Based on Hungarian period literature, the study presents the main features of 1920s Polish electoral law, while comparing it to the Hungarian electoral law of the same period. Those elements of Polish electoral law are highlighted that the interwar Hungarian literature covers. Likewise, the study outlines the two differing directions which – already apparent in the first decades following the world war – the development of Polish and Hungarian electoral law had taken, despite starting out on a similar footing in the wake of independent statehood. Before drawing conclusions – with a consideration of their impact on political life – the study touches upon, in both states, the structure of the legislature, the electoral system and the distribution of seats, the conditions of active and passive suffrage law and the questions surrounding the nomination process. While in Poland “politics was shaped by electoral law’s chronic state of crisis”, in Hungary the admittedly manipulated electoral law ensured governability.
Tekst stanowi analizę mającą na celu zestawienie głównych zasad polskiego prawa wyborczego z 1920 r. oraz węgierskiego prawa wyborczego, przeprowadzoną na podstawie literatury węgierskiej tego okresu. Artykuł przedstawia, widoczne już w pierwszych latach po I wojnie światowej, dwa odmienne kierunki ewolucji węgierskiego i polskiego prawa wyborczego, różne, pomimo rozwoju dokonującego się w oparciu o podobne zasady, a także w rezultacie powstania suwerennego państwa. Analiza obejmuje strukturę władzy, system wyborczy i zasady podziału miejsc w parlamencie, warunki czynnego i biernego prawa wyborczego, praw wyborczych kobiet, a także kwestii dotyczących procedury wyborczej. Podczas gdy w Polsce „polityka została ukształtowana przez prawo wyborcze w przewlekłym stanie kryzysu”, na Węgrzech starano sie kształtować prawo wyborcze, w celu zagwarantowania praworządności.

The text contains a catalog of the functions of electoral law (creating, expressing the will of the voters, legitimizing, controlling and integrating) and a brief description of their character. Then, the European Parliament is described, focusing on regulations concerning the election procedure, both on a European and national level. The next part presents an evaluation of each function’s implementation, through the norms of electoral law to the European Parliament, particularly in the context of the elections of the 25th May 2014 from the Subcarpathia district, especially on the basis of the elec-tion’s results, stated in the declaration of the State Election Commission of the 26th May 2014.

At the end of World War I, in many European countries women won the active and passive right to vote. Poland was one of the first countries, where women were allowed to participate in political life. Already at the time of establishing the Legislative Sejm (1919) the first women-MPs took their seats in Parliament. Similarly, the situation presented itself in the case of the Senate. During its first session (1922) women participated in the works of the upper chamber. The purpose of this paper is to present the participation of women in the legislative work of the Senate in various terms of office. The participation of women in the legislative work of Parliament was characterized by their involvement in issues concerning education or social services, while avoiding participation in the legislative work or that dealing with political matters. The situation presented itself differently as regards women’s involvement in the work of the Senate. A good example here was the activity of Dorota Kałuszyńska, who – during the work on the so called April Constitution of 1935 – not only participated in it very actively, but also ruthlessly attacked the then ruling camp. Another very interesting episode related to activities of women in the Senate was an informal covenant during the work on the bill to limit the sale, administration and consumption of alcoholic beverages. Belonging to different political groups: the said D. Kłuszyńska as a representative of the Polish Socialist Party, Helena Kisielewska from the Bloc of National Minorities and Hanna Hubicka of BBWR [the Nonpartisan Bloc for Cooperation with the Government] unanimously criticized the regulations in force, which – in their opinion – did not fulfill their role when it came to anti-alcohol protection. The participation of women as far as their number was concerned was indeed small, but the Senate (like Parliament) of the Second Republic functioned in the period when women had just begun their activity on the legislative forum. Undoubtedly, it was a very interesting period, in which women had the benefit in the form of gaining their parliamentary experience. For example, it gave rise to subsequent activities of Dorota Kłuszyńska, who actively participated in the legislative works of the Sejm in the years 1947–1952, dealing with social issues or family.

In December 2017 and January 2018, the Sejm and Senate, thanks to the votes of the deputies of ruling party Law and Justice, passed hugely controversial law amending inter alia Polish Electoral Code. Its adoption was opposed by the parliamentary opposition, by the electoral administration bodies and by many experts, however unsuccessfully. The enactment of this law destabilises the electoral system without a clear or evident need and treats the electoral code as a political instrument. Secondly, it does not provide the sufficient time for adaptation (vacatio legis), which may jeopardise free and fair local elections and the stability of the political system. Thirdly, the bill contains numerous unclear provisions and is in many parts written in a careless and contradictory way. Such amendments do not correspond with the European standards, described in the Venice Commission’s Code of Good Practice in Electoral Matters.

