The marine pollution is rarely debated from the perspective of land-based sources of pollution under the 1982 UN Convention on the Law of the Sea (UNCLOS). This article centres not only on a land-based source of pollution of the sea, but also a very particular one – the 2011 Fukushima Daiichi accident. Apart from causing severe infrastructural damage and posing a radiation-related threat to the public, Fukushima has had a lasting impact on the marine environment, too. Especially, since the operator of the plant has so far been unsuccessful in completely eliminating the radioactive leakage into the seas. This article considers the actual impact of the accident on the marine life along with the relevant recovery and remediation measures aimed to limit said impact, all in the light of the provisions of UNCLOS. Especially, with regard to its problematic (rather underdeveloped) enforcement and sanctioning system which should be more balanced, considering the various contemporary sources of pollution of the seas. Notwithstanding, UNCLOS will most likely further strengthen international cooperation with the ultimate aim of preventing the pollution of the world’s oceans.

Kazakhstan is a country experiencing tangible environmental problems. Currently, it faces numerous environmental problems such as air pollution, water pollution, exploitation of natural resources, negative consequences of mining, etc. In order to cope with environmental problems, a number of legislative acts have been enacted: the Environmental Code, the Water Code, the Forestry Code, a number of laws and government decrees that provide a legal basis for sustainable development. But, unfortunately, these laws and policies were not properly implemented due to issues such as inconsistency, weak enforcement, the presence of internal contradictions, gaps, and discrepancies, etc. As a result, the current legislation in the field of environmental protection does not meet the development objectives of our country, its lack of transparency hinders the development of the economy, and indistinctness reduces the competitiveness of domestic producers in the world market and the volume of investments attracted to the economy. Many aspects of the state's environmental activities remain unregulated from a legal point of view, which, on the one hand, leads to a deterioration in the quality of the environment and the plunder of natural resources, and on the other hand, creates conditions for the development of corruption. This study proposes individual solutions to problems in the environmental sphere by creating new legal norms, as well as eliminating contradictions between existing regulatory legal acts, systematizing legislation and establishing a unified practice of applying norms. It is concluded that the implementation of environmental human rights depends on the quality of regulatory legal acts and their effective application.

The subject of the analysis is an attempt to answer the question whether it is required to attach a decision on environmental conditions in order to successfully submit an application for a new integrated permit. The problem stems from the lack of precision of the regulation, non-uniformity of decisions of administrative courts in this respect and divergent practice of administrative bodies competent in these matters. According to the author, the conducted considerations lead to an unequivocal conclusion: the analysed provision cannot be interpreted as resulting in the inclusion of entities applying for such an integrated permit with the requirement to attach a decision on environmental conditions to the application, as well as with other provisions related to such a duty.

EU law is multilingual and multi-cultural. It is initially drafted in one language, now frequently English, often by non-native speakers and then translated into the other EU languages. Amendments may be proposed that are drafted in a different language. The result is a single multilingual text created in 23 language versions that are authentic within the context of the EU legal order. These circumstances have led EU legal language to develop its own terminology and legislative style as a separate genre.One question is to identify different national cultural drafting styles and traditions that lie behind the creation of EU legislative texts and terminology. The Member State traditions vary, yet they merge in the EU legislative texts. In order to assist in the understanding of EU legislative texts, it is useful to reflect on how they are constructed and the features and requirements lying behind their creation, interpretation and transposition.One approach is to consider a specific piece of EU text in a range of languages and consider how the text is reproduced in each language in terms of structure and terminology. Since the original draft is frequently made by non-native speakers and then translated into the other EU languages, which are bound by the structure of the base version, we obtain little information from it about divergent national linguistic and legislative methods. However, if the EU text is a directive which is transposed into national law, we should be able also to look at the national implementing legislation intended to implement the directive. The implementing texts are produced within the national legal context and, one assumes, aim at similar results, as laid down by the directive. Thus it could be expected that they should provide vehicles for study between the national systems and between each national system and the EU legal order. The paper explores these ideas to see where they lead.

