Characterizing the phenomenon of religious, spiritual, gnostic exclusivity, Stanisława Hausnerowa recognized that it is a manifestation of a centuries-old tradition of seeking esoteric knowledge that comprehensively describes the nature of reality. Referring to the research of Antoine Faivre, it can be assumed that this type of perception of spirituality represents theosophical esotericism. Wanting to justify her thoughts, the Polish theosophist sought spiritual support, among others in the works of Juliusz Słowacki (1809–1849). Therefore, the aim of these considerations will be to discuss several literary attempts to explicate the spiritual reality that function in the artistic output of the cited romantic poet and to seek to verify their esoteric, gnostic character.

This article discusses issues associated with exclusive rights to broadcast television coverage of sports events, in light of a decision of the President of the Office of Competition and Consumer Protection (hereafter, the UOKiK President) relating to a long-term licence agreement between the Polish Football Association and Canal+. It describes the special features of a sports event as the subject of licensing rights and discusses the impact of intellectual property issues on assessing whether agreements comply with the law on competition and consumer protection. Emphasis is put on the special role of analysing each case of exclusivity economically, particularly with regard to its long-term market effects and the significance of additional restrictions accompanying exclusivity. Attention is also drawn to the precedential nature of the position of the UOKiK President that media licences can, in justified cases, cover periods of several years.
L’article traite de questions liées à l’exclusivité en matière de retransmission télévisée d’évènements sportifs, à la lumière de la décision du Président de l’OCCP (Office polonais de la protection de la concurrence et des consommateurs) portant sur le contrat d’exploitation pluriannuel conclu entre la Fédération polonaise de football et Canal+. L’auteur y présente les caractéristiques particulières des manifestations sportives faisant l’objet de droits d’exploitation. L’article aborde également la question de l’impact de la propriété intellectuelle sur l’appréciation de la conformité des contrats conclus avec le droit de la protection de la concurrence et des consommateurs. L’auteur souligne par ailleurs le rôle particulier de l’analyse économique de chaque cas d’exclusivité, notamment de l’impact exercé sur le marché sur une période plus longue et de la portée des restrictions supplémentaires accompagnant l’exclusivité. Enfin, l’article évoque la position d’un précédent du Président de l’OCCP, en vertu de laquelle les droits d’exploitation peuvent, dans des cas justifiés, être cédés pour plusieurs années.

The article explores the alternative strategies adopted by the lowest caste groups known by the generic term dalits to improve their social status in India. The mapping of various strategies has been done by taking into consideration the four historical stages, namely, medieval period, renaissance, postcolonial modernity and postmodernity. It has been argued that in these stages different strategies were employed by the dalits. It is in the postmodern state that the dalit discourse of equality has shifted its emphasis from inclusion and equality to exclusivity and difference. There are two predominant dalit discourses, each complimenting the other, in contemporary India. The first is the use of democratic means to claim power at the formal level by creating a distinct voter-constituency through the articulation of dalit identity. The second is a strong articulation of the exclusiveness of the dalit experience. The argument is that the dalit experience cannot be comprehended by non-dalits as a result of which only dalit can theorise his experience.

