Opis:
Election of Members of the European Parliament on Polish territory for the first time took place in 2004. This election is a historic moment, because Poland and Polish people for the first time we were able to choose their representatives to the European Parliament. For the first time will Parliamentarians have its European family, the structures of the Polish accession to the European Communities, so that we share responsibility for the further development and future of our Europe. The elections were conducted under the Act of 23 January 2004 – Elections to the European Parliament. The literature on this subject is small, they are mainly publications concerning mechanisms for passing laws and discussing its main goals. Existing data do not cover the whole subject, as appeared before the majority of the Ordinance implementing acts. I hope that my article although the closer the issue of electoral law and the holding of elections to the European Parliament, and will be for the reader an introduction to the handbook and knowledge for entry to the course of European integration, European communities law and will bring the functioning of the institutions of the European Union.

The article concerns primarily the effects of the membership of the European Union on national (Polish) law and, to a limited extent, on the political system of a state. The conclusions presented in the article are of universal value. Although the article deals with Polish affairs, the principles, tendencies and consequences identified are typical of the relationship state – the EU, both before and after accession, regardless of the state concerned. It should be, however, noted that the path to membership and the membership itself are different in each case. The practice of the Polish membership of the European Union, its systemic dimension and the changes in the national legal system (Europeanisation) do not differ significantly than in the case of other Member States. Europeanisation of Polish law, politics, economy, culture and society has been in progress since the 1990s. One can differentiate between two stages of Europeanisation: before and after Poland’s EU accession, each characterised by different conditions. Over time, this process, on the whole, has been undergoing numerous changes but it has never weakened in importance. Poland faces issues such as poor legitimation of integration processes, supremacy of the government over the parliament, passivity of parliamentary committees in controlling the government and EU institutions in the decision making process, as well as dilution of responsibility for decisions taken within the EU. The process of Europeanisation relies mostly on direct application of the standards of EU law in the national legal system, implementation of directives into national law and harmonisation or standardisation of national legal solutions so that they comply with the EU framework. It is also reception of a common, European (Union) axiology.

One of the political goals of the EU in broad is the absorption of all European continent state in a sort of United States of Europe. Nowadays the EU counts 28 states and the perspective of enlargement is not stopped by the current economic crisis. The current situation after the just completed pro-EU revolution in Ukraine and the implementation of strong economic link with former USSR Transcaucasian Republics (Georgia, Armenia and Azerbaijan) may suggest the final number of state in the EU. Many people believe that the United States of Europe puzzle is nearly full defined … but a new kind of EU enlargement may change the situation. This paper will focus only in one question. “Is an EU Member state secessionist territory automatically in the EU after archiving its Independence or have to reapply?” To answer to this question I will analyses the possible past experiences in secessionist territory getting membership in international organization like UN. The Vienna Convention on Succession of States in Respect of Treaties is a good material to use in case of succession but the fact that is not in force and not signed by the greatest part of EU member state make it only advisory and not binding.

In the face of the European integration, the legal protection of national symbols enjoys momentous significance. The present turbulent times and numerous conflicts, the etiology of which is – e.g. social or political in nature – require an attempt to make a scientific overview of the situation. In this article I will examine the scope of standardization of the protection of national colors in the Polish law, the Italian law and the Community legislation. The study takes into account the historical and contemporary judicial decisions. I will try to answer the question whether the scope of protection of the Community colors in the Polish law is sufficient? The analysis of the examined normative acts has led me to the conclusion that the Polish legislator, after the restoration of independent statehood, attached a great importance to the normative grounds ensuring protection of colors of the national symbols. The Italian constitutional adjustment, compared to the Polish one in the scope of the national colors, is very sparse. Aside from the Community rules, each member state – as a result of historical development – has developed its own model of protection. The colors of the European Union are not expressly protected under the Polish normative regulations. However, de lege ferenda, I reckon that for the interests of legal certainty, the legal status in this field should be amended and relevant norms should be laid down.
W obliczu integracji europejskiej, doniosłego znaczenia nabiera prawna ochrona symboli narodowych. Współczesne czasy nie są spokojne. Liczne konflikty, których etiologia ma charakter społeczny, polityczny, nakazują próbę dokonania scjentystycznego oglądu sytuacji. W niniejszym artykule zbadam zakres normowania ochrony barw narodowych w prawie polskim i włoskim oraz wspólnotowym. W badaniach uwzględnię historyczne i współczesne orzecznictwo sądowe. Spróbuję udzielić odpowiedzi na pytanie o to, czy na gruncie prawa polskiego zakres ochrony barw wspólnotowych jest wystarczający? Analiza zbadanych aktów normatywnych doprowadziła mnie do wniosku o tym, że polski prawodawca po odzyskaniu niepodległego bytu państwowego przywiązywał dużą wagę do normatywnych podstaw mających zapewnić ochronę barwom jako symbolom narodowym. Włoska regulacja konstytucyjna, w porównaniu do polskiej, w zakresie barw narodowych jest bardzo skąpa. Pomimo regulacji wspólnotowej, każde z państw członkowskich – na skutek rozwoju historycznego – wykształciło własny model tej ochrony. Barwy Unii Europejskiej nie są expressis verbis chronione na gruncie polskich regulacji normatywnych. Moim zdaniem, de lege ferenda, dla pewności obrotu prawnego, należałoby stan prawny w tym zakresie zmienić i stosowne normy subrogować.

