Artykuł dotyczy wyroku, w którym Sąd Najwyższy uznał, że wieloletni związek zamężnej kobiety z innym mężczyzną, który jest ojcem jej czwórki dzieci, utrzymywany w tajemnicy przed mężem, nie narusza dóbr osobistych zdradzanego męża. Argumenty przedstawione przez Rzecznika Praw Obywatelskich i przyjęte przez Sąd Najwyższy nie zasługują na aprobatę, mogą natomiast prowadzić do poważnych konsekwencji w zakresie realizacji praw i obowiązków wynikających ze stosunku prawnego, jakim jest małżeństwo. Odmówienie mężowi odszkodowania za krzywdę wyrządzoną mu przez żonę i jej kochanka, którzy zamienili jego życie rodzinne w fikcję (nie był de facto ojcem dzieci, które utrzymywał i wychowywał przez kilka lat), należy także uznać za sprzeczne z konstytucyjną zasadą ochrony małżeństwa (art. 18 Konstytucji RP) oraz z prawem do ochrony życia rodzinnego i prywatnego przewidzianym w art. 47 Konstytucji i art. 8 Konwencji o ochronie praw człowieka i podstawowych wolności.
This article concerns a judgment in which the Polish Supreme Court ruled that a married woman’s long-term cohabitation with another man who fathered her four children, which was kept secret from her husband, did not infringe the personal rights of the cuckolded husband. The case presented by the Polish Ombudsman and approved by the Supreme Court may be considered not arguable and may lead to serious consequences regarding the implementation of rights and obligations resulting from the institution of marriage. Moreover, the refusal of compensation to the husband for the harm he had suffered from his wife and her lover, who turned his family life into a lie, since the husband was not the real father of the children he had been maintaining and raising for several years, should also be considered contrary to the constitutional principle of protection of marriage (Art. 18 of the Constitution of the Republic of Poland) and to the right to protection of family and private life provided for in Art. 47 of the Polish Constitution and Art. 8 of the European Convention on Human Rights and Fundamental Freedoms.

Everyone’s personal dignity guarantees freedoms and rights regardless of age, which means these freedoms and rights are also granted to children. Children’s rights highlight children’s subjectivity and draw attention to their special status, which is, in fact, determined by the child’s dependence on adults, but is still not passive or submissive. This emphasis on the child’s rights sort of equalises the child’s legal situation which is results from their physical and mental immaturity and dependence. However, every human being – including a child – has duties in addition to rights, which remain in relative balance. Thus, they contribute to the formation of the child’s personality in a balanced manner. Focusing solely on the enjoyment of rights and simultaneously neglecting duties distorts this balance and contributes to the development of attitude of taking everything for granted, laziness, and choosing to live at the expense of others. It seems therefore necessary to restore the balance between the focus on children’s rights and the marginalisation of their responsibilities.

Opis:
Millions of children around the world are deprived of their family environment. All those children are a particularly vulnerable group and therefore there are entitled to special protection and assistance from the State. The basis for that protection have been incorporated into the provision of Article 20 of the Convention on the Rights of the Child of 1989 which requires from the States to ensure alternative care for such children. The aim of the article is to present the scope and content of Article 20 of the CRC. The author focuses on the interpretation of the most essential terms used in Article 20, such as “family environment” and “deprivation of child’s family environment.” She also analyses the nature and content of State’s obligations towards a child living outside his or her family. The analysis of Article 20 is made from the legal perspective. Analyzed are the Travaux Préparatories of the article in question,Article 20 itself, The UN Guidelines for the Alternative Care of Children adopted in 2010, others provisions of the CRC and other relevant international documents and chosen subject literature.
Miliony dzieci na całym świecie są pozbawione środowiska rodzinnego. Dzieci te mają prawo do specjalnej ochrony i pomocy ze strony państwa. Prawną podstawę  tej ochrony stanowi przepis artykułu 20 Konwencji o Prawach Dziecka z 1989 roku, który nakłada na państwa obowiązek zapewnienia opieki zastępczej dzieciom pozbawionym opieki rodzinnej. Artykuł przedstawia cel i treść przepisu artykułu 20 Konwencji o Prawach Dziecka. Autorka skupia się na interpretacji najważniejszych terminów użytych w artykule, takich jak pojęcie „rodziny” oraz „pozbawienia dziecka środowiska  rodzinnego”. Analizuje również charakter i zakres zobowiązań państwa wobec dziecka żyjącego poza swoją rodziną. Analiza artykułu 20 dokonana została w kontekście prawnym. Poddano jej Travaux Préparatories artykułu 20, treść przepisu artykułu 20, wytyczne dotyczące alternatywnej opieki nad dziećmi uchwalone w 2010 roku, a także adekwatne postanowienia zawarte w Konwencji o Prawach Dziecka i innych relewantnych dokumentach prawa międzynarodowego oraz wybranej literaturze przedmiotu.