For many years, exclusivity payments and its specific type – loyalty rebates – were treated by the European Commission (Commission) as restrictions by object. This approach has been gradually revised towards a more effect-based reasoning. In the Guidance on the Commission’s enforcement priorities in applying Article 82 of the EC Treaty to abusive exclusionary conduct by dominant undertakings (Guidance), the Commission demonstrated its willingness to follow the so-called ‘economic approach’. In particular, the Commission announced that for price-based exclusionary conduct the so-called ‘as-efficient competitor’ test (AEC test) is going to be used. This article aims to verify whether the Commission followed the Guidance in its assessment of exclusionary practices in two cases, Qualcomm and Google (Android), considered by the Author as an opportunity to make a move from a form-based to an economic-based approach. In his considerations, the Author provides proposals on how the practice of the Commission should be changed to ensure dominant undertakings are provided with a sufficient level of legal certainty.
Pendant de nombreuses années, les paiements d’exclusivité et le type spécifique de rabais de fidélité ont été traités par la Commission européenne (la Commission) comme des restrictions par objet. Cette approche a été progressivement révisée en faveur d’un raisonnement fondé sur les effets. Dans les Orientations sur les priorités retenues par la Commission pour l’application de l’article 82 du Traité CE aux pratiques d’éviction abusives des entreprises dominantes (Orientations), la Commission a démontré sa volonté de suivre l’approche “économique”. En particulier, la Commission a annoncé que pour les pratiques d’exclusion fondées sur les prix, le test du “concurrent le plus efficace” sera utilisé. Cet article vise à vérifier si la Commission a suivi les lignes directrices dans son évaluation des pratiques d’exclusion dans deux affaires, Qualcomm et Google (Android), considérées par l’auteur comme des occasions de passer d’une approche fondée sur la forme à une approche économique. Dans ses considérations, l’Auteur fournit des propositions sur la manière dont la pratique de la Commission devrait être modifiée afin de garantir que les entreprises dominantes bénéficient d’un niveau suffisant de sécurité juridique.

Opis:
The phenomenon of right-wing populism, which has been spreading in Poland for several years, is deeply permeated with exclusive and anti-pluralist demagogy, which has consequences for public education in our country. In this context, an urgent socio-educational challenge is to counteract students’ fear of what is different and unknown, as well as to develop respect and empathy towards other people, i.e. their different worldview, culture and religion. The aim of this article is not to construct some ad hoc and one-off school and pedagogical initiatives in the face of populist lies and manipulation, but to create the conceptual foundations of an educational, interdisciplinary and, above all, anti-populist preventive system that would be thoroughly filled with the premises of intercultural education and educate young citizens who perceive pluralism as cultural and social value.
Szerzące się w Polsce od kilku lat zjawisko prawicowego populizmu jest dogłębnie przesiąknięte ekskluzywistyczną i antypluralistyczną demagogią, która nie pozostaje bez konsekwencji dla edukacji publicznej w naszym kraju. W tym kontekście naglącym wyzwaniem społeczno-pedagogicznym jest przeciwdziałanie wśród uczniów lękowi przed tym, co inne i nieznane, a także rozwój szacunku i empatii wobec drugiego człowieka, tj. jego odmiennego światopoglądu, kultury i religii. Celem niniejszego artykułu nie jest konstruowanie jakichś doraźnych i jednorazowych inicjatyw szkolno-pedagogicznych wobec populistycznych kłamstw i manipulacji, ale stworzenie koncepcyjnych podwalin edukacyjnego, interdyscyplinarnego i przede wszystkim antypopulistycznego systemu profilaktycznego, który byłby na wskroś wypełniony przesłankami edukacji międzykulturowej i wychowywał młodych obywateli, postrzegających pluralizm jako wartość kulturowo-społeczną.

The article comments on Milen Ruskov’s third novel Summit (The Heights / Възвишение, 2011) and its critical acclaim in Bulgaria. Set in 19th-century milieu, the revolutionary struggles and the novel’s unique language have been indicated by critics as its most outstanding aspects that provoke new debates on the national and linguistic identity of contemporary Bulgarians. At the same time the novel’s Polish translation by Magdalena Pytlak (Wzniesienie, 2017) poses other questions concerning the promotion of modern Bulgarian culture abroad, the translatability of Ruskov’s work and the translator’s strategies in terms of successfully “importing” Bulgarian literature into the Polish context.

Opracowanie zawiera prezentację problematyki zasady wyłączności firmy w polskim systemie prawa. W pierwszej części pracy autor prezentuje reguły, do których powinien stosować się przedsiębiorca zamierzający zarejestrować nową firmę. Wykładni poddano taki pojęcia jak „dostateczna odróżnialność firmy” oraz „rynek”. Zasadnicze rozważania koncentrują się wokół analizy mechani-zmów, jakimi władają organy rejestrowe, a mających na celu przestrzeganie tejże zasady na etapie rejestracji przedsiębiorcy. Zdaniem autora w obecnym stanie prawnym organy rejestrowe nie są wyposażone w mechanizmy / procedury służące realnej weryfikacji zasady wyłączności firmy na etapie postępowania rejestrowego.
The study includes a presentation of a company’s exclusivity rule in the Polish legal system. Its first part presents rules that need to be followed by an entrepreneur willing to register a new company. The explanation of such terms as ‘sufficient company’s responsibility’ and ‘market’ has been provided. The core solutions are concentrated around analysis of the mechanisms available for registering authorities, aiming for the compliance with this rule at the registration stage. In the author’s opinion, in current legal situation, registering authorities are not equipped with required mechanisms/procedures leading to the proper verification of the company’s exclusivity rule at the registration stage.