The term ‘beneficiary’ used for the purposes of spending the EU aid funds was introduced into the Polish legal system before Poland became member of the European Union. Initially, the national legislator used this term only in the domestic regulations on the basis of which public funds were transferred. Over time, the legislator also introduced the definition of the beneficiary to national regulations adapted to the needs of the cohesion policy. It can be observed that the legislator, while initially providing own definitions of the beneficiary, recently has only referred to particular provisions of the directly applicable EU regulations. Obviously, national authorities must operate in an integrated legal system, in which there are many sources of binding law that define ‘beneficiaries of funds allocated to the implementation of the cohesion policy’. In this context, one can speak of the Europeanisation of national law with regard to the implemented policy.

This article aims synthetically to refer to discussion between Polish academiclawyers about the controversies regarding to reduction of a specified sum in “agreed or stipulated payment for non-performance” in art. 484 § 2 of Polish Civil Code. These conclusions, resulting from the analysis of Polish private law - will be referring to the same reduction-clause in three selected acts of contracts model law: UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law and the Draft Common Frame of Reference. The last part of this article contains the conclusions de lege ferenda from comparative analysis.

The article is an explanation of the way the European company operates. The author briefly points to the laws and their provisions regulating the status of the European company in its present form. The author primarily highlights EU legislation in the field of European company law, but also regulations in French commercial law related to the analyzed company. Additionally, the author shows the ways of creating a European company and possible styles of managing it. The author also highlights the situation of the employees of a European company and the advantages of creating this type of company, whether fiscal, related to the location, or resultant from the statute of thiscompany. In conclusion, the author points out a number of prospects for the functioning of a European company, highlighting the competitiveness of such a company on the European market and the possibility of its development by European enterprises, as well as indicating that the company is a kind of compromise between the regulations proposed by the European legislator and the regulations laid down by the domestic law of the Member States.

The year 1993 marked the establishment of formal EU citizenship and, subsequently, special relations were forged between the earlier status of the individual, a subject of internal market freedoms, and the notion of political EU citizenship. The social and welfare rights of individuals were strengthened, thus enabling a deeper integration. The social rights in the EU’s legal system play a special role in the construction of EU citizenship as they add meaning to the notion of citizenship and go beyond the traditional, economic dimension of integration. What links the constructs of market citizenship and social citizenship is the strong emphasis on the individual’s right to their status, and to rights which can be exercised effectively. Recently, political and economic citizenships have merged. However, this process has been confronted with resistance from some member states, particularly the ones with wealthy social protection systems. This has been caused by the abuse of rights by migrants from other member states, i.e., through so-called social tourism.

The article is designed to provide readers with a legal context of medical experimentation. Medical research involving humans needs careful regulation. Although international law, European law, and domestic law are usually described as separate sources of law, they are increasingly interdependent. Their interaction produces a layering effect of laws that address medical experimentation. The paper begins with an overview of content of soft international law. In the next section the author addresses the issue of hard law, i.e. the Geneva Conventions, provisions of the International Covenant on Civil and Political Rights and International Covenant on Economic, Social and Cultural Rights. The Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine is the subject of analysis in the third part of the paper. The next section discusses selected issues related to regulations of European Union law. At the national level, the Polish Constitution provides for a medical research principium. In order to provide deeper insight, the next part of analysis is based on domestic criminal law. The final section discusses the role of the physician in medical research in light of the norm included in the 1996 Act on the professions of the physician and dentist.