Dzieciństwo to etap życia człowieka, który wymaga szczególnej ochrony i wsparcia ze strony środowiska. W tym okresie dziecku powinny zostać zapewnione warunki do właściwego rozwoju duchowego i fizycznego. Stworzenie bezpiecznego gruntu do rozwoju człowieka umożliwia jego zbilansowany wzrost psychofizyczny. Prawa dziecka, które odpowiadają na jego potrzeby, regulują warunki życia i wychowania, choć objęte ochroną, stale nie są respektowane. Niezbędne jest poszukiwanie nowych środków zaradczych, zarówno profilaktycznych, jak i terapeutycznych, wobec problemu krzywdzenia dzieci, naruszania ich praw. Metodą, którą uważam za niezmiernie delikatną, a przy tym skuteczną, jest bajkoterapia, czyli oddziaływanie na dziecko za pomocą odpowiednio skonturowanych lektur, mających uchronić przed zagrożeniem lub pomóc w przypadku doznanej krzywdy.
A child is a helpless human being that requires special protection. Providing each child with proper care, support, security and decent living conditions makes it possible for a child to develop spiritually and physically in a correct way. These factors govern children’s rights, which are protected, but the violation thereof is still a common social phenomenon. Children’s social, cultural and civil rights are constantly broken, very often all of them simultaneously, which has a multidimensional deleterious influence on the little ones and aggravates their suffering. Lack of respect for the biological and psychological needs of a child very often stems from ignorance or aggression. The damage to a child may include scarcity, inadequate protection, inadequate child care, and venting one’s frustration (both unintentionally and intentionally) and drives on children in the form of psychological, physical, and sexual abuse. This phenomenon requires new forms of prevention, understood as providing children with protection, making them aware, informing them about the dangers and remedies, and finally – organising therapies – to help those already harmed. The method proposed by me – a storytelling therapy – is directed primarily towards children at preschool and early school age and can be used both as a preventive and supportive measure. The plot of a speech therapeutic story presented to a little listener refers to a problematic situation which is analogous to the child’s current situation or the one the child is in danger of experiencing. By identifying with the story’s characters, the child becomes aware of the models of coping with negative emotions and difficult situations. Characters’ actions based on rational thinking, persistent work, and using the help of friends motivate the child to act and evoke his positive emotions. In addition, a speech therapeutic story features and reinforces positive values such as faith, hope, love, trust, respect, perseverance, and cooperation, which could be lost in a child due to negative experiences. Therefore, a storytelling therapy is a form of emotional support and a wake-up call to spiritual development, which is necessary for a child to be able to cope when faced with danger or physical and emotional damage the child has suffered.

The article describes the genesis of can. 226 § 1 of the 1983 Code of Canon Law, which has its origin in the teaching of the Second Vatican Council. The subject of the special obligation are the lay Christian faithful who are married. They are obligate to strive for the building up of the People of God through their marriage and family.

Cardinal Wyszyński was a defender of every individual, family, nation and Church during the time of communist enslavement of Poland. He was an ardent defender of the truth with regard to human being and its dignity, he constantly emphasized the significance of respecting basic rights and obligations of men, and strongly demanded the observance of these rights when the state violated them. Furthermore, he was radical defender of the freedom of human persons, families, nation and the Church, indicating that only in freedom can they truly develop and fulfill their vocation and goals. He constantly reminded us of the need for justice made in the spirit of love with regard to every individual, family and nation. He clearly defined the tasks and duties of the state and the Church in relation to every human person that should be regarded as the highest value in the world, as well as towards families that are to be considered the cradle of the nation, and towards the nation that he regarded as a family of families sui generis. Additionaly he emphasized that the Church has a unique role to perform in relation to these communities, bringing into their existence not only the supernatural dimension, sanctifying God’s grace, salvation, but also the natural dimension consisting in the care of the Church for the national raison d’etat. Last but not least, in his view, the Church must be free and independent in its activities to be able to perform its religious and social role properly. The Primate indicated the need for cooperation between the state and the Church for the benefit of man, family and nation. When the communist state did not fulfill its role and acted against the rights of citizens, especially believers, against families and nation, he radically opposed these actions, demanding respect for dignity, rights, truth, freedom and justice with regard to every human person, family and family of families – that is the nation.

