter oryginalny i został poświęcony w całości problematyce współpracy międzynarodowej w okresie agresji Rosji na Ukrainę.

This article provides an overview of the social assistance granted to aliens applying for the refugee status under the Polish law. In the first section, the author introduces the binding legal acts, which stipulate minimum standards for the recognition of asylum seekers and reviews the types of the social security benefits which an alien is entitled to. Next, she discusses whether the minimum social standard for aliens applying for granting the refugee status prescribed by the Polish law is sufficient to ensure them a necessary standard of living.

Opis:
Problem ubóstwa i wykluczenia społecznego stał się niezwykle ważny w następstwie kryzysu finansowego i gospodarczego z 2008 roku. Opracowanie koncentruje się na ocenie wdrażanych instytucjonalno-prawnych form pomocy w Polsce. Głównym celem opracowania jest identyfikacja rodzajów wydatków budżetowych związanych z analizowanym zagadnieniem i zbadanie zależności pomiędzy wydatkami z budżetu państwa na realizację zadań związanych z pomocą społeczną a zasięgiem ubóstwa w Polsce. W rezultacie przeprowadzonych badań z wykorzystaniem analizy statystycznej stwierdzono, że wzrost wydatków publicznych wpływa na poziom ubóstwa w Polsce zmniejszając jego zasięg. W ramach wniosków płynących z badań odnotowano, że liniowe zależności między wydatkami z budżetu państwa w działach dotyczących pomocy społecznej i rodziny a dwoma zmiennymi zależnymi będącymi wskaźnikami ubóstwa (skrajnego i relatywnego) są statystycznie istotne i są to zależności silne bądź umiarkowane.
The problem of poverty and social exclusion has become extremely important in the wake of the financial and economic crisis of 2008. The study assesses the institutional and legal forms of social assistance that were implemented in Poland. The main objective of the study is to examine the dependence between state budget expenditures for the implementation of social assistance and the extent of poverty in Poland. As a result of the conducted research using statistical analysis, it was found that an increase in public expenditure influences the level of poverty in Poland, reducing its range. As part of the conclusions drawn from the research, it was noted that linear dependencies between expenditures from the state budget in the spheres of social and family policy, and two dependent variables that are indicators of poverty (extreme and relative), are statistically significant and have strong or moderate dependence.