Regulation of this matter is based on the specific division of lawmaking powers – in the Fifth Republic, which makes the government superior to the parliament. Although the change in the Constitution in 2008 greatly depleted the government’s prerogatives in the legislative procedure, it also imposed new obligations on the government to draft laws of better quality. The government is still the main actor in the legislative process. It is also responsible for ensuring progress in the implementation of EU legislation in France and for conformity of French national legislation with EU law.

La proclamazione di diritti senza contestuale strumenti che ne assicurino l’effettività è fonte di crisi de diritto e della Giustizia. Occorre proporre un nuovo ‘modello’, per il quale il diritto ed il processo romano appaiono fonte di suggestioni e di spunti innovativi applicabili anche all’oggi. In particolare è inammissibile l’enfatizzazione dei ‘Trattati’ sino al punto di minacciare l’uomo e l’ambiente. Il diritto romano indica la via per impedire l’assoggettamento agli interessi economico- finanziari di pochi.
The proclamation of rights without contextual means to ensure. is not an effective source of justice and leads to a justice crisis. A new ‘model’ must be proposed , which sees the Roman law and process as a source of innovative suggestions and ideas that apply to the present. In particular, it is important to emphasize the ‘Treaties’ as threatening to man and the environment. The Roman law indicates the way to prevent the underlying economic and financial reign of the few.

The paper presents the problem of public interest in the context of water law act established in 2017. In the article, general problems of water-law relations, the institution of public interest itself and European water law are described. The analysis is about conceptual grid of the act and its cohesion, and compatibility with Rules of Proper Legislation. The author assumes that water law regulations have a specific subject, thus, they must be focused on the guarantee of public interest.
Opracowanie przedstawia problematykę interesu publicznego na gruncie ustawy – Prawo wodne, uchwalonej w 2017 r. W pracy zostały omówione ogólne zagadnienia dotyczące konieczności odrębnej regulacji stosunków wodnoprawnych, interesu publicznego jako takiego i europejskich podstaw prawa wodnego. Analiza dotyczy siatki pojęciowej stworzonej przez prawodawcę pod kątem jej spójności i zgodności z zasadami techniki prawodawczej. Autor opiera się na założeniu, że stosunki wodnoprawne – z uwagi na ich przedmiot – w sposób szczególny powinny podchodzić do problemu odpowiedniego zagwarantowania interesu publicznego.

Starting from the 2015 until now European Union struggles with the biggest migration crisis from the time of Second World War. This crisis - determined by many as one of the biggest European Union challenge in XXI century - requires to take more effective action by every member states. The aim put by the authors of this article is synthetic characterization of actions made by European Union and attempt to rating them.

In recent years, a tormenting phenomenon can be observed related to the decreasing number of transplants performed due to the limited amount of patron organs. This fact has become an opportunity to analyse the European Union’s regulations of transplantations. The achievements of the Council of Europe and the European Union in terms of organ donation and transplantation has been presented in detail with a conclusion heading towards the dangerous commercialization process of transplantations. This article presents also the standards developed by the European Union in regard to transplantology which clearly supports the fact that organ donation should be on non-profit and altruistic basis excluding commercial aspects.

Pursuant to the Regulation (EC) No 562/2006 of the European Parliament and Council establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) border control and determining the possibility of entry to the European Union apply individually to every third country national. One of the conditions of entry of third country nationals into the Union is to have a visa. EU law indicates those third countries whose nationals must be in possession of visa when crossing the external borders of the Union. This requirement applies also to citizens of Russia. The existence of reasons for refusing entry stipulated in the EU law obliges competent authorities of Members States to issue a decision to refuse entry to the European Union for third country national.

There is no detailed legal regulation, which directly refers to nature conservation in context of use of nanotechnologies. European Commission is finalizing the few years long review, assessing the adequacy of EU legislative framework including the nature conservaion laws to the use of nanomaterials. In 2012 European Commission has finished the second regulations review in field of nanomaterials, proposing legal actions and approved the need of using unified definition of nanomaterial. “Precautionary principle” forms the basis for all environmental directives that are under consideration or have been issued by the EC.

The article deals with the procedure for assessment of conformity of bills with the EU law in the United Kingdom. In the British legal system, due to the principle of duality, international law (including EU law) has an impact on domestic law only through acts of national parliament. Moreover, the principle of sovereignty of parliament is applied. Bills are checked for their compliance with EU law on the government’s drafting stage. In the course of legislative work in Parliament compliance of bills with EU law is not assessed.