The article presents analysis of those fragments of Jesus’ ministry in the Gospel of Mark that were directed exclusively to the addresses referred to as “Disciples and/or the Twelve. The frames for these teachings are contained in the Parable of the Sower (Mk 4,11-20) and in the Mission Speech (Mk 16, 15-17). The parable and its explanation, that may be called Jesus’ programme speech, assume their final and appropriate meanings when combined with the Mission Order. The Mission Order, on the other hand, interpreted in the light of expla-nation of the Parable of the Sower, takes into consideration variants of the Sower’s identity present in the Parable, circumstances of Gospel preaching and reactions to the conveyed contents.

The fundamental condition of the Christian-Islamic dialogue and of mutual tolerance represents the triumph over the exclusive fundamentalism that, in the Christian religion, found expression in an axiom accepted for centuries – that of extra ecclesiam nulla salus (outside the Church there is no salvation). The fundamentalist-exclusive interpretation of the Koran dogma extra islam nulla salus, still compulsory today, precludes any form of dialogue with and tolerance of people of other faiths. This is not because such an interpretation views Islam as the one true religion – every religion is entitled to this ex natura rei – but rather because it degrades Christians as devotees of polytheism, and thus as “infidels”, whereby they are definitively discredited as partners for dialogue and tolerance.
Zasadniczym warunkiem międzyreligijnego dialogu i wzajemnej religijnej tolerancji islamu i chrześcijaństwa jest przezwyciężenie przez islam ekskluzywnego fundamentalizmu, tak jak to miało miejsce w religii chrześcijańskiej, gdzie przez wiele wieków ów ekskluzywizm wyrażał teologiczny aksjomat extra ecclesiam nulla salus. Obowiązująca do dziś fundamentalistyczno-ekskluzywna interpretacja dogmatu Koranu extra islam nulla salus wyklucza jakąkolwiek formę dialogu i tolerancji nie dlatego, że głosi ona, iż islam jest jedyną prawdziwą religią – takie prawo ex natura rei przysługuje każdej religii – ale dlatego, że degraduje ona chrześcijan do statusu wyznawców politeizmu, do statusu niewierzących („niewiernych“), a tym samym definitywnie dyskredytuje ich jako równoprawnych partnerów dialogu i tolerancji.

Wierność w przekładzie tekstów prawa jest nadrzędnym kryterium jakościowym. Do jej skrupulatnego zachowania obliguje polski Kodeks Zawodowy Tłumacza Przysięgłego. Natomiast z perspektywy norm preskryptywnych w języku docelowym i zasad ekwiwalencji tekstowo-normatywnej dodawanie lub opuszczanie określonych elementów tekstu może być wręcz obligatoryjnym działaniem translacyjnym. Artykuł omawia wybrane konteksty, w  których wymienione procedury znajdują swoje uzasadnione zastosowanie.
Fidelity in the translation of legal texts is the overriding qualitative criterion. Its meticulous observance is obliged by the Polish Professional Code of a Sworn Translator. However, from the perspective of prescriptive norms in the target language and the principles of textual and normative equivalence, adding or omitting specific elements of the text may even be an obligatory translational action. The article discusses selected contexts in which these procedures are justified.
Die Übersetzungstreue ist ein übergeordnetes Qualitätskriterium beim Übersetzen von Rechtstexten. Zu deren strikter Einhaltung verpflichten die polnischen Richtlinien für die Erstellung beurkundeter Übersetzungen. Aus der Perspektive der präskriptiven Normen der Zielsprache und der Anforderungen der textnormativen Äquivalenz kann sich die Hinzufügung (Explizitation) oder Tilgung (Simplizitation) bestimmter textueller Elemente als eine obligatorische Übersetzungsprozedur erweisen. Im Artikel werden die Kontexte behandelt, in denen die genannten Übersetzungstechniken ihre begründete Anwendung finden.

