    Opis:
    The Finance Council and the finance officer support and work with the Bishop in the administration of the goods of the diocese. The relationship between the Council and the treasurer is not without some features, and the analysis of these peculiarities about this article. Both functions are presented and specific situations are discussed. Some concerning the various situations described, with special reference to the reality in Argentina statistical data are available. Suggestions aimed at optimal performance of their respective tasks are performed.

    Parafialna rada duszpasterska i parafialna rada ds. ekonomicznych są nowymi instytucjami ustanowionymi przez KPK/83. Dają możliwość aktywnego zaangażowania się świeckich w działalność Kościoła na poziomie parafialnym. Celem artykułu była próba odpowiedzi na pytanie, czy parafialna rada duszpasterska i parafialna rada ds. ekonomicznych mogą być połączone w jedno gremium parafialne. Przedstawiona analiza obydwóch rad parafialnych wskazuje, że są to odrębne gremia parafialne. Prawodawca w KPK/83 nie przewiduje żadnych wspólnych kompetencji pomiędzy parafialną radą duszpasterską a parafialną radą ds. ekonomicznych. Taki wniosek uznała również Papieska Komisja ds. Rewizji Kodeksu Prawa Kanonicznego. Na pytanie: czy możliwe jest połączenie dwóch rad parafialnych w jedną parafialną radę, autor stwierdza, że prawodawca kodeksowy nie przewiduje takiej możliwości prawnej. Dowodzi temu instrukcja Kongregacji ds. Duchowieństwa o niektórych kwestiach dotyczących współpracy wiernych świeckich w ministerialnej posłudze kapłanów Ecclesia de mysterio (15 sierpnia 1997).
    This paper concerns the parish pastoral council and the parish finance council. The question which the Author addresses is whether the parish pastoral council and the parish finance council can be connected together in one parish council. The content of the study shows that the work of both parish councils demonstrates active engagement of the Christian faithful in the life of the parish. The parish pastoral council is an advisory body which assists the parish priest in his pastoral tasks. The establishment of the parish pastoral council according to can. 536 § 1 is not obligatory. The decision as to whether or not a pastoral council is to be established in each parish of the diocese is left to the diocesan bishop; following consultation with presbyteral council (can. 536 § 1). The parish pastoral council possesses a consultative vote only and it is regulated by the norms laid down by the diocesan bishop (can. 536 § 2). The parish finance council is also an advisory body which assists the parish priest in matters of mthe administration of parish temporal goods in accordance with can. 1281‑1288. The establishment of the parish financial council, according to can. 537 is obligatory. The legislator does not provide the citereria of common competence for both the parish pastoral and the parish financial council. In the instruction on certain questions regrding the collaboration of the non-ordained faithful in the sacred ministry of priest Ecclesia de mysterio (15 August 1997) pope John Paul II recommended that: “The parish councils established by universal law cannot be replaced any parallel entity” (art. 5 § 5). Both parish councils can work together for the common good of the parish. In this regard, particular law should lay down rules on such cooperation.

    Ustawodawca w Kodeksie Prawa Kanonicznego z 1983 r. stanowi, że ci, którzy otrzymali święcenia, zdolni są do sprawowania, zgodnie z przepisami prawa, władzy rządzenia, która jest w Kościele z Bożego ustanowienia. W wykonywaniu tej władzy mogą współdziałać wierni świeccy, zgodnie z przepisami prawa (kan. 129). Autor analizuje w artykule podstawy współdziałania we władzy rządzenia wiernych chrześcijan świeckich oraz ich uczestnictwo w organach kolegialnych Kościoła partykularnego, tj. w radzie ds. ekonomicznych, radzie duszpasterskiej i radzie mediacyjnej.
    The legislator in the Code of Canon Law of 1983 states that those who have received sacred orders are qualified, according to the norm of the prescripts of the law, for the power of governance, which exists in the Church by divine institution. Lay members of the Christian faithful can cooperate in the exercise of this same power according to the norm of law (can. 129). In the article the author analyzes the basics of the cooperation of faithful lay faithful in the power of governance and their participation in the collegial organs of the particular Church, i.e. the finance council, the pastoral council and the mediation council.

    Opis:
    One of the main messages of the Second Vatican Council was to highlight that members of the laity not only constitue and shape the Church but, even more importantly, have joint responsibility for it. The Church wants them to willingly respond to Christ’s calling which encourages them to take responsibility for the Church (see: Pope John Paul II, Apostolic Exhortation “Christifideles laici”, 2-3). The Canon Law from 1983 mentions two advisory bodies which may help the parish priest manage the parish. These are: the parish pastoral council (Canon 536 § 1) and the parish finance council (Canon 537). The aim of this article is to discuss the competencies of the parish finance council which is obligatory in each parish, according to the Canon 537 of the Code of the Canon Law. This rule applies to every parish, both territorial and personal. The parish finance council does not have a legal identity, does not replace or cover for the parish priest in representing the parish, nor does it act on his behalf (Canon 532). It is an advisory body whose aim is to advise the parish priest on how to manage the assets of the parish. The duties and rules of membership of the council should be defined both in the common law and in the particular law issued by the bishop of the diocese.

    In the opinion of the author, the European Council Decision 2020/2053 does not determine new competencies of the Union, but only the creation of new financial instruments to implement political priorities or better reflect the importance of the general budget. It does, however, impose a significant financial burden on the state, and thus meets the criteria for ratification of an international agreement set forth in the Polish Constitution in Article 89 para. 1 subpara. 4. It is therefore not permissible for the Decision to be ratified solely by the President of the Republic of Poland without the consent of the Sejm and the Senate expressed in a statute.

    The author of the opinion points out that the Council Decision 2020/2053 imposes a significant financial burden on the state and concerns matters regulated by statute or matters for which the Polish Constitution requires a statute, and as such may not be ratified without consent expressed by statute. The ratification of the Decision, due to the fact that through it the competencies of state authorities are transferred to the European Union in certain matters, should be conducted in accordance with Article 90 of the Polish Constitution.

    In the author’s opinion, on the grounds of the Constitution it is not possible to ratify the Council’s decision without the consent expressed in a law by the Sejm and the Senate. This decision causes a significant financial burden on the state and concerns matters for which the Constitution requires a statute. The Council’s decision has the effect of transferring to an international organization the competences of public authorities in certain matters. The author of the opinion estimates that the best form of expressing consent to the ratification of the decision of the Council would be to determine the mode of nationwide referendum by the Sejm.