Opis:
Formed at the end of the nineteenth century in the United States, the essential facilities doctrine was created to prevent the refusal of access to certain key equipment, which is used as an instrument to secure the dominant position of the undertaking in those markets where the emergence of competition is strictly related to obtaining access to key device. The author describes the initiation in the 1970’s of the acquisition of the American doctrine by European Union law by focusing on the role of the European Commission and the Court of Justice of the European Union in this process. Both American and European prsemises for an application of the essential facilities doctrine are presented, as well as its advantages and disadvantages.

The purpose of this article is to set out the multiannual process for establishing the European Ombudsman's office and the reasons for its establishment. It presents the history of the first European Ombudsmen and the history of the European Communities from a legal perspective. The author goes back to the reasons for setting up the European Ombudsman's body, which were the lack of legitimacy in the European Union. The role of bodies such as the European Ombudsman is to ensure that citizens' rights are actually respected. The European Ombudsman strengthens the rule of law in the European Union and complements the role of the courts by providing a cheap, accessible individual remedy and, on the other hand, complements the representative function of the European Parliament by becoming the centre of independent critical assessment and improvement of the quality of European administration. The rule of law serves to maintain the EU system as a supranational system. It is the construction of the axis of integration. If there is a lack of trust in the community in this respect, it begins to be treated differently. It is therefore important that the European Ombudsman fulfils his Treaty obligations as a body of the European Union effectively.

In Germany, the Ministry of Justice plays a central role in assessing the compatibility of draft federal laws with EU legislation. The Ministry of Internal Affairs and other ministries are also involved in this process. The Federal Minister of Justice may raise an “objection” to any bill which is inconsistent with the law (including EU law). Each new bill requires an explanatory statement which must also deal with the relationship of the bill and the EU law (with few exceptions). In fact, the responsibility for ensuring that the law adopted by the Bundestag is consistent with EU law rests primarily on the Federal Government and, within it, primarily on the legal services of the Federal Ministry of Justice.

The article discusses the issue of standards of the right to defence and takes into account the recent amendments of the Code of Criminal Procedure. The analysis is conducted against the background of minimum standards of the right to defence set out under European law. A reference introduced to the title of the Code includes the assertion that the legislator has implemented the provisions of Directive of 22 October 2013 on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty as well as Directive of 9 March 2016 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings. However, it should be emphasized in this context that as a result of changes made in the discussed scope in the years 2016-2019, the legislator not only failed to fully implement the aforementioned Directives, but even introduced modifications that led to lowering the standards of the right to defence and guarantees of its implementation, both in material as well as formal terms.

The opinion presents major differences in the legal situation of clients- entrepreneurs in relation to (legally privileged) recipients being household owners and consumers. Moreover, the author presents legal arguments for an extension of the protection standard regarding privileged entrepreneurs to micro-entrepreneurs and small entrepreneurs under the European Union legislation and in compliance with the national one. The opinion contains arguments for a specific national legislation, which would provide content to the state obligation to provide assistance to the development of entrepreneurship, in particular the micro-entrepreneurs, and which would facilitate an effective use of liberties of a uniformed EU market in the trans-border dimension.

The judgement of the Polish Constitutional Court of 26 June 2013 compared with the judgment of the German Federal Constitutional Tribunal of 18 March 2014 indicates that some significant amendments should be introduced into the Polish Constitution. Both amending procedures foreseen by the Treaty of Lisbon and the “Schengen method” used to reform the Eurozone imply a necessity to differ between the ordinary revision procedure and the simplified revision procedure also in national constitutional law. Taking into a account German constitutional provisions and jurisprudence of the German Federal Court such an amendment allows to concentrate on a question how to effective secure an influence of Polish constitutional institutions, especially the Sejm, on integration process.

The creation of a single market in Europe, conceived as the application of the so-called four freedoms (goods, services, capital and manpower) of movement was in vogue in the 1990s. What has happened to this dream? At the time not only business communities but also consumer associations, and even labour unions were all in favour of opening their national economies to the winds of continental competition. Three decades after, some national communities seem to have turned their backs on the free movement of people. The case of Eastern European immigrants settling for work in the UK after 2004 comes to mind, something which arguably was one of the main reasons for the Brexit vote in 2016. The issue could again become the focus of populist governments or parties (e.g., in Italy, France, Sweden, Austria, Hungary or The Netherlands), should the danger of an EU-wide recession or an idiosyncratic crisis in one of the poorest member states (MSs) materialize. Actually, a new intensification of intra-EU migration flows could be one of the outcomes of the unravelling of supply chains as a result of the COVID epidemic and geopolitical considerations, such as the EU’s wish to diminish trade dependence from China and Russia. The ground is slowly eroding under the feet of those adamant to cling to the free movement of people as part of the acquis. The EU Commission should give thought, before it is too late, about the fourth freedom particularly in view of future EU enlargements.