Environmental protection is an area of interdisciplinary, in which the rule is the use of science concepts relevant to the legal, natural, technical or chemical. Therefore, in practice they may have different meanings depending on the conceptual context in which they are used. The concept, which draws attention to the rights and duties of citizens, public administration or environmental organizations, the legal and administrative aspects of environmental protection. Legal and administrative aspects of the environment in a manner related to the inherent rights of citizens, duties of public administrations, as well as practice and custom of our country and the European Union. Thus, their analysis is certainly an interdisciplinary context, and an important environmental dimension, the effect will be implied in the form of application by analogy comparisons and examples of not only national but international.

Maritime spatial planning has become on of the fundamental instruments of managing human activity at the sea. It is mostly due to the rising competition for marine space, which is a consequence of rising number and variety of uses of the sea. Among the principles of marine spatial planning ecosystem approach as well as the taking into account the interaction between land and sea seem to play the most important role. First one is more general and axiological in it’s nature, while the second functions more as technical guide for planners. Together they can be called guiding principles of marine spatial planning. Ecosystem approach is a concept closely related to ecosystem services. It’s main aim is to sustain the productivity of ecosystems in the field of ecosystem services, what is often connotated with the health of the marine ecosystem. Multiple correlations between land and sea can be easily seen in the managerial goals of the marine ecosystem. Trophic relations seems to be reflected in legal regulations, but the question remains if the marine spatial planning regime really reflects the interactions between land and the sea.

This article addresses the concept of environmental law. The paper begins with a general background on the justification for the study of environmental law. The second section focuses on the nature of law. In the next section the author analyses legal definitions of environmental protection and environment. As the analysis shows that environmental legislation plays a crucial role, the final section discusses its location in the Polish legal system. This study highlights that environmental law should be treated as a branch of law.
Настоящая статья касается правовой концепции охраны окружающей человека среды. Начинается с представления общих причин изучения естественного права. Вторая часть концентрируется на сути права. В следующей части автор поддает анализу легальные дефиниции охраны окружающей среды. Анализ показывает, что регулирование этой области играет ключевую роль. В последней части автор рассматривает расположение естественного права в системе польского закона. Настоящие исследования подтверждают обоснованность отношения к праву охраны окружающей среды как отрасли права.

Obszary przyrodnicze z uwagi na ich walory i unikalne cechy krajobrazowe zostają objęte ochroną prawną (rozporządzenie z 16.04.2004) w sytuacji dużego zainteresowania turystów tymi terenami. Obserwuje się wówczas zjawisko degradacji przyrody. W artykule omówiono formy turystyki, które nie byłyby zagrożeniem dla stabilności i funkcjonowania chronionych ekosystemów. Za najbardziej przyjazną środowisku formę uważa się ekoturystykę.
The areas being protected by law (regulation from 16.04.2004) due to the beauty of landscape and the unique features of nature are the main matters of tourists´ interest. On thee areas with the great number of tourists we can observe the phenomena of degradation of nature. In the article we discuss the forms of tourism, which wouldn't be a threat to stability and functioning of protected ecosystems. As a form of the most environmentally friendly we consider ecotourism which - according to definition of D. Zaręba (2000) - is a concept of tourism associated with nature organized and managed in a sustainable way with elements of ecological education and financially supplying conservation of nature.

Environmental degradation in the world in general, and in Africa in particular, is occurring on a scale of increasing concern. The challenge for public policy is to change the relationship between people and their environment in order to reverse this trend. To this end, in an internal and an international context characterized by, on the one hand, the establishment of democracy and the rule of law and, on the other, by the globalization of environmental law following the Rio Conference (1992) in particular, the rule of law has naturally emerged as the key tool for these transformations. The aim of this article is to identify and analyze the African legal instruments and the actions of transformation in the relationship between the regional legal framework and international environment law, with the goal of the sustainability of natural resources and sustainable living environment as the key environmental issues in a fragile region. Africa is in the processes of decision making and adopting environmental protection methods as it embarks on a normative production process, with the aim of producing a law combining international standards and local norms and practices. The contemporary issues of environmental protection in Africa are analyzed in an interdisciplinary approach.

Precautionary and prevention principles can be found in the legal system of the European Union as well in the courts’ jurisdiction as in the both primary law (art. 191 sec. 2 of the Treaty on the Functioning of the European Union) and legislation (i.e. directives). Both principles are of a general character and are often treated as guidelines for law interpretation. In fact their presence in the legal system guarantees all actions that are to be planned shall be compliant with the environmental law. Thus the environment can be protected and serve successive generations.