The topic of children's participation in various issues was updated in the second half of the last century. It was largely due to the adoption of an important international document such as the United Nations Convention on the Rights of the Child. Children are as important participants in social life as adults so they have the right to express their opinions on various issues related to their activities, as well as to take into account these opinions by adults in decision-making in the family, in school, in the community, etc. Russian society is dominated by the traditional discourse of the perception of children as human becoming, socially and mentally immature, not-yet-an-adult. To study the parental discourse of children's participation in family issues, empirical material of the network discussion organized at the parental forum called Vladmama (Vladivostok, Russia) is used. In order to organize the discussion, an information injection was carried out. It was the description of the imagined problematic situation of child-parental relations on the issue of child’s participation in family affairs. The 81 messages received from 25 users were analyzed according to James Gee approach.  Seven Gee’s “building tasks” (Activities; Identities; Relationships; Politics; Connections; Sign Systems and Knowledge) are researched on the materials of mother’s forum. The process of creating value is always connected with the exercise of power. In our case, mothers using their power as parents redefine the meanings of children's participation. The main resource that opens the way for adults to power is money. Earning money is interpreted by the participants of the forum as a way for a child to involve in the adult’s world, an opportunity to legalize the child’s right to express his/her own opinion and defend this opinion. Other sources of parent’s power are their own life experience, knowledge and social skills.

Marietta MessmerUniversity of Groningenthe Netherlands Children and Youth: Disadvantaged and Disenfranchised by the Current U.S. Immigration Regime Abstract: Focusing on undocumented immigrant children who were brought to the US by their parents at a young age (the so-called 1.5 generation) and US citizen children living in irregular or mixed-status immigrant families, this essay argues that the current US immigration regime is too strongly adult-centered and in this way not only systematically disenfranchises immigrant children but also structurally disadvantages US citizen children living with at least one undocumented parent because the parent’s irregular status in practice tends to extinguish the child’s citizen status. Analyzing the US’s current immigration regime through the lens of under-age youth can thus function as an enabling prism to highlight the extent to which current US immigration laws and policies collide with both national and international legal practices and produce inherently contradictory or paradoxical situations; it can throw into relief the extent to which children (even US citizen children) lack sufficient agency and voice in current US immigration law; and it can foreground the deleterious consequences of the current immigration regime’s prioritization of deterrence and deportation for one of the most vulnerable segments of the US population for whom not even DACA can provide sufficient protection.

The aim of this paper is to have a look at some institutions of civil law and family law in the light of the requirements of the Convention on the Rights of the Child, on the occasion of the 30th anniversary of this Convention. The child’s incapacity or limited capacity to act, the child marriage and the child’s right to be heard shall be envisaged from a legal historical perspective with a special regard to the age-limits and the modifications of these age-limits on the field of civil law and family law. The subject of the historical overview is the concerned regulations of Hungary, namely the changes in the Hungarian legal rules and the regulations of the effective Hungarian Civil Code which entered into force in 2014. The paper would like to provide a guide for a travel from the end of the nineteenth century to today’s legal rules on the field of age-limits in connection with the above-mentioned institutions which designate the child’s legal position concerning some children’s rights. Some issues of the judiciary concerning the child’s right to be heard in family law proceedings will be mentioned as well to highlight a problem of the everyday legal life. The final aim of this historical travel is to discover whether the discussed legal rules being in force today meet the requirements of the Convention on the Rights of the Child and to compare the legal attitude behind the effective legal rules and the attitude of the child-focused thinking, which shall be also analysed.

The problem raised in this article revolves around the relationship between the activity of contemporary advisers with women’s rights in the early Christianity? The article provides a new perspective on the theory of activity of Polish Catholic family life counsellors. It presents an overview of the history and character of those advisers’ activity as well as the origin of secular women’s rights in the early Christianity (including the reasons for their gradual restriction). The article finishes with conclusions from the conducted research addressed to Catholic advisers dealing with the issues associated with family life in Poland.
Problem podjęty w tej pracy brzmi: jaki jest związek działalności współczesnych doradczyń życia rodzinnego z formowaniem się praw kobiet świeckich we wczesnym chrześcijaństwie? Praca wnosi nowe treści do teoretycznych (historyczno-teologicznych) podstaw działalności katolickich doradczyń życia rodzinnego. Zaprezentowano w niej historię i charakter działalności tych doradczyń oraz formowanie się praw kobiet świeckich we wczesnym chrześcijaństwie (wraz z przyczynami ich stopniowego ograniczania). Tekst kończą wnioski płynące z odkrytej i analizowanej wiedzy dla katolickich doradczyń życia rodzinnego w Polsce.

