    Opis:
    This article addresses cross-border cooperation between Polish law enforcement authorities and those of other European Union Member States in obtaining electronic evidence in criminal matters. It discusses provisions such as Article 589g § 1, Article 589l § 1, Article 589w § 4, and Article 589ze § 10 of the Code of Criminal Procedure (CCP), focusing on defining electronic evidence. Currently, there are no legal definitions for these terms. The article posits that the existing definitions of electronic evidence are imprecise and lead to interpretational doubts. Therefore, it is crucial to organise the conceptual framework in the CCP by creating new definitions or clarifying existing ones. The analysis incorporates the provisions of Regulation (EU) 2023/1543 of the European Parliament and of the Council of 12 July 2023 on European Production Orders and European Preservation Orders for electronic evidence in criminalproceedings and the execution of custodial sentences following criminal proceedings.

    2017 brought about a significant and long awaited change in the rules applicable to dawn raids in Poland. After many years of being criticized by scholars and practitioners, the practice of the President of the Office of Competition and Consumer Protection – consisting of the subsequent review of electronic data copied during an inspection at the authority premises and without the presence of a representative of the inspected undertaking, has been finally overruled by the Court of Competition and Consumer Protection. Even thought there are still several improvements that need to be made in order to guarantee the full respect of fundamental rights of inspected undertakings in the Polish legal order, the Court ruling incontestably constitutes a significant step in strengthening the legal position of inspected undertakings in Poland.
    En 2017 les règles applicables aux perquisitions en Pologne ont été modifiées de façon significative et attendue depuis longtemps. Après de nombreuses années de critiques de la part d’universitaires et de praticiens, la pratique du Président de l’Office de la Concurrence et de la Protection des Consommateurs – consistant À examiner des données électroniques copies pendant une perquisition par la suite dans les locaux de l’autorité et en l’absence de représentant de l’entreprise inspectée, a finalement été renversée par la Cour de la Concurrence et de la Protection des Consommateurs. Même si plusieurs améliorations doivent encore être apportées afin de garantir le plein respect des droits fondamentaux des entreprises inspectées dans l’ordre juridique polonais, la décision de la Cour constitue incontestablement une étape importante dans le renforcement de la situation juridique des entreprises inspectées en Pologne

    Opis:
    Przedmiotem artykułu jest współpraca transgraniczna pomiędzy polskimi organami ściągania a organami ścigania z innych krajach członkowskich Unii Europejskiej w zakresie pozyskiwania dowodów elektronicznych w sprawach karnych. W artykule zostały omówione postanowienia art. 589g § 1 k.p.k., art. 589l § 1 k.p.k., art. 589w § 4 k.p.k. i art. 589ze § 10 k.p.k., które dotyczą określeń dowodów elektronicznych. Podjęto też próbę zdefiniowania tych określeń, gdyż brak jest ich legalnej definicji. Sformułowano tezę, że obecne określenia dowodów elektronicznych nie są precyzyjne i wywołują wątpliwości interpretacyjne. Konieczne jest więc uporządkowanie siatki pojęciowej stosowanej w k.p.k. poprzez stworzenie nowych definicji lub doprecyzowanie już istniejących. Analiza jest prowadzona z uwzględnieniem postanowień rozporządzenia Parlamentu Europejskiego i Rady (UE) 2023/1543 z dnia 12 lipca w sprawie europejskich nakazów wydania i europejskich nakazów zabezpieczenia dowodów elektronicznych w postępowaniu karnym oraz w postępowaniu karnym wykonawczym w związku z wykonaniem kar pozbawienia wolności.
    The subject of the article is cross-border cooperation between Polish law enforcement authorities and law enforcement authorities of other European Union Member States in the field of obtaining electronic evidence in criminal matters. The article discusses the provisions of Article 589g § 1 CCP, Article 589l § 1 CCP, Article 589w § 4 CCP and Article 589ze § 10 CCP, which concern the definition of electronic evidence, attempts to define these terms, as there are no legal definitions of them, and formulates a thesis that the current definitions of electronic evidence are not precise and raise interpretational doubts. It is therefore necessary to organise the conceptual framework used in the Code of Criminal Procedure by creating new definitions or clarifying the existing ones. The analysis carried out is taking into account the provisions of the Regulation (EU) 2023/1543 of the European Parliament and of the Council of 12 July 2023 on European Production Orders and European Preservation Orders for electronic evidence in criminal proceedings and for the execution of custodial sentences following criminal proceedings.

    W artykule omówiono ideę utworzenia i wdrożenia w policji narzędzia informatycznego pn. Elektroniczny Rejestr Czynności Dochodzeniowo-Śledczych (ERCDŚ). Wskazano najważniejsze przepisy prawne regulujące ewidencjonowanie wykonywanych przez funkcjonariuszy i pracowników policji czynności w ramach prowadzonych postępowań sprawdzających i przygotowawczych. Omówiono główne cele aplikacji, zakres przetwarzania w niej danych oraz warunki bezpieczeństwa teleinformatycznego. Ponadto przedstawiono kierunki rozwoju elektronicznego systemu z uwzględnieniem nowych funkcjonalności.
    The article presents an idea for the development and implementation of a police information system, Electronic Register of Investigations (ERCDŚ). The primary legal provisions governing the registration of activities performed by police officers and other employees during the screening and preparatory proceedings are indicated. The main purposes of the application, the scope of data processing as well as the ICT security requirements are discussed. Moreover, the article presents the directions of development of the electronic system, including its new functionalities.

Celem artykułu jest zaprezentowanie informacji o Rejestrach Służby Celnej m.in. o sposobie ich realizacji, modelu przechowywanych danych, podstawowych przypadkach użycia i o ich dotychczasowym wykorzystaniu.
    In recent years, the Customs Service introduced many innovative electronic solutions that improve the quality of customer service and organization of work in the customs administration. As part of the improvements the circulation of paper documents is gradually reduced. One of the projects electronic Registers of the Customs Service to replace paper registers used in the course of customs control are implemented. The aim of the article is to present information about the Registers of the Customs Service, among others, the manner of their implementation, the model data storage, basic use cases and their current use.