In the article chosen issues of the relation of the Polish and the European agricultural law in basic concepts were presented. They made an appraisal of the need of the redefinition of these notions. In conclusion, it was found that only changes of a basic concepts may make it necessary to formulate a new agricultural legislation in a European perspective. They pointed also at issues of sending back legal for European regulations. They also dealt with linguistic issues and interpretation of formulated notions. It was emphasized, that the concepts of agricultural legislation contained in European law are concepts national law of particular importance. They are not only modifying already existing notions, but also, when the contradiction is occurring between them they are more important and should be applied in the given area of the regulation.

Artykuł dotyczy również faktu, że - na podstawie rozporządzenia Ministra Rodziny, Pracy i Polityki Społecznej z dnia 16 grudnia 2016 r. w sprawie upoważnienia do uznawania kwalifikacji - Centralny Instytut Ochrony Pracy - Państwowy Instytut Badawczy pełni funkcję organu prowadzącego postępowanie o uznanie kwalifikacji nabytych w państwach członkowskich Unii Europejskiej do wykonywania w Rzeczypospolitej Polskiej zawodów regulowanych w dziedzinie bhp. Zgodnie z rozporządzeniem są to takie zawody jak specjalista ds. bezpieczeństwa i higieny pracy oraz technik bezpieczeństwa i higieny pracy. Możliwość korzystania z usług CIOP-PIB w zakresie uznawania kwalifikacji zawodowych mają na równych prawach wszyscy wnioskujący.
This article presents information on the process of recognizing professional qualifications acquired within EU member states and on becoming employed in Poland in OSH-related occupations. Following the act of the Minister of Family, Work and Social Policy of January 16,2016, on authorization to recognize qualifications, the Central Institute for Labour Protection - National Research Institute (CIOP-PIB) is a body governing the procedure for recognizing qualifications for OSH-related regulated professions (OSH specialist and OSH technician) acquired within the EU to be used in Poland. All applicants can use CIOP-PIB's services.

The article provides an overview of consumer protection measures designed to ensure the rights of owners and users of virtual currencies. The authors state that there is an ongoing debate in the EU about the legal qualification of virtual currencies as financial instruments. It is contrary to the initial purpose of virtual currencies which was the payment function. The authors attempt to answer the question which EU law should cover the virtual currencies, MIFID2 or PSD2, as the legal qualification will be crucial for consumer rights. They claim that the position adopted by the European legislative should provide the fullest possible scope of consumer protection.

Stan środowisko glebowego jest niezwykle ważny z punktu widzenia świata ożywionego – gwarantując mu środowisko życia oraz wytwarzając pokarm. Każda działalność człowieka nieuchronnie prowadzi do degradacji środowiska, w tym również gleb. Stopień ich zanieczyszczenia i nakaz ochrony wynika bezpośrednio z zapisów prawnych, obecnych zarówno w prawodawstwie krajowym jak i aktów uchwalanych na szczeblu unijnym. W pracy przedstawiono ochronę gleb w aktach polskich i europejskich aktach prawnych.
Environmental condition of the soil is extremely important from the point of view of the living world - it's a guarantee of environment of living and producing food. Every human activity inevitably leads to environmental degradation, including soil pollution. The degree of soil degradation and the order of its protection is a direct result of legal provisions, which is present both in the national legislation and the acts adopted at EU level. This paper presents the problem of soil protection in the files of Polish and European legislation.

Opis:
This article analyses the priorities of European competition law in the air transport sector in the light of the ongoing process of the industry’s consolidation. The oligopolistic nature of the airline business results in a natural tendency towards its concentration. From the standpoint of regulatory oversight, the question is how to manage or counteract this tendency in order to achieve defined policy goals. In this vein, European competition law has departed from the model whereby the competitive process in itself is the priority and turned to an instrumental approach, with preference given to the welfare of customers. This analysis will highlight three policy areas relevant to the discussed subject. It begins with antitrust law, with special emphasis on the sector-specific phenomenon of airline alliances; then discusses merger control, especially in the context of pro-competitive remedies, and finally State aid, with particular focus on the effects of the compensatory scaling-down of operations which are imposed on recipients of a rescue and restructuring aid grant.