Artykuł ukazuje ewolucję orzecznictwa ETPCz w zakresie wykładni artykułu 8 Europejskiej Konwencji Praw Człowieka i Podstawowych Wolności. Autor koncentruje się na zmianie, jaka następowała w sposobie kwalifikowania praktyk homoseksualnych, których penalizacja była początkowo akceptowana przez Trybunał, by później przyznać im ochronę jako aspektowi życia prywatnego, aż do uznania ich za element pozwalający kwalifikować relacje dwóch osób tej samej płci za życie rodzinne. W tym kontekście, w świetle ostatnich wypowiedzi orzeczniczych, Autor stawia tezę, że Europejski Trybunał Praw Człowieka zmierza do wykreowania na gruncie Europejskiej Konwencji Praw Człowieka prawa do instytucjonalizacji związku jednopłciowego, jako wynikającego z art. 8 Konwencji.

Opis:
Discussions about the support system for children experiencing violence have been taking place both on an international forum as well as locally in Poland. (Zmarzlik, 2011; Wójcik, 2013; Jarosz, 2007; Jarosz, 2008; Jarosz, 2018; Dąbrowska, 2012). The questions about who should undertake tasks in this area and what their scope and type should be are still unresolved. Individuals who work with abused children agree that teachers may be an important link in the support system due to their role. The purpose of the current study is to examine the tasks of the school in the context of the experience of children growing up in a family with a problem of domestic violence. In contemporary discourses on preventing domestic violence against children, the active participation of the children themselves in creating solutions in this area is increasingly emphasized. Due to the participatory and emancipatory character of the project, the current research represents the paradigm of qualitative methodology and, within it, the assumptions of radical humanism. The final result is a description which includes answers to the above research questions and an analysis of legal and statutory actions aimed at social emancipation through education and participation of individuals experiencing domestic violence. In light of international standards of support for abused children, education can and should play a significant support role. Education and participation are considered significant factors in the social emancipation of children - victims of domestic violence - and their families. However, in the perception of individuals experiencing violence, schools do not effectively fulfill their role in this respect. It seems that the place a teacher will take in the process of supporting abused children and their families will depend largely on how the teachers themselves define their own role, as well as on the appropriate legislative solutions for their education. I think that the curricula of teachers’ studies should not only include obligatory exercises in cooperation procedures and communication skills workshops, but they should also address issues shaping active attitudes towards the situations the teachers will find themselves in over the course of their careers.

Opis:
The path to changing the concept of marriage led through a change in the understanding of the family. The EU Charter of Fundamental Rights was intended to cover cases in which national legislation recognizes other possibilities of family formation than marriage. Thus, the entry in the Charter has been shaped in such a way as to avoid a clear response to the new issue of same-sex relationships; that is, it neither permits nor prohibits because of trends based on social movements. This does not affect the institution of marriage itself, but allows the recognition of other forms of family found in the internal regulations of the states as corresponding to marriage.

Opis:
Contemporary changes in family structures, and first of all changes in social mentality and perception of the importance of family relationships, undoubtedly bear the evolution hallmarks. This concept does not necessarily mean a change for the better, but it may also identify the degeneration and the change of adverse quality. There is no doubt that appreciation of woman’s role and impact, emphasis put on the equal dignity of the spouses, the necessity of their mutual respect and subjectivity of children are the steps in the right direction. However, the attempt to redefine the concept of the family without taking into account the type and quality of bonds between parents (whether they are married or not) and aiming to treat any kind of adult relationship (regardless of their gender) to whom children are assigned as a family should be considered a highly problematic trend. It contrasts with the essential elements of the Christian perspective on family. The starting point of Christian reflection on the family is, on one hand, God’s pre-intention towards the man included on the first pages of the Bible with the covenant marriage as the main element, and on the other hand, a kind of anthropological realism which perceives fragility and threats of this primary and natural communion. However, irrespective of accepted assumptions, there is no doubt that the stability of the family whose key element is a permanent heterosexual relationship between parents becomes a prerequisite of the successful socialization of the young generation. In this sense the future fate of the society depends on durability and quality of the family. All attempts of relativization of the family should be considered as disquieting, beginning with promotion of informal relationships up to attempts at giving privilege to same-sex relationships and granting them privileges analogical to those enjoyed by the family. Concern for the family is one of the most important responsibilities of the state, therefore one of the elements of restoring its proper social status is demanding from the government not to confine the family policy only to pre-election promises.

In this article I will try to articulate that gender equality means also changing the patriarchal system. In my opinion, family changes in the last decades contributed to defense and development of women’s rights. Family changes and family varies from one society to the other. Anywhere and at any time in the history of human societies, kinship systems and family systems have evolved and continue to do so. But European societies today are torn between two contradictory trends, on the one hand we can observe the extension of social relationship in the case of blended families, and on the other hand the continuing reference to a genealogical, therefore biological relationship, because adoption in Europe and the United States still refers to the model of a fictitious family lineage. It displaces real family lineage of birth parents which legally disappear.
