    The subject of the article was to discuss the institutions of presumptions and legal fictions applicable in the general administrative procedure. Due to the complexity of the problem, the author has attempted to only analyse selected issues relating to the subject matter hereof. The study identifies situations in which the discussed institutions are established, describes their substance, function and the objective for which they were introduced. The impact presumptions and legal fictions on the validity of objective truth in the course of administrative proceedings have been demonstrated and the values underlying their introduction to the Code of Administrative Procedure have been discussed.
    Przedmiotem artykułu było omówienie instytucji domniemań oraz fikcji prawnych występujących w ogólnym postępowaniu administracyjnym. Z uwagi na złożoność problemu autor podjął próbę analizy tylko wybranych zagadnień odnoszących się do tematu opracowania. Wskazano sytuacje, w jakich ustanawiane są omawiane instytucje, opisano ich istotę, funkcję, a także cel, dla którego zostały wprowadzone. Wykazano, jaki wpływ na obowiązywanie prawdy obiektywnej w toku postępowania administracyjnego mają domniemania oraz fikcje prawne. Ponadto omówiono wartości leżące u podstaw ich wprowadzenia do Kodeksu postępowania administracyjnego.

    Sei Solo. On solitude in the strict sense (Jerzy Pilch „The Living Spirit”) Jerzy Pilch’s novel Żywego ducha [Living Spirit], published in 2018, is an exceptional item in the writer’s oeuvre, being a manifestation of his ‘late style’ (Spätstil). The uniqueness of this work also stems from the fact that Pilch subjected not only himself and his writing to intellectual and artistic revision, but also Culture, i.e. that sphere which – opposing the mythical powers of Nature – constitutes a kind of fortification (also consolation) against the randomness (randomness) of events. The absolute loneliness of the novelistic narrator results from the hypothetical assumption that the signs of words, the signs of culture, do not indicate the presence of some external instance guaranteeing the meaning of the world. On the other hand, it is possible to pose the thesis that it is literature that is the individual’s act of defence against nothingness.

    Artykuł jest obszernym omówieniem książki Arkadiusza Żychlińskiego pt. „Labo-ratorium antropofikcji. Dociekania filologiczne” (Warszawa 2014). Autorka podkreśla pionierski, zwłaszcza na gruncie polskiej humanistyki, charakter rozważań po-znańskiego germanisty, który odnosząc się do wybranych badań z zakresu zoologii, etologii, antropologii, rozważa możliwość uczynienia z filologii soczewki do namysłu nad antropogenezą. Wypracowywanej w ten sposób koncepcji przyświeca przede wszystkim myśl Martina Heideggera, przekonanego o nieredukowalnej różnicy między człowiekiem a zwierzęciem. Żychliński chce ową różnicę eksplorować za pośrednictwem fikcji; uczony przyjmuje, a poniekąd również wprowadza szerokie rozumienie tego pojęcia, którym obejmuje fabuły literackie, filmowe, serialowe oraz występujące w grach komputerowych. To one stają się owymi laboratoriami, w których eksperymentuje się z różnymi modelami życia, sposobami bycia człowiekiem (wyłącznie człowiekiem!). Autorka niniejszego omówienia dowartościowuje oryginalną koncepcję, wynikającą między innymi ze splotu studiów humanistycznych z naukami o życiu, jednocześnie wymienia szereg zastrzeżeń, jakie rodzą się, gdy czytać pracę Żychlińskiego z perspektywy krytycznych studiów nad zwierzętami.
    The article is a comprehensive overview of the book by Arkadiusz Żychliński, “Laboratorium antropofikcji. Dociekania filologiczne” (Warsaw 2014). Emphasised is the pioneering, especially in Polish humanities, character of reflections presented by the author, who, referring to selected research in zoology, ethology, and anthropology, considers the possibility of making philology the lens to reflect on anthropogenesis. The conceptis primarily inspired by Martin Heidegger, who was convinced of the irreducible difference between man and animal. Żychliński wants to explore this difference through fiction, introducing a broad understanding of the term, which includes narratives in literature, film, TV series and computer games. They become laboratories where experiments with different models of life, ways of being human (only human!) are carried out. The reviewer emphasises originality of the concept, resulting, inter alia, from combining humanistic studies with life sciences. She also lists a number of concerns that arise when if Żychliński’s work is read from the perspective of critical studies on animals.

    Starting with the Middle Ages, the system of writs (forms of actions) began to dominate the English law. Like Roman actiones which may be regarded as equivalents of writs, thus also the latter allowed to determine the circumstances in which an individual was guaranteed to protection of law. The list of writs was exhaustive while the law was considered to be something that was not subjected to changes. Therefore the legal fictions were found to be the only mechanism that made it possible to adapt the common law to the evolving socio-economic circumstances. Thanks to these fictions the parties involved in the litigation could reach the objectives that they desired and that otherwise (without resorting to the fiction) might be unattainable by them. The exploitation of the fiction consisted in the invoking by the trial participant the circumstances that notoriously were not true, the adversary party being simultaneously prevented from proving the opposite. In the course of time the fictions became a characteristic feature of the common law. It was thanks to their application that in the 15th through 17th centuries the scope of the Westminster courts’ jurisdictional competence became enlarged. The fictions enabled these courts to settle matters that originally were beyond the scope of their jurisdiction. The application of fictions resulted also in the broadening of the scope within which the particular writs could be resorted to. This consequently led to the extention of legal protection to the situations with respect to which the earlier common law proved helpless for the lack of any legal remedy.