The issue of re-nationalization (disintegration and fragmentation) of integration process is manifested by the will of some of the Member States to verify their relations with the European Union. In the age of an economic crisis of the EU and in relation to the large migration of the population, there has emerged strong social and political criticism, on the European level, of the integration process, with some Member States even consideringtheir withdrawal from the EU. In those States, demands forextending the Member States’ competences in the field of some EU policies are becoming more and more popular. The legal effects of the above-mentioned processes are visible in the free movements of the internal market, mainly within the free movement of persons. Therefore, there are problems, such as increased social dumping process, the need to retain the output of the European labour law, the issue of the so-called social tourism, erosion of the meaning of the EU citizenship and the principle of equal treatment.

Freedom of contract and corrective justice are considered to be the basic principles governing contract law. However, many contemporary legal orders implement various policy goals into private law. The regulatory private law of the European Union is the most striking example of such a trend. This article aims at reconciling the corrective justice theory of private law and the principle of freedom of contract with the regulatory dimension of the EU law. The main argument is that the meaning of the concept of harm, one that is crucial to the principle of corrective justice, should be understood broadly so that it can transform the corrective justice theory from a monistic one into a pluralistic one.

At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.

Upon entry into force of the accession treaty, Poland – as a member state of the European Union – became bound by the body of EU law (the acquis communautaire), including its primary and secondary law as well as the interpretation of EU law contained in the Court of Justice of the European Union case-law. Due to a very close approximation of Polish legislation to EU law – resulting from the obligation to consider, employ, and apply in the process of implementing the former a number of EU legal acts, i.e. regulations, directives, as well as acts of soft law such as guidelines and recommendations that are not acts of common law – the problem of the scope of application of EU law within the Polish legal system has occurred; this problem, or a gap in the legal sense, has been addressed and resolved, to a large extent, by case-law of the CJEU.

Ukraine has chosen its way of development towards Europe, European values and respect for human dignity and human rights. The signing of the Association Agreement in 2014 obliged Ukraine to harmonize its legislation in priority spheres of life with the legislation of the European Union. But legislative approximation should touch not only upon the fields of public law, but private law too and, in particular, tort law. The main problem of tort law approximation is that there are no joint tort rules in the EU. All attempts to harmonize tort law stopped at the creation of acts of “soft law” – general non-binding rules and principles. One of the most significant examples is the PETL – the Principles of European Tort Law. The PETL show a modern understanding of torts, spell out the conditions of tort liability, as well as other relevant requirements. Ukrainian rules of tort law do provide protection of a victim’s violated rights, however some recommendations of the PETL, such as provisions governing the conditions of tort liability, the understanding of causation and fault should be taken into account when Ukrainian tort law is modernised.

The article considers the problem of adaptation of the law of Ukraine to EU private law. It analyzes the concept of “European Law” and “EU law” as elements of European civilization and their correlation is determined. On the basis of differentiation between the Western and the Eastern European civilizations a conclusion about the existence of corresponding traditions of private law is made. The idea that the concept of private law is grounded in western culture is based on the fact that there is a need for the adaptation of Ukrainian law to EU law. This approach is the basis for the conclusion that the success of the adaptation of the law of Ukraine to EU law depends primarily on the willingness of Ukrainian society to accept the fundamental values of European civilization, such as liberalism, human rights, the right of private property, freedom of contract etc.
Artykuł poświęcony jest zagadnieniom dotyczącym adaptacji prawa Ukrainy do prawa prywatnego Unii Europejskiej. Na podstawi analizy różnic pomiędzy Zachodnimi i Wschodnimi sub-cywilizacjami autorzy podjęli próbę podsumowania, przez pryzmat istnienia odpowiednich tradycji prawa prywatnego. Zwracają uwagę na to, ze koncepcja prawa prywatnego jest elementem Zachodnioeuropejskiej sub-cywilizacji i podstawą adaptacji prawa Ukrainy do prawa Unii Europejskiej. Adaptacja prawa Ukrainy do prawa Unii Europejskiej jest możliwa, przede wszystkim, w oparciu o takie wartości europejskie jak liberalizm, prawa osobiste, prawo własności prywatnej, swoboda umów i inne.

