In the article, the author introduces a distinction between two types of recipients: individuals (institutions) seeking the assistance of a practitioner psychologist, and practitioner psychologists, who use the results of the work of research psychologists in order to make their assistance ethical and effective. The article stresses the role of methodological awareness (as important as ethical awareness). The the central idea of the paper is R. Rosenthal’s thesis: “Bad science makes for bad ethics.”

Opis:
Three main problems are considered. The first is that psychology should avoid any inclination towards neuroscience or a type of brain science. Making use of the achievements of natural sciences, psychology should take into regard the cultural conditions [determinants] and methods worked out in social sciences. Thus, it should adopt the antireductionistic methodological programme. The second problem is that psychology must reject the papers that entice with apparent scientific approach being actually of no real worth. Also the threat posed to psychological practice by pseudo-scientific monographs and pseudo-test should be recognised. They offer scientifically false basis of practical work of psychologists in the sphere of social practice. The third problem is that each psychological practice should be preceded by a psychological theory that is empirical and needs to be verified by a methodologically correct method. Thee underlying empirical psychological theory makes a given psychological practice sensible and ethical. The status of psychology as a science and the status of psychological practice are related to the quality of education of future psychologists. The author definitely opts for the model of full-time 5-year master’s degree studies (so against the Bologna model of 3-year licentiate (BA) followed by a 2-year master’s degree study (MA)), supplemented with a one-year training under supervision of an experienced specialist. The effective and ethical work of professional psychologists in Poland suffers from the lack of legal regulations that would protect this profession against the infiltration of all kinds of charlatans offering pseudo-scientific diagnostic tools like e.g. the Tree test of Charles Koch and therapies like e.g. the Systemic Constellation of Bert Hellinger. Of utmost importance is development of not only methodological awareness but also ethical awareness in psychologists and students of psychology. Moreover, the education should bring the realisation of the effects and danger of scientific misconduct of FFP type, that is fabrication, falsification, plagiarism.

Opis:
Anosognosia for hemiplegia is a multifaceted syndrome that has a detrimental impact on the patient. Various theories based on behavioural and neuroanatomical data have been proposed to explain the mechanisms underlying the symptoms. These approaches have resulted in the development of a number of different proce- dures aimed at reducing symptoms or enhancing residual aware- ness. The article reviews rehabilitation attempts and their effects on individual cases and groups of patients. A selection of material was made using indexed articles published between 1987 and 2019. The inclusion criteria were: i) the presence of a neuropsychological assessment and ii) the presence of one or more methods specifically used to reduce AHP symptoms, or to enhance residual forms of awareness. The review indicates that intervention procedures have moved from bottom-up to more cognitive and metacognitive approaches. In fact, initially anosognosia for hemiplegia was considered to be a co-oc- current symptom of other neuropsychological conditions (e.g. spa- tial neglect) and interventions were borrowed from the rehabilitation techniques that had had success in relieving these other disorders. When anosognosia was identified as an independent syndrome and residual forms of awareness were demonstrated, procedures attempting to modulate awareness started to focus on specific components of the disease, such as visual perspective, motor monitoring and the updating of beliefs. Although further research is needed in this field, the most recent approaches seem to give more stable, lasting results than earlier methods. A timeline for interventions relating to anosognosia is suggested, and ethical issues are also discussed.