This paper is an examination of the many points of intersection between Korean nationalism in both Koreas, and Chinese characters (Hanja), as well as a contextualization of the historical and, at times, antithetical relationship or binary consisting of Hanja and Han’gŭl (Chosŏn’gŭl). Emerging from liberation the two Korean states over the next several decades would “engage” Hanja with diverse and fluctuating positions and approaches at different times. These responses have ranged from the abolition of Hanja or the enforcement of Han’gŭl (Chosŏn’gŭl) exclusivity, to the re-establishment and strengthening of Hanja education. Koreans for over a century have responded to “issues of script” based on socially-created narratives. This phenomenon can be viewed through constructivist paradigms, or can be interpreted as implemented pragmatic policies exemplifying instrumentalist nationalism. This paper’s assertion is that Korea’s vacillating response regarding Korean nationalism’s digraphic conflict is eloquent of the complex confluences that formed Korean ethnic nationalism, and therefore, Korean national identity.
Niniejszy artykuł stanowi wieloaspektowy przegląd „punktów stycznych” między koreańskim nacjonalizmem w obu Koreach a chińskimi znakami (Hanja). W tym aspekcie ukazuje również kontekstualizację historyczną, występujący niekiedy przeciwstawny związek czy istniejącą „podwójność”, która składa się z Hanja i Han’gŭl (Chosŏn’gŭl). W powstałych po wyzwoleniu dwóch państwach koreańskich w ciągu kolejnych kilku dekad znaki chińskie były nadal stosowane różnorodnie w różnym czasie. Zastanawiano się nad zniesieniem (likwidacją) Hanja i wprowadzeniem wyłącznie pisma koreańskiego, jak i nad przywróceniem i umocnieniem edukacji Hanja. Koreańczycy od ponad wieku odnoszą się do „kwestii pisma” w oparciu o społecznie tworzone narracje. Zjawisko to może być rozważane (analizowane) przez paradygmaty konstruktywistyczne lub może być postrzegane (tłumaczone) jako wprowadzenie pragmatycznych zasad ukazujących instrumentalny nacjonalizm. W kontekście koreańskiego nacjonalizmu pokazano konflikt dotyczący stosowania w Koreach dwuznaku (podwójności pisma: Hanja i Han’gŭl (Chosŏn’gŭl), co powiązane jest z kształtowaniem się koreańskiego nacjonalizmu etnicznego, a zatem i koreańskiej tożsamości narodowej.
본 논문은 남북한의 민족주의와 한자 사이의 많은 교차점을 분석하는 것뿐만 아니라, 한자와 한글(조선글) 간의 역사적 때때로는 상반되는 관계 및 이중성을 맥락화하는 것이다. 해방 후 수십 년 동안 남북한의 한자에 대한 입장과 정책은 다양하게 변화해 왔고, 그것은 한자폐지 혹은 한글(조선글)전용의 강제로 시작하여 한자교육의 재건이나 강화 등으로 나타났다. 한 세기 이상에 걸쳐 한국(조선)인들은 “문자의 문제”에 대해 사회적으로 이루어진 내러티브에 입각하여 반응했다. 이 현상은 구성주의 패러다임을 통해 볼 수 있으며, 또는 도구적 민족주의를 증명하는 실용 정책의 구현이라 해석될 수도 있다. 본 논문은 한국(조선) 민족주의의 이중(二重)문자 갈등에 관한 변동적 반응이 한국(조선)의 민족주의 즉, 한국(조선)의 정체성을 형성해 가는 복잡한 합류점임을 밝힌다.