The article covers the Europen Commission’s proposal of sales law. The regulation aims at creation of ancilliary rules existing simultaneously with national civil codes. As we can read in grounds for the proposal Differences in contract law between Member States hinder traders and consumers who want to engage in cross-border trade within the internal market. The obstacles which stem from these differences dissuade traders, small and medium-sized enterprises (SME) in particular, from entering cross border trade or expanding to new Member States’ markets’. The regulation includes only B2C relations. In B2B transactions it can be applied if at least one of the parties is SME (small and medium-sized enterprises). The author presents all regulation and wonders how the regulation can affect future of private law in Europe.
Artykuł jest poświęcony propozycji Komisji Europejskiej dotyczącej wspólnotowej sprzedaży. Przedstawiony przez KE projekt rozporządzenia Common European Sales Law (CESL, Instrument Opcjonalny) stanowi pierwszy projekt kodyfikacyjny europejskiego prawa prywatnego, który ma szansę wyjść poza sferę akademickiego dyskursu. Jest on podyktowany trudnościami, jakie napotykąją międzynarowe transakcje. Projekt CESL jest ograniczony do materii, które stwarzają istotne problemy w transgranicznych transakcjach i nie obejmują zagadnień, które mogą zostać rozwiązane na szczeblu państw członkowskich. Zakres podmiotowy projektu został ograniczony do stosunków konsumenckich i stosunków profesjonalnych (business to business relations – B2B), w których przynajmniej jedna strona jest małym albo średnim przedsiębiorcą (small and medium-sized enterprises – SME).

The European integration is opening new perspectives of social, cultural, economic and political development. The free movement of people caused extinction of the old border conflicts. The integration processes on a global scale require ideological foundation based on a certain system of values. Consequently, within the European Union, there is the collision of traditional culture, built on Christianity, Greek philosophy and Roman law. The new system of values, mainly contained in the Charter of Fundamental Rights of 2000, storms the existing concept of family, marriage, social welfare system, and finally the traditional conception of the state. The collision of two systems of values must raise some concerns and social tensions, that we should talk about. The basis for discussion is the issue of citizenship of the Member State and the citizenship of European Union in the context of national identity.
Integracja europejska otwiera coraz to nowsze perspektywy rozwoju społecznego, kulturowego, gospodarczego i politycznego. Swoboda przepływu osób spowodowała w głównej mierze wygaszenie dawnych granicznych konfliktów. Procesy integracyjne na skalę globalną wymagają podbudowy ideologicznej osadzonej na określonym systemie wartości. W konsekwencji dochodzi w ramach Unii Europejskiej do zderzenia tradycyjnej kultury, zbudowanej na chrześcijaństwie, filozofii greckiej i prawie rzymskim. Nowy system wartości, zawarty głównie w Karcie Praw Podstawowych z 2000 roku, burzy dotychczasową koncepcję m.in. rodziny, małżeństwa, systemu pomocy społecznej, a w końcu tradycyjną koncepcję państwa. Zderzenie się dwóch systemów wartości musi rodzić pewne obawy i napięcia społeczne, o których należy mówić. Podstawę rozważań stanowi kwestia obywatelstwa państwa członkowskiego i obywatelstwa Unii Europejskiej w kontekście tożsamości narodowej.

30 April 2016 saw the entering into force of the Act of 14 April 2016 on the Suspension of Sale of Land of the Agricultural Property Stock of the State Treasury and on Amending Numerous Acts . The amendments pertained to, inter alia, the Act of 11 April 2003 on the Formation of the Agricultural System , and introduced a variety of alterations thereto, thus restricting significantly the freedom of trading in agricultural land. This article provides an analysis of conformity of Polish legislation with European Union legislation and also explains the liability of the State Treasury in case of violations of EU law.

Unimpeded functioning of the natural environment is the basis for the operation and effective development of society. However, the fundamental role that nature plays in the existence of society has not protected it from overexploitation. Human activity focused mainly on the progressive economic development has gradually led to a significant environmental degradation. Therefore the problem of environmental protection has rightly become the main topic of public discourse worldwide. In response, governments and international organizations have taken a series of coordinated actions to prevent further destruction. Law is one of the most effective instruments in environmental protection. The Polish Constitution provides that environmental protection is a duty of public authorities, which they are obligated to fulfil. The EU law also protects the environment by means of many legislative acts. Over the years, the European Union, as the economic and political union of states, has developed one of the most restrictive mechanisms of environmental protection. The EU legislation has always emphasized that sustainable development and green economy are the supreme values for the Union. The EU law is part of the Polish legal system, and thus also imposes the obligation on Polish public authorities to care for the environment.