Teza artykułu jest związana z twierdzeniem, że kazuistyczny, quasi-prawny model etyki prawniczej powinien zostać porzucony. Tym zaś, co należałoby rozwinąć, jest indywidualna i kolektywna, zwana także korporacyjną, świadomość specyfiki doznania prawnego i wartości istotnych z perspektywy etyczno-zawodowej, oparta na solidnych podstawach metodologicznych. Przedstawiona w artykule koncepcja etyki prawniczej rezygnuje z prób jej opisu z perspektywy wymuszonej kategoriami związanymi z pozytywizmem prawniczym. Ta sugestia odnosi się do: 1) fenomenologicznego „myślenia według wartości etyczno-zawodowych”, 2) pojęcia intuicji etyczno-zawodowej oraz 3) koncepcji pól świadomości aksjologicznej prawnika i korporacji prawniczej. Dwudziestowieczna filozofia fenomenologiczna, a także związana z nią ściśle nieformalna etyka wartości przedstawiona głównie przez M. Schelera i N. Hartmanna, stanowi podstawę proponowanej koncepcji etyczno-zawodowej. Etyka fenomenologiczna, polegająca na indywidualnym doświadczaniu wartości etycznych, zbudowana na indywidualnych aktach preferencji wartości dokonywanej w obliczu konfliktu moralnego, daje szansę na zdystansowanie się od quasi-prawnej, kazuistycznej percepcji etyki prawniczej. To zaś stwarza możliwość niezbędnej metodologicznej niezależności etyki prawniczej od prawa.
The thesis of the paper is connected with the statement that the casuistic, quasi-legal model of legal ethics should be abandoned. What should be broadened instead, is individual and collective, namely corporate one, awareness of the specificity of legal experiencing of the values relevant from ethical-professional perspective and based on firm methodological basis. The conception of legal ethics presented in the paper gives up the attempts of describing it from the perspective which is forced by categories connected with legal positivism. This suggestion refers to the following: (1) phenomenological “thinking according to ethical-professional values”, (2) the notion of ethical-professional intuition and (3) the concept of a lawyer’s and legal corporation’s field of axiological awareness. The 20th century phenomenological philosophy and, closely connected with it, informal ethics of values, as presented mainly by M. Scheler and N. Hartmann, serves as the basis of the suggested ethical-professional concept. Phenomenological ethics, relying on individual experience of ethical values, based on individual acts of value preference in case of moral conflict, gives a chance to distance itself from a quasi-legal, casuistic perception of legal ethics. It, then, creates the possibility of necessary methodological independence of legal ethics from law.

The paper aims to study the work of Leon Petrazycki and analyze modern Ukrainian scholars’ opinions on Petrazycki’s scientific achievements. This study focuses on Petrazycki’s work, his psychological theory, in particular, in view of our own perspective on the law and within the framework of our theological and sociological theory, which considers the law as a social life phenomenon and regards moral imperative of the Almighty God as the basis of law. Every civilization communicates moral imperative through sacred writings (the Ten Commandments in Christian Bible, six hundred and seven rules in Jewish Torah, seventy-two rules in Muslim Quran). It is within the framework of this moral imperative that the society and the state develop the law. The paper addresses the modern absurdity and at the same time antinomy of law, lying in the fact that there is more and more law in the society but less and less law in life of an individual due to the fact that states rapidly upscale rulemaking, but laws are becoming less accessible to an individual. This study draws on conceptual issues of Petrazycki’s theoretical heritage, fundamental principles of his psychological theory, as well as connection between law and morality, described by Petrazycki, which are the spiritual heritage of society. The most important issues of Petrazycki’s work, in our opinion, are studying the nature of law, balance of emotion and intellect, official and intuitive, desirable and actual components in law, as well as subjective and objective law, law policy and power. The paper reveals that assessment of Petrazycki’s work in modern Ukrainian legal studies is ambivalent: from sharply critical (Prof. P. Rabinovich), compliant with Russian (O. Timoshina (St. Petersburg)) approach and critical yet positive perception of Petrazycki’s psychological theory (S. Maksymov, O. Merezhko, M. Kuz, O. Stovba) to admiration for Petrazycki’s genius, whose work was ahead of his time (I. Bezklubyi, N. Huralenko, V. Dudchenko, O. Rohach, M. Savchyn, V. Tymoshenko). Thus, the research findings suggest that Petrazycki’s work belongs not only to the past, but also to the present and future of jurisprudence, sociology, psychology, economics. Further in-depth analysis of Petrazycki’s heritage will contribute to more accurate diagnosis of urgent legal issues in social development of modern Ukraine, real assertion of personocentrism as a postulate of contemporary theoretical jurisprudence and guidelines for public authorities, as well as practical solution to many controversial scientific and legal issues.