Artykuł proponuje spojrzenie na krytykę literacką po 1989 roku z perspektywy zmieniającego się rozumienia i recepcji społecznej pojęcia elit i elitaryzmu. Autorka, nawiązując do różnych teorii elit – przede wszystkim nowszych, dla których najważniejszym punktem odniesienia jest koncepcja dystynkcji Pierre’a Bourdieu – pokazuje, jak koncepcje te uzgadniają się z estetycznymi i społecznymi dominantami polskiego życia literackiego po przełomie politycznym 1989 roku. W trzech „przypadkach krytycznych”: artykułu Krzysztofa Uniłowskiego z 2005 roku, facebookowej akcji związanej z „aukcyjną” sprzedażą książki poetyckiej Konrada Góry z 2020 roku oraz rysujących się w ostatnich latach nowych tendencji w języku młodego pokolenia krytyków, interesują ją relacje pomiędzy literaturą i krytyką literacką a dominującymi tendencjami estetycznymi i kontekstem społeczno-politycznym, dla których „papierkiem lakmusowym” są w niniejszym tekście pojęcia elit i elitaryzmu oraz ich różnie wykorzystywany potencjał manipulacyjny: analitycznie lub perswazyjnie, świadomie lub nieświadomie, w dobrej lub złej wierze itd.
This article examines literary criticism in Poland after 1989 from the dynamic perspective of elites and elitism. Drawing on various elite theories, mainly the more contemporary ones, for which the most important point of reference is Pierre Bourdieu’s concept of distinction, the author shows how these concepts function in relation to the aesthetic and social dominants of the Polish literary scene after 1989. The author analyzes three “critical case studies:” Krzysztof Uniłowski’s article from 2005, a Facebook event related to the “auctioning” of Konrad Góra’s book of poetry in 2020, and recent trends in the language used by the young generation of critics. The author is interested in the relationship between literature and criticism and the dominant aesthetic tendencies and the socio-political context, especially the use of the concepts of elites and elitism, be it analytically or persuasively, consciously or unconsciously, positively or negatively, etc.

W niniejszym eseju dokładnie analizuję koncepcję przedstawioną w niedawno wydanym tomie The Creation Hypothesis: Scientific Evidence for an Intelligent Designer pod redakcją J.P. Morelanda. Moreland gani chrześcijan za, jak to ujmuje, niezrozumienie, na czym polega właściwa integracja ich wiary z dyscyplinami świeckimi, a zwłaszcza z naukami przyrodniczymi. Współtwórcy tego tomu przedstawiają „naukę teistyczną”, która skupia się głównie na taktycznym lub strategicznym występowaniu przeciwko wykluczeniu bezpośrednich odwołań do boskiego sprawstwa (czyli przeciwko naturalizmowi metodologicznemu). Autorzy ci przyjmują zasadę inkluzji, to znaczy pogląd, że wyjaśnienia mówiące o bezpośrednim działaniu boskiego sprawcy mogą stanowić właściwą część nauk przyrodniczych. Jeśli dobrze rozumiem, koncepcja ta przybiera postać dwóch tez: (1) wierność chrześcijańskiego naukowca naturalizmowi metodologicznemu jest zupełnie irracjonalna; (2) przeciwstawianie się odwołaniom do bezpośredniego boskiego sprawstwa jako właściwej części nauk przyrodniczych jest irracjonalne również w przypadku szerszego grona naukowców, ponieważ nauka nie ma cech, które z natury odróżniałyby ją od innych dyscyplin. Wykażę przede wszystkim, że pierwsze twierdzenie jest błędne, drugie natomiast — nierozsądne. Rozróżnienie pomiędzy dyscyplinami, określone częściowo przez naturalizm metodologiczny, jest dobrze ugruntowane, wartościowe samo w sobie i jeśli je odpowiednio rozumieć, stanowi kluczowy element chrześcijańskich dociekań. Zgodnie z moją konkluzją dopuszczenie bezpośrednich odwołań do boskiego sprawstwa na gruncie nauk przyrodniczych miałoby szkodliwe konsekwencje dla ogólnie pojętego celu, jakim jest poszukiwanie prawdy.
In this essay, I closely scrutinize the proposal presented in a recently edited volume entitled The Creation Hypothesis: Scientific Evidence of an Intelligent Designer by J.P. Moreland. Moreland chides Christians for what he takes as their failure to understand the proper integration of their faith with secular disciplines, particularly the natural sciences. Contributors to this volume propose a „theistic science” which focuses primarily on the tactical or strategic proscription against direct reference to divine agency (methodological naturalism). These authors endorse the inclusivity principle, that is, the claim that explanations in terms of the direct and immediate activity of a divine agent may constitute a proper part of natural science. As I see it, the recommendation takes two forms: (1) it is positively irrational for the Christian engaged in natural science to remain committed to methodological naturalism, and (2) because science has no intrinsic individuating features, it is irrational for the broader scientific community to continue to resist appeal to immediate divine agency as a proper part of natural science. Specifically, I argue that the first statement is mistaken, and the second is ill-advised. The disciplinary distinction, as determined in part by methodological naturalism, is well-grounded, intrinsically valuable, and, when properly understood, a critical component of Christian inquiry. I conclude that permitting direct reference to divine agency in natural science severely undermines the overall quest for truth.