    Artykuł jest próbą wprowadzenia i wyjaśnienia pojęcia transfikcjonalności. Badania w tej dziedzinie rozwinęły się w literaturoznawstwie francuskojęzycznym. Główną przyczyną ich zapoczątkowania wydaje się być potrzeba nowej koncepcji, która stanowiłaby rozwinięcie i uzupełnienie teorii międzystekstowych. W zderzeniu z niektórymi zjawiskami literackimi (brane pod uwagę mogą być wszelkie domeny sztuki) perspektywa intertekstualna wypaliła się – jej narzędzia przestały być efektywne. Tekst opiera się na książce Richarda Saint-Gelais, Fictions transfuges i w szkicowy sposób próbuje omówić takie zabiegi jak expansion (rozszerzanie), versions (wersje) czy croisement et annexions (skrzyżowania i przyłączenia). Przybliżona została nie tylko egzemplifikacja kanadyjskiego badacza. Autor artykułu aktywował nową siatkę terminologiczną na gruncie polskiej literatury.
    This article attempts to introduce and explain the concept of transfictionality. The scholarship in this area developed in francophone literary studies. The main reason for its formation appears to have been the need for a new concept that would develop and supplement the theory of intertextuality. In that theory’s collision with certain literary phenomena (though all domains of art can be taken into consideration here) the intellectual perspective exhausted itself and its tools ceased to be effective.  The text focuses on the book Fictions transfuges by Richard Saint-Gelais, and attempts to sketch out and discuss such procedures as expansion, versions, crossings and incorporations. Not only the examples provided by the Canadian theorist, but also their substance and heft, are outlined. The author of this article has initiated the active use of a new terminological constellation in Polish literary studies.

    Punktem wyjścia artykułu jest założenie, że opowieści fantastyczne są narzędziami myślenia spekulatywnego i słu- żą refleksji nad przeszłością oraz przyszłością człowieka. Przedmiotem analizy są dwa seriale zaliczane do szeroko rozumianej fantastyki – Kraina Lovecrafta (Lovecraft Country, HBO, 2020) i Więzy (Kindred, FX on Hulu, 2022). Oba reprezentują ruch artystyczny określany mianem afrofuturyzmu, będący przykładem narracji spekulatywnej, mającej na celu reinterpretację historii, czyli przepracowanie traumatycznych doświadczeń związanych z niewolnictwem oraz zaprojektowanie alternatywnej wspólnoty dla czarnej mniejszości. W omawianych serialach afrofuturystycznym pomysłom towarzyszy narracja, którą można nazwać afropesymistyczną, ponieważ opowieść o emancypacji jest zderzona z diagnozą przeciwną, zgodnie z którą „bycie Czarnym” jest tożsame ze „śmiercią społeczną”.
    The author begins with the assumption that fantastic stories are tools of speculative thinking and reflection on man’s past and future. The analysis concerns two television series classified as fantastic: Lovecraft Country (HBO, 2020) and Kindred (FX on Hulu, 2022). Both represent the artistic movement called Afrofuturism, which is an example of speculative narrative aimed at reinterpreting history, i.e., working through the traumatic experiences of slavery, and designing an alternative community for the black minority. In the above series, Afrofuturist ideas are accompanied by what can be called Afropessimism, because the story of emancipation is confronted with the opposite diagnosis, according to which being Black is synonymous with social death.

    This paper is concerned with Polish labour law governing the formation of the individual employment relationship. After the changes made by national legislative authority (Sejm) in 1999 and 2002 the right to choose a legal source (employment or civil contract) provisions of regulation – civil law mentioned by the author in article as well as in Polish language summary – was more limited in relation to the contents of the employment relationship. Since 2002 the existence of the legal relationship of employment is based not on the presupposition of the both parties but more on acceptance their choice of civil law type of contract by the judicial (labour court) and administrative authority (labour inspection).
    Przemiany w prawie pracy, które miały miejsce w latach 1996 i 2002, sprawiły, iż obowiązujące w polskim systemie prawa pracy i prawa cywilnego zasady wolności umów i prawa stron stosunków prawnych, w ramach których świadczona jest praca, sformułowane w art. 55 k.z., art. 3531 k.c. w związku z art. 300 k.p. oraz art. 10 § 1 k.p., zostały w stosunkach pracy poważnie ograniczone. Zainteresowane strony stosunku prawnego mają prawo wyboru podstawy prawnej zatrudnienia pod warunkiem, że będzie to podstawa, która zostanie zaakceptowana – jako zgodna z obowiązującym prawem pracy – przez organy sprawujące merytoryczny nadzór nad przestrzeganiem przepisów prawa pracy przez przedsiębiorców (sądy pracy oraz Państwową Inspekcję Pracy).

    Contemporary biographical fictions in France: between narrative and visual – This paper discusses an evolution of point of view on biographical fictions from 90’ to the present, due to the important increase of literary practices exploring images and their role in the constitution of the biographical discourse. The relation between fiction and reality presented from the point of view of Paul Ricoeur’s ‘narrative identity’ in first approaches of biographical fictions is now substituted by the reflection about the relation between narrative and visual which discloses, particularly in the case of biographical portraits of writers, the commemorative aspects of a literary text.
    Współczesne fikcje biograficzne we Francji: między narracyjnością a wizualnością. Artykuł omawia zmianę podejścia w badaniach nad fikcjami biograficznymi, jaka dokonała się od lat 90. do współczesności. Związana jest ona z wzrastającym znaczeniem literackich praktyk odwołujących się do obrazu, głównie fotograficznego, i jego roli w konstytuowaniu biograficznego dyskursu. Relacja pomiędzy fikcją a rzeczywistością, we wcześniejszych badaniach fikcji biograficznych rozważana w perspektywie „narracyjnej tożsamości” Paula Ricœura, zastąpiona została refleksją nad relacją pomiędzy narracyjnością a wizualnością, która obejmuje również, w szczególności w przypadku biograficznych portretów pisarzy, upamiętniający aspekt tekstu literackiego.