The article is an analysis of the local elections, from the perspective of the actors taking part in it. The study involved the election committees taking part in elections in 2006, 2010, and 2014. Exploration statistical data and results of the election was preceded by theoretical observations concerning the discussed issues. It outlines the legal basis for election to local government and made a typology of electoral committees, in accordance with the electoral laws in force during the specified election. It shows the level of participation of each type of election committees. In the analysis, the number of registered electoral committees, the number of candidates each gained votes and seats obtained. The model analyzes afflicting a number of key statistical data allowed to create a picture that revealed the definite advantage of election committees of political parties in electoral competition at the local government level. In addition, the cross-section analysis gave the word Stagnation scenery election, in respect of the entities competing election. The survey covered a national and provincial level. Data were analyzed in the whole country, as well as the division into 16 voivodeships. Information and data on issues taken taken from literature, existing normative acts and the data of the State Electoral Commission. We conducted a descriptive considerations of a comparative analysis using descriptive statistics methods.

The aim of this paper is a comparative analysis of the new methods used to organise the 2020 general elections in Poland and the Czech Republic, which were held in the state of the SARS-19 virus pandemic. This paper analyses the voting methods introduced in connection with sanitary regulations in both countries and the scale of votes cast in this way in relation to the total. It discusses and compares the requirements introduced that voters and electoral commission members had to meet on voting day to minimise the risk of infection with the virus. The text shows a number of similarities in both countries in terms of the measures applied to prevent the spread of the virus associated with a personal visit to a polling station. An additional aspect of the comparative analysis of the covid-voting methods in the two countries was a discussion of voting rules for those infected or in quarantine on voting day. Analysis of the data showed that in both countries the alternative voting method, was not very popular.

The right for electing the representatives of authority bodies is one of the fundamentals of democracy. This right entitles citizens for active public participation through expressing their support (votes) for candidates, which will respectively represent their voters in certain institutions. Polish electoral law, which regulates the local self–government elections is very controversial. The existing legal rules were changed many times since 2011. Among the subjects being discussed one can mention electoral campaigns, candidate registration rules and organization of elections. Frequent changes in the electoral law result in misunderstandings and unwillingness to participate in elections. Their effect is low voter turnout and a large number of invalid votes. To sum up considerations over a political model of large cities, it is worth to indicate that during the last 25 years of operation of Polish local government none of political models of big cities was adopted.

2018 local self-government elections in Poland were special ones. Brought to light mismatching of provisions of the Electoral Code and Act on Local Self-Government Employees and attempt to use it to obtain an advantage in fight for political power caused political emotions and legal controversies. The aim of this article is presents limits imposed by criminal law on right to be elected in this type of elections and more general, role of criminal law as a tool in politics. The article presents a problem of conflict of legal regulations regarding the right to be elected and perform a public function in a local self-government unit as a problem of conflict between will of voters and attitude of politicians to creation of law and aim they try to obtain.

Elections in a democratic state, conducted in compliance with the rules allowing fair consideration to be given to the will of voters, are the primary means of establishing public authorities. They form one of the pillars of a state that derives its foundations from the will of the nation. The article analyses the electoral rights of citizens (i.e. the right to vote and the right to stand as candidates) from the point of view of respect for the principle of the common good. A separate part of this paper is devoted to reflections on the institutional design of the electoral system and electoral process. The article ends with a part devoted to the issues of creating and applying electoral law, with particular focus on the problem of legal stability. The conducted analysis leads to the conclusion that both, proper functioning of a pluralist electoral system supported by the Constitution and effective application of electoral law depend largely on the recognition of the common good as such by all participants of this system and on the implementation of the indications arising from this principle.
Wybory w państwie demokratycznym, przeprowadzane z poszanowaniem reguł pozwalających uczciwie uwzględnić wolę wyborców, są podstawowym sposobem kreowania organów władzy publicznej. Tworzą one jeden z fundamentów państwa czerpiącego swoje podstawy funkcjonowania z woli Narodu. W artykule dokonano analizy praw wyborczych obywateli RP, tj. prawa do głosowania i prawa do kandydowania z punktu widzenia poszanowania zasady dobra wspólnego. Osobną część poświęcono rozważaniom dotyczącym instytucjonalnemu kształtowi systemu wyborczego i procesu wyborczego. Artykuł kończy część poświęcona problematyce zasad tworzenia i stosowania prawa wyborczego, ze szczególnym uwzględnieniem problemu stabilności prawa. Przeprowadzona analiza prowadzi do konkluzji, że prawidłowe funkcjonowanie wspartego na konstytucji pluralistycznego systemu wyborczego oraz stosowanie prawa wyborczego zależą w dużej mierze od uznawania przez wszystkich uczestników tego systemu dobra wspólnego jako takiego i realizowania wskazań z tej zasady wypływających.