Nazwa „epistemiczny układ odniesienia” została wprowadzona przez Kazimierza Jodkowskiego w 2004 roku i jest efektem jego uprzednich analiz sporu ewolucjonizmu z kreacjonizmem. Epistemiczne układy odniesienia to niewielkie, dwu- lub trzyelementowe zbiory najogólniejszych, historycznie zmiennych założeń, które określają konieczne warunki uprawiania nauki. Współcześnie, z dwoma, bazującymi na naturalizmie metodologicznym, epistemicznymi układami odniesienia, rywalizują epistemiczne układy odniesienia nadnaturalizmu i artyficjalizmu. Epistemiczny układ odniesienia naturalizmu antynadnaturalistycznego to nakaz przyjmowania jedynie naturalistycznych wyjaśnień dla faktów i procesów, któremu towarzyszy zakaz przyjmowania wyjaśnień antynaturalistycznych, pojmowanych jako zakaz powoływania się na przyczyny nadnaturalne. Epistemiczny układ odniesienia nadnaturalizmu to nakaz dopuszczania w wyjaśnianiu zjawisk przyrodniczych obok przyczyn naturalnych również wyjaśnień odwołujących się do przyczyn nadnaturalnych — interwencji bytu nadprzyrodzonego, czyli Boga. Epistemiczny układ odniesienia naturalizmu antyartyficjalistycznego to nakaz przyjmowania jedynie naturalistycznych wyjaśnień dla faktów i procesów, któremu towarzyszy zakaz przyjmowania wyjaśnień antynaturalistycznych, pojmowanych jako zakaz powoływania się na przyczyny sztuczne (inteligentne, celowe). Epistemiczny układ odniesienia artyficjalizmu to nakaz dopuszczania w badaniach naukowych obok przyczyn naturalnych również przyczyn sztucznych, inteligentnych.
The term “epistemic framework” was coined by Kazimierz Jodkowski in 2004. That expression, together with the notion of epistemic frameworks, is the outcome of his prior analyses of the evolution-creation controversy. Epistemic frameworks are small, two- or three-element sets of the most general, historically changeable assumptions. These assumptions determine sine qua non conditions of scientific practice. Nowadays, two epistemic frameworks based on methodological naturalism are in competition with the epistemic frameworks of supernaturalism and artificialism. The epistemic framework of antisupernaturalistic naturalism adheres to the precept of accepting only naturalistic explanations for facts and processes. That precept is correlated with a proscription on accepting antinaturalistic explanations, construed in turn as a proscription on referring to supernatural causes. The epistemic framework of supernaturalism follows the precept of accepting not only naturalistic explanations for facts and processes, but also supernaturalistic ones — interventions by a divine being, namely God. The epistemic framework of anti-artificialistic naturalism observes the precept of accepting only naturalistic explanations for facts and processes. That precept is correlated with a proscription on accepting antinaturalistic explanations, construed in turn as a proscription on referring to artificial (intelligent) causes. The epistemic framework of artificialism embraces the precept of accepting, in the context of scientific research, not only natural causes, but artificial (intelligent) ones as well.