Mediation is an integral part of contemporary criminal law. It represents an implementation of restorative justice elements in penal policy. W artykule przedstawiono zagadnienia związane z utrzymaniem pojazdów kolejowych. Rozporządzenie to nakłada na podmioty odpowiedzialne za utrzymanie pojazdów kolejowych budowę Systemu Zarządzania Utrzymaniem (Maintenance Management System - MMS). W artykule skupiono sie na analizie wymagań prawnych niezbędnych do budowy systemu zgodnie z ww. Rozporządzeniem, oraz przedstawiono autorski model budowy Systemu Zarządzania Utrzymaniem dla rynku kolejowego.
This article presents issues related to the maintenance of railway vehicles. Subject was taken in connection with the current requirements of European law in this area - Commission Regulation (EU) No. 445/2011 of 10 May 2011 on a system of certification of entities in charge of maintenance for freight wagons and amending Regulation (EC) No. 653/2007. This regulation imposes on the parties responsible for maintenance of the railway vehicles construction of Maintenance Management System (MMS). The article focuses on the analysis of the legal requirements necessary to build the system according to the Commission Regulation, as well as presents the author's model of Maintenance Management System for the railway market.

Regulacje prawne istotnie wpływają na prowadzenie działalności archiwalnej, w tym na stan zachowania i dostępność materiałów archiwalnych. Artykuł syntetycznie przedstawia obowiązujące w Polsce w dniu 1 września 2020 r. unormowania prawa powszechnie obowiązującego bezpośrednio odnoszące się do ustroju instytucji archiwalnych oraz do ochrony materiałów archiwalnych, a także kształtowania, opracowywania i udostępniania zasobu archiwalnego. Regulacje te znajdują się w Konstytucji Rzeczypospolitej Polskiej, w ustawie z 1983 r. o narodowym zasobie archiwalnym i archiwach wraz z aktami wykonawczymi, a także w szeregu innych ustaw i rozporządzeń oraz w licznych umowach międzynarodowych i aktach prawa Unii Europejskiej. Szczególną uwagę zwraca wzrost liczby uregulowań traktujących archiwalia łącznie z innymi dobrami kultury oraz lokujących działalność archiwów w obszarze zapewniania szeroko rozumianego dostępu do informacji. Dużym wyzwaniem jest rozproszenie tych norm wśród wielu aktów prawnych oraz liczne i fragmentaryczne zmiany w nich dokonywane. Niektóre obszary regulacji prawnych wymagają pogłębienia badań, zwłaszcza nad ich rzeczywistym wpływem na działanie archiwów. Legal provisions significantly affect archival activities, including the state of preservation and availability of archival materials. This article presents the provisions of generally applicable law in Poland as of 1 September 2020, taking into account provisions directly related to the structure of archival institutions, the protection of archival materials and the processes of shaping, developing and sharing of archival resources. These provisions can be found in the Constitution of the Republic of Poland, the Act on National Archive Resources and Archives of 1983 with secondary legislation, a range of other acts and secondary legislation to them, numerous international agreements and legal acts of the EU. It is particularly interesting that there is an increase in the number of regulations which treat archives together with other cultural assets, which locate the activities of archives in the area of general access to information. A major challenge is the dispersion of these norms across many legal acts, as well as frequent and fragmentary amendments to them. Some areas of legal regulations require more in-depth research, especially in terms of their actual impact on the activities of archives. This reflection may be useful in methodological discussions, educating archive staff at all levels and formulating proposals for legislative amendments.

In European Union there are three levels of law governing elections to the Europen Parliament. First of all, European Union election law is regulated by the primary law and directive 93/109/WE as well as by the jurisprudence of the European Court of Justice. The second level is that of the Council of Europe – set out in the European Convention of Human Rights and interpreted by the European Court of Human Rights – to guarantee basic election principles. The third level of election law is national law. This, naturally, must conform to the wording of the Convention and decisions of the ECtHR in all member states of the Council of Europe and to the European Union election rules in 27 EU member states. The author of the article presents European Union law regulations concerning to the all stages of the electoral process and proposals of changes in this area. Stages of electoral process regulated in the European Union law are: ordering the elections, nomination of elections, setting roster of persons which have right to elected and right to be elected, electoral campaign, voting, establishing of the voting results and announcing of them, establishing of the elections results, affirmation of the validity of the elections, expirations of the mandate and by-elections. The author presents the opinion, that there are two ways of evolution of European Union regulation concerning to the elections to the European Parliament. First is gradual widening regulations of Act concerning the election of the members of the European Parliament by direct universal suffrage, and second is establishing the all-European constituency, in which right to present candidates would have only European political parties.
